Re: Lease Agreement between City of Dania and PNC Leasing Corp., Kentucky
Dear Mayor Mikes and Commissioners
Please be informed as follows
1. The City of Dania, Florida is a municipality created and existing under and by
virtue of the laws of the State of Florida.
3. The City Commission has the authority to enter into the Lease and Purchase
Agreement and to bind the city to the terms and conditions of the Lease and
Purchase Agreement beyond the terms of the current city commission members
should a change occur during the term of the lease.
4. The Lease and Purchase Agreement must be signed by the city manager, mayor
and city clerk and approved as to form and correctness by the city attorney.
5. This opinion does not cover any provisions of the lnternal Revenue Code.

suBJECT: Agreement with Broward counly communily Development- Proiect IMPAC
Attached is a new agreement between the City of Dania and Broward County regarding a housing
replacement and repiir program for low and moderate income families known as Prolect IMPAC.
The City has participated in this program with the Broward County Community Development Division
since 1'9BS with excellent results. 25 dilapidated homes have been replaced and two rehabilitated.
Cunently permits have been applied for on two replacement homes , upon approval of this agreement
the permits will be issued.
This program provides no or low cost loans (0-3%) to eligible families including otherfavorable loan

A public hearing is scheduled for the June"l4, 1994 City Commission meeting
concerning the request for variances by Edward Thompson, 737 SW 2 Street. The
request is for variances for the rear and side yard setbacks for an accessory building.
Section 5.44(a)(1) of the zoning code requires both the rear and side yard setbacks to
be 10'. The proposed shed has a rear yard setback of 8' and a side yard setback of 'l'.
The Planning and Zoning Board reviewed this request at their May 25, 1994 meeting.
The recommendation is to approve the variances as requested. lt was found that there
is an alley to the rear and then a lake. As there is no abutting lot the rear yard setback
doesn't affect anyone. The side yard setback was also recommended. lt was noted
that the abutting property owner did not object to the variance.

Public hearings are scheduled for the June 14, 1 gg4 city commission meetingconcerning the requests for variances by the Dania Economic Developmentcorporation. Three separate agenda items are needed to consider the requests.
The Dania Economic Development corporation has obtained four lots which are fortyfeet wide each and are consolidating the property into three lots. This was previously
discussed with the city commission and liens for lot mowing and demolition werewaived.
The Planning and Zoning Board reviewed these requests at their May 25, 1994meeting. The recommendation is to approve the variances as requested. The specialconditions or unique circumstances which exist in this case is that property is beingconsolidated so lot sizes are actually being increased. single family dwellings arebeing constructed on these three sites. The property is zoned RD-6ooo which allowsduplexes.
vA-15-94 - This request concerns the southernmost property which is approximately140' north of NW 2 street. This site would need a variance for lot area but not lotfrontage. The site would be 5,379 sq. ft and 6,000 sq. ft is required in the RD-6000
district.
vA-16-94 - A variance from both lot frontage and lot area is requested for this sitelocated approximately 200' north of NW 2 street. This site is composed of parts of Lot
5 and Lot 6 of A.R. Wixon Subdivision. The frontage proposed is 51.52' and the area
would be 5,191 sq. ft. The requirement is 60'of frontage and 6,000 sq. ft. of area.
VA-17-94 - This request concerns the northernmost of the three sites which begins
approximately 251' north of NW 2 Street. This site is part of Lot 6 and all of Lot 7 of
A.R. Wixon Subdivision. The site is proposed to have 51 .52'ot frontage and 5,838 sq.
ft. of area. The minimum requirements of the RD-6000 district is 60' of frontage and
6,000 sq. ft of area.
The recommendation is to approve the variances as there are special conditions in this
case. The lot sizes are being increase over the existing lot sizes which are only 40'
wide. The proposed density is less than alternatives as these sites are proposed for
single family dwellings and duplexes are permitted in this district.

The attached lefter from Emily Rushin, President of the Graves Museum of Archaeology
and Natural History indicates the landscaping and parking lot work at the museum will
not be completed on time.
As a housekeeping item, it is suggested to have the City Commission extend the time
period. Minutes of the May 25, 1993 City Commission meeting are attached. Eight
months were given to complete landscaping and parking lot improvements.
According to the May 27,1994 letter it is estimated that work will be completed by
August 27, 1994. This would amount to a two month extension.

Although work began May '10 and Hardrives estimated the
paving would take only a week to complete, it is now May 27
and it is far from finished. The next step is installation of

An application for vacating easements has been submitted concerning the property at
the southwest corner of Griffin Road and SW 31 Street. The first step in the vacation
process, according to Section 3 of Part lX of the City Charter is for the City Commission
to grant permission to apply for the vacation.
Three types of vacations are requested as relate to blocks 1 and 2 of Donna
Subdivision. This property is the 175' deep area abutting the south side of Griffin Road.
The request ls being made to obtain clear title to the site.
One request is to vacate an anchor easement which is five feet in width in four locations
perpendicular to Griffin Road. These easements are for guidewires to anchor utility
poles.
The second request is to vacate a 6' wide conductor overhang easement which
parallels the south property line.
Lastly, the request is to vacate the setback lines which are 60'front building setback
line and a 25' rcat building setback line.
Please schedule the request to obtain permission to apply for vacation of these
easements at the June 14, 1994 City Commission meeting. Backup information such
as letters from utility companies will be submitted during the process which requires a
public hearing.

Prior to the enactment of Chapter 166, Florida Statutes in 1973, which is known as the
"Municipal Home Rule Powers Act", cities were required to obtain authorization from the
state legislature by special acts to amend any provisions of the city charter. Since the
enactment of the Municipal Home Rule Powers Act all provisions contained in the city
charter (with a few exceptions) became ordinances of the municipality on the effective
date of said act subject to modification or repeal the same as other ordinances.
The exceptions as mentioned hereinabove include the following:
Any changes in the charter which affect the exercise of extraterritorial
powers.
Any changes which affect the creation or existence of a municipality.
The terms of elected officers and the manner of their election.
The distribution of powers among elected officers.
Matters prescribed by the charter relating to appointive boards
Any change in the form of government.
Rights of municipal employees

FLORIDA:
section 1. That a charter Review Board for the city of Dania, Frorida, is
hereby established with the membership thereof to consist of five (5) residents of
the city, each of whom shall be appointed by the city commission and shall serve
at the pleasure of the city commission. one of said appointees shall be
appointed chairman by the city commission.
section 2. Following the appointmenE as set forth hereinabove the
chairman shall schedule meetings of the board for the purpose of reviewing the
various provisions of the city charter and to make recommendation to the city
commission for any suggested changes.
Section 3. That upon completion of the charter review by the board and
the submission of its recommendations to the city commission, the provisions of
this resolution shall expire and stand repealed.
Section 4. That all resolutions or parts of resolutions in conflict herewith
be and the same are hereby repealed to the extent ofsuch conflict.
Section 5. That this resolution shall be in force and take effect
immediately upon its passage and adoption.

SUBJECT: Updale on 94/95 CDBG Program
The Broward County Committee for Community Development (CCD) held its' meeting on Wednesday,
JuneSandofthethieeproiectssubmitted bytheCity,onlytheChesterByrdParklmprovements($75,
000)was recommended for funding. A second project, the Ely Blvd/Phippen Rd. Sidewalk and
Landscaping lmprovements was recommended by the sub-committee but was not recommended by
the CCD due to lack ol {unds. Should funds become available through either new lunding or
reprogramming of other CDBG lunds previously allocated to other organizations the project is in good
positi6n to reciive funding. Unfortunately the Modello Park Pool project was turned down completely
based on the recommendation of the planning sub-committee that the project was a low priority
amenity secondary to other needs throughout the County. Two other pool projects submitted by other
agencies were similarly rejected.
The city can request that the county commission approve the application of the $75,000
recommended for Byrd Park to the pool project. This would only be beneficial if the City is planning to
fund the balance of the cost o1 replacing the pool. The negative side ol this is that even though the
CDBG funds would be a small portion of the proiect we would still be required to adhere to all
applicable federal and county regulations and requirements. The County Commission meets July 18
to make final decisions on the CDBG program.
