Thank you unable to for allowing this letter to be read this evening. I amattend due to ny work schedule, In reqards to the airport issue, I first want to say that each ofyou have put forth a good tight on behalf of the cltizens of Dania who may be affected by expansion of the airport facility. Ibelieve that your effort, as sincere as it has been. is nisguided and a total uaste of tax payer money. Election tine will be rolling round next year for a couple ofyou. Some citizens have stated that if you vote to discontinuethe fight aqainst the airport that you wiII not be re-elected. I say to you that is pure B.s. Your performance over the years speaks for itself. There are a lot more people not affected by the airport than those that are and they respect your leadership in city matters. We aII know that the rnoney we have used in the borrowed and that it has to be repaid. tookinqt this debt wiII most surely mean an increase in airport fight is ahead to paying our taxes. It is time for the City of Dania to throw in the towel- on this one and not spend one dime more on this futile legaL battle. Yourjob fron this point forr,rard should be to urork with the Aviation Department to insure that the proper nunber of noise monitors areinstalled and that we are provided with a true reading on the noise Ievel. Sone in the city have condenned you Conmissioners for notdefeatinq the County and the FAA. ft is a wise person that knolrs when to give up a fight. only a fool continues to try to fight when they are beaten. Every person that lives near the airport knew when they bought their hones, that the airport was there to6tay. Those of us having a little foresight also knew that someday the airport would expand. In spite of this potential for expansion, nany of us chose to live near the airport anyway. Ue have no problem with it. f know of no other place where you pay a tax on landscaping except Dania. what else can you politicians tax us on in order to support your bad habit of involvlnq the city in frivolous Iaw suits? I believe that you would be in trouble with ALL the voters if you end up raising taxes as you surely must to continue supportinq this Iitigation. with all due reapect to the citizens in the annexed area of Dania, they had voted to join Dania because Holllrwood would not fight for their i.nterests. Dania has fought and lost- This fiscal nadness of continuing to borrow money to pay for the 1aw suit must stop. History reninds us of ifohn Lassiter, who some 20 years ago advlsed the people just south of the airport to rezone the area from the cutoff canal to the airport from residential to comnercial , No one lranted to hear about it. Failinql to heed that foresight has come home to roost. For Connissioners Bertino and Hyde you must feel that you are in a no-win circumstance. Gentlemen, the people I taLk to say it is time to give up the fight now. Aa the late chester Byrd said You must "vote on this issue with your mind and not with your heart". The property owners in the affected areas of Dania that wish to continue the fight should be encouraged to do so - so long as they pay their own legal fees. The city however nust stop wasting thi6 "borroued" moneY. Some of rny friends do not hold my view on this i6sue and I know that some of the frj,ends of Commissioners Hyde and Bertino have threatened to discontinue their friendship with you qentlemen, should you vote incorrectly. A true friend would not expect the impossible. The interfocal agreement is between Broward county and the city of Dania regarding the expansion of runway 9L/27P. at the Fort l,auderdale/HoLlyrrood International Airport. The agreement addresses the extension of the runrray, annexation and de-annexation of certain ]ands, the jurisdiction over annexed and de-annexed lands, restrictions on the runl^,ay use, mitigation of the noise iropact and replacement of the tax base and infrastructure loss to the City. Extens ion of the Runwav: 2. The city agrees to support Brordard county's decision to widen and extend the runway from its present length to 9000 feet' The land needed for the expansion will be de-annexed fron the city and will cone under the jurisdiction of Broward County ' The county will- have permitting authority for the expansion. Annexa ion and de-nexation of lands: 3. The fands annexed and. de-annexed are identified in exhibit 1 and 2. The city losses jurisdiction over the de-annexed l-and and gains jurisdiction over the annexed l-ands. 1 Restrictions on the Runl,iay Use: 4. The runway use is dessribed as Phase l, II , III and unrestricted. During Phases f, II and III the runlray will not be used at night and wiJ-I only be used by Stage III aircraft. westerl-y operations by l-arge aircraft are not al-lohred during Phase I and increase in Phase II and III. Night operations wj-11- be allohred if unrestricted use is required. The County cannot move to the next phase or unrestrj.cted. use until nitigation below is substantially conplete. Mitigation: 5. The intent of the agreement is to require the County to identj.fy the inpact, in advance, and to complete rnitigation before the irnpact occurs. The noise inpact is identified by the Federal Standard, FAR Part 150 Appendix 2. That standard considers noise l-eve1s of 65 LDN or greater unacceptable for residential use- The agreement recognizes the possibility of the standard being changed by the Federal- or State government and applies the current standard. The County cannot increase the use or nove to the next phase until the nitigation is conplete. 5. This is accoutplished by requiring Broward County to annual-1y prepare a noise contour for the base year and a five year projection. The city has the right to independently verify the accuracy of the base year and the projected contours. Mitigation of the impacted residential properties must completed before the 2 operations increase or the County proceeds to the next phase. Tax base and Infrastructure: 8. The annexation of land into the City lriI1 replace the present tax base loss caused by the land acquisition for the runway. Dismiss al of the Liti cration : g. The risk of dismissal- of the lawsuit with prejudice is great. Disrnissal- with prejudiee precludes the City from agaj.n suing the county for acts or oni.ssions that were allegred or coul-d frave been atleged j-n the case. ff any part of the agreement is invalidated at any tine in the future, the county is relieved of its remaining oblj-gations under the agreement. But, the city night be precluded fron enforcing its rights in court. Paragraph 16 should be amended 3 7. If the mitigation proposed by the county is acceptable, the City uray approve the proposal . If the mitiqation proposed by the county is not acceptable, the city can present a counter-proposal . The counter-proposal , if it neets current and applicable guidelines, must be instituted by the county. to provide that the city will disrniss the case ( without prejudice), and agree not to sue the county under the theories asserted in the case so long as the county is performing in compliance with the interlocal agreernent. Nothing in the agreement precludes enforcenent of the interlocal agreement by future li,tigation. The second sentence should be deleted in its enti-rety' other Provisions: 10. In paragraph l-9 the City waives its right to prevent the issuance of a development order. And, the city agrees not to exercise its poJ-ice power in connection with the County issuinq a development order, or seeki-ng a perrnit frorn another governmental entity. The waiver is irrespective of the county's cornpliance under the agreement, the lawful-ness of its application to another entity or the integrity of any impact assessment' The waiver directly implicates the principle proscribing a 1ocal government from contractinq away its policy power. The last two sentences of paragraph l-9 should be deleted. conclusions: 1L. The identification and nitiqation of the noise inpact is the best the cj.ty can expect to achieve by negoti.ation and exceeds the nitigation programs at other large airports. ),2. The city is compensated for the tax base Loss and the expenditures for the infrastructure . 4 13. The princj.pal objective of the litigation is to prevent the County fron condemning land for the runway expansion until- it has anended its comprehensive plan, obtained DRI approval fron the ci-ty, and obtaj,ned FAA approval and EIS review. The najor objections to county condemnation at this time are that acquisition of Iand woul-d divest the cj_ty frorn exereising DRI regulatory powers over the county before the county has prepared and made comrnitment to a noise rnitigation pl-an. Under the present facts, the likelihood of securingr the principal objective is reasonabLy good. 14. The likelihood of success diminishes as the county satisfies each of the current ornissions, such as amendingi the conprehensive pLan and obtaining FAA approval . If all the omissj-ons are satisfied except for City DRf approval , the City could prevail only if it proves that the main reason for the County sondemning the land is to divest the city of DRI regElatory pohlers ' 15. The base year infordation shall be dra$rn frou the bestavailable data on actual aircraft operations at the Airport. The forecasts and all supporting data shall be provided tothe cfTY inrnediately upon acceptance by the Broward County AviationDepartment. Ilowever, CogNTY nay Dove to such phase uithout having substantiallyconpleted the noise nitigation prograu if, because of naturaldisaster or other torce maj eure, there is a drastic reductj-on incoumercial airport capacity in the South Florida area, such as theLong-tem closure of a coumercial aircraft runway, which causes an'lncreased corn'nercial deroand at the Airport beyond reasonableprojections. In the event this occurs and is expected to lastgEeater than six (5) nonths, coUMPY shalI irn'nediately prepare arevised noise contour reflecting the increased use to-tre-prelrarsd- and iunediately coumence noise roitigation as defined below. B. The noise nitigation programs conteroplated hereinnay include: acquisition of fee title to all property (and reloca-tion of property owners) within a defined arear' voluntary acquisi-tion and relocation; purchase assurance or sales assistanceprogrraus; and, acqui.sition of avigation easements. The exact terosof any avigation easenents purchased will be subject to negotiation between the coIrNTY and the property olrner. Mitigati.on progrrrnsshall be based upon a consideration of the desires of the residents -4- B. Restrict the use of Proposed runway 9R/27L asfolloss : (1) At all tines durj.ng phases 1, 2 and 3 of opera-tion, proposed runway 9P./27L shaLl be used only during the hours of 7:Oo a.D to 1O:Oo p.n. and onLy by Stage IIf aircraft. Ilolrever,proposed runhray 9P./27L may be used at any ti.ne in the event of an eBergency or the closure of runway 9L/27R as hereinafter provided. (2) At the start-up of operation of the proposed runuay 9R/27L, aircraft exceeding 58,000 lbs. wilL land only to theuest and depart onLy to the east. CITY shall prepare all necessary documents for annexationlnto the CITY of the parcels of land Dore fully described on Ea-Liblt 1, attached hereto and incorporated herein by reference, andsonetiues referred to herein as the itAnnexation Parcels.r.
