ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE WITH REGARD TO ANY MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDING, AND FOR SUCH PURPOSE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDING IS MADE WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED. LOBBYIST REGISTRATION REQUIRED. REGISTRATION AS A LOBBYIST IN THE CITY OF DANIA BEACH IS REQUIRED IF ANY PERSON, FIRM OR CORPORATION IS BEING PAID TO LOBBY THE COMMISSION ON ANY PETITION OR ISSUE PURSUANT TO ORDINANCE # 01-93. IN ACCORDANCE WITH THE AMERICANS WITH DISABILITIES ACT, PERSONS NEEDING ASSISTANCE TO PARTICIPATE IN ANY OF THESE PROCEEDINGS SHOULD CONTACT THE CITY CLERK’S OFFICE, 100 W. DISCUSSION AND POSSIBLE ACTION 10.2 Legal Services – Commissioner Duke 10.3 Special Election 13. ADMINISTRATIVE REPORTS 13.1 City Manager 13.1.1 Water Supply Issue – Status Update Item #10.3 TO: Mayor and City Commission CC: Robert Baldwin, City Manager FROM: Louise Stilson, City Clerk RE: Special Election to fill vacancy DATE: November 24, 2009 After considerable discussion with the Supervisor of Elections Office, the dates for the City of Dania Beach Special Elections are: Tuesday, March 9, 2010 for the Primary Election; and Tuesday, April 6, 2010 for the General Election. There is a city in northern Broward County that is holding a Special Election on Tuesday, February 2, 2010. However, we cannot meet the timeframe to hold our Primary Election on this date, and the SOE will not allow 2 Special Elections during the same month on separate dates. (The ballot goes to the printer on December 11, 2009.) ¾ The City Charter requires that within 30 days from the date the vacancy occurs, the City Commission shall take action to call a special election to fill the vacancy for the remainder of the unexpired portion of the term. ¾ The City Commission must adopt a resolution calling for the special election. ¾ The City Commission must enter into an agreement with the SOE to run the election and hire the pollworkers. ¾ State Law requires that the notice of special election be published 2 times at least 10 days prior to the first day set for qualifying. ¾ Because this is a special election, the City can set the dates for the qualifying period. My recommendation would be from 9:00 a.m. on Monday, January 4, 2010 – 12:00 p.m. on Wednesday, January 6. 2010. All ballot information is due to the SOE by Friday, January 8, 2010. ¾ If only 2 people qualify, no Primary Election is needed, however the General Election will still be held on April 6, 2010. ¾ If more than 2 people qualify for the Primary Election, and if a candidate receives a majority of the valid votes cast, that candidate shall be declared elected without holding the General Election.
