SEQ. , OF THE BROITARD COUNTY ZoNING CoDE, AS
AMENDED THROUGH SUPPLEMEMT NO. 63, WHICH SI{ALIJ
APP].JY TO THE RAVENSWOOD-GRIFFEN ROAD ANNEXED
AREAS; PROVIDING FOR LEGISI,ATIVE TNTENT;
PROVIDTNG FOR CODIFICATION; PROVIDTNG FOR
SEVERABILITY, ORDINANCES IN CONFLICT, AND AN
EFFECTIVE DATE .
WHEREAS, the CiLy Commissj-on of E.he City of Dania adopt.edOrdinance No. 33-91- on September 11, 1991. which adopted the
Broward Count.y zoning reguLations through Supplement no. 53 and
made the regulations applicable to t.he Ravenswood-Griffen Road
annexed areasi and,
WHEREAS. the legislatj.ve int.ent of Ehe City Commission inadopting Ordinance No. 33-91 was to implement Section 3.30(f) ofthe City of Dania Zoning Code whi.ch provLdes that parcefs of landshal1 retain the zoning classifications and permitted uses which
were in effect at the time of an annexation; and,
WHEREAS, in the zoning case styled Wackenhut Corrections
Corporaxion v. City of Dania, Case No. 96-01371 (L2) (fl,a. 17thCir. Ct. L996) the circuj"t court judge, in granting summary finaljudgment in favor of the City of Dania, did not address. and lefts
open, the quest.ion whether Section 39-f67 of t.he Broward County
Zoning Code. entitled "County uses," applies in the annexed areas;
and,
WHEREAS, under the "County uses" provisj-on of the Broward
County Zoning Code, Broward County purportedl-y retaj-ns the power to
use any property in any county government. capacity, function or
purpose, regardless of, or in contravent.ion of, the existing zoningrest.rictions which apply Eo E.he property; and,
WHEREAS, the City Commissj-on has the Municipal Home Rufe power
under Article VIII, Sect.ion 2 of the F]orida Constitution and
ORDINANCE NO.77 -96
Section 6.05 of the Broward County Chart.er to specify permitted orprohibited uses or vari-ous other restricti,ons concerning the use ofland as may be in the best interest of the City of Dania,. and,
WHEREAS, the City Commissj.on desires to declare that it i,s thelegislative intent of the City Commission that Section 39-L67 oflhe Broward County Zoning Code does not apply in the annexed areasand to fist the zoning classifications and permitted uses whichwere in effecL at the ti,me of the annexation of the Ravenswood.-Griffen Road annexed area.
NOW, THEREFORE. BE IT ORDATNED BY THE CITY COMMISSION OF THE
CITY OF DA]N]A, FLORIDA:
Section 1. It was the legislat.ive intenL of the CityCommission of the City of Dania, in adopt.ing Ord.inance No. 33-91,to implement Section 3.30(f) of the City of Dania Zoning Code whichprovides that parcels of land shal1 retain the zoning
cl-assi f icati-ons and permitted uses which were in effect at the timeof an annexation. and the Cily Commission declares that. thepurposes of adopting this amendment to Ordinance No. 33-91 are (1)
to affirm that Ordinance No. 33-91 and this amendment continue the
sEatus of the 1awfu11y existing uses of land and sEructures at the
Lime of annexati.on as permitted uses and (2) to decfare that
Sect.ion 39-167 of the Broward County Zoning Code does not. appl-y to,or j-n. the annexed area.

The City ol Dania, Florida proposes to adopt the following ordinance. A public
hearing-on the ordinance will be held by the city commission 91 Tues_day, Octobel
22, 1996 at or after 7:30 p.m. in the City Commission room of Dania City Hall, 100
West Dania Beach Blvd., Dania, FL. The title of the proposed ordinance which
encompasses the proposed changes is:
