That that certain Eleventh Amendment to lnterlocal Agreement Between Broward County and City of Dania Providing for Division and Distribution of the Proceeds of the Local Option Gas Tax lmposed by the Broward County Local Option Gas Tax Ordinance; a copy of which is attached hereto and made a part hereof as Exhibit "A", be and the same is hereby approved and the appropriate city officials are hereby directed to execute same. Section 2. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 3. M ELEVEMTII AUENDMSNT to INTERLOCAL AGREEMENT Between BROWARD COUNTY and CTTY OF DANIA Providing for DIVISION AND DISTRIBI]:TTON OF THE PROCEEDS OF THE LOCAL OPTIO}I GAS TAX II.{POSED BY THE BROWARD CO(,NTY LOCAL OPTION GAS TAX ORDINANCE EXHIBIT "A" EI,EVENTH AMENDMENT to ITAERTOCAI, AGREE!{E![T Between BROWARD COT'NTY and CITY OF DANTA Providing for DIVISION AND DISTRIBUTION OF THE PROCEEDS OF THE LOCAL OPTION GAS TAX II.{POSED BY THE BROWARD COT NTY LOCAL OPTION GAS TAX ORDINANCE Ihis is the Eleventh Amendment to Interlocal Agreement, made and entered into by and between: BRoWARD Cot NTY, a political subdivision of the state of Florida, hereinafter referred to asncot NTY, n AND CITY OF DANIA, a nunicipal corporation, existing under the laws of the state of Florida, hereinafter referred to as ircITY.rl I{HEREAS, section 336.o25 (1) (b), Florida statutes, authorizesthe counties to extend the levy of the six (5) cent local option gas tax upon every ga1lon of motor fuel and special fuel sold in Broward county for a period not to exceed thirty (30) years on anajority vote of the governing body of the coUNTY; and WHEREAS, on June L4, L988, the Board of county coromissioners enacted Ordinance No. 88-27, effective Septenber 1, 1988, through Augrust 31, 2OL8, pursuant to Section 335.O25(1) (b), Floridastatutes, extending the levy of the six cent local option gas taxfor thirty years and providing for a rnethod of distribution of the proceeds of the tax; and WIIEREAS, pursuant to said ordinance, the roethod fordistribution of the proceeds is the execution of an interlocal agrreenent with one or nore of the urunicipalities representing a naj ority of the population of the incorporated area within the county which establ-ishes the distribution formulas for dividing theproceeds of the tax amonq the county and all eligiblenunicipalities within the county, as set forth in Section 335.025 ( 3 ) (a) 1. , Florida Statutes; and WHEREAS, paragraph 4 of ttre Interlocal Agreement, as anendedby the Addendum to the fnterlocal Agreement, requires' annualadjustnent of the population of the individual nunicipalities andunincorporated Brorrard County in accordance with the population f,igrures set forth in the mo6t current edition of trf'lorida Estimatesof Populationr'r publLshed by the Bureau of Economics and Busl,nessResearch, PopulatJ.on Division, University of Florida; NOYI, TIIEREFORE, IN CONSIDEAATIoN of the mutual terEs, conditions, pronises, covenants and paynents hereinafter set forth, cot NTY and CITY agreeas follows: 1.
