ROLL CALL II. APPROVAL OF MINUTES 1. Approval of Minutes of the Planning and Zoning Board/ Local Planning Agency from the June 20, 2024, regular meeting. III. PUBLIC HEARINGS 1. VA-016-24/VA-017-24: The property owners, Robert, and Sandra DeVlieger, are requesting variances for the redevelopment of a new two (2) story, single-family home with a roof deck for the property located at 313 NE 2nd Avenue. (Continued from June 20th meeting) 2. VA-028-24: The property owner, Rina Apel, is requesting a variance to reduce the required side setback and minimum lot width requirements from Code Sec. 205-10 for a lot split request for three single-family homes for the property located at 1405 NW 10th Street. IV. BOARD ITEMS 1. City Commission actions on items previously heard by the board: • TX-097-24 Artificial Turf- 2nd Reading on 07/09 • TX-007-24 Shipping Container- 1st reading on 06/25 & 2nd reading on 07/09 • CD-095-23 LPA (EAR) Comp Plan- 2nd reading on 07/09 2. CITY OF DANIA BEACH PLANNING AND ZONING BOARD/LOCAL PLANNING AGENCY - MINUTES CITY COMMISSION CHAMBERS/CITY HALL 100 W. DANIA BEACH BLVD. WEDNESDAY, JUNE 20, 2024 – 7:00 P.M. I. ROLL CALL The meeting was called to order at approximately 7:00PM by Vice Chair Rimoli. Board Clerk Ibel Larios called the roll. Discussions/actions notated below were not limited to what was typed. Rimoli Present Corinne Lajoie, AICP, Deputy Dir Comm Dev Deborah Bell Present Claudia Viviana Batista, PZ Senior Manager Derrick Hankerson Present Jonathan Cady, Planner Morris Stowers Present Ibel Larios, Board Clerk Motion was made by Board Member Hankerson to excuse Chair Robertson’s absence tonight and was seconded by Vice Chair Rimoli. Motion passed 4-0. II. APPROVAL OF MINUTES 1. Approval of Minutes of the Planning and Zoning Board / Local Planning Agency from the April 17, 2024 regular meeting. Motion was made by Board Member Hankerson to approve the minutes of the meeting of the Planning and Zoning Board/Local Planning Agency for April 17, 2024 as presented and was seconded by Board Member Stowers. Motion passed 4-0. III. PUBLIC HEARINGS 1. VA-016-24/VA-017-24: The property owners, Robert and Sandra DeVlieger, are requesting variances for the redevelopment of a new two (2) story, single-family home with a roof deck for the property located at 313 NE 2nd Avenue. (Continued from the April 17th meeting) Planning and Zoning Board/Local Planning Agency Minutes 2 June 20, 2024 Deputy Director Community Development Corinne Lajoie explained that the applicant was requesting this item to be continued to the July 17, 2024 meeting as their architect was out of state today and unable to attend tonight’s meeting. Motion was made by Board Member Hankerson to continue this agenda item (VA-016-24/VA-017-24) to the date certain meeting of July 17, 2024 and was seconded by Board Member Stowers. Motion passed 4-0. 2. TX-007-24: The applicant, the City of Dania Beach, is requesting a text amendment to the City’s Code of Ordinances, Land Development Code (LDC) modifying the container regulations. PZ Senior Manager Batista presented a PowerPoint presentation for updating and providing detailed regulations for cargo/shipping containers in the LDC. She gave some background starting with April 2023 when amendments were made to the LDC to allow containers to be used for construction. The City wanted to establish regulations and guidelines now to allow for expanded use for shipping containers. They needed to do such things as remove the special exception requirement for implementation, acknowledge cargo/shipping containers as a suitable alternative to traditional construction materials, and implement architectural design standard details required by the LDC for residential, commercial and/or accessory use. She showed pictures from other cities around the county and even around South Florida already using alternate construction material and explained what would be needed for residential, commercial and/or accessory use. She then spoke about non-residential use and advised that the Community Development Department suggested the Board recommend approval to the City Commission for the addition of the container text amendment to the City’s Code of Ordinances, LDC. The Chair asked if any one from the public wished to speak on this issue. Rhonda Hollander said she owned a law firm on Federal Highway and asked about some of the wording in the text amendment. She explained where she owned her property and wanted to know if this was something she could consider. Deputy Director Lajoie said that Attorney Hollander was in the South Federal Highway Mixed Use Zoning District and answered her that setbacks would not be her problem. Using containers would be possible on her property and reminded her that there were design requirements. Ms. Hollander asked if she could use multiple layers of containers and was told that the intent was to allow containers to be used as alternate construction material and what was constructed had to pass building code. Attorney Hollander was glad to know that this was feasible for her property. Board Member Hankerson said there were a couple of businesses that currently have containers on their property being used in different ways and he explained where they were. He wanted to know if these containers were grandfathered in because they were existing already. Deputy Director Lajoie answered negatively and explained that they did not have a permit. She believed it was meant as temporary staging and there were no permits for occupancy of those structures and she hoped they were not being occupied. Discussion ensued about the rules and that preliminary conversations had taken place. Board Member Hankerson then spoke about a building that had two halved containers. He said they were before the Magistrate who gave them a little more time. Deputy Director Lajoie did not know what the violation(s) in front of the Magistrate were. City Attorney Boutsis thought it might have been for work without permits or something to do regarding permits and this was at least two years ago. Deputy Director Lajoie said she remembered that permits did come through. Board Member Hankerson said the halved containers looked like they had sliding glass which might not be up to code and that they were on a major thoroughfare and the exterior needed to reflect that area better. Motion was made by Board Member Stowers to recommend approval of this agenda item (TX-007-24) to the City Commission for the addition of the container text amendment to the City’s Code of Ordinances, LDC and was seconded by Board Member Hankerson. City Commission actions on items previously heard by the Board: • TX-028-23 Sign Code Text Amendment- 2nd Reading on 05/14 • TX-097-24 Artificial Turf Text Amendment 1st Reading on 05/14 2. Upcoming meeting dates: July 17, 2024 Deputy Director Lajoie explained that TX-028-23 was approved on 2nd Reading and TX-097-24 was continued on 2nd Reading due to Staff researching/gathering answers for the City Commission’s questions. She further stated that there would be a meeting on July 17, 2024. Deputy Director Lajoie spoke about a Vulnerability Workshop being held on Tuesday, June 25th at 5:15PM in the Northwest Conference Room (this event would be part of the Green Advisory Board Meeting). There would be consultants who were working on a Vulnerability Grant for the City, trying to get resident input and doing some outreach. V.
