HomeMy WebLinkAboutR-1994-088RESOLUTTON NO 88-94 A RESOLUTION OF THE CIry OF DANIA, FLORIDA, WAIVING ALL FEES EXCEPT WATER AND SEWER IMPACT FEES IN CONNECTION WITH THE BROWARD COUNTY COMMUNITY DEVELOPMENT DIVISION'S HOUSING REHABILITATION PROGRAMS IN THE PROJECT "IMPAC" AREAS OF DANIA, PROVIDING FOR SEPARABILIry' PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Broward County Community Development Division is requesting assistance to implement its housing rehabilitation programs in the Project 'IMPAC' areas to address substandard housing conditions, and eliminate and prevent slum and blight within the City of Dania, Florida; and WHEREAS, the Broward County Community Development Division is requesting assistance with marketing efforts for the project and to expedite matters pertaining to variances, building permits, demolition permits, neighborhood standard reviews, etc., in an effort to avoid hardships to applicants; and WHEREAS, an Annual Plan of the Broward County Community Development Division was approved by the Board of County Commissioners, and included funding for housing rehabilitation programs; and WHEREAS, in order to help in the success of this project, a request to the city is being made to waive any and all fees related to variances, building permits, demolition permits, impact fees and other such fees to the extent allowable within relevant codes and ordinances in order to lower the cost of service delivery. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CIry OF DANIA, FLORIDA: Section 1. That the City Commission of the City of Dania, Florida, hereby agrees to provide assistance with marketing efforts for the project and to expedite matters pertaining to variances, building permits, demolition permits, neighborhood standard reviews, etc., in an effort to avoid hardships to applicants. Resolution No. BB-94 Section 2. That the City Commission of the City of Dania, Florida, hereby waives any and all fees related to variances, building permits, demolition permits, and other such fees except water and sewer impact fees in order to help minimize the cost to the Broward County Community Development Division relating to its housing rehabilitation programs in the Project "IMPAC" areas of Dania, Florida, as depicted in Exhibit "A" which is attached hereto and made a part hereof. Section 3. lf any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this ordinance. Section 4. That all resolutions or parts of resolutions in conflict herewith be and the same is hereby repealed to the extent of that conflict; Section 5. That this resolution shall be in force and take effect immediately upon its passage and adoption.
