I have consulted with Glenn Morris and rhadeus Hamilton of the Department of Agriculture regarding the proposal. The City would be responsible for approximately $20,000.00 as a match. Some in-kind costs are eligible to offset actual cash matching. The grant is due May 1st. Therefore, please place this as an item on the April lgth workshop so, if desired, it can be approved at the April 26th meeting. Gwen Wilcox has been a postal clerk for nineyears at the southside post office in Fort Lauderdale, and can easi- ty spread herself too thir betneen her two jobs and home. So herhusband is sensitive to her timitations."I know if she puts too much time in. that puts a straitr on the relationship," he said.Before they started Ad pro, Gerald Wilcox considered biing- ing in an outside partner, but hiswife quickly discouraged it."I said, 'Hey, this is our idea,' ,' Gwen Wilcox said. Organize and coordinate a citywide parade that includes floats, high school marching bands, community organizations, a grand marshall, veterans groups, tomato queen, etc. b. Parade would be on U.S. I and would end up at the Tomato Festival grounds. c. Parade panicipanu would be judged for best float, best costume, best band, etc. Awards will be presented at Tomato Festival. 2. Tomato Festival - Late Saturday Moming and Aftemoon, Nov. 5 a. A city and countywide event that harks back to the days when Dania was the tomato capital of the world. Could be held in multiple locations - Grounds behind Dania Jai Alai, railroad tracks, antique row - !o encourage people to walk or take trolleys throughout the city. Strive to create the atrnosphere of an old-time festival.. Research past tomato festivals. Work with the Anniversary Committee to develop and implement the elements of the festival, including a beauty contest, cooking contest that use tomatoes, desert sampling contest, gzrmes and contests, oral history/story telling corners for children, arts & crafts and antique booths, bands, elected officials speeches, and parade awards.. Have congressmen ask President Clinton to write a letter commending the city on its 90th year, read and display letter at the festival.. A wall or fence was not required in those days to separate the commercial area from the residential area. Mr. Glassman has been cited for loose debris causing a public nuisance behind the shopping center. His March 30, 1994 letter offers to place dumpster enclosures around the two troublesome dumpsters. The Code Board gave him 30 days to accomplish this. Mr. Glassman has offered to place a fence with roll gates along the entire length of the shopping enter if the city would participate in the cost. REGULAR MEETING MARCH 8, 19!1415 CITY OF DANIA INTER.OFFICE MEMORAN DU NT To:Will Allen, Growth Management Director From: Dan Oyler, City Date:March 17, t994 Re KathnTn Fritz Request to Vacate a Portion of SW 27th Ave. The City Commission has requested further information on this item prior to a workshop to be scheduled later this month (Ci$ Manager requested it be done at workshop not on the next commission meeting). 1 Property was bought by Broward County in 7982 by condemnation and $15,900 (plus or minus) was paid to the previous owner. 2. Road was constructed between L984 and 7987. Expanded intersection was built for the extension of Tram road which at that time was a trafficways. After completion of Griffin Road the Alanco project was proposed and 30th Ave. was constructed, their then was no need for the constructi on of 27th. Mrs. Fritz states that one foot of the property the County bought is under her home. We have no proof of this since a survey has not been submitted at this time. J 4 5 I have done research on their request. The following has be ascertained. 6 7 Plans for this area of Griffin road received from Broward County indicate an extensive drainage system is contained in this area. Mrs. Fritz has requested the vacation of the one foot under her home plus six feet for a total of seven leet. The plans indicate that the first six feet from her home to the street is a construction easement, not road right of way. The other one foot is road right of way where the curb and gutter now exists. 8. The area requested for vacation is where a future sidewalk would be placed. Mrs. Fritz bought the property with full knowledge of the fact that the road right of way was there. 10. If this area were to be vacated by the City the owner must then secure the vacation by Broward County since the tal,jng was done by the County and the right of way is in their name. A process that can take up to six months to complete. In the mean time the city can not issue building permits until notilication is received from the county as to their approval of the vacation. 11.If the area is vacated the city would not have the ability to construct a sidewalk on this side of the street without undue cost in pavement remo',ral and drainage relocation. Since the property to the north and south of this site are not a subject of this request the sidewalk construction would not be feasible. L2. There is a slight possibility the county may request a reimbursement for the money spent to buy the road right of way from the present property owner. (More on this after meeting with county next Tuesday) 13. There must be another way to exit the home with a handicap ramp on the north side of the house where the care are now being parked. 9 CITY OF DANIA INTEROFFICE MEMORANDUM GROWTH MANAGEMENT DEPARTMENT TO:Robert Flatley City Manager FROM: \Mll Allen Growth Management Director RE:Request for Permission to Vacate Rlght-of-Way Adjoining 4750 SW 27 Ave., Lawrence and Kathryn Fritz Date:March 3, '1994 The attached letter from Mrs. Kathryn Frilz, 4750 sw 27 Avenue, concerns problems with the right-of-way ad,jacent to her house. This property is located on the east side of SW 27 Avenue approximately 160 feet north of Griffin Road. The letter requests that the right-of-way for SW 27 Avenue be returned to them so that they can use the area for a porch and ramp into their house. The request involves vacating right -of-way so that it can be used by the Fritzs'. The procedure for vacating street right-of-way is found in Section 3 of part lX, Article 3 of the City Charter. The first step in the vacation pro@ss is to request that the City Commission authorize an application and waive the platting requirement. ln my opinion the City Commission should not authorize the application for vacation. lt is not practical to vacate this area. The street pavement extends to the curb which is only 6.5'to the house. Ultimately, a sidewalk should be built in this area. There is an extensive drainage system for Griffin Road in this right of way as well as other utilities. There is a catch basin just south of the house. This right-of-way is necessary to maintain the utilities. Mr. and Mrs. Fritz have been cited for constructing a porch over the right-of-way. No building permit was issued or could be issued for this structure as it is not on their property. I have been to this site several times. ln my opinion, it is not practical to vacate the right-of-way but the Fritzs' have the right to ask. lf the request to vacate is allowed to continue, the Fritzs'will need to supply a survey and a legal description of the area to be vacated. They will also have to show that there is no public purpose for the right-of- way, which would include letters from Broward County, Jones lntercable, Southern Bell, as well as the City of Dania. MARCH 8, 1994REGULAR MEETING 15 CITY OF DANIA INTER-OFFICE MEMORANDU M To:Wilt Allen, GroMh Management Director From: Dan Oyler, City Date:March 17, 1994 Re KathnTn Fritz Request to Vacate a Portion of SW 27th Ave. The City Commission has requested further information on this item prior to a workshop to be scheduled later this month (City Manager requested it be done at workshop not on the next commission meeting). I have done research on their request. The following has be ascertained. 1 Property was bought by Broward County in 7982 by condemnation and $15,900 (plus or minus) was paid to the previous owner. J 2. Road was constructed between L984 aod 1987. Expanded intersection was built for the extension of Tram road which at that time was a trafficways. After completion of Griffin Road the Alanco project was proposed and 30th Ave. was constructed, their then was no need for the construction of 27th. Mrs. Fritz states that one foot of the property the County bought is under her home. We have no proof of this since a survey has not been submitted at this time. 4 5 6 7 Plans for this area of Grilfin road received from Broward County indicate an extensive drainage system is contained in this area. Mrs. Fritz has requested the vacation of the one foot under her home plus six feet for a total of seven ieet. The plans indicate that the first six feet from her home to the street is a construction €asement, not road right of way. The other one foot is road right of way where the curb and gutter now exists. 8. The area requested for vacation is where a future sidewalk would be placed. Mrs. Fritz bought the property with full knowledge of the fact that the road right of way was there. 10 If this area were lo be vacated by the City the owner must then secure the vacation by Broward County since the taking was done by the County and the right of way is in their name. A process that can take up to six months to complete. In the mean time the city can not issue building permits until notification is received from the county as to their approval of the vacation. 11. If the area is vacated the city would not have the ability to construct a sidewalk on this side of the street without undue cost in pavement removal and drainage relocation. Since the property to the north and south of this site are not a subject of this request the sidewalk construction would not be feasible. L2. There is a slight possibility the county may request a reimbursement for the money spent to buy the road right of way from the present property owner. (More on this after meeting with county next Tuesday) 13. This property is located on the east side of SW 27 Avenue approximately '160 feet north of Griffin Road. The letter requests that the right-of-way for SW 27 Avenue be returned to them so that they can use the area for a porch and ramp into their house. The request involves vacating right -of-way so that it can be used by the Fritzs'. The procedure for vacating street right-of-way is found in Section 3 of part lX, Article 3 of the City Charter. The first step in the vacation process is to request that the City Commission authorize an application and waive the platting requirement. ln my opinion the City Commission should not authorize the application for vacation. lt is not practical to vacate this area. The street pavement extends to the curb which is only 6.5'to the house. Ultimately, a sidewalk should be built in this area. There is an extensive drainage system for Griffin Road in this right of way as well as other utilities. There is a catch basin just south of the house. This right-of-way is necessary to maintain the utilities. Mr. and Mrs. Fritz have been cited for constructing a porch over the right-of-way. No building permit was issued or could be issued for this structure as it is not on their property. I have been to this site several times. ln my opinion, it is not practical to vacate the right-of-way but the Fritzs' have the right to ask. lf the request to vacate is allowed to continue, the Fritzs'will need to supply a survey and a legal description of the area to be vacated. They will also have to show that there is no public purpose for the right-of- way, which would include letters from Broward County, Jones lntercable, Southern Bell, as well as the City of Dania. Capital items in the amount of $437,175 were budgeted. Line item changes have increased the budget for capital items to $450,000 and the remaining $150,000 was to be used to retire current debt. This amount must now be reallocated for capital items. These bond proceeds were part ofthe refunding portion ofthe Series 1994 Sales Tax Revenue Bonds issued 2/24/94. This program utilizes revenues received from the Local Option Gas Tax. The attached map and list show the location of streets whioh have been recommended for resurfacing in the February 10, 1994 letter from Don Windham. The total quantity of paving proposed is approximately 1,900 tons of asphalt which would be in the neighborhood of $55,000 based on last years prices. Since the contract for services and materials is expected to exceed $15,000 the work must either be awarded through a bid process or "piggybacked" on the bid of another governmental entity. The attached section of City Code indicates the City Commission may, by resolution, authorize such purchases in excess of $15,000 without competitive bids if such purchases are made pursuant to a competitive bid obtained in the last twelve months by other governmental entities. Last year, the work on the beach parking lot was based on the bid awarded in Ft. Lauderdale on January 5, 1993. This contract to Pan American Construction Company was renewed by Ft. Lauderdale but wasn't competitively bid so it can't be piggybacked by Dania. I checked with a number of municipalities and have not found a situation in which we can piggyback a bid. Coral Springs and Plantation awarded bids for street resurfacing but the contractors are not willing to honor the same prices in Dania because the quantities are substantially less in Dania. GROWTH MANAGEMENT DEPARTMENT Page 2 The City of Dania would, of course, prepare specifications and advertise for bids for street resurfacing. Based on the smaller quantities it would be expected to get a higher per unit price than other communities. lt may be wise to carry over funds until next year to obtain a better unit price. A list of potential projects for next year is shown on the exhibit. At the workshop the City Commission can give direction on how this should be addressed. lt is recommended to carry over the projects until next year to obtain a better price. lt is recommended that drainage maintenance as explained in another memo be implemented this year. The April 15, 1994 memo from Finance Director Marie Jabalee indicates approximately $195,000 is received annually. There is $83,OOO available now and $53,000 is due prior to the end of the year for $136,000. one of the potential projects for next year is the repair of the bridge on NW 1 Street over the C-10 canal. This project should be high priority. The bridge has been reduced to a two ton load limit due to deterioration. Property. Charles Herdman, Owner. Mr. Charles Herdman, ovrner of the property known as Creative Crafu, located to the east of Boisy Waiters property on the south side of Stirling road has requested a pre- annexation agreement prior to the annexation of his property into the City of Dania. The agreement provides for the same items as several of the past agreements that the City has entered into in the Marina Mile area. Some of the items are as follows: Property to retain the existing M-2 zoning for a period of 20 years and the zoning may not be changed without the consent of the owner. Property is grand fathered for the square footage of the existing buildings on the property for traffic concrnrence. Owner &s not have to apply for a Occupational License for the balance of this year. Recognizes the fact that the entrance drive to Boisy Waiters is on his property and is a very dangerous driveway and that the City will construct an altemate driveway through right-of-way that exists to the rear of his property before December 31, 1994 and close the existing one. HERDMAN, his successor andlor assigns, (hereinafter refened, to as the "Owner"). RECITALS' WHEREAS, Owner holds fee simple title to the propefty as described in Exhibit A (hereinafter relenedto as "Property"h and WHEREAS, the City desires to annex the property into the City and to that end will initiate the process required by law to enact an ordinance adopting a Petition for Voluntary Annexation of the Properp into the City filed by Owner, pursuant to Section 77L.04412\, Fla. Annexation. Together with the execution of this Agreement, Owner has voluntarily petitioned the City to annex the property into the City pursuant to the Petition, by completion and submission of the form attached hereto as Exhibit "B". The City has initiated the process to and shall promptly accomplish and complete annexation of the Property into the City in the manner provided by Section 177.044(2), Fla. Stat., and all other applicable state and local laws and regulations. 4.1 Land Use,and Land Development Requlations The City acknowledges and accepts that the Property is currently depicted on the Broward County Land Use Map as Commercial and that the Property is zoned M-2 Industrial. Upon annexation of the Property into the City, the City will cause the Property to bear a City land use designation of commercial with M-2 zoning and may upon agreement of both parties, change the zoning designation to a City zoning designation, which the City represent will be an identical zoning designation to the existing Broward County M-2 Industrial District zoning, including all permitted and special exceptions uses, and that said zoning will continue unchanged for a period of 20 years following the annexation, unless sooner changed to an altemate zoning designation upon the petition of the owner. The City further represents that the said County or City zoning designations and the uses permitted thereunder will be incorporated into the City's Comprehensive Land Use Plan and use regulations. 4.2 The use, development and regulation ol the Property and businesses operation on the Property now or in the fufure shall be govemed by the Broward County Code sections or the City of Dania code sections, whichever are less restrictive. The City of Dania shall not adopt any land use or development ordinance or regulation pertaining to any of the property described in Section 2 of this act until twenty years from the date of annexation without the prior written consent of the Owner of the Property. All businesses operating now or in the future on the Property annexed into the City of Dania by this ordinance shall be allowed to develop on the Property annexed herein, and do business pursuant to the existing provisions of the Broward County Code of Ordinances as amended, or the City of Dania Code of Ordinances as amended whichever are less restrictive and have those provisions enforced in an equal and reasonable manner, including, but not limited to, provisions relating to hours of operation, signs, parking, landscaping, open space, code enforcement, nois€, building setbacks and heights, concurTence requirements and other regulations affecting the conduct of business on, or use of the Property hereby annexed. Approved plats, site plans, land development licenses, permits and other development orders and development permits as defined in section 163.3L64, Florida statutes (1987) which have been granted or approved for the Property annexed into the City of Dania by this act prior to the annexation date, shall not be modified by the city of Dania. such approved plats, site plans, land development licenses, permits, development orders or development permits shall not be required to obtain any further review or approval by the City of Dania. Such land use designations and their authorized uses are acceptable to the City. 4.3 The following specific agreements have been reached between the City and the Owner and are inducements by the City to Owner for Owner's annexation into the City of Dania: b. The City currently has established its own set of concurrence regulations which do not apply to the Property as of this date. Since the Property is not platted the City agrees that the Property has vested rights for development up to the amount of square feet of building area that exists on the site at the time of annexation. This in no way limits Owner's ability to seek approval for additional square footage. The City acknowledges that it has sufficient capacity and has reserved such capacity for the providing of all public services to the Property. c. The City acknowledges that the current height restriction for development of the Property under the Broward County Code is 100 feet. The City has no objection to such a height restriction being applied to the Property and shall grant such approvalslimits as may be needed to accomplish the extent of this provision. d. The City agrees to apply its existing open space requirements for commercial and industrial development to development of the Property for a period of twenty (20) years. e. The City recognizes that the owner has paid all applicable Occupational License Fees to Broward county through october, 1994. No additional Occupational License Fees shall be collected by the City until that date. f. The City recognizes that the existing drive to the Boisy Waiters Center is on owner's property. owner hereby grants permission to the city to continue using said driveway until such time as a second access way is built. Said access way shall be built no later than December 31, 1994 at no exp€nse to Owner by the City. If said driveway is not complete by December 3L, L994 Owner shall be compensated for the use of the existing driveway at the rate of one-hundred (100) dollars a month until such time as the new driveway is completed by City or upon receipt of a one-year written notice by Owner to City to cease and desist use of the existiqg driveway. 5. Due Diligence. The City covenants that it shall immediately commence all actions and execute any documents as are necessary and appropriate to fulfill the City's obligations under this Agreement and shall diligently pursue the same throughout the existence of this Agreement. 6 Miscellaneous. A. Entire Aqreement. This Agreement sets forth all the promises, covenants, agreements, conditions and understandings between the Owner and the City, and supersedes all prior and contemporaneous agreements, understandings, inducements or conditions, express or implied, oral or written, except as herein contained' B. Severabilitu. The invalidity of any provisions hereof shall in no way affect or invalidate the remainder of this Agreement. C. Countemarts. This Agreement may be executed in one or more counterparts, each of which shall be deemed an original but all of which together shall constitute one and the same instrument. D. Headinqs. The section headings contained in this Agreement are inserted for convenience onty and shall not affect in any way the meaning or interpretation of the Agreement. E. Goveminq Law. This Agreement shall be construed in accordance with the Iaws of the State of Florida, and any proceedings arising in any matter pertaining to this Agreement shatl, to the extent permitted by [aw, be held in Broward County, Florida. F. Bindinq Effect. The obtigation is imposed pursuant to this Agreement upon the Property shall run with and bind the Property as covenants running with the tand and this Agreement shatl be binding upon and enforceable by owner and the city, and their personal representatives, heirs, successors, grantees and assignees, in accordance with the terms hereof. lN WITNESS WHEREOF, Owner and the City have executed this Agreement as of the day and year first above written.
