That that certain bid submitted by wooden shoe Gardens in the amount of $5,693.00 relating to l.T. Parker Community center Landscaping Project, copy of which is attached hereto as Exhibit "A", be and the same is hereby accepted and the appropriate city officials are hereby directed to execute any and all instruments necessary to contract with Wooden Shoe Gardens for landscaping services relating to said project' section 2. I I I I I NOTICE lS HEREBY GIVEN that the City Commission is seeking sealed bids for the following work as specified on the plans and specifications known as: Bids will be accepted until 2:00pm Monday June 20, 1994 in the oflice of the City Clerk, and to be opened at2:'15 al the City of Dania, Florida, at which time all bids will be publicly read aloud. Envelopes must be sealed and plainly marked "CITY OF DANIA - LT. PARKER COMMUNITY CENTER LANDSCAPE PROJECT'. ln general, the work includes the procurement and installation of plant materials to be installed at the project site. Plans, Specifications and the Bid Document may be examined and obtained on or after May, 23, 1994 at the office of the City Clerk. PARKER COMMUNITY CENTER LANDSCAPE PROJECT INSTRUCTIONS IO BIDDERS 1 SUBMITTAL 1.1 Sealed bids will be received until the time and date specified in the Notice for Bids. 1. 1A Only those firms that employ at least one Florida Certified landscape Contractor or have been in business continuously for a period of 10 years may submit bids. 1.2 Each proposal shall be submitted in a sealed enveloped marked: To: The Mayor and CitY Commission City of Dania 100 West Dania Beach Boulevard Dania, FL 33004 Submitted by: Wooden Shoe Gardens, lnc. 3601 Vinkemulder Road 7.4 Bids shall contain the following information: a. I 1.3 If said proposal is forwarded by mail, it shall be enclosed in another envelope addressed to the City Clerk, City of Dania, Florida' Proposals witl be received at the office of the City Clerk until the time and date specified in the Notice of Bids. Proposals received after the time and date sp€cified will not be considered. 2. PROPOSAT,S 2.1 It is understood by the bidder that the quantities in the proposal are for bid comparison only. Certain portions of the bid or the entire bid document may be deleted from the awarded contract. 2.2 Proposals shall be made upon forms provided for that purpose in this document. Erasures or other changes in a bid shall be explained or noted over the signature of the Bidder. Each bidder shall submit a single, original copy of the proposal, and its accompanying documents. 3. IRREGUI.AR PBOPOSAI,S 3.1 Proposals which are incomplete, conditional or which contain additions not called for, alterations or irregularities of any kind may be rejected. 4, SIGNATURA9ONPROPOSAIS 4.L Each bidder shall sign the proposal with his or her full name, company name and address. In cases where a firm or corporation submits a proposal, the proposal shall be signed with the full name of each officer of the firm or corporation, or by the name of the officer or officers authorized by its by-laws, in addition to the firm or corporation signafure with its official seal affixed thereto. 5. D<AMINATION OFSITE 5.1 Each Bidder shall visit the site of the proposed work before submitting a proposal and shall fully acquaint himself with conditions relating to the site. It will be assumed that the Bidder has investigated and is satisfied as to the conditions of work to be performed and materials to be fumished and shall base his bid on his own opinion of the conditions likely to be encountered, and of the bid prices must assume all risk of variance' by whomsoever made, in any computation or statement of amounts or quantities necessary to fully complete the work in strict compliance with these documents 2 I I iI i I 5.2 Each Bidder shall thoroughly examine and be familiar with the plans and specifications. The failure or omission of any Bidder to receive or examine any form, instrument, addendum or other documents or to visit the site and acquaint himself with existing conditions there, shall in no way relieve any Bidder from any obligation with respect to his bid or to the contract. The submission of a bid shall be taken as prima Iacie evrdence of compliance with this document. 5.3 No plea of ignorance of conditions that exist or that may herealter exist, or o{ conditions or difficulties that may be encountered in the execution of the work under this Contract, as a result of failure to make the necessary examinations and investigations, will be accepted as an excuse for any failure or omission on the part of the Conhactor to fulfill, in every detail, all of the requirements of the Documents, nor will they be accepted as a basis on any claim whatsoever for extra compensation or for an extension of time. 6. DISCREPANCIES 7. TIME OF COMMENCEMENT AND COMPLETION OF WORK 7.1 AII work for this project shall commence within thirty (30) days from the issuance ol a Purchase Order from the City of Dania. 7 .2 Completion of the project shall be within forty (40) days from the issuance of a Purchase Order from the City of Dania. 7.3 Completion of the project shall imply complete possession and occupanry by the City. 3 6.L Should a Bidder find discrepancies or ambiguities in, or omissions from, the Drawings or Specifications, or should be in doubt as to their meaning, he shall at once notify the City Planner' 8. IABOR REGUIATIONS 8.1 The Contractor shall comply with all laws and regulations conceming labor, work hours, wage rates, labor conditions and related matters. 9. WITHDRAWALOFPROPOSAI-S 9.1 A Bidder may withdraw his proposal provided that request is made in writing and delivered either in person or by special delivery mail to the Gty not less than one hour prior to the time set for opening bids. No bid may be withdrawn after the scheduled closing time for the receipt of bids for a period of ninety (90) days. 10. CITV'S BIGHTS RESERI/ED 10.1 The City reserves the right to accept any bid which, in his opinion, is the lowest and best, and in the best interest of the City. The City also reserves the right to reject any and all proposals. 77. INSU&ANCE 11.1 The successful Bidder shall provide the city with Proof of Insurance that is standard in the industry. 12. AWARD OF CON'TBACT t2.L The Contract, if awarded, will be awarded to the lowest responsible and eligible bidder. Such bidder shall possess the skill, ability and integrity necessary for the faithful performance of the work. The term "lowest and responsible and eligible bidder" as used herein shall mean the bidder whose bid is the lowest of those bidders possessing the skill, ability and integrig necessary to the faithful performance of the work. 4 13. ACCEPTANCEPERIOD 13.1 The Bidder shall hold his bid good for acceptance by the City for a period of not less than sixty (60) calendar days following the date of the bid opening. 74. EQUAL OPPORTUNITY REQUIREMENTS 14.1 During the performance of the Contract, the Bidder agrees not to discriminate against any employee or applicant for employment because of race, color, religion, sex, national origin, age, handicap or marital stafus. The Bidder shall tale affirmative action to insure that applicants are employed, and that employees are treated during the employrnent, without regard to their race, color, religion, sex, national origin, age, handicap or marital status. Such action shall include, but not be limited to, the following: employment, upgrading, demotion, transfer, recruitrnent, recruitrnent advertising, Iayoff, termination, rates of pay or other forms of compensation and selection for training, including apprenticeship. The Contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this nondiscrimination clause. 75. AGREEMENT 5 15.1 The successful Bidder shall complete the enclosed agreement within five (5) working days of the award of the contract. Said conhact shall include all documents contained in this Notice Of Bid. 76. MEXHODOFPAYMENT 16.1 The method of payment shall be as follows upon written proof that all vendors have been paid. a. 20o/o ol contract price after first inspection. b. 3570 of contract after second inspection. c. 35% of contract after third inspection. d. 107o of contract alter guarantee. The Bidder proposes and agrees, if this proposal is accepted to fumish all necessary materials, tools, equipment, all necessary transportation and labor to complete the construction as shown, detailed and described in the Specifications and on the drawings. It is understood by the Bidder that all bid item amounts shall be submitted. In the event any item is not included, rejection of the bid will be considered by the City. It is further understood that certain portions of the bid section may be deleted from the awarded contract at the City's discretion. Description of Work The work covered by this section consists of fumishing all labor, materials, equipment, and appliances necessary to install all planting and related work in accordance with the drawings and specifications. The Contractor shall fumish all labor, transportation, materials and equipment necessary for the complete and substantial execution of everything prescribed, shown, or reasonably implied in the drawings and specifications as belonging to the work and included in the contract. C. The work shall generally consist of but not be limited to the following: Provide and plant all trees, shrubs and palms at the specified unit price. Water all new installation in accordance with sound nursery practice. Remove eisting plant material and prepare planting beds. Guarantee all trees and palms for the establishment period of three (3) months. 2. Project Conditlons The contractor shall comply with all laws, ordinances, rules and regulations relating to the work and shall obtain all permits as required to initiate and complete the work. If the drawings and specifications are a variance with each other, the Contractor shall notify the City in advance, in writing, stating the variance. B 1 2 3 4 A B 1 A. Nothing contained in these specifications, or shown on the plan shall be conshued to conflict with any local, county or state laws or regulations goveming the work shown on the plans, and all such ordinances, regulations and rules are hereby incorporated and made part of this specification. All such requirements are to be satisfied by the Contractor and the cost shall be included in the contract price. The Contractor will at all times protect the adjacent structures and facilities from damage due to his work. The Conkactor shall use all precautions necessary to prevent damage or intem-rptions of service of any utility and shall be responsible for any and all damage to existing structures, site improvements, utilities, irrigation, etc., from operations under this conhact. No material shall be stockpiled, no oil, gasoline, or other material shall be placed, washed or dumped under the crown of any existing trees. Utilities: Determine location of underground utilities and perform work in a manner which will avoid possible damage. Hand excavate all shrub and tree pits. Planting Season: Perlorm actual planting only when weather and soil conditions are suitable in accordance with locally accepted practice. 3. Quality Assurance A All materials are subject to inspection and approva.l by the City prior to installation. 4. Source Quall9 Control General: Ship landscape materials with certilicates on inspection, if required by goveming authorities. Comply with regulations applicable to landscape materials. Trees, Shrubs and Palms: Provide trees, shrubs, and palms of quality, size, genus, species, and variety shown and scheduled for landscape work and complying with recommendations and requirements of ANSI 260. 1 "American Standard for Nursery Stock". Provide healthy, vigorous stock grown in recognized nursery in accordance with good horticulfural practice and lree of disease, ins€cts, eggs, larvae, and defects such as knots, sun- scale, injuries, abrasions, or disfigurement. Inspection: The City may inspect trees, shrubs, and palms either at place of growth or at site before planting, for compliance with requirements for genus, species, variety, size and quality. City retains the right to further inspect trees, shrubs, and palms for size and condition of balls and root systems, insects, injuries and latent defects and to reject unsatisfactory or detective material at any time during progress of work. Remove relected plant material immediately for project site. Planting Inspections: Conhactor shall notify the City at the time of the application o{ the pre-emergent for an inspection by City. AII bee and palm material shall be staked for location at this time for approval prior to installation. After all plant material has been installed and prior to applying mulch the contractor shall call for an inspection. The final inspection shall be held with the conbactor after the guarantee period. Any existing inigation heads that fall within the new four (4) foot plantirg beds shall be relocated to locations selected by Gty at contractors cost. ' C D F 3 B. E. l I t I I 5. Scheduling 6. Planting Beds A A The Contractor shall start plant installation within thirty (30) working days after receiving the "Notice to Proceed" and sha.ll complete the work within ten (10) working days. Conhactor shall guarantee all plant material for a 90 day establishment period. At the end of the establishment period, inspection of plants will be made by the Cig and Conhactor. Any plant required under this contract that is dead, not true to name or size as specified or not in satisfactory groMh as determined by the City shall be removed from the site and replaced at no cost to City. AJI planting beds shall be excavated to a depth of 2 inches and to the width indicated on the plans, excess soil shall be hauled away. A weed mat shall be installed prior to the plant installation. 8. MiscellaneousLondscapeMaterlals A All trees and palms shall be staked in accordance with sound nursery practices. Mulch shall be Flora Mulch and shall be placed in all planting beds to a depth of 2 inches. Soil super-absorbent shall be used for all plant material and shall be "Terra- Sord or equal and shall be applied accodirg to manufacfurers schedules. D. A pre-emergent herbicide shall be applied to all planting beds. E. Water shall be supplied by the City. It is further mutually agreed between the parities hereto that if, at any time after execution of the Agreement and the Cash Bond in the amotmt of twenty{ive percent of the contract amovnt ($J!43|:UZIA hereto attached for its faithful performance and payment, the Owner shall deem the cash bond to be unsatisfactory or if, for any reason, such cash bond ceases to be adequate to cover the performance of the work, the Contractor shall, at its expense, within five days after the receipt of notice from City (owner) fumish to owner additional surety or sureties as shalt be satisfactory to the Owner. In such event, no further payrment to the contractor shall be deemed to be due under this Agreement until such new or additional security for the faithful performance of the work shall be fumished in a manner and form satisfactory to the Owner. No additional work or extras shall be performed unless the same shall be duly authorized by appropriate action of the Owner' That in the event either party brings suit for enforcement of disagreement, the prevailing party shall be entitled to attomey's fees and court costs in addition to any other remedy alforded bY law. 7 8 9 2 6. 10. The making and acceptance of the final payment shall constitute a waiver oi all claims by the owner other than those arising from unsettled liens, from faulty work, or from requirements of the specifications. It shall also constitute a waiver of all claims by the Contractor, except those previously made and still unsettled. L i 11.
