Adler, City Attorney Resolution No. 154-95 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING THE AGREEMENT BETWEEN THE CITY OF DANIA AND COASTAL SYSTEMS INTERNATIONAL, INC., FOR ADDITIONAL ENGINEERING SERVICES RELATIVE TO THE PROPOSED DREDGING OF THE DANIA CUTOFF CANAL; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CIry COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That the City Commission of the City of Dania, Florida, hereby approves the agreement between The City of Dania and Coastal Systems lnternational, lnc., for additional engineering services relatlve to the proposed dredging of the Dania Cutoff Canal in the City of Dania, a copy of which agreement is attached hereto and made a part hereof as Exhibit "A", be and the same is hereby approved, and the appropriate city officials are hereby directed to execute same. Dear Dan Pursuant to our discussions, this is to submit our proposal for engineering services relative to the proposed dredging of the Dania Cutoff Canal within the City of Dania. The following are proposed ierms of agreement lor engineering services to be provided by Coastal Systems International, Inc. (Coastal Systems) for the City of Dania (City): RT R E APPLICATIONS Coastal Systems will prepare permit applications for submittal to the Department of Environmental Protection @EP) and Broward County DNRP with the assistance of the City. Specifically, the City sha[[ provide Coastal Systems with any surveys, legal descriptions, warranty deed, and any permit fees that may be required to complete the permit applications. Coastal Systems will prepare permit sketches to be submitted along with the applications. PERMIT PROCESSING ln general, Coastal Systems will maintain contact with the Regulatory Agencies to answer questions, to clarify the proposed construction, and to expedite permit approvals. 24030-R4 Mr. Dan Oyler November 2, 1995 Page 2 Coastal Systems witl provide details of the proposed construction and respond to incompleteness summaries from the regulatory agencies. Coastal Systems wilt provide additional information that may be required including information relative to the migration of manatees in the viciniry of the proposed project, as may be available from Broward County. PART III - SOIL TESTING Coastal Systems will coordinate with the City to obtain representative soil samples from the canal bottom. The laboratory shall be an approved facility recognized by the DEP and shall have an updated Q/A plan on file with the State. Lab personnel will transport the samples to the environmental testing lab for analysis. Collected soils samples will be placed in the appropriate sized and preserved containers for transportation to the laboratories for analysis. The samples will be mllected in accordance with the lab's Comprehensive Quality Assurance Plan, which is on file with the Florida Department of Environmental Protection (DEP) in Tallahassee, Florida. At a minimum, the soil samples will be analyzed for the following parameters: (l) organochlorine pesticides and PCB's, (2) arsenic, (3) barium, (4) cadmium, (5) chromium, (6) lead, (7) mercury, (8) selenium, (9) silver, (10) nickel, (11) copper and (12) zinc, organics, thallium and beryllium, oils and greases. Appropriate chain of custody documentation will be submitted to Coastal Systems. The results will be forwarded to the DEP along with a letter report showing location depth, test results of each sample and a comparison of the results meeting DEP minimum standards. PART TV - ENGTNEERING DESIGN coastal Systems will prepare preliminary and final design drawings for the proposed dredging project along with bid specifications as required by the City for implementation of this project. Coastal Systems will prepare construction plans including all details of proposed dredging of the Dania Cutoff Canal. Coastal Systems will utilize the bathymetric surveys and other bathymetric data that may be provided by the City, in order to prepare design profiles and dredge volurnes, for inclusion in the plans and specifications. Coastal Systems will conduct field observations to verify that dredging is being performed in compliance with the plans, specifications and permits issued for the project. Coastai Systems will review and approve the confiactor's periodic pay requests to the City. At project completion Coastal Systems will issue a final certification to the City and Regulatory Agencies. A proposal for this part of the project shall be submitted to the City for consideration after permits are issued. GENERAL Engineering fees are $69,000. Coastal Systems will invoice the City monthly on a percentage coriplete ULis. fne City shall make payment to Coastal Systems upon receipt of an invoice. Invoices not paid within thirty (30) days and not in dispute shall inq.r interest at a rate of 1.5 percent per month. Coastal Systems lnternational are the City consultants for many ongoing projects. The contract with them for the Bathometric survey of the canal provides for additional services for the continuation of the dredging project. The cost of permitting is $69.000. The funds for the project are being provided through a grant from the Florida lnland Navigation District. By copy of this memo to the City Attorney, I am requesting that he prepare the necessary resolution for acceptance. Please place this item on the City Commission agenda of November 14, 1995.
