Approval of Minutes of the Planning and Zoning Board / Local Planning Agency from the May 21, 2025 regular meeting. Motion was made by Board Member Wright to approve the minutes of the Planning and Zoning Board/Local Planning Agency for May 21, 2025 meeting and was seconded by Vice Chair Granett. Motion passed 5-0. III. PUBLIC HEARINGS 1. OT-005-25: The applicant, Cooper’s Hawk Inc., is requesting an Extended Hours License to sell alcohol at 10:00 a.m. on weekends only for the property located at 1822 Point Blvd. (Continued to July 16th Meeting) Deputy Director Lajoie explained that they were asking to continue this to the July 16, 2025 Meeting and City Attorney Boutsis answered Chair Robertson that a motion was needed. Motion was made by Vice Chair Granett to continue this agenda item to the July 16, 2025 Meeting and was seconded by Board Member De Las Salas. Motion passed 5-0. 2. TX-039-24: The applicant, the City of Dania Beach, is proposing an amendment to the City’s Public Art contribution. Deputy Director Lajoie presented with a slideshow. She explained that this was a text amendment to the Land Development Code which identified a Public Art Fee established December 10, 2019 in the Code. The contribution was for all new development allowing the City to establish a Public Art Fund for the purchase, commissioning and installation of public art. Industry standard’s required contribution was 1% but ours was .5%. The Department was Planning and Zoning Board/Local Planning Agency Minutes 2 June 18, 2025 recommending an increase of our required contribution to 1% with a maximum contribution of $500,000 which was $250,000 at this time. Staff recommended the board’s recommendation of approval to the City Commission. She called for questions. Vice Chair Granett asked if her being on the City’s Public Art Advisory Board caused a conflict. City Attorney Boutsis answered that both boards were advisory to the City so there would not be a conflict. Board Member De Las Salas expressed his concern that Vice Chair Granett was advising the City on the budget so there may be a bias there. The City Attorney advised that there was no legal bias. The issue was whether it brought her own personal gain or loss and not whether the City received a gain or loss. He wanted to make a motion. Motion was made by Board Member De Las Salas to recuse Joanna Granett and was seconded by Board Member Wright. Discussion: Joanna Granett agreed with Board Member De Las Salas and recused herself so the motion did not have to be finished. The Vice Chair was then recused for this agenda item and would abstain from voting and be given a form to fill out. Board Member De Las Salas said that what was online did not reflect the updated changes to the agenda and to the agenda package that the Board received two days ago and if online was also updated, maybe someone from the public would have liked to comment on this agenda item. In his opinion, this was not fair notice to allow for the opportunity to speak. City Attorney Boutsis said the notice was correct but that he raised a good point. She asked the Deputy Director if there was a rush on this item or could this be deferred to the next meeting? The Deputy Director answered that this was on next week’s City Commission agenda for first reading. The City Attorney then explained that this item could be continued to the next P&Z Meeting and the City Commission could decide if they wanted to continue the item for themselves or between their first and second readings this board could hear this agenda item. In case the City Commission decided to hear this agenda item at their next meeting, Board Member De Las Salas felt that this board might as well have their discussion now. Board Member Wright said that Dania Beach wanted to encourage development but yet developers could pay double. Deputy Director Lajoie explained why .5% was established and why the increase was important. She answered Board Member Wright that there were no voluntary funds and this was the only funding source. He felt that the Art Commission Board should go to the public for funding. Board Member De Las Salas said he requested the minutes from the Art Board from September 16, 2024 which depicted a funding discussion in which there was still funding money not being used. Deputy Director Lajoie explained that the required contribution was applicable to projects that were valued at $500,000 and greater. She further explained that the last minute changes made to the agenda and package were because of the support and requests of City Administration. Board Member De Las Salas was answered by the Deputy Director that there were cities in Broward County without a Public Art Program. He wanted to know why we were proposing to increase this instead of eliminating it like in other cities with no art program. He felt that the agenda package contained advocacy and not all information. Board Member Wright wanted the public and not the developers to support this fund. Board Member Rauhe asked about the industry standard in 2019 and the Deputy Director explained why the City started low at .5%. As there were no other board questions/comments, the Chair called for public comments, but there weren’t any. The Chair told the board he was a big believer in art and gave his reasons. Board Member De Las Salas agreed with the Chair but felt that the government should not have to force the developer to contribute. City Attorney Boutsis clarified that projects were underway that needed to be funded so looking at what was in the funds now did not give the whole picture. Deputy Director Lajoie gave examples. Board Member De Las Salas spoke about presentations regarding bringing down the cost of construction but this agenda item would bring the cost up. Motion was made by Board Member Wright to recommend denial of TX-039-24 to the City Commission and was seconded by Board Member De Las Salas. Motion to recommend denial passed 3-1 (Chair Robertson voted against recommending denial - Vice Chair Granett abstained from voting). 3. TX-010-25: The applicant, the City of Dania Beach, is requesting a text amendment to the City’s Land Development Code (LDC) to change the parking requirement for hotel use locating in within the Regional Activity Center (RAC). Deputy Director Lajoie presented this item, which she previously presented at the last meeting. There were some concerns that she wanted to address today. She explained that they amended the request from the original. Instead of being applicable to all form-based zoning districts in the Regional Activity Center, they carved out South Federal Highway Mixed Use. She showed a map of the area. The City was not enforcing minimum parking standards but rather the hotels were coming to the City with the number of parking spaces required. She said they were still Planning and Zoning Board/Local Planning Agency Minutes 3 June 18, 2025 observing Hotel Dello and Hotel Tru. Staff was recommending the board recommend approval to the City Commission. As there were no other board questions/comments, the Chair called for public comments but there weren’t any. Motion was made by Vice Chair Granett to recommend denial of TX-010-25 to the City Commission but this motion died for a lack of a second. Motion was made by Board Member De Las Salas to recommend approval of TX-010-25 to the City Commission as presented this evening and was seconded by Board Member Rauhe. Motion to recommend approval passed 4-1 (Vice Chair Granett voted against recommending approval). IV. BOARD ITEMS 1. RESOLUTION NO. 2025- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE APPLICATION SUBMITTED BY COOPER’S HAWK INC., TO ALLOW FOR EXTENDED HOURS LICENSE, FOR THE RESTAURANT LOCATED AT 1822 POINTE BLVD, PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 4, Article II, Section 4-18.1 provides that any place of business operating as a restaurant or restaurant bar in the City which is duly and regularly licensed by this State to prepare, sell and serve full course meals to the public, and is duly licensed to sell and dispense alcoholic beverages, wine or beer therein, may apply for an extended hours license from the City Commission, after receipt of a recommendation by the Planning & Zoning Board; and WHEREAS, the Planning & Zoning Board has recommended that the City Commission approve the application for an extended hours license at its May 21, 2025, regular meeting; and WHEREAS, the Planning & Zoning Board took into consideration the following criteria in recommending approval: (1) the amount of off-street parking in relation to the demands created by the extra hours of operation, especially with regard to the adverse impact on adjacent residential areas of any illegal or hazardous parking; (2) the amount and degree of law enforcement activities generated by the operation of any restaurant or restaurant/ bar, both outside and inside the particular location, with particular emphasis on vandalism, noise, vehicular use by patrons and illegal activity of any kind by employees, patrons or other associated with the establishment, and (3) the adverse effects, if any, that the extended hours of operation will have on neighboring properties, especially with respect to the effects of noise, parking and glare from headlights or exterior lighting on nearby residential properties; and WHEREAS, the City Commission, during the public hearing, may require, as a condition of the privilege of extending hours of operation, compliance with any reasonable conditions deemed to be necessary to mitigate or eliminate the adverse effects of such extended hours. These conditions may include, without being limited to, provision by the owner or operator, at his/her expense, of additional off-street parking, security personnel, and screening and buffering from nearby properties. The Commission may also require that the licensed establishments be wholly enclosed, soundproofed, and air-conditioned, with any windows, doors, or other openings be kept 2 RESOLUTION #2025- closed, except for normal and emergency ingress and egress, in order that noise and music emanating therefrom will not disturb the peace and quiet of the neighborhood; and WHEREAS, the owner of the application site shall record in the public records of Broward County, Florida, a covenant running with the land which expressly sets forth any and all conditions required by the City Commission. WHEREAS, the Applicant has provided sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the Code; and WHEREAS, the City’s Staff Report analyzes the applicant’s request based on the criteria and supports the Applicant’s request, and is incorporated by reference herein as the City’s findings of fact. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application for an extended hours license (OT-005-25) submitted by Cooper’s Hawk Inc., owner of Cooper’s Hawk Restaurant located at 1822 Pointe Blvd, Dania Beach, Florida, a copy of which is attached and made a part of this Resolution as Exhibit “A,” is approved pursuant to Chapter 4, Article II, Section 4-18.1 and the appropriate City officials are authorized to process the application. Section 2. The permission granted by the City Commission pursuant to Section 4-18, and 4-18.1, to operate in excess of the hours provided by Section 562.14 of the Florida Statutes, is terminable at the will of the City Commission consistent with the requirements delineated in the City Code, as such permission being in the form of a privilege and not a right. Section 3. The owner of the application site shall record in the public records of Broward County, Florida, a covenant running with the land which expressly sets forth any and all conditions required by the City Commission. Section 4. That the associated Planning & Zoning Division Staff Report prepared for the above application(s) is incorporated into this resolution as findings of fact. Section 5. Growing Brunch Culture: By opening earlier, we can tap into this trend and offer our guests looking for an additional dining experience. Our brunch program features signature dishes complemented by a curated selection of cocktails, providing a delightful option for those seeking a relaxing start to their weekend. 2. Economic Benefits: Increasing our hours of operation will boost revenue, which can lead to increased tax revenue for the city. More guests will mean higher sales, and subsequently, increased employment opportunities as we may need to hire additional staff to meet demand. 4. Community Engagement: We envision our brunch program as a community gathering spot, where residents can enjoy an additional menu with seasonal offerings. By facilitating earlier liquor sales, we can create a vibrant atmosphere that encourages community engagement and promotes local culture. 5. Safety and Regulation Compliance: We are committed to maintaining responsible alcohol service and ensuring the safety of our patrons. By adhering to all necessary regulations and training our staff thoroughly, we will provide a safe environment that respects the city’s guidelines. Conclusion I would like to address some concerns that have been raised. • The amount of off-street parking in relation to the demands created by the extra hours of operation, especially with regard to the adverse impact on adjacent residential areas of any illegal or hazardous parking. 4-18.1(c). o We are part of the mall’s shared parking and do not believe the additional hour in the morning will affect parking in any way. o Guests dining for Brunch will have already used the shared parking in the mall. • The amount and degree of law enforcement activities generated by the operation of any restaurant or restaurant/bar, both outside and inside the particular location, with particular emphasis on vandalism, noise, vehicular use by patrons, and illegal activity of any kind by employees, patrons or others associated with the establishment. 4-18.1(c). o We do not believe by allowing our guests the ability to pick up their wine of the month or the ability to purchase a bottle of wine on the way out of the restaurant at 10:00 am on Sunday that there will be a need to increase law enforcement. • The adverse effects, if any, that the extended hours of operation will have on neighboring properties, especially with respect to the effects of noise, parking, and glare from headlights or exterior lighting on nearby residential properties. 4-18.1(c). o The hours extended will be in the morning and will not disturb the neighboring properties. This seems to pertain more to late night bars and/or restaurants with live entertainment. • Identify whether the business will be “wholly enclosed, soundproofed, and air-conditioned, with any windows, doors or other openings be kept closed, except for normal and emergency ingress and egress, in order that noise and music emanating there from will not disturb the peace and quiet of the neighborhood.” See Section 4-18.1(d) o All of the FUN happens inside Cooper’s Hawk, with the exception of our patio dining. o We do not believe that opening earlier in the morning will create any disturbance. In conclusion, Cooper's Hawk respectfully requests approval to begin off-premise package sales at 10 am on Sundays. This would allow wine club members to pick up their monthly bottle while enjoying brunch or afterward and enable guests to bring home a bottle of wine. We believe this initiative will enhance our brunch program, make our services consistent for our guests across Florida, and positively impact the local economy and community. It aligns with Dania Beach’s goals of fostering a vibrant dining scene and attracting visitors. Thank you for considering our request. Currently, packaged sales can begin at 12:00 PM on Sunday’s and the ask is to allow for those sales to begin at 10:00 AM to accommodate for the organizations new Brunch rollout across all locations in Florida. Key Points Discussed Variance Request • Cooper’s Hawk is doing a Brunch program on weekends and are requesting to be able to have packaged alcohol sales beginning at 10:00 AM on Sunday’s (currently it is 12:00 PM on Sunday) • Jennifer went through Cooper’s Hawk’s vision for Brunch and the impact it has on the community and how the uniformity of 10:00 AM brunch on Sunday’s is crucial for all their locations in Florida. • General feedback was that this is not a major ask and should not be a problem but there are a few more steps to get final approval. • No attendees from the community/other businesses were present during this meeting. Next Steps Cooper’s Hawk will continue to engage with the community through regular updates and feedback sessions. The next meeting will be June 18th with Planning and Zoning and Jennifer will be in attendance in person with a meeting followed on June 24th @ 7:00PM for Final approval with Jennifer Lesyna in attendance once again. The meeting concluded with positive feedback from attendees, many expressing enthusiasm about the new location and its potential to enhance Dania Beach’s dining and cultural scene. THE REQUIREMENTS OF SECTION 655-40 OF THE LAND DEVELOPMENT CODE (LDC) APPROVING THE RIGHT-OF-WAY VACATION REQUEST (VC-018-25) SUBMITTED BY THE APPLICANTS/ADJACENT PROPERTY OWNERS, TAMMIE AND ELLIS JAMES, FOR THE PROPERTY GENERALLY LOCATED BETWEEN NW 2 PLACE AND NW 12 AVENUE, RESPECTIVELY, WHICH CONSISTS OF APPROXIMATELY 100 BY 70 FEET OF NW 12TH AVENUE, LYING EAST OF THE APPLICANTS’ PROPERTY LOCATED AT 255 NW 12TH AVENUE WHICH RIGHT OF WAY IS GENERALLY DESCRIBED AS “NORTHWEST 12TH AVENUE,” AND IS LOCATED WITHIN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; PROVIDING FOR WHEREAS, pursuant to Chapter 28, entitled Land Development Code (the “LDC”), Part 6, entitled “Development Review Procedures And Requirements,” Article 655, entitled “Vacations Of Right-Of-Way” of the City’s Land Development Code (the “LDC”), the property owner of the property located a 255 NW 12th Avenue, Dania Beach, Tammie and Ellis James, (the “Applicants”), have applied to the City of Dania Beach (the “City”) for approval to Vacate the Northernmost 100 feet of the 70 foot wide Right-of-Way (VC-018-25), known as a portion of “NW 12th Avenue” (the legal description for the Northernmost 100 feet right of way to be vacated is attached to this Ordinance as Exhibit A); and WHEREAS, the proposed vacation is identified in Exhibit B, which is attached and incorporated into this Ordinance; and WHEREAS, consistent with the requirements of Section 655-20, of the LDC, the Applicant obtained notarized signatures of property owners abutting affected portions of the right- of-way proposed for vacation, indicating support or objection for the application. WHEREAS, the City Planning and Zoning Board, sitting as the Local Planning Agency, held a duly advertised public hearing on July 16, 2025, and recommended approval of the proposed right-of-way vacation; and WHEREAS, staff have confirmed that all utilities with a potential interest in the area have been notified and given the opportunity to object. No objections have been raised. 2 ORDINANCE #2025-XX WHEREAS, staff recommends approval of the proposed right-of-way vacation in its staff report to the City Commission dated August 26, 2025; and WHEREAS, the City Commission finds that granting the requested right-of-way vacation will not adversely affect access to neighboring properties and will not be detrimental to the public health, safety, and welfare; and WHEREAS, the City Commission finds that NW 12th Avenue is no longer needed as a road, and that it is in the best interest of the City to grant the request to vacate the right-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. The foregoing WHEREAS clauses are ratified and confirmed as being true and correct, and they are made a specific part of this Ordinance. Section 2. Pursuant to Chapter 28, entitled “Land Development Code,” (“LDC”) Part 6, entitled “Development Review Procedures and Requirements,” Article 655, “Vacations of Right-Of-Way,” the requested partial right of way Vacation (VC-018-25), as delineated on the attached Exhibit “A,” is approved. Section 3. That if any clause, section, sentence, or phrase of this Ordinance is for any reason held unconstitutional or invalid by a competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. All ordinances or parts of ordinances, resolutions or parts of resolutions in conflict with this Ordinance are repealed to the extent of such conflict. Section 5.
