Sandler Present Marc LaFerrier, Department Director Randy Wright Present Eleanor Norena, Board Clerk APPROVAL OF MINUTES Motion was made by Derrick Hankerson to approve the August 21, 2013 minutes of the Planning & Zoning Board and was seconded by David Nuby Jr. Motion was approved 5-0. BOARD ITEMS 1.VA-48-13:The applicant, Jose Martinez is requesting a variance to waive the maximum 30% curb-cut openings for a property located at 141 SE 2nd Avenue. City Planner, Mariluz Maldanado made a presentation and recommends approval. Property Owner, Jose Martinez said he did not know he needed a permit to install his new driveway and he is willing to remove the concrete and use permeable pavers as recommended by staff. Randy Wright asked if staff is requiring the property owner to remove all concrete and use only permeable pavers. Department Director, Marc LaFerrier stated that staff was requiring the property owner to only remove the concrete located in the swale area and the two feet setback from the property line. He also clarified that staff would allow the use of permeable pavers in the swale. Rae Sandler asked staff if all swales city wide should be permeable surface. ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE BY THE PLANNING AND ZONING ADVISORY BOARD WITH REGARD TO ANY MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED. LOBBYIST REGISTRATION REQUIRED - REGISTRATION AS A LOBBYIST IN THE CITY OF DANIA BEACH IS REQUIRED IF ANY PERSON, FIRM OR CORPORATION IS BEING PAID TO LOBBY THE COMMISSION ON ANY PETITION OR ISSUE PURSUANT TO ORDINANCE NO. 01-93. REGISTRATION FORMS ARE AVAILABLE IN THE CITY CLERK’S OFFICE IN THE ADMINISTRATION CENTER. Planning and Zoning Board Local Planning Agency Regular Meeting 3 October 16, 2013 Marc LaFerrier answered that the City Engineer determined this on a case by case basis Motion was made by Derrick Hankerson to approve item #1, VA-48-13, for variance and was seconded by David Nuby Jr. Motion was approved 5-0. Derrick Hankerson yes Rae Sandler yes Randy Wright yes David Nuby Jr. yes Tim Pribisco yes 2.SP-51-13/VA-52-13/VA-53-13/VA-54-13: The applicant, the Dania Beach Community Redevelopment Agency, is requesting a site plan modification and variances to construct a pavilion at 1200 NW 1 Street and adjoining right-of way. City Planner, Corinne Lajoie made a presentation and recommends approval. Dania residents, Issac Gathers and Leon Carroll both stated they promote growth for the community garden. Motion was made by Rae Sandler to approve item #2, SP-51-13/VA-52-13/VA-53-13/VA-54-13, for site plan modification and variances and was seconded by Derrick Hankerson. Motion was approved 5-0.
