Approval of Minutes of the Planning and Zoning Board sitting as the Local Planning
Agency from the August 20, 2014 meeting.
BOARD ITEMS
1. TX-100-14: The applicant, the City of Dania Beach, is requesting a text amendment
to the land Development Regulations, Chapter 28 to provide definitions and land use
regulations which will address the location of medical marijuana uses in the City.

Approval of Minutes of the Planning and Zoning Board from the August 20, 2014
meeting.

1. PL-075-14: The applicant, Pulice Land Surveyors, Inc. on behalf of the property owner
Lawrence Turner Jr and Roberta Backus Turner, is requesting to create a plat known as
the “Florida Park Plat” for the property generally located east of SE 5th Avenue, west of
Gulfstream Road and south of East Dania Beach Boulevard.

APPROVAL OF MINUTES
Motion was made by Randy Wright to approve the July 16, 2014 minutes of the Planning &
Zoning Board sitting as Local Planning Agency and was seconded by Derrick Hankerson, Motion was
approved 5-0.
BOARD ITEMS
1. TX-74-14: The applicant, Dennis D. Mele, Esq., on behalf of Dania Beach Developers, LLC., is
requesting a text amendment to the Beach Gateway Mixed-Use (GTWY-MU) zoning district and
the Incentives section of the Land Development Code.
Corinne Lajoie, Principal Planner made presentation and recommends approval.
Randy Wright asked about the increase in traffic and how will it be offset.
Staff responded that the City will collect a park impact fee and a traffic analysis will need to be
done.

The applicant, Dennis Mele made a presentation showing a plan for the properties requesting
rezoning.
Tim Pribisco asked staff if the City has any other locations for this proposed density.
Staff responded not without a great deal of land assembly.
Randy Wright asked staff to explain the way density is calculated. Staff explained in detail
Dwain Dickerson, attorney of neighboring property stated they are in full support of this project.
Motion was made by Bill Harris to approve item #1, TX-074-14 and was seconded by Derrick
Hankerson motion was approved 5-0.

2. TX-80-14: The applicant, City of Dania Beach, is requesting several zoning text amendments to
the City’s Unified Land Development Code, known as OneCode.
Corinne Lajoie, Principal Planner made presentation and recommends approval with deletion of
#9.
Randy Wright asked to better define fitness club.
Tim Pribisco stated how code enforcement is going to handle allowing unsightly view of boat
storage.
City Attorney asked staff for clarification on page 4 of the ordinance in the table, if this was
additional underlined language.
Staff responded yes.
Motion was made by Randy Wright to approve item #2 with additional language for boat
storage, definition of fitness club and removal of temporary signage language, TX-080-14 and was
seconded by Derrick Hankerson, motion was approved 5-0.

3. RZ-69-14/LUF-70-14: The applicant, Scott Backman, on behalf of Robert Favarato and Sarah
Diane Favarato, as Trustees under the Robert C. Favarato and Sarah Diane Favarato Living Trust,
is requesting assignment of flex and rezoning on property located at SW 29 Terrace (NW corner
of Griffin Road and SW 29 Terrace).
Corinne Lajoie, Principal Planner made presentation and recommends approval.

Tim Pribisco stated that this plan is compatible with the City’s vision for this area about two (2)
years ago.
Christine Bilenki, attorney for the project, stated prior to this development project, she recently
worked on a Family Dollar project proposed for this site and did not receive any negative
feedback then.
Lara Gumball, one of the owners of the property, stated she also approves this project.
Motion was made by Bill Harris to approve item #1, RZ-069-14; LUF-070-14 and was
seconded by Derrick Hankerson, motion was approved 5-0.

Motion was made by Randy Wright to approve the July 16, 2014 minutes of the Planning &
Zoning Board and was seconded by Derrick Hankerson, motion was approved 5-0.

1. PL-68-14: The applicant, Scott Backman, on behalf of Robert Favarato and Sarah Diane
Favarato, as Trustees under the Robert C. Favarato and Sarah Diane Favarato Living Trust, is
requesting plat approval for the property located at SW 29 Terrace (NW corner of Griffin
Road and SW 29 Terrace). (SEE ITEM #3 FROM LPA AGENDA FOR STAFF REPORT
AND BACK UP)
Corinne Lajoie, Principal Planner made presentation and recommends approval.
Randy Wright stated that the Plat document is missing the signature of the engineer on
record and would require this prior to commission approval.
Motion was made by Derrick Hankerson to approve item #1, PL-068-14 with the stipulation
that this plat is to be presented exactly as shown tonight or any changes made shall be highlighted and
