CITY OF DANIA BEACH PUBLIC ART ADVISORY BOARD MEETING – MINUTES REGULAR MEETING / NW CONFERENCE RM – CITY HALL 100 W DANIA BEACH BLVD MONDAY, JUNE 12, 2023 – 5:00 P.M.

The meeting was called to order by Chair Sharaby at approximately 5:08PM. Discussions/actions were notated but were not limited to what was typed. Board Members Staff

a) Approval of Minutes of the Public Art Advisory Board (PAAB) from the May 15, 2023 meeting. Without objection, a motion was made to excuse board member absences. Motion was made by Chair Sharaby to excuse tonight’s board member absences for Kyla Holmes and Lloyd Goradesky and was seconded by Board Member Aptakin. Motion passed 5-0.
Without objection, a motion was made to approve the May 15th minutes after hearing the Call to Artists for City Hall Parking Garage West Wall (Final Draft)
Motion was made by Board Member Granett to approve the Public Art Advisory Board Minutes of May 15, 2023 as presented and was seconded by Chair Sharaby. Motion passed 5-0. III. ACTION ITEMS a) Call to Artist for City Hall Parking Garage West Wall (Final Draft) Planning Art Consultant Linda Flynn made the presentation to the board and explained that the selected artist or artist team would design exterior artwork to enhance a prominent wall location
within the City Hall Complex. They discussed the applicant’s eligibility, the application process
and the selection criteria. The board would review the applications for the Call to Artists. Director Norena anticipated this being a potential agenda item for the June 27th City Commission Meeting, if they got a recommendation for a consensus to move forward. Commissioner Davis asked about who would be considered to be included in the call to artists. Ms. Flynn reminded that she would
keep in touch with Hotel Dello for any future collaboration and discussed the first possible Call to
Artists date.
Public Art Advisory Board Meeting - Minutes 2 June 12, 2023
Motion was made by Board Member Aptakin to make a recommendation for approval to the City Commission for the City Hall Parking Garage West Wall (Final Draft) and was seconded by Board Member Granett. Motion passed 5-0.
b) PA-035-23 Mural Application for Gaspar Arts Center located at 250 S Federal Hwy This application was continued from the previous meeting because the board wanted to know if the mural was finished and if not, what would the final mural look like. The board now had the
answers they needed. Motion was made by Board Member Aptakin to make a recommendation to the City Commission to approve this mural application, PA-035-23, and was seconded by Board Member Granett. Motion passed
5-0. IV. ADMINISTRATOR UPDATES
a) Totor Sculpture Planning Art Consultant Linda Flynn said last month that the Totor Sculpture was shipped to Tampa and the artist would pay for the shipping from Tampa to Fort Lauderdale. She described all the problems they had to fix. Director Norena said that a base was being created and the sculpture would sit in the base. She described how this all would be done. There would be a
temporary unveiling at Dania Pointe (right in front of the Marriott Hotel) on June 29, 2023. Then the permanent location at a City Hall future park was discussed. Discussion pursued about a plaque stating something like this was part of the Dania Beach Public Art Program/Board. It should also depict artist information. The plaque contract would come in front of the board and the City Commission.
V. OTHER DISCUSSION a) Next meeting date: Monday, July 17, 2023 (canceled) This meeting was canceled because the month of July would be used as a board summer break, as there were no items for a July agenda. Everyone was in complete agreement. The next meeting
date would be Monday, August 21, 2023. As we were very close to our first Call to Artists, we would use it to learn from for future Calls to Artists. The first call would be like our Experimental Call. VI. MEETING ADJOURNED
As all business was concluded, the meeting was adjourned at approximately 5:33PM.

PHASE 1: DANIA BEACH: CRITERIA FOR SELECTION OF ARTISTS ⇒ Each Artist or Artwork will be valued on a scale of 1-10, with a total possible score of 40 ⇒ The top 5 scores will advance to the proposal stage.
1. Qualifications: Artists shall be selected based on their qualifications as demonstrated by past work and the appropriateness of their concepts to the project. Of highest priority are the artistic capabilities of the artist and the inherent quality of their artwork.

2. Artistic Excellence: Artists and the public art shall demonstrate excellence of creative and aesthetic ideas, a mastery of skills and techniques, communication of unique vision or perspective, and professional approaches to process and presentation. 3. Media and Style: All forms of public art shall be considered, subject to any requirements set forth by the project prospectus. Artists whose artworks are representative of all schools, styles, and tastes shall be considered, as appropriate to the specific characteristics of the project and the site.

4. Appropriateness to Site: Artwork shall be appropriate in scale, material, form, and content for the selected site. The art must have an artistically compelling relationship to the physical
character or significance of the site, and the surrounding geographic context.

PHASE 2: The following additional criteria will be used for artwork selection (in addition to the above)
5. Durability: Consideration shall be given to structural and surface integrity, permanence, and protection of the proposed artwork against theft, vandalism, weathering, excessive maintenance, repair costs, and extreme weather events such as hurricanes, floods, or fires. Durability shall be defined in relation to the intended lifespan of the project.
6. Visual Accessibility: The proposed artwork will be readily visible to the public and meet the location requirements of the project.
7. Public Liability: Safety conditions or factors that may bear on public liability should be considered in selecting an artist or artwork. Examples of safety concerns may include a work that invites children to climb on it, has sharp edges, or is at risk of damage from extreme weather.
8. Diversity: The public art program shall strive for diversity of style, scale, media, and artists. The program shall also strive for an equitable distribution of artworks throughout the City. 9. Maintenance: The proposed artwork will not require extraordinary maintenance and the maintenance plan addresses vandalism, weathering, natural disasters, and the timeframe of
the artwork.
GUIDE TO SELECTION OF A SPECIFIC ARTWORK OR ARTIST
The goal is to select art works of the highest quality and set up a regular procedure for evaluating
artwork, and establishing standards for the acquisition of artwork:

a. High quality of craftmanship and skill
b. Materials used skillfully

Project Name: City of Dania Beach Parking Garage Wall Public Art Project

Introduction:
The City of Dania Beach is seeking to commission an artist or artist team to enhance a prominent exterior location within
the City Hall Complex, located in Dania Beach, Florida. The City of Dania Beach intends for the public art program to
showcase the city’s sense and character of place and be a source of pride and inspiration for residents, visitors, workers,
and artists. The core themes for public art include environmental stewardship, community history, and celebrating Dania
Beach’s sense of place. The selected artist will design exterior artwork that visually enhances the wall.

42 feet tall
137 feet long

Project Budget:
Not-to-exceed $65,000
Eligibility: The chosen professional public artist should be registered with the Florida Department of State Division of
Corporations (Sunbiz.org). Any artwork requiring construction will require that the contractor performing the work be
bonded.
South Florida-based artists are strongly encouraged to apply.
Artwork Opportunity
The City of Dania Beach is interested in commissioning a dynamic exterior artwork or mural that:
• Creates a sense of place;
• Creatively enhances the exterior wall;
• Compliments the surrounding environment; and
• Functions within the existing space;
The City Hall Parking Garage is in the City Hall Complex at 100 West Dania Beach Boulevard, Dania Beach, Florida.
The site for the creative artwork, light installation, mosaic, or mural is the wall that currently overlooks a City green
space that is utilized for City events such as Dania Beach After Dark. There is a newly acquired large-scale freestanding sculpture within the space. It is envisioned that an artist will make a visual statement with the wall art installation.
The artist is encouraged to submit a concept to the City and the Public Art Advisory Board that is creative, may be
temporary, or may be an interchangeable light installation throughout the calendar year.
Questions regarding to this Call to Artist must be submitted in writing to Ibel Larios at ilarios@daniabeachfl.gov.
Project Budget
The budget for this project shall not exceed $65,000, and this should allow for a range of creative design concepts. The
budget will include Artist’s design fee, presentation expenses, meetings, Artist’s contingency, and all applicable taxes. If
the creative concept is based on an interchangeable interactive or light installation it should include the full budget for
all phases. Permit fees, as required, will be the responsibility of the City.
Applicant’s Eligibility
This Call to Artists is open to professional artists, eighteen years of age or older; residing in the United States. Applicants
should demonstrate through their submission materials that they have the skills and experience to successfully complete
the project. Professional artists with strong experience in executing their ideas through completion, meeting deadlines and
budgets are encouraged to apply. Professional Artist should be registered with the Florida Department State Division of
Corporations (Sunbiz.org) to do business in Florida.
Application Process and Selection Criteria
The City of Dania Beach Community Development Department manages the application process. A Public Art Advisory
Board (PAAB) reviews the applications to this Call to Artists. This Board includes arts professionals, design professionals,
and community representatives. The Board shortlists applicants based on excellence of past work of similar scope, as
demonstrated by the visuals and other submission materials. The Board also considers the versatility and appropriateness
of the media in which the applicants have demonstrated proficiency relating to the scope of the project.
Up to five (5) shortlisted Artists will be invited to develop preliminary conceptual design proposals to present via video
conference or in-person to the PAAB. Each shortlisted Artist will receive information about the project and have a minimum
of one (1) month to prepare a preliminary conceptual design proposal for review by the Artist Selection Panel. Shortlisted
Artists will be paid an honorarium of $1,000 for the proposal and presentation.
The City of Dania Beach reserves the right to negotiate with any qualified Artist selected for this project, to re-issue this
Call to Artists, and to reject any and all responses to this Call to Artists.
Application Requirements
Applications must be submitted to Ibel Larios at the City of Dania Beach at ilarios@daniabeachfl.gov.
Electronic Images – Submit at least five (5) digital images of relevant work. Artists are encouraged to submit work
samples that best illustrate their qualifications for this opportunity. Each digital image must feature a single work.
• Annotated Image List – Include title of work, year, media, size, location of artwork, project budget, and
any other relevant information.
Résumé – Includes all contact information (phone number, email, and mailing address).
Brief statement – Describe your interest in the project, any initial ideas, demonstrate your understanding of the
objectives.
Please note, if selected, the Artist shall be required to provide insurance. Attached to this Call to Artists is the
insurance requirements of the City.
Prohibition Against Considering Social, Political or Ideological Interests in Government Contracting
Respondent/Artists are hereby notified of the provisions of section 287.05701, Florida Statutes, as amended, that the City
will not request documentation of or consider a Respondent/Artist’s social, political, or ideological interests when
determining if they are a responsible Respondent/Artist. Respondents/Artists are further notified that the City's governing
body may not give preference to a Respondent/Artist based on the Respondent/Artist’s social, political, or ideological
interests.

Cone of Silence
Cone of Silence: Definitions: “Cone of Silence,” as used in this Call to Artists, means a prohibition on any communication,
between:
• a potential vendor, service provider, Respondent/Artist, lobbyist, or consultant, and
• a City Commission member, City’s professional staff including, but not limited to, the City Manager
and her staff, or any member of the City’s Selection Committee/Public Art Advisory Board.
Restriction; Notice: A Cone of Silence shall be imposed upon this Call to Artists upon its advertisement. At the time
of imposition of the Cone of Silence, the City Manager or designee shall provide for public notice of the Cone of Silence
by posting a notice at City Hall. The City Manager shall issue a written notice as to the Cone of Silence to the affected
departments, file a copy of such notice with the City Clerk, with a copy to each City Commissioner, and to the Public Art
Advisory Board and this shall include in any public solicitation for goods or services a statement disclosing the requirements
of this section.
Termination of Cone of Silence: The Cone of Silence shall terminate at the beginning of the City Commission meeting
(whether a regular or special meeting) at which the Public Art Advisory Board, through the City Manager, makes a written
recommendation of final award to the City Commission. However, if the City Commission refers the Public Art Advisory
Board and the City Manager’s recommendation back to the Public Art Advisory Board and to the City Manager or staff
for further review, the Cone of Silence shall be re-imposed until such time as the Public Art Advisory Board and City
Manager1 makes a subsequent written recommendation.
1 The City’s Code provides that the Public Art Board is to make recommendations to the City Commission. As the staff liaison works for
the City Manager, and as the City Manager is in charge of the agenda, and in reconciling the City’s procurement code with the City’s
Code as to the Board, the Board and Manager will work together on issuing the recommendation to the City Commission, of the Board’s
Art recommendation.
Exceptions to Applicability: The provisions of this section shall not apply to:
a. Oral communications at pre-submission conferences;
b. Oral presentations before the Selection Committee/Public Art Board;
c. Public presentations made to the City Commission members during any duly noticed public
meeting;
d. Communications in writing at any time with any City employee, unless specifically prohibited by
the solicitation. The Respondent/Artist shall file a copy of any written communication with the City
Clerk. The City Clerk shall make copies available to any person upon request;
e. Communications regarding the solicitation between a potential vendor, service provider,
Respondent/Artist, lobbyist or consultant and the City’s Procurement Administrator or City
employee designated as responsible for administering the procurement process for the Call to
Artists, provided the communication is limited strictly to matters of process or procedure already
contained in the corresponding solicitation document;
f. Communications with the City Attorney and her staff;
g. Duly noticed site visits to determine the competency of a Respondent/Artist regarding the
solicitation during the time period between the opening of Bids and the time the Public Art Board
and City Manager makes a written recommendation;
h. Any emergency procurement of goods or services pursuant to City Code;
i. Responses to the City’s request for clarification or additional information;
j. Contract negotiations during any duly noticed public meeting;
k. Communications to enable City staff to seek and obtain industry comment or perform market
research, provided all related communications between a potential vendor, service provider,
Respondent/Artist, lobbyist, or consultant and any member of the City’s professional staff
including, but not limited to, the City Manager, Public Art Board staff liaison, and her staff are in
writing or are made at a duly noticed public meeting.
Penalties: Violation of this section by a particular Respondent/Artist shall render any solicitation award or contract to the
Respondent/Artist voidable by the City Commission or City Manager. Any person who violates a provision of this section
may be prohibited from serving on a City selection or evaluation committee. In addition to any other penalty provided
in this solicitation, violation of any provision of this section by a City employee may subject the employee to disciplinary
action.
Please contact the City Attorney for any questions concerning “Cone of Silence” compliance. Insurance
The Artist shall secure and maintain throughout the duration of this Agreement insurance of such type and in such amounts as required by the City Manager. Certificates of Insurance for any required insurance shall be provided to the City at the time of execution of this Agreement and certified copies provided if requested. Each policy certificate shall be endorsed
with a provision that not less than thirty (30) calendar days' written notice shall be provided to the City before any policy
or coverage is cancelled or restricted.

• $500,000 for bodily injury caused by disease, policy limit
Confirmation of exemption to the laws of the State of Florida or Exemption Form is required for businesses exempt from obtaining
Worker’s Compensation coverage.
Subcontractors’ Compliance: It is the responsibility of the contractor to ensure that all subcontractors comply with all
insurance requirements.
Copy of Additional Insured Endorsement or other endorsements may be attached to the Certificate.
Insurance Carrier Requirements: The Company must be rated no less than “A-” as to management, and no less than “Class
VII” as to financial strength, by the latest edition of Best Insurance Guide published by A.M. best Company, or its equivalent.
All policies or certificates of insurance are subject to review and verification by Risk Management. Companies authorized
to do business in the State of Florida with the following qualifications shall issue all insurance policies required above.
Verification of Coverage: Proof of the required insurance must be furnished by Vendor to the City of Dania Beach Human
Resources Department by Certificate of Insurance within 5 days of notification of award. All certificates (and any required
documents) must be received and approved by Human Resources before any work commences to permit Vendor time to
remedy any deficiencies.
