A RESOLUTION OF THE CITY OF DANIA, FLORIDA VACATING 3
ANCHOR EASEMENTS, 60'FRONT BUILDING SETBACK LINE AND
A 25' REAR BUILDING SETBACK LINE AS SHOWN ON THE PLAT
ENTITLED "DONNA SUBDIVISION" ACCORDING TO THE PLAT
THEREOF AS RECORDED IN PLAT BOOK 55, PAGE 24 OF THE
PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA AS SHOWN
ON THE SKETCH AND DESCRIPTION ANCHOR EASEMENT AND
SETBACK LINES PREPARED BY BERRY AND CALVIN, INC. P.E
DATED JUNE 23, 1994, A COPY OF WHICH IS AfiACHED HERETO
AND MADE A PART HEREOF AS EXH]B|T "A". ; SAID LANDS LYING
AND BEING IN THE CITY OF DANIA, BROWARD COUNTY, FLORIDA;
AND PROVIDING THAT ALL RESOLUTIONS OR PARTS OF
RESOLUTIONS IN CONFLICT HEREWTH BE REPEALED TO THE
EXTENT OF SUCH CONFLICT;AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 3, Article 3, Part lX, as amended, of the Charter of the City
of Dania, sets forth the procedure for vacating and abandoning streets, alleys or other
property dedicated to the public use; and
WHEREAS, VST /MlF Oakridge Partnership duly petitioned the City
Commission, City of Dania, Florida, for the vacation of 3 anchor easements and front
and rear setbacks legally described as follows:
3 ANCHOR EASEMENTS, 60' FRONT BUILDING SETBACK LINE
AND A 25' REAR BUILDING SETBACK LINE AS SHOWN ON THE
PLAT ENTITLED "DONNA SUBDIVISION'ACCORDING TO THE PLAT
THEREOF AS RECORDED IN PLAT BOOK 55, PAGE 24 OF THE
PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA AS SHOWN
ON THE SKETCH AND DESCRIPTION ANCHOR EASEMENT AND
SETBACK LINES PREPARED BY BERRY AND CALVIN, INC. P.E
DATED JUNE 23, 1994, A COPY OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF AS EXHIBIT,.A,'. ; SAID LANDS LYING
AND BEING IN THE CITY OF DANIA, BROWARD COUNTY, FLORIDA;
WHEREAS, the City Commission referred said petition to the City Planning and
Zoning Board for its recommendation; and
RESOLUTTON 116. 122-94
WHEREAS, at the meeting of the Planning and Zoning Board held sn 16s 27th
day of July , 1994, the Planning and Zoning Board unanimousiy voted to
recommend that the 3 anchor easements and front and rear setbacks be vacated; and
WHEREAS, after publication of notice as required by Section 3, Article 3, Part lX
of the Charter of the City of Dania, a public hearing was held before the City
Commission at its regular meeting held on the 23rd day of Auoust , 1994.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CIry OF DANIA, FLORIDA:
Section 1. That the City Commission of the City of Dania, Florida, does hereby
vacate, abandon, renounce and disclaim all of the right, title and interest of the City of
Dania in and to the following 3 anchor easements as well as the front and rear
setbacks, to-wit:
3 ANCHOR EASEMENTS, 60' FRONT BUILDING SETBACK LINE
AND A 25' REAR BUILDING SETBACK LINE AS SHOWN ON THE
PLAT ENTITLED'DONNA SUBDIVISION" ACCORDING TO THE PLAT
THEREOF AS RECORDED IN PLAT BOOK 55, PAGE 24 OF THE
PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA AS SHOWN
ON THE SKETCH AND DESCRIPTION ANCHOR EASEMENT AND
SETBACK LINES PREPARED BY BERRY AND CALVIN, INC. P.E
DATED JUNE 23, 1994, A COPY OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF AS EXH|B|T "A". ; SAID LANDS LYING
AND BEING IN THE CITY OF DANIA, BROWARD COUNTY, FLORIDA;
Section 2. That the City Commission does hereby find and determine that the
procedure for the vacation and abandonment of the subject 3 anchor easements as
well as front and rear setbacks has been in strict conformity with the requirements of
Section 3, Article 3, Part lX of the Charter of the City of Dania.
Section 3. That all resolutions or parts of resolutions in conflict herewith be
and the same are hereby repealed to the extent of such conflict.

Section 4. That this resolution shall be in force and take effect immediately
upon its passage and adoption.

THENCE Nonh 87"30' 47" West, along the Nonh line of said Section 31, a distance
of 246.40 feet;
THENCE South 02'29'13" West, 53.00 feet to the intersecdon with the South Right-of-
Way line of Gnffin Road as dedicated by said plat of DONNA SUBDIVISION and the
POINT OF BEGINNING of said center line:
THENCE continue South 02'29'13' West, along said center line, a distance of 47.00
feet to the POINT OF TERMINATION of said center line:

A ponion of Lot 2, Block l, DONNA SUBDMSION, according ro the plat thereof as
recorded in Plat Book 55, Page 24 of the Public Records of Broward County, Florida
said Easeme[t lying 2.5 feet on each side of the following described center line:
