BE IT RESOLVED BY THE CITY COMMISSION OF THE CIry OF DANIA, FLORIDA: Section 1. That the City Commission of the City of Dania, Florida, hereby approves the lnterlocal Agreement between Broward County and the City of Dania pertaining to expansion and jurisdiction of Fort Lauderdale-Hollywood lnternational Airport, a copy of which is attached hereto and made a part hereof as Exhibit "A", and the appropriate city officials are hereby directed to execute same. (1) At all times during phases 1, 2 and 3 of opera-tion, proposed runway 9R/27L shall be used only during the houis of7:00 a.m to 10:00 p.m. and only by Stage III aircraft. However,proposed runway 9R/27L may be used at any time i-n the event of anemergency or the closure of runway 9L/27R as hereinafter provided. (2) At the start-up of operation of the proposedrun$ray 9F./27L, aircraft exceeding 58,ooo Ibs. will land on1-y tt thelrest. and depart only to the east. These are explained as follows: Amendment One -- Leaves Trails End in the City of Dania. The Trails End property, until three weeks ago, was to be included with land left in the City. As Trails End represents the first intrusion by the airport into a residential neighborhood, it is important that this site remain in Dania. This way Dania can maintain development approval and assure that the neighborhood is properly buffered from commercial development. The City's recent approval of the Value Rent-A-Car plat on the site is testament that the City's demands are not unreasonable. Unfortunately the County's business deal with Value did not come to closure. However, this should not be a reason to remove the site from the City's tax rolls. The agreement also reflects changes recommended by County staff in the document labeled CoUNTY STAFF CHANGES To CuRTls REVlsloN oF lt'$ERLocAL AGREEMENT. ltems 1, 2,5,9,10,11, and 12 have been incorporated. ltems 3 and 4 have been changed to reflect the County draft received on July 17, 1995. Items 6, 7, and 8 relate to Trails End. The Honorable Suzanne N. Gunzburger August 25, 1995 Page2 Amendment Two - Requires that any mitigation program base the determination of value on comparable properties selected from outside any airport affected area. The language is incorporated at page 5, footnote 2. This revision should not be objectionable as according to the aviation department staff it has always been the intent and further requirement of the Relocation Assistance Act for Condemnation. Amendment Three - Requires City approval of mitigation programs and binding arbitration of disputes regarding mitigation remedies. This language is incorporated on page 5, paragraph 4.C. The revision adopts the County's July 17 , 1995, proposal. Amendment Four - Which deletes language at page 5, paragraph 4. B provides for mitigation remedies at the County's option, This is in conflict with Amendment Three above and it is also consistent with the County's July 17, 1995, version. This city desires the right to approve any mitigation affecting a large segment of the City's population, the integrity of its neighborhoods and actions which significantly impact the City's fiscal condition. I urge the County Commission to carefully review this document that the Dania City Commission has approved as an equitable and fair resolution to disputes between our two government agencies. Our intent from the beginning has been to protect the property interests of our citizens and their quality of life.
