?his Addendun to Service Agreenent, made and entered into in
Broward County, Florida this day of June, 1994 by and betweenthe city of Dlnia, a municipa-I corporation organized and existingunder the laws of the State of Florida, which is a nunicipalitylocated nithin the boundaries of Brohrard county, Florida,(hereinafter referred to as crTY) and RoN cocHRAN, as sheriff of
Broward County, Florida (hereinafter refeEed to as SHERIFF) to beeffective october 1, 1994.

WHEREAS, the CITY heretofore contracted with the SHERfFF toprovide municipal police services I
WHEREAS, the CITY is desirous of renewing the police servicescontract for a tlro (2) year period.
THEREFoRE, in consideration of the suns hereinafter set forthand for other good and valuable consideration, the receipt and1egaI sufficiency of which are hereby acknowledged, it is hereby
agreed as f olIo$rs:
1. The tern of this Agreenent is hereby extended toseptenber 30, L996.
2. Sections t.L2, 1.2.L, 1.2.2, L.2.3, 1.2.4, and 1.2.5 arehereby deleted from this Aqreenent.
3. Section 1.2 is hereby added to this Agreenent as follows:

5. 1.6 is hereby added to this Agreenent to read as follows:
Utilizing the staffing structure, as provided in
Anended Section 1.2 above, the District Commanderwill provide the CITY with a total of tuenty (20)
sworn personnel during a tlrenty-four hour periodsubject to a three and one half percent (3.58)
vacancy rate.
Sections 2.4 and 2.13 are hereby deleted fron this
Agreement.
Notwithstanding anything to the contrary contained in theAgreenent and with respect to Article VfIf of theAgreenent, the compensation payable by the CITY to the
SHERIFF shall be three rnillion five hundred fifty twothousand eiqht hundred seventy three dollars($3,552,873.00) for the twelve (12) nonth period of tinefrom Octobet L, L994 through September 30, 1995.
Notwithstanding anything to the contrary contained in theAgreenent and with respect to Article VIfI of theAqreenent, the compensation payable by the CITY for theperiod of October 1, 1994 through Septernber 30, 1995shalI be payable in rnonthly installments of two hundredninety six thousand seventy tlro and 75/]-OO dollars(1296,072.75) on the fifteent! (15th) day of each nonth.
Section 8.3 shall be applicable to the period of OctoberL, 1994 through Septenber 30, 1996.
10.Notwithstanding anythingt to the contrary contained in theAgreernent and lrith respect to Article VIII, the CfTYagrees to pay the SHERIFF a sun not to exceed a fivepercent (5*) increase from the consideration for fiscalyear 1994/]-995 for the period of October 1, 1995 through
September 30, 1995. Said increase shall only be approvedafter the SHERIFF has provided detailed financial backupjustifying the increase to the cfTY.
11.The folIolring provision shall be added to this AgreeEentas Section 8,6:
The parties acknowledge that the considerationprovided in Article VfII uith respect to fiscalyears 1994/1995 and L995/96 include a 3.5 percent
vacancy rate. The CITY shall be entitled to anannual credit if the annual vacancy rate exceeds3.5 percent. A vacancy occurs when a deputy or
employee is absent from work and such absenceresults in a salary (regular salaries, special pay,FICA taxes (regular and special pay only),

2 BSo agrees that any currency seized lrithin theCITY, through active participation of DaniaDistrict's personnel, pursuant to thisagreenent and chapter 932 of the Flori.daStatutes, and subsequently forfeited to Bso,sha1l be deposited into the La!, EnforcementTrust Fund established by the Broward County
Cornrnission in an arnount which represents theDania District's share, as defined inparagraph 9.5, of such currency. Suchcurrency shalI be earmarked for BSO's usewithin the confines of the city.
Upon concurrence of the District Cornmander,the CITY nay apply to BSo for the use of suchfunds if such application is in compJ.iancewith Florida Statutes. BSO agrees to subnitsuch application to the Bror,rard countyCornrnission for appropriation. Uponappropriation, such funds sha1l. be Dadeavailable to BSo for its designated use withinthe confines of the city.
.3 The parties agree that the decision to disposeof or use personal property seized within the
CTTY through active participation of DaniaDistrict personnel shall be in the solediscretion of BsO. In the event BSO decidesto use such personal property outside of theCITY, Bso shall allocate funds to the La!,Enforcement Trust Fund equivalent to the DaniaDistrict's share, as defined in paragraph 9.5,of the nutually agreed upon fair narket valueof such personal property less any lien onsuch property and the cost incurred by Bso inproceeding with such forfeiture actionincluding, but not limited to court costs,attorney fees, publicatj.on costs, storagecharges, security, and naintenance costs.
Such allocated funds shall be earmarked for
BSO,s use within the confines of the City.
.4 The parties agree that the decision to use ordispose of real property seized vithin the

retirernent contribution/regular, retirementcontribution/ special risk, and life and healthinsurance savings to BSo.

personnel shal1 be in the sole discretion ofBSo. In the event BSo decides to dispose of
such real property, Bso sha1l allocate fundsto the Larrr Enforcement Trust Fund equivalentto the Dania District's share, as defined inparaqraph 9.5, of the nutually agreed uponfair market value of such real property lessany Ioans, nortgages, Iiens, or any other
encumbrance on such property and the costincurred by Bso in proceeding with suchforfeiture action includingT, but not linritedto court costs, attorney fees, publication
costs, security, and naintenance costs. Suchallocated funds shall be earmarked for Bso's
use within the confines of the CITY.
9.5 The Dania District's share vill be based uponthe ratio that the Dania District'spersonnel's participation bears to theparticipation of a1I law enforcement agencies'
and units' participating in the seizure of theproperty.
6 BSo shaI1, on a quarterly basis, supply the
CITY with a written record of the above-described fines and forfeitures. suchreport(s) shalL include a description and
estimate of value of properties seized underthe Iar,rs of the State of Florida, whether ornot disposition thereof has been adjudicated.
Moreover, such report(s) sha1l be anended,fron tine to tine, by reflecting the ultinatedisposition of property described in anearlier report(s), and such anendatoryreport(s) shall be submitted to the CITYwithin ten (10) days of the ultimateadjudication with regard to the seizure of
such propertY.
13.13.5 is hereby added to this Agreenent as
SHERIFF reserves the right to provide to above-
stated insurance under a self-insurance plan.

agreements with loca1 vendors. From tine to tirne,
SHERIFF, through his agents or employees
investigate traffic cases and/or fatalities which

require stringent custodial procedures wherecrininal evidence is i,nvolved. The SHERIFF sha11honor the CITY,s agreements with 1ocal vendorsconcerning towing within the nunicipal boundariesof the CITy OF DANIA; provided hovrever, that thevendors neet all of the SHERIFFTS specificationslrith regards to maintaininq crinrinal evidence andits ability to provide adequate insurance coverageto the satisfaction of tlre Director of theSHERIFF,s Clairns Division. SHERIFF reserves theright to tow if vendor fails to conply with saidspecification. Further the SHERIFF also reservesthe right to continue to use the towing servicesother than those of the 1ocal vendors qrith regardsto all confiscations/ forfeiture cases occurringwithin the CITY OF DANIA.

FY 94/95 ADDENDUM TO BSO SERVICE AGREEMENT
Listed below is a brief outline of the proposed addendum to the BSO Service
Agreement:
Item 1: The term of the agreement is extended to September 30, 1996.

agreement.
Items 7 throuoh 10: The Sheriff proposes a 5% increase in contract costs, from
$3,383,690 to $3,552,873 ($169,183). The FY 93194 increase was 4.5%. lhave
suggested to Major Carney that a reduction in the proposed increase be
considered. Section 8.3 of the current agreement references a cost of living
adjustment for Sheriff personnel if implemented by Broward County. This
section will be applicable through September, 1996.
Item 'l 1: Allows for a maximum increase of 5% in FY 95/96

ARTICLE I: POLICE SERVICE LEVEL OF
SEERIPF shall provide to CITY, for the teru herelnafter
set forth, as t.he same may be extended ln accordance uith the
provisions hereof, conpetent professional police protection
rithin and throughout the corporate linits of CITY to the extent
and in the roanner hereinafter described;
1.1 Service shal1 be provided each day of the year,
from year to year, on a 24-hour per day basis, and such service
shall be of a standard corresponding to, but not less than, the
level of service provided by personnel of the former police
Departroent of the City of Dania.
l.ll A fully equipped, uniformed patrol force shall be
maintained to include Patrol units. A patrol unit shall be
defined to Eean one narked patrol car nith one uniforued Deputy
Sheriff and aII standard support equipment. It is planned that
each deputy will have a t.ake home car, however this rill take at
least tso (2) fiscal years to compleEe, commencing fiscal year
1989 through and-including Harch 1991. It is contenplated that
these eoployees previously employed by the City of Dania and yho
are hired by the SHERIT'F as deputies shall be among the first to
receive take hone vehicles provided said enployee(s) reside
uithin the nunicipal boundaries of the City of Dania. The
folloring minimal criteria shall be raaintained:
Shift shall mean and include service provided on
an eight (8) hour basis unless revised by nutual agreement of the
parties, the comnencement hour of any shift shal.l be deteruined

particular shift, the assigned nanporer is reduced to less than
four (1) deputies because of court appearances, then SEERIFF
agrees to temporarily assign replacements.
I .2.1 Eirst Shift (Alpha) : Six (6) patrol units
and one (1) Sergeant on duty specifically for the
benefit of DANIA for seven days a week.
Second Shift (Bravo) : six (6) patrol units and
one (1) sergeant on duty specifically for the
benefit of DANIA seven days a seek.
Third shift (Charlie) 3 Seven (7) patrol units
and One (l) Sergeant on duty specifically for the
benefit of DANIA seven days a seek.
It is contemplated that it sill take thirty-
six (36) Deputies and Six (6) Sergeants to
accomplish this level of service stated in
Sections 1.2.L, L.2.2, L.2.3. Failure of SHERIFF
to provide sEaff levels on a daily basis as
specified in Sections-1.2.1, 1.2.2 and 1.2.3
shall cause the CITY to receive a credit. for
each hour of service due. Said credit shall be
calculated using the hourly rate of pay of
'Step D' of the affected class. Credits shall
only be deducted from the nonthly palrment after
the SEERIEF has received t.en (10) days not.ice of

respective functions and assigned at the
Comrounications and Records Divisions of BSO.
(c) Tuo 12, Deputy vill be assigned to the
Tactical Unit
1.3 The uniforn patrol force shall respond to and
render aid in lifesaving and in-progress crime scenes, and the
response time incident thereto shall not exceed three (3)
uinutes. Said Lieutenant (senior deputy) shall be on duty at the

local poLice facility flve (5) days a reek, llonday through
Friday, for a full eight (8) hour shift excluding aPproved B's'o
holidays. The unifonu patrol force shall Provide vacation house
check services and premises surveillance not less than once
during each tHenty-four (24) hour period for each resident of the
CrTI rho regist.ers for such service, and the uniform patrol force
shall provide a high visibility profile in both residential and
business areas.
1.4 SEERIEF shall ansser and administrate, on a ti'enEy-
four (24) hour daily basis, all telephone conruunications related
to police services at the Broward sheriff's office communication
Center.
ExcepB as otherIise hereinafter specifically set forth

ARTICLE II I: IITAINTENANCE OF ABILITY
SEERIFP shall furnish to and maintain for the benefit of
the CITY, riEhout additional cost therefore, all necessary labor,
supervision, equipment communication facilities and supplies
necessary and proper for the purpose of performing the services,
duties and responsibilities set forth and contenplated herein and
as necessary to maintain the level of service to be rendered
he re unde r .
ARTICLE IV:ADDITIONAL SERVICES
SHERIrP shall provide to the CITY. upon the request of
the CITY, which request shall be nade by resolution by the City
Commission stating the necessity thereof, such additional
services as Eay be needed from time to time, as determined by the
CITY at its discretion.
{.1 The cost of such service shall be borne by the CITY
and shall be payable in such amounts and in such a manner as may
be determined by nutual agreeEent, upon each occurrence.
1.2 Notrithstanding anything to the contrary contained
herein, in the event the CITY should request. additional police
services, pursuant to the right inposed hereby, particularly in

8.2 The CITY aqrees to pay SHERIFP a suD not to exceed
a five percent (5$) increase for operations for the period of
this agreement beginning october l, 1993 and ending September 30,
199{. Said increase shall only be approved after the SEERIFP has
provided detailed financial backup justifying the increase to the
CITY.
During the period october l,1993 t.hrough Septenber
30, 1994 of this agreeEent, said anount shall be subject to an
adjustnent in - the event the Board of county Commissioners of
Brosard County inplements a cost of living increase or base pay
adjustment for las enforcernent officers, deputy sheriffs or other
persons eoployed by SEERIPF, in vhich event the above sums shall
bc increased by the anount of said cost of living increase or
base pay adjustnent. Said amount shall be due and payable on or
before october l, 1994.
8.1 The CITY agrees to continue to provide the space
nov occupied by SHERIPP as a district headguarters. The space is
provided at no cost to SIIERIFP. SHERIPF vill reinburse the CITI

8.5 The consideration recited herein, except as recited
shall constitute the entire consideration to be paid hereunder
and upon the palrEent thereof, in the manner and at the times
prescribed herein, the CITY shatl have no further monetary
obligations to SBERIFE or any third Party providing the services
described in this agreenent.adlfr6 ARTICLE IX:EINES, FORFEITURES, PAYMENT
AlllauenforcementeducaEionfundsleviedandcollected
bytheclerkoftheCourtandearmarkedforclTYpursuantto
SecEion g43.25, Plorida Statutes, shall be assigned over to
SHERIET and used by SEERITP for the las enforcement education
purposes authorized in said statute- Apart fron such funds,
SEERIPP 'shall have no Clain or right to any other monies or
things of value vhich CITY receives or ltray hereinafter receive by
ray of entitlement prograns, grants or othervise in connection
vith police or lan enforcement acLivities.
9.1 CITY and SHERIFP do hereby acknorledge, one to the
other, that nothing contained herein shall in anyrise be
construed t.o vitiate the CITY'S right to the disposition of fines
and forfeitures to vhich Ehe CITY sould be entitled, pursuant to
Section 3f6.026f P.S.A., as the same may be amended from time to
time, or as to proceeds and forfeitures arising under the sale or

disposition of unclaioed property or under any statutory or
conmon lav proceedings to vhlch the CITY vould otheruise be

Notwithstanding anything to the contrary contained in the

The CITY shall be entitled to anannual credit if the annual vacancy rate exceeds3.5 percent. A vacancy occurs when a deputy orenployee is absent from work and such absenceresults in a salary (regular salaries, special pay,FICA taxes (regular and special pay only),retirement contr ibution/ regular, retirementcontribution/ special risk, and life and healthinsurance savj-ngs to BSO.

BSO agrees that any currency seized within theCITY, through active participation of DaniaDistrict,s personnel, pursuant to thisagreement and Chapter 932 of the FloridaStatutes, and subsequently forfeited to BSO,shaLl be deposited into the Lar^r EnforcementTrust fund established by the Broward CountyCornmission in an amount which represents theDania District,s share, as defined inparagraph 9.5, of such currency. Suchcurrency shal1 be earmarked for BSO,s usewithin the confines of the City.
Upon concurrence of the District Commander,the CITY nay apply to BSO for the use of suchfunds if such appLication is in compliancewith Florida Statutes. BSO agrees to subnitsuch application to the Broward CountyComrnission for appropriation. Uponappropriation, such funds shatl be madeavailable to BSo for its designated use withinthe confines of the City.
The parties agree that the decision to disposeof or use personal property seized within thecITY through active participation of DaniaDistrict personnel sha1l be in the solediscretion of BSO. In the event BSO decidesto use such personal property outside of theCITY, BSO shal1 allocate funds to the LawEnforcement Trust Fund equivalent to the DaniaDistrict,s share, as defined in paragraph 9.5,of the nutually agreed upon fair narket value

any loans, mortgages, liens, or any other
enLumbrance on such property and the cost
incurred by BSO in proceeding with such
forfeiture lction including, but not lirnited
to court costs, attorney fees, publication
costs, security, and maintenance costs. such
allocated funds shal-l be earmarked for BSo's
use $/ithin the confines of the CITY.
The Dania District's share will be based upon
the ratio that the Dania District'spersonnel's participation bears to the
participation of all law enforcement agencies'ind unlts' participating in the seizure of the
property.
9 6 BSo shaLL, on a quarterly basis, supply the
CITY with a written record of the above-
described fines and forfeitures. Such
report(s) shaII include a description and
estirnate of value of properties seized under
the laws of the State of Florida, whether or
not disposition thereof has been adjudicated.
Moreover, such rePort(s) shal-1 be amended,
from time to time, by reflecting the ulti:nate
disposition of property described in an
earlier report(s), and such amendatory
report(s) shall be subnitted to the CITY
wj.thin ten (10) days of the ultinate
adjudication with regard to the seizure of
such property.

Vice Mayor Grace encouraged the Commission to use the $150,000 available for capital items
towards building improvements to Modello Park and Frost Park. Ciry Manager Flatley
meorioned rhat he expecrs information nert week on CDBG funds and rhat staff could bring a
bener proposal back to the Commission.
5. Ciry Manager Flarley mentioned that there aren't aoy good asphalt bids available
currendy for rhe amounr of street resurfacing that the Ciry nee&. He advised thar there is
$130,000 available from the Bas tax revenue and recommended to extend the street resurfacing
into nexr years budget so that a better comprehensive program could be bid.
Mr. Allen mentioned rhat the Ciry receives $195,000 a year from gas tax revenues for
mainraining streets, purchasing stleet right-of-y/ays, building new streets, and for drainage
work. He encouraged the Commission to begin the drainage project in the SE 5th Avenue
area and to repair of the bridge at N'W 1st Street since the load limit has been lowered to rwo
tons.

6. Ciry Manager Fladey explained that Mr. Herdman, owner of the properry kaown as
Creadve Crafu, located ro the east of the Boisy Waiters cenrer, has requested a pre-annexadon
agreemenr prior to the annexation of his properry into the Ciry of Dania. Mr. Herdman
ov/ns the propeq/ used for the entrance into the center which is a dangerous access from
Stirling Road. Mr. Flatley suggested to build an alteruate drive-way through the rightof-way
that exists to the rear of the building.
Dan Oyler, City Planner, mendoned his negotiations with Mr. Herdman ove! the pa$ few
months to come to rhe Pre-annexation agreemetrt that is attached in the backup. Further
discussion followed on the zoning for the properry and the need to go back to Mr. Herdmao
to see if he agrees with IG zoning.

CAPITAL OUTLAY
When the 93194 budget was prepared it included $600,000 in sales tax revenue bond
proceeds. Capital items in the amount of $437 ,175 were budgeted. Line item changes
have increased the budget for capital items to $450,000 and the remaining $150,000 was
to be used to retire current debt. This amount must now be reallocated for capital items.
These bond proceeds were part ofthe refunding portion ofthe Series 1994 Sales Tax
Revenue Bonds issued 2124/94. In order to comply with the bond requirements, all ofthe
proceeds must be used for capital outlay. Since the bond has been refunded and we are
not required to fund the debt service until95196 FY, there will be no adverse effect on the
budget by making this change from debt retirement to capital outlay.

Sidewalk Signs for Federal Highway Businesses.
The business along Federal Highway have complained about the fact that their
store fronts do noi lend themselves to being visible by passing motorists until
they are directly in front of the store. Many of them have resorted to placing
,"id*irh boarj signs on the sidewalks in violation of Section 3-28 Painted Signs
on public Property which states that painted signs on streets, sidewalks or other
prUfrc ptop"rt, aie no allowed. Many of the have been cited by the code
enforcement division of the CitY.
ln the city of Ft. Lauderdale they have been ignoring the same type of code
provision is it relates to the Las Olas area where there are numerous sandwich
board and free standing signs indicating that the store is open'
per your request I have investigated various types of street signs being used in
the [as Olas area. The one that seems most appealing is at Apropos Art Galley.
The sign is a 16'X 20" board hung from a pipe inserted in the planting bed
adjaceit to the sidewalk which is similar to the planting bed on Federal Hwy.
I have attached a photo copy of the sign for your convince. The sign was made
by the owner but could be made by any sign company'
The city of Hollywood adopted an ordinance in1979 that allows for signs
identifying a business establishment if the City Commission determines that
certain cJnditions are met. A copy of that ordinance is attached'

An item scheduled for discussion at the June 21 , 1994 City Commission workshop
meeting concerns welcome signs within Port Everglades. The attached letter from
Deborah Scoft-Queenin explains the goal of trying to have a uniform welcome sign
through the Port. The request is to obtain approval of a uniform welcome sign for use
through the Port.
The lnterlocal Agreement, adopted earlier this year concerning the transfer of
jurisdiction of Port Everglades from the Port Everglades Authority to Broward County,
tontains the authority for the cities (Dania, Hollywood and Ft. Lauderdale) to construct
welcome signs in Port Everglades within their municipal boundaries. such signage
would be placed at the municipalities expense at city's design and had to include
county logos. The signage was supposed to be done in a uniform and coordinated
manner.
This would lead to some very confusion situations. For instance, there could be a Ft.
Lauderdale sign on one side of a street such as Eisenhower Blvd. and a welcome sign
for Hollywood on the other side.
Hollywood is proposing to place two such welcome signs. Rather then competing
against each other by placing conflicting signs which would be confusing to the public, a
,nifor. sign scheme including the design of a sign, accompanying landscaping, and
location oi signs has been prepared. Copies of the proposed signage including
landscaping and sign location is attached.
The monument type sign identifies Port Everglades and lists each of the three
communities in which the Port is located. The first signs proposed to be constructed
are on Eller Drive.

Welcome Signs for Port Everglades
It is recommended that the concept for the uniform signage be approved. The
proposed signs name each of the three communities and prevents the confusion of
multiple jurisdictional signs which could be very confusing to a visitor.
This topic was discussed at a meeting at Port Everglades and based on that
discussion, there are some conditions which should be noted. The first is that the signs
be erected at no cost to the three cities. Another is that each of the three cities must
concur with the uniform signage. lt should be noted if a motion is made to approve the
design, that this is considered to be consisted with the lnterlocal Agreement'

The Port Everglades Landscape Committee, chaired by Port AuthorityChalr Mary Anne Gray, met on June 9, 1994, to dlscuss regulatory
and informational/directional signs in the Port, as well as theCity of Ho11]ryood's interest to post welcome slgns. Present atthe meeting were representatives from the Cities of Holl)rrdood,Fort Lauderdale, and Danla, Broward County, the Port business
community and various Port Authority staff. Committee members andothers j,n attendance discussed the Port's efforts to implement anew lnformational/dlrectional sign program that will facilitatetraffic flow and effectively direct trafflc to Port destlnations.Because of the many Port facillties, our obj ective is tostreamllne the directlonal/lnformational signs in a user-friendlymanner and eliminate signs that do not serve a useful portpurpose. The Port Everglades Association, under the auspices ofthe Port business community. strongly endorsed the Port's new signprogram at the June 9 Landscape Committee meeting. A copy of themeeting minutes will be transmitted to you next week underseparate cover.

A discussion concerning the policy on undersized lots is scheduled for the June 21,
1994 City Commission workshop. The Zoning Code permits the use of lots of 50'or
more width to be developed with single family residences. Less than 50'width requires
a variance.
This item was discussed at the January 18, 1994 workshop meeting. lt was reported
that there were 32 such situations of undersized lots of which we were aware' This has
been reduced by four based on the variances granted to D.E.D.C. for property on NW 8
Ave.. My recollection of the conclusion of this meeting was that these situations would
be reviewed on a case by case basis through the variance procedures. lf that is
incorrect, please so inform me.
The variance procedure usually takes anywhere from six weeks to three months in
normal circumstances depending on when a petition is submitted. ln the case of the
D.E.D.C.'s requests for variances, the procedure look 4112 weeks from the date that
complete petitions for variances were submitted. The petitions were submitted April 2't,
1994 and the City Commission approved them on June 14, 1994'

property that amount to over $11,@0.
The Commission agreed thar it would make better sense to increase tax revenue by developing the lo* and
that action would bi taken on the liens at the next regular meeting'

7. Dan Oyler, City Planner, advised rhe Commission that Broward County has enacted two new
ordinances on "Tree preservation' and "Tree Abuse" that are being enforced by the Depanment of Natural
Resource protection. He advised that the Ciry's Tree Ordinance does not meet the requirements in the
County Ordinances and Presented a draft ordinance'
The Commission discussed some changes to the ordinance and directed Mr. Oyler to amend the ordinance
and bring it back for Commission action.
8. Chief Farley, BSO, presented a requesr to expand the southwest ponion of the District building and
ro enlarge the parking lot. The reqr"rt intlrrded the remodeling of the first fl-oor restrooms and locker

eviderrce, file and property rooms and the new space for administrative offices. Chief Farley advised that

Please see attached a map of a lot owned by the County adjacent to Byrd Park and the
City Westlawn Cemetery. Also attached is a letter from the County Parks Division
indicating a willingness to give the property to the City. The County is currently
searching the deed to determine if there are any restrictions as to use.
Provided there are no adverse restrictions, I recommend the Clty accept the land for
improvements to Byrd Park.
