A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, VACATING
PORTIONS OF UNIMPROVED SE 14TH AND 15IH STREETS AND
MISCELLANEOUS EASEMENTS LOCATED EAST OF SE 2ND AVENUE,
NORTH OF SHERIDAN STREET, IN THE CIry OF DANIA BEACH AND
LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED
TO THIS RESOLUTION; PROVIDING THAT ALL RESOLUTIONS OR
PARTS OF RESOLUTIONS IN CONFLICTWITH THIS RESOLUTION ARE
REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 3, Article 3, Part lX, as amended, of the Charter of the City of
Dania Beach, sets forth the procedure for vacating and abandoning streets, alleys, and
utility easements or other property dedicated to the public use; and
WHEREAS, John Bartley, representing B & B Builders, lnc., duly petitioned the City
commission of the city of Dania Beach, Florida, for the vacation of certain streets and
Miscellaneous Utility Easements legally described in Exhibit "A", a copy of which is
attached to this resolution.
WHEREAS, the City Commission referred petition (No. VC-07-02) to the City
Planning and Zoning Advisory Board for its recommendation; and
WHEREAS, at the meeting of the Planning and Zoning Advisory Board held on
August 21, 2002, the Planning and Zoning Advisory Board unanimously voted to
recommend that the streets and miscellaneous utility easements be vacated and
abandoned;
WHEREAS, after publication of notice as required by Section 3, Article 3, Part lX of
the charter of the city of Dania Beach, a public hearing was held before the city
Commission at its regular meeting held on November 26,2002'
NOW, THEREFORE, BE IT RESOLVED BY THE GITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
RESOLUTION NO, 2OO2 - 206
Section 1. That the City Commission of the City of Dania Beach, Florida, vacates,
abandons, renounces and disclaims all of the right, title and interest of the City of Dania
Beach in and to the following streets and miscellaneous utility easements.
Section 2. That the C ity Commission finds and determines that the procedure for
the vacation and abandonment of the subject streets and utility easements have been in
strict conformity with the requirements of Section 3, Article 3, Part lX of the Charter of the
City of Dania Beach.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Land use designation. The zoning designations and existing land use for the

This property is located within Flexibility zone 94. Flex Zone g4 includes thatportion of the city east of the FEC railroad tracks and south of the Dania cut-offcanal' There are an estimated 171 reserve units remaining in Flex Zone g4.
The applicant is requesting 19 reserue units in conjunction with his rezoning
request to PUD-B, leaving a balance of 152 reserve units within Flex Zone g4.
The city of Dania Beach cannot replenish the reserve unit pool once exhausted.Staff supports the use of reserve units for small-scale projects (25 or less units)
consistent with the comprehensive plan or the objectives of the city commission.
MINIMUM tOT SIZE VARIANCE
Staff has no objection to this variance.
SITE PLAN WITH PUD-B ZONING REQUIREMENTS
The site plan indicates the following:
1) 30o/o building coverage provided (Maximum 35olo allowed).
2) 42o/o pervious area provided (Minimum 40olo required).
3) 47 exterior parking spaces provided (44 exterior parking spaces
required).
4) 19 dwelling units provided (PUD-B allows up to 23 units).
5) Lot Size: Minimum 3,600 - 3,800 square feet provided.
6) Front yard setback; Minimum 20 feet provided.
7) Rear yard setback: Minimum 14,feet provided.
8) Side yard setback: Minimum five feet provided (Minimum 10 feet
distance between units).
PUD-B requires no minimum lot size or setback requirements. The lot size and
setbacks are consistent with those provided in "Maple Ridge" (city of Hollywood),
specifically that portion of Maple Ridge located at the southeast corner oi Grlffin
Road and SW 4Ou1 Avenue.

Pursuant to your request, I have reviewed the documentation B&B Builders has
forwarCed to rne ccncerning the vacation cf rights-of-'"vay and the corresponding sketch
prepared by Gibbs Land Surveyors dated April 29,2002 under Drawing No. RN4586, a copy
of which is attached hereto for your review. The sketches include: (1) SE 15h Street East of
SE 2"d Avenue; (2) SE 14'r' Street East of SE 2d Avenue; and (3) Easement for water and
electricity located between SE 14h Street and SE 15n Street. Based on the information
provided to me, I have verified that the proper titleholders have joined in and executed the
vacation applications. It is my understanding, pursuant to discussions with Tom Ansbro, that
the vacation may now be considered effective. The only documentation which still needs to be
reviewed is a letter from Dubow & Dubow concerning responsibility relating to any and claims
concerning the water and lighting easement between SE 14u Street and SE 15s Street,
otherwise, all outstanding matters have been complied with. Please note, however, my review
did not include whether each property has acceptable access or anything beyond fee simple title
interest. I have signed each sketch confirming that these streets and easements are in fact the
properties vacated by the above referenced instruments.
