HomeMy WebLinkAboutR-2002-187RESOLUTTON NO. 2002-187 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING MODIFICATIONS TO THE APPROVED SITE PLAN SUBMITTED BY TREASURE COVE ASSOCIATES, LTD, FOR PROPERTY LOCATED AT SW 45TH STREET AND SW 27TH AVENUE; PROVIDING FOR CONFLICTS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 'l of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Gary Posner, owner of Treasure Cove Associates, Ltd., has applied for a modification to the site plan (SP-13-02) to allow a concrete slat wall with no footer for property located at SW 45th Street and SW 27ih Avenue, Dania Beach; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section '1 . That the proposed modifications to the site plan (SP-13-02) to allow a concrete slat wall with no footer for property located at SW 45th Street and SW 27h Avenue, by Treasure Cove Associates, Ltd., is approved, subject to the following conditions: (1) Straightening the wall at the northwest corner. (2) Remove the sod. (3) lnstall the drainage basins. (4) Plant Coco Plums (2 ft. in CenteQ on exterior of the wall. 1sP-'13-02 RESOLUTTON NO. 2002 -187 Section 2. fhat based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvais shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3 That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict Section 4. The site plan was approved with 42o/o pervious area and a wood shadowbox fence around the perimeter of the complex. The site plan as approved by the City Commission complied with all zoning code requirements and no variances were required. On June 11,2002, the City Commission approved a screen enclosure setback variance and a 1o/o pervious area variance. During the meeting, the applicant agreed to install a 6 foot high solid masonry wall with minimum 16" footer around most of the project (see aftached minutes). The applicant is limited to a wood fence along that portion of the west lot line over an easement. The applicant proceeded to install a concrete slat wall with no footer. When informed that the concrete wall was different than what was offered at the City Commission meeting, the applicant agreed to apply for a site plan modification. Applicant was also informed that continued construction of the wall was at his own risk. The consultant recommends modification of the catch basins, or the addition of new catch basins, along the west lot line of the development, next to new buildings 27 - 34 (see attached sketch). The consultant also identifies a problem with the location of the wall and an existing one story unit in the northwest corner of the development. Page I TREASURE COVE STAFF REPORT CC 10-8-02 doc TO: SITE PLAN MODIFICATION REQUEST: Gary Posner, Treasure Cove Associates, LTD. requests approval to modify a site plan to allow a concrete slat wall without footers (Property located at SW 45th Street and SW 27th Avenue) The engineering consultant (see attached letter) indicates that based on proposed building elevations, "runoff for the entire site is to be kept within the perimeter of the site with the possible exception of a small area on the western edge of the project adjacent to existing buildings." RECOMMENDATION The zoning code allows the construction of a fence or wall surrounding the perimeter of this project. Though not required, the developer offered to construct a solid concrete wall with minimum 16" footer. Some residents have indicated they believe the concrete wall and footer is necessary to prevent runoff onto their property. The engineeing consultant has identified alternative ways of addressing drainage. Quesflons regarding drainage should be directed to the Public Works/Utilities Director. While the concrete slat wall is permitted by the zoning code, the slat wall does not reflect developer's commitment at the June 11 City Commission meeting. Assuming drainage can be addressed with the installation of additional catch basins; fhe lssue becomes one solely of aesfhellcs, and is at the discretion of the City Commission. The consultant indicates the location of the wall in the northwest corner of the site presents an ingress/egress problem for an existing home. The original plan called for a wood shadowbox fence at this location. Staff recommends the developer consider replacing the damaged wall section with a shadowbox fence relocated just enough to provide easier access to the existing one story unit. Based solely on the information provided and thl conditions of the existing sitg we offer the following comments. The drainage report backs up the calcutations of onsite water retention for this project. The gowerning agencies have permitted the Treasure cove yaoht club project ,ia ,ipon reviewing the calculations the sirc should have ample water retention. In ihe review of the design plans, the grades for this project show that the runoff for the entirc site is to be kept within the perimeter of the site with the possible exception of a small area on the western edge of the projec adjacent to the existing buildings. The plans call for three catch basins in this area that should alleviate any conditions that these grades may cause. After a site visit, it is immediately apparent that there is a significant grade difference between the existing roadway and the constructed buildings 27-34 on the west side ofthe project. The remaining wall construction behind buildings 27-34 hx not been comploted and seems to be too high. If constructed propcrly, tlre two oatoh basins near the wali at an elevation of4.0' would retain on site storm water. In any drainago systenr, the water will seek the path of least resistance. This coupled with the f&ct that the wall will have op-enings for ingress and egress eludes to the fact that the wall will serve no purpose in coiitaining the uater. A suggestion to help alleviate concems offlooding from buildings 27-34 and the existing roadway would be to either move tJre two basins near the wall west to rhe edge of the roadway or add in new catch basins at the edge. ' City Manager Pato advised that Mr. Kodner had someone attend the last meeting to request acontinuance to this meeting and that staff is recommending to move forward with'entorcing tneCode violations against his property. Discussion followed on how Mr. Kodner ls unwilling to work with the City Commission to resolvethe matter. A motion was made by Vice-Mayor Flury, seconded by. commissioner Mikes, continuing theResolution (SA-102-99) indefinitely and referring the Co-de violations to tne Cooe EnforcementBoard. COMMISSIONCOMMENTS: 10.1 commissioner Bertino reminded the public that school is out and to drive carefully. 10.2 commissioner McElyea commended the owners at 195 sE 2nd Avenue for improving theproperty with the planting of trees. Commissioner McElyea mentioned that the water has risen about a foot at the MeadowbrookLakes and that the lakes should be pumped down lower. ln addition, tne citcn'uasins atongDania Beach Boulevard should be vacuumed out.
