ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE WITH REGARD TO ANY MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDING, AND FOR SUCH PURPOSE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDING IS MADE WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED. CONSENT AGENDA 7.3 RESOLUTION NO. 2011-104 Revised Resolution A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION BY THE CITY TO THE U.S. DEPARTMENT OF COMMERCE, ECONOMIC DEVELOPMENT ADMINISTRATION, FOR FUNDING OF THE U.S. 1/FEDERAL HIGHWAY AND FLORIDA EAST COAST RAILWAY BRIDGES PROJECT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. 7.7 RESOLUTION NO. 2011-105 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE CHANGE ORDER NUMBER THREE RELATED TO THE DANIA BEACH CITY CENTER REDEVELOPMENT GARAGE, ENTRYWAY AND LIBRARY PROJECT IN AN AMOUNT NOT TO EXCEED $22,352.30; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. 7.8 RESOLUTION NO. 2011-106 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, SUPPORTING PUBLIC MANAGEMENT OF THE FLORIDA EAST COAST RAIL LINE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. #7.3 Revised Resolution RESOLUTION NO. 2011-104 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION BY THE CITY TO THE U.S. DEPARTMENT OF COMMERCE, ECONOMIC DEVELOPMENT ADMINISTRATION, FOR FUNDING OF THE U.S. 1/FEDERAL HIGHWAY AND FLORIDA EAST COAST RAILWAY BRIDGES PROJECT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Dania Beach established the Dania Beach Community Redevelopment Agency and sits as the Community Redevelopment Agency Board; and WHEREAS, the Dania Beach Community Redevelopment Agency Board adopted the redevelopment plan titled “City of Dania Beach Community Redevelopment Agency Redevelopment Plan“ on March 11, 2009 which provides for a plan to renew the economic vitality of the City by redeveloping valuable waterfront properties to marine use through the removal of impediments caused by low fixed bridges; and WHEREAS, the Dania Beach Community Redevelopment Agency Board commissioned a bridge study titled “City of Dania Beach Projects preliminary Implementation Plan” (the “Bridge Plan”), which identifies strategies and methods for funding the Plan; and. WHEREAS, the City Commission funded $500,000.00 in its capital improvement plan budget for the purpose of performing a project development and environmental study, which is necessary for state, county and federal grant funding opportunities; and WHEREAS, a December 2008 economic impact study (the “Study”) of the expansion of the marine industry in Dania Beach estimates a potential annual economic impact of $500,000,000.00 to the region; and WHEREAS, the project development and environmental study is necessary to identify costs and strategies that are crucial to regional planning and multi-jurisdictional coordination of a funding stream to implement the “Bridge Plan”; and WHEREAS, the City of Dania Beach met with stakeholders on August 11, 2011 for the purpose of raising awareness and gaining support to actualize the “Bridge Plan” as described in the “Study” and those stakeholders are the Florida Department of Transportation, Florida East Coast Railway, elected federal representatives, elected state representatives, Broward County officials, the South Florida Marine Industry Association, and Marina Mile Association; NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission of the City of Dania Beach approves the submission of an application to the Department of Commerce, Economic Development Administration, to assist in the funding of the “Bridge Plan Study”. Section 2. That the City Commission of the City of Dania Beach is committed to construction of the Project, provided that funding can be obtained and the City will fully engage with regional partners to use its best efforts to obtain funding for construction of the Project. Upon the securing of all necessary funding, the City will work with its partners to provide for construction of the proposed bridge improvements. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption PASSED and ADOPTED on September 13, 2011. ATTEST: LOUISE STILSON, CMC PATRICIA A. ANSBRO CITY ATTORNEY Item #7.7 RESOLUTION NO. 2011-105 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE CHANGE ORDER NUMBER THREE RELATED TO THE DANIA BEACH CITY CENTER REDEVELOPMENT GARAGE, ENTRYWAY AND LIBRARY PROJECT IN AN AMOUNT NOT TO EXCEED $22,352.30; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proper City officials are authorized to execute Change Order No. 3 relating to the Dania Beach City Center Redevelopment Garage, Entryway and Library in an amount not to exceed Twenty-Two Thousand, Three Hundred Fifty-Two Dollars and thirty cents ($22,352.30); a copy of which is attached as Exhibit “A”, and it is made a part of and incorporated into this Resolution by this reference. Section 2. That the City Manager and City Attorney are authorized to make minor revisions to the terms of such change order as needed and as are deemed necessary and proper for the best interests of the City. Section 3. That funding for this change order is available from existing Garage / Entranceway Capital Project appropriations and will be charged to account # 301-1802-519- 6210. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. ANSBRO CITY ATTORNEY Item #7.8 RESOLUTION NO. 2011-106 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, SUPPORTING PUBLIC MANAGEMENT OF THE FLORIDA EAST COAST RAIL LINE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach City Commission is supportive of the South Florida East Coast Corridor Study, an initiative to bring commuter rail service to the Florida East Coast (“FEC”) Railroad; and WHEREAS, the Dania Beach Bridge Plan envisions the replacement of the existing FEC bridge with a bridge that would accommodate commuter rail service; NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission of the City of Dania Beach is supportive of commuter rail service along the FEC rail corridor and of public management of the FEC bridge to be re-built. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3.
