In reqards to the airport issue, I first want to say that each ofyou have put forth a good tight on behalf of the cltizens of
Dania who may be affected by expansion of the airport facility. Ibelieve that your effort, as sincere as it has been. is nisguided
and a total uaste of tax payer money.
Election tine will be rolling round next year for a couple ofyou. Some citizens have stated that if you vote to discontinuethe fight aqainst the airport that you wiII not be re-elected. I
say to you that is pure B.s. Your performance over the years
speaks for itself. There are a lot more people not affected by
the airport than those that are and they respect your leadership
in city matters.
We aII know that the rnoney we have used in the
borrowed and that it has to be repaid. tookinqt
this debt wiII most surely mean an increase in
airport fight is
ahead to paying
our taxes.
It is time for the City of Dania to throw in the towel- on this
one and not spend one dime more on this futile legaL battle. Yourjob fron this point forr,rard should be to urork with the Aviation
Department to insure that the proper nunber of noise monitors areinstalled and that we are provided with a true reading on the
noise Ievel.
Sone in the city have condenned you Conmissioners for notdefeatinq the County and the FAA. ft is a wise person that knolrs
when to give up a fight. only a fool continues to try to fight
when they are beaten. Every person that lives near the airport
knew when they bought their hones, that the airport was there to6tay. Those of us having a little foresight also knew that
someday the airport would expand. In spite of this potential for
expansion, nany of us chose to live near the airport anyway. Ue
have no problem with it.
f know of no other place where you pay a tax on landscaping
except Dania. what else can you politicians tax us on in order to
support your bad habit of involvlnq the city in frivolous Iaw
suits? I believe that you would be in trouble with ALL the voters
if you end up raising taxes as you surely must to continue
supportinq this Iitigation.
with all due reapect to the citizens in the annexed area of
Dania, they had voted to join Dania because Holllrwood would not
fight for their i.nterests. Dania has fought and lost- This fiscal
nadness of continuing to borrow money to pay for the 1aw suit
must stop. History reninds us of ifohn Lassiter, who some 20 years
ago advlsed the people just south of the airport to rezone the
area from the cutoff canal to the airport from residential to
comnercial , No one lranted to hear about it. Failinql to heed that
foresight has come home to roost.
For Connissioners Bertino and Hyde you must feel that you are in
a no-win circumstance. Gentlemen, the people I taLk to say it is
time to give up the fight now. Aa the late chester Byrd said You
must "vote on this issue with your mind and not with your heart".
The property owners in the affected areas of Dania that wish to
continue the fight should be encouraged to do so - so long as
they pay their own legal fees. The city however nust stop wasting
thi6 "borroued" moneY.
Some of rny friends do not hold my view on this i6sue and I know
that some of the frj,ends of Commissioners Hyde and Bertino have
threatened to discontinue their friendship with you qentlemen,
should you vote incorrectly. A true friend would not expect the
impossible. I r.rant both of you to know that regardless of your
vote on the airport issue I pledge my continued friendship.

1. The interfocal agreement is between Broward county and the
city of Dania regarding the expansion of runway 9L/27P. at the Fort
l,auderdale/HoLlyrrood International Airport. The agreement
addresses the extension of the runrray, annexation and de-annexation
of certain ]ands, the jurisdiction over annexed and de-annexed
lands, restrictions on the runl^,ay use, mitigation of the noise
iropact and replacement of the tax base and infrastructure loss to
the City.
Extens ion of the Runwav:
2. The city agrees to support Brordard county's decision to widen
and extend the runway from its present length to 9000 feet' The
land needed for the expansion will be de-annexed fron the city and
will cone under the jurisdiction of Broward County ' The county
will- have permitting authority for the expansion.
Annexa ion and de-nexation of lands:
3. The fands annexed and. de-annexed are identified in exhibit 1
and 2. The city losses jurisdiction over the de-annexed l-and and
gains jurisdiction over the annexed l-ands.

Restrictions on the Runl,iay Use:
4. The runway use is dessribed as Phase l, II , III and
unrestricted. During Phases f, II and III the runlray will not be
used at night and wiJ-I only be used by Stage III aircraft.

Mitigation:
5. The intent of the agreement is to require the County to
identj.fy the inpact, in advance, and to complete rnitigation before
the irnpact occurs. The noise inpact is identified by the Federal
Standard, FAR Part 150 Appendix 2. That standard considers noise
l-eve1s of 65 LDN or greater unacceptable for residential use- The
agreement recognizes the possibility of the standard being changed
by the Federal- or State government and applies the current
standard. The County cannot increase the use or nove to the next
phase until the nitigation is conplete.
5. This is accoutplished by requiring Broward County to annual-1y
prepare a noise contour for the base year and a five year
projection. The city has the right to independently verify the
accuracy of the base year and the projected contours. Mitigation
of the impacted residential properties must completed before the

operations increase or the County proceeds to the next phase.
Tax base and Infrastructure:
8. The annexation of land into the City lriI1 replace the present

at any tine in the future, the county is relieved of its remaining
oblj-gations under the agreement. But, the city night be precluded
fron enforcing its rights in court. Paragraph 16 should be amended

7. If the mitigation proposed by the county is acceptable, the

county is not acceptable, the city can present a counter-proposal .
The counter-proposal , if it neets current and applicable
guidelines, must be instituted by the county.

case so long as the county is performing in compliance with the
interlocal agreernent. Nothing in the agreement precludes
enforcenent of the interlocal agreement by future li,tigation. The

10. In paragraph l-9 the City waives its right to prevent the
issuance of a development order. And, the city agrees not to
exercise its poJ-ice power in connection with the County issuinq a
development order, or seeki-ng a perrnit frorn another governmental
entity. The waiver is irrespective of the county's cornpliance
under the agreement, the lawful-ness of its application to another
entity or the integrity of any impact assessment' The waiver
directly implicates the principle proscribing a 1ocal government
from contractinq away its policy power. The last two sentences of
paragraph l-9 should be deleted.
conclusions:
1L. The identification and nitiqation of the noise inpact is the
best the cj.ty can expect to achieve by negoti.ation and exceeds the
nitigation programs at other large airports.
),2. The city is compensated for the tax base Loss and the
expenditures for the infrastructure .

13. The princj.pal objective of the litigation is to prevent the
County fron condemning land for the runway expansion until- it has
anended its comprehensive plan, obtained DRI approval fron the
ci-ty, and obtaj,ned FAA approval and EIS review. The najor
objections to county condemnation at this time are that acquisition
of Iand woul-d divest the cj_ty frorn exereising DRI regulatory powers
over the county before the county has prepared and made comrnitment
to a noise rnitigation pl-an. Under the present facts, the
likelihood of securingr the principal objective is reasonabLy good.
14. The likelihood of success diminishes as the county satisfies
each of the current ornissions, such as amendingi the conprehensive
pLan and obtaining FAA approval . If all the omissj-ons are
satisfied except for City DRf approval , the City could prevail only
if it proves that the main reason for the County sondemning the
land is to divest the city of DRI regElatory pohlers '

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA,
FLORIDA;
Section 1. That that certain lnterlocal Agreement Between Broward County
and City Of Dania Pertaining to Expansion, Mitigation of the Expansion and Jurisdiction of
Fort Lauderdale-Hollywood lnternational Airport; a copy of which is attached hereto and
made a part hereof as Exhibit 'A", be and the same is hereby approved and the
appropriate city officials are hereby directed to execute same.
Section 2. That this resolution shall be in force and take effect immediately
upon its passage and adoption.

Such leports sha1l beprovided in the forE requested by the CITY, to the extent the forrrequested by the CITY is within the standard existing capabilitiesof the noise nonitoring equipuent and software. CITY has the rightto independently verify the accuracy of the Airport noise nonitor-ing systeu.
C. Not proceed with the construction of the proposed
runhray extension unless the restrictions described above are
approved in substance by the Federal Aviation Administration.
4. Noise Mitigation:
A. Starting in the calendar year during which construc-tion of the proposed runway 9R/27L commences, coIrNTY shaI1 prepare
annuaLly a projected s-year 55 YLdn noise exposure Dap for theAirport. The base year infordation shall be dra$rn frou the bestavailable data on actual aircraft operations at the Airport. Datafrou the COITNTY, s noise nonitoring systen shaIl be utilized toverify the accuracy of the conputed base year contour. Theprojected 5-year noise exposure Eap sha1l. utilize the bestavailable data to project the. nunber and t:rpe of aircraft opera-tions. The forecasts and all supporting data shall be provided tothe cfTY inrnediately upon acceptance by the Broward County AviationDepartment. At such time as a projected s-year 65 YIdn noiseelq)osure Dap sholrs that a portion of any residential area rithinthe CITY til1 be exposed to 65 Ldn !,rithin sucb 5 years, COITNIYshall corrnence a noise nitigation progrram, as described below andas peroitted by applicable regrulation, ln such area and shallsubstantially conplete such nitiqation prior to aIlo!,ring the nextphase of use of runway 9R/27L. CITY has the right to independentlyverify the accuracy of COITNTY, s projected noise contours. Ilowever,

In the event this occurs and is expected to lastgEeater than six (5) nonths, coUMPY shalI irn'nediately prepare arevised noise contour reflecting the increased use to-tre-prelrarsd-
and iunediately coumence noise roitigation as defined below.
B. The noise nitigation programs conteroplated hereinnay include: acquisition of fee title to all property (and reloca-tion of property owners) within a defined arear' voluntary acquisi-tion and relocation; purchase assurance or sales assistanceprogrraus; and, acqui.sition of avigation easements. The exact terosof any avigation easenents purchased will be subject to negotiation
between the coIrNTY and the property olrner. Mitigati.on progrrrnsshall be based upon a consideration of the desires of the residents

(1) At all tines durj.ng phases 1, 2 and 3 of opera-tion, proposed runway 9P./27L shaLl be used only during the hours of

(6) Unrestraj.ned use of runway 9R/27L because ofthe closure of runway 9L/27R or due to the existence of aneuergency condition at the Airport as declared by a pilot, AirTraffic control personnel or the Airport operator sha11 bepernitted at all tiues.

10. The cot NTY and the CITY agrree that the annexation and
deannexation of lands described herein, when considered togethervith the reroaining provisions of thls agreement, provide comparablebenefits and obligations to each party. Therefore, lf for any
reason the Legislaiure does not enact a local bill in substantiallythe forn attlched hereto as Exhibit a, the renainder of thLsInterlocal Agreeuent shaI1 be nu1l and void and of no further force
and effect. Siuilarly, if for any reason any clause or paragraph
of the reuaj.nder of this Interlocal Agreement is not aqreed to and
approved by each conmission, then both the coUNTY and the CITY
sha11 lrithdraw suPport for a 1oca1 bi11.
11. coUNTY and cfTY agree that, for any specially assessed
iuprovements constructed or installed prior to the effective dateof-this Agrreenent and benefitting any portion of the Annexation or
Deannexation Parcels, paltnents by property orrners for such
improvements shal1 continue to be nade to the entity that undertook
and. installed such inprovements, regardless of jurisdiction.
L2. CITY shaLl support, to the naximum extent Peruitted byIaw, rezoning and ptatting of the rrTrails End'r property for
a j.rport-coupatible uses, as herein defined. Hovever, that Portionof the rrails End property located within the runlray Protectionzone for run$ray 13/31 as depicted on the Airport Layout Plan
approved 7/14/92 shal1 renain in couNTY ownership and sha11 be
deannexed pursuant to paragraph 8, above. coUNTY and CITY agrree

Any counter-proposals Eade by CITY shall bebased upon a consideration of the desires of the residents of thearea and shaIl be consistent with current and applicable gnride-U.nes, including, at a nininum, federal regulations regarding theexpelditure of aviation funds. 5. COUNTY ag?ees that any condemnation undertaken as a noisenitigation Deasure will be conducted pursuant to the FederalRelocation Assistance Act.
rI. ANNEXATION/DEjANNEXATTON
5. CITY shall prepare all necessary documents for annexationlnto the CITY of the parcels of land Dore fully described on Ea-Liblt 1, attached hereto and incorporated herein by reference, andsonetiues referred to herein as the itAnnexation Parcels.r.
Although the partles at one tine considered the annex-ation by the CITY of an additional area known as the ttrelated
airport uses arearr as described in Section 4 of Chapter 90-483,
Laws of Florida, the CITY and the COITNTY now agree that such areashall not be annexed into the CITY pursuant to this agreement. Thejurisdiction and future developroent of this area shal1 be asdescribed in Section 4 of Chapter 90-483, Laws of Florida.
Consistent lri.th that act, in the event all or any portion of therrelated airport uses areatr is sold or otherwise transferred to

that would enhance the proper and efficient functioning of theAirport or Port Everglades, and would stiuulate desirable conpati-b1e grrowth and expansion of the tax base of the CfTY.
15. COUIIrY and CITY agree to voluntarily disniss withprejudice all on-going litigation (including that certain lawsultstyled fCity of Dania v, Broward countyrr Case No. 93-L8222 05, J.nthe 17th ,Iudicial. Ci.rcuit, Brolrard County, Florida) and by approvalof this agreeDent direct counsel to proceed accordingly. Further,CIIY agrees to neither file nor encourage, support or fund thefiJ.ing of another lawsuit or adninistrative couplaint by any otherparty raising substantiaLly the same Datters as those raised ln theabove-styled case pertaining to the Airport.
v OTHER PROVISTONS
17. COIJMTY agrees to pay CITY rrithin two (2) years of theacquisition of eighty percent (80*) of the land intended forextensi.on of runway 9P./27L the costs expended by the CITY,excluding gEants received or other amounts advanced or reinbursedby any other entity, for the installation of infrastructureiuprovements on the land to be purchased for the extension ofrunway 9P./27L, lrhich costs the CfTY shal1 demonstrate and document.
18. COT NTY ag?ees to initiate amendments to the Bro!,rardCounty Conprehensive PIan and Land Use Plan to reflect thisInterlocal Agrreeuent, and dillgentIy pursue such amendments.Further, COUMTY agrees to provide all necessary technical assls-tance to CITY to enable it to sinil.arly amend 5.ts CoroprehensivePlan.
19. The parties agree that, as between CfTY and the COUNTy,
COITNTY sha1l be the 1ocal government hrith exclusive jurisdiction toissue any developnent order pursuant to Section 380.05, FloridaStatutes, or any 1oca1 progran established to replace the DRIproefrau, for lands within the planned Airport boundary, as depictedon Ea,bibit 5. CITY expressly raives any right it . nay bave,
Pursuant to applicable law or as deternined by any board, agency,adninistrative hearing officer or court with authorj.ty to determinesuch matters, to issue or prevent the issuance of such a develop-ment order. Ifowever, the CITY sha1l retain any right it nay haveas an adjacent nunicipality to connent on such proposed developuentorder.

maxj.mize the capacity of the site, not unreasonably restrict the
use of the land and be conpatible with the Airport and the adjacent
uses.
13. (a) coUNTY has purchased certain properties west of ttreAirport pursuant to county commission action an october 27, 7987.A portion of such properties, generally located west and north ofthe runlray protection zone for ruNray 9R/27L, are nithin thejurisdiction of the CITY.
(b) As to those properties that are curentLy within thejurisdiction of the crTY, generally depicted on Exhiblt 3, attachedhereto, CoIJMBY agrees to prepare and subroit for approval plats of
a1l. such properties that are susceptible to boundary platting and,
upon approval and recordation of such p1ats, offer such land forsale or exchange in accordance with the reguJ.reuents of FloridaStatutes, so that such lands nay be returned to the tax roles ofthe CITY. It is the parties' intent that such lands be offered forsale as soon as practicable after plat recordation, considering theprevall-lng narket conditlons.
(c) CITY shal] support, to the maximum extent pernitted byIaw, platting of these properties, and initiate rezoning ifnecessary, for airport-cornpatible uses and shall approve the platsif they meet the 1egal reguirenents of the CITY.
(d) I{hen used in this agreement, ttairport-related usesrr orrairport-conpatible uses'r sha11 nean uses and facilities that arerelated to tbe Airport or aviation, or that provide supportservices to the Airport, its tenants, users, concessionaires and
euployees, and which may, by the application of reasonable site-plan, zonj.ng or sinil.ar regulations, be conducted on a proposedsite in a Eanner that is conpatibLe with existing, non-airport uses1n the vicinity of the site. without in any way J.iuiting thegenerality of the foregoing, rrairport-related usesrt and ralrport-
coupatible usesrt incLude: rental car facilities and storage lots,Iong-tern passenger parking facilities, enployee parking facili-ties, airline in-flight services, air carqo services, specializedairclaft and ground transportation equipnent repair and naintenanceexcluding aircraft engine testing, and aviation-oriented trainingfacilities.
14. coUNTY agrees to identify and begin processing all of theplats described in paragraph 13(b), above, within fiscal year 1993-
94.
15. coUNTY and CITY shal1 participate in an Airport/SeaportVlcinity planning effort, uhich shall include the collection andcorrelaLion of all existing data regardlng land use, zoning andinfrastructure. coIlNTY and CITY will take actions necessary to
inplenent any recolnmendations of the Airport/Seaport Vicinity Plan

and Griffin Road (s.R. 818), provided CITY agrees to uaintain saj.dentry sign.
23. coIiNTY agrees that at such tirne as coUNtY no longerprovides fire and/or rescue services frou Fj.re Station #32 ( locatedon S.w. 31st Avenue), CITY shall be given first consideration topurchase such fire station for the purpose of providing its fire
rescue services.
24. The parties hereto agrree that aII legal requirements orprerequj.sites pertalnlng to the execution of, this Agireenent have
been perforned. Each party sha1l notify the other, at least seven(7) days in advance, of the date upon which its governing boardeba1l consider approval of this Interlocal Agreenent, and shallfurther provide the other with coples of the official records
evidencing the action taken by its governing board rrith regard tothls fnterlocal Agreement.
25. This Interlocal Agrreenent shall be governed by and
construed in accordance rrith Florida Law, supersedes all priorrrritten or oral agreeDents between the parties, and .nay not benodified or anended unless in vriting following approval by bothtbe Board of county conmissioners of Broward county and the DaniaCity Co'rrnission.

RELATING TO BROWARD COUNTY; ESTABLISHING PURPOSE AND
INTENT; PROVIDING FOR THE ANNEXATION OF CERTAIN LANDS
LOCATED IN UNINCORPORATED BROWARD COUNTY INTO THE CITIES
OF DANIA AND FORT LAUDERDALE UPON CERTAIN TERMS; PROVIDING
FOR DEANNEXATION OF CERTAIN LANDS PRESENTLY LOCATED
WITHIN THE MUNICIPAL BOUNDARIES OF THE CITY OF DANIA;
PROVIDING FOR JURISDICTION OF THE FORT LAUDERDALE.
HOLLYWOOD INTERNATIONAL AIRPORT; PROVIDING FOR LAND USE
CONSIDERATIONS; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA:
Section 1. That that certain Act Relating to Broward County; Establishing Purpose and
lntent; Providing for the Annexation of Dania and Fort Lauderdale Upon Certain Terms;
Providing for Deannexation of Certain Lands Presently Located Within the Municipal
Boundaries of the City Of Dania; Providing for Jurisdiction of the Fort Lauderdale-Hollywood
lnternatlonal Airport; Providing for Land Use Considerations; and Providing For An Effective
Date, a copy of which is attached hereto as Exhibit ?", is hereby approved'
Section 2. That this resolution shall be in force and take effect immediately upon its
passage and adoption.
