PROCLA]UIATION
WHEREAS, since December 16, 1968, Wanda Mullikin has served the City of
Dania as a loyal and faithful employee, first as an account clerk and, from February 27,
1973, as city clerk; and
WHEREAS, on June 2, 1980, Wanda completed the educational requirements
necessary to become a certified municipal clerk; and
WHEREAS, married to James "Buddy" Mullikin, grandson of the first mayor of
the City of Dania, John W. Mullikin, Wanda herself has become an integral part of the
history of our city; and
WHEREAS, in addition to being a mother to four children, Donald' David, Nancl,
and Kenneth, wanda has always most ably carried out the duties of her position as city
clerk; and
WHEREAS, effective January 1, 1995, Wanda Mullikin will retire from public
service to become a private citizen looking forward to spending many hours of leisure
with her husband and family at their vacation home in Cudjoe Key; and
WHEREAS, the City Commission of the City of Dania wishes to formally
recognize the contributions Wanda Mullikin has made to the citizens of Dania, not only
as a public servant but also as a private citizen, active in her church and community
affairs.
NOW, THEREFORE, l, Robert A. Mikes, as Mayor of the City of Dania, Florida,
in recognition of the contributions made to our community through her years as a public
servant and those as a private citizen, do hereby proclaim December 21 , 1994 as

I would like to get the commissions approval to procure a Cherrington Corporation beach cleaner. Themachlne that we have is in poor condition and out dated.
The Parks and Recreation Department requires a self contained beach cleaner that can make tight radiustums and perform beach cleaning services in an efficient manner. The tight radius control ;llows formaneuverability around the life guard tovvers and other objects on the beach unlike the tow typeequipment. lt also has the ability to dump its trash into a dump truck on trash container. The CheningtonBeach Cleaner maximizes cleaning time due to it being one piece of equtpment and has the ability to runat 10 m.p.h. At tfris time Chenington Corporation is the sole manufacturer of a self contained beachcleaning unit.
This is a budgeted item for this years budget and will be financed by a lease purchase. The City of BocaRaton just purchased one of these machines. Cherrington Corporation will honor the same price to us.The cost to be s59,526.81 inctuding freight.

As you requested, I have reviewed Bud Palm's request to puchase a Cherrington
Corporation beach cleaner.
The request indicates the Cherrington Corporation is the sole source for this piece of
equipment. Based on Mr. Palm's research, the purchasing agent has not bid for the
requested item.
The 94/95 budget allows for the lease-purchase of this equipment. Eighty-eight hundred
dollars has been budgeted.
If the Commission approves the purchase, I will prepare an RFP {or financing either by
bank loan or lease-purchase which ever provides the most bene{icial rates.

Section 1. That the purchas'e of one self-propelled beach cleaner from Chenington
Corporation. P.O. Box A, Fairfax, Minnesota, 55332-0901, the sole source for manufacture and sale of
said equipment. for the amount of Fiffy-Nine Thousand Five Hundred Twenty-six and 81/100
($59,526.81) as set forth in Composite Exhibit'A", attached hereto and made a part hereof, be and
the same is hereby authorized and approved.
Section 2. That the city manager be and he is hereby authorized to pay from the General
Fund, Streets and Parks account, to Cherrington Corporation, the sum of Fifiy-Nine Thousand-Five
Hundred Twenty-six and 81/100 ($59,526.81) upon delivery of said equipment to the city.
Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are
hereby repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its passage

Please schedule an item for first reading for the December '13,1994 City Commission
meeting concerning the request to rezone 7.2834 acres at the northwest corner of
Taylor Road and NE 7 Avenue from lG-lndustrial General to IRO-lndustrial Research
Office. The owner of this site known as Parcel A of "Sea-Aire No.1" is South Florida
lndustrial Park lnc. Please schedule the public hearing for the January 9, 1994 City
Commission meeting.
The Planning and Zoning Board reviewed this request at their November 17,1994
meeting. The recommendation is to rezone the property as requested as the proposed
IRO zoning district is consistent with surrounding zoning and with the land use
designation on the Comprehensive Plan which is Employment Center.
At the November 17,1994 meeting it was found that this property was platted in 1984
and restricted to industrial use. A site plan was approved by the City of Dania for three
warehouse buildings totaling 88,920 sq. ft. A mitigation plan has been approved for this
site which includes a mangrove preservation area of 1.37 acres at the northern 310.26'
of the lot.
The present zoning district of lG allows all the permitted uses of both the IRO and lR
zoning districts. The IRO district has broader uses listed in the special exception
categories. Commercial uses such as a car leasing agency or hotel are in the IRO
special exception listing. The applicant intends to request a car leasing facility for this

site in the future. Such a use requires the use of flexibility zoning. Rezoning allows the
ability to request a special exception for a car leasing facility. Such a request would
require a number of city reviews of a specific plan including assigning flexibility units'

The adjoining property to the west and to the south is zoned lRo. The property to the
east is zoned lG. The property to the north is road right-of-way owned by FDOT
commonly known as "Mount Dania".
As the proposed rezoning is consistent with the comprehensive plan, is consistent with
surrounding zoning classifications, and the city of Dania will be able to review any

Please find attached City Ordinance Section I1-46.1 referencing Annual Fire lnspection
and Permit fees. This Ordinance was recently passed but contained some errors and
omissions of fee assignments. AIso, it did not cleady differentiate between lnspection fees
and permit fees.
It will be necessary to amend this section for clarity. I have made all the necessary changes
and the attached version is ready for first reading.

against all buildings and structures within the City to provide funding for the cost of
providing such fire safety inspection services, which annual fee shall be payable at the

Ordinance No. 06-92 was adopted on February 25' 1992. This ordinance added a
section to the code of ordinances concerning home occupations. The ordinance
provided definitions, provided standards and detailed restrictions for home
occupations. This ordinance was adopted with the stipulation that it uould erpire one
year from the effective date. Ordinance 07-93 extended the repealer provision until
September30, 1994.
It is recommended that the home occupation ordinance be extended. This is based on
the eperience thus far. To date 23 home occupation licenses have been issued
generating $ 1s22.OO in revenue. There have been no complaints of anyone violating
the terms and conditions of the ordinance. The Occupational License Committee
recommended continuation of home occupations at their october 25, 1994 meeting.

The "Home Occupations" ordinance was adopted and implemented February 1992.
Since that time and as of today, November l, 1994 there have been 23 Home
Occupational licenses issued, for a total of $1,822.00 in revenue. Also, as of today there
are 3 "Home Occupations" applications that are pending approval.
Additionally, there have no complaints regarding any business violating the terms and,/or
conditions of the "Home Occupations" ordinance received to date.

The Plan Administrator Marie Jabalee, has requested thatthe actuarial impact statement which projects costs
for a change in the basic formula for the general employees retirement plan from 2Yo lo 2.5Yo, be placed as an
item on the next regular Commission agenda for discussion.
Any benefit change as it affects members of the collective bargaining unit (AFSCME) must first be negotiated
during regular negotiations. The cunent contract expires in September 1 995, and we expect to begin
negotiations in mid-March 1995.
The Commission can take unilateral action on non-bargaining unit personnel including the Commission
members themselves. A separate cost estimate has been provided for each group.

DATE: November 28, 1994
A public hearing is scheduled forthe December 13, 1994 City Commission meeting
concerning the request for variances by Thomas Sweeney, 35 SE 12th Skeet. The
variances requested are from the minimum lot frontage and lot area requirements for
the RD-6000 zoning district as listed in the Schedule of Lot, Yard and Bulk Regulations
of the Zoning Code. The request is to construct an addition to the existing single family
residence. The minimum frontage requirement is 60' and the minimum area
requirement is 6000 sq. ft. The subject property has 40'offrontage and 3680 sq. ft. of
area.
The Planning and Zoning Board reviewed this request at their November 17 1994
meeting. The recommendation is to approve the variances as requested (4-0). The
Planning and Zoning Board found that the criteria for granting a variance as described
in Section 10.13 of the Zoning Code had been met.
The proposed 329 sq. ft. addition is to the rear of the existing approximately 600 sq. ft.
house. The proposed addition meets setback requirements. Other lots in the
neighborhood are 40 ft. wide as well. No property is available for purchase to increase
the lot size. A variance is necessary to build any improvement on this site. The Planning
and Zoning Board felt the addition would upgrade the property and neighborhood.

NOTICE lS HEREBY GIVEN that the Planning and Zoning Board on November 17, 1994 and the

A public hearing is scheduled for the December 13, 1994 City commission meeting
concerning the request for a variance from height regulations of the Zoning Code by St.
Ruth,s Baptist church, 145 NW 5 Avenue. The request is to construct a23%' steeple
with an overall height of approximately 47%' . the site is located within the RD-6000
zoning district. The schedule of Lot, Yard and Bulk Regulations allows a maximum
building height of 25' in the RD-6000 district. section 5.22(a) of the Zoning code
permits an additional 40 percent or 10' for a total of 35' for a church steeple.
The Planning and Zoning Board reviewed this request at their November 17, 1994
meeting. The Planning and Zoning Board found that the request complies with the
criteria ior a variance in Section 10.13 of the Zoning Code. The recommendation is to
approve the variance (4-0).
The site is located at the southwest corner of NW 5 Avenue and NW 2 Street. The site
is zoned RD-6OOO, as is the surrounding neighborhood, which is developed with houses
and duplexes. Testimony given to the Planning and Zoning Board indicated the
proposed steeple is the smallest (shortest) available. The Planning and Zoning Board
felt the steeple would beautify the building and thus improve the neighborhood.

A public hearing is scheduled for the December 13, 1994 City Commission meeting
concerning the request for variances by Joy Bailey for property at 321 NE 2 Avenue.
The variances requested are from the minimum lot frontage and lot area requirements
for the RD-6000 zoning district as listed in the Schedule of Lot, Yard and Bulk
Regulations of the Zoning Code. The request is to construct an addition to the existing
single family residence. The minimum frontage requirement is 60'and the minimum lot
area requirement is 6000 sq. ft. The subject property has 45'offrontage and 5625 sq.
ft. ofarea.
The Planning and Zoning Board reviewed this request at their November 17,1994
meeting. The Planning and Zoning Board frond the criteria for granting a variance as
described in Section 10.13 of the Zoning Code had been met and recommended to
approve the variances as requested (4-0).
The existing house is roughly 750 sq. ft. The proposed 12'x29'E" addition would be to
the south side of the existing building. The proposed addition meets setback
requirements. The lot is located on the west side NE 2 Street. This block is zoned
RD-6000. Lot sizes vary from 45' in width to 86' on this block. There is one lot to the
north and then the Dania Cutoff Canal. To the east of NE 2 Avenue is a finger canal
and the adjoining property to the east is zoned RS-8000. The property to the west is
zoned RD-6000 to NE 1 Court and then C-3 to Federal Highway.
The Planning and Zoning Board felt the addition would upgrade the neighborhood and
indicated that any improvement would require a variance. The adjoining property owner
to the south was represented at the meeting and indicated the property would be more
appropriately used for landscaping. The representative also stated that city policy was
for a minimum frontage of 50' and that no hardship was shown.

NE 7 AVENUE
Several items are scheduled for the December 13,1994 City commission meeting
concerning the request to utrlize 17.749 acres on the east side of NE 7 Avenue for a car
leasing faJility including storage, service and repair, specifically Hertz Rent A Car. This
facility-would'replace the current location east of the airport terminal comp.lex. Public
hearings are scheduled for the review of allowing such a commercial use in an area
design-ated as Employment center on the land use plan, review of the request for the
speclal exception ugof car leasing facility in the IRO zoning district as well as the
petition for three variances. The request for site plan approval should also be
scheduled.
The Planning and Zoning Board reviewed these petitions at their November 17 ,1994
meeting. A 6rief descripiion of each request and the recommendation of the Planning
and Zoning Board follows below.
1. LAND USE FLEX (LUF-32-94)
This request is to allow a commercial use Icar leasing, storage,service and limited
repairl within an area designated as Employment center in the city of Dania
Compiehensive plan. Section 16.40 (b) (4) of the Zoning Code indicates such a car
leasing facility is determined to be an employment center use provided that the
combined land area does not exceed twenty percent of the land in a flexibility zone.
The Planning and Zoning Board recommends approval of the commercial use as it is
compatible with the uses listed as being permitted in the Employment center
designation (4-0).

This land use designation ls defined as areas encouraging non-residential
development, compatible with residential and less intensive land uses, and which
support the tourism oriented segment of Dania's economy as well as high technology
and service based activities. A car rental agency is service based and serves the
tourism industry. ln this flexibility zone there is capacity for such a commercial use.
The site is within Flexibility Zone 79 which has 44 acres of commercial flex area
remaining. The site is 17.749 acres.
2. SPECTAL EXCEPTTON (SE-33-94)
This request is for a special exception use for a car leasing facility including storage,
service and repair for property in the IRO zoning district. The Planning and Zoning
Board found that the request complies with the criteria for reviewing special exceptions
in Sections 6.40, 10.12, and 16.40-'16.70 of the Zoning Code and recommends
approval (4-0).
The use is a listed special exception use in the IRO district. It is compatible with
adjoining development which includes a mini-storage building and vacant land. lt was
found that the proposed use is compatible with the intended purpose of the district in
which it is located. This is primarily a tourist related activity which is listed as being
allowed in the Employment Center land use designation. The proposed plan conforms
to applicable regulations including access and landscaping. The proposed use is also
consistent with the approved plats. The Port Everglades Commerce Center is restricted
to 400,400 sq. ft. of general industrial. Parcel A of the NISA Plat is restricted to a 3'10
room hotel. A delegation request has been filed to allow 13,804 sq. ft. of commercial
use on both Parcel A and B of the NISA Plat. This generates the same number of trips
per day. The delegation request cannot be heard until the City of Dania reviews the
development plan as submitted. The Planning and Zoning Board felt this use would be
a good use ofthe property.
3. Variances (VA-34-94)
A. The first variance requested is from Chapter 26, Vegetation, Section 26-48 which
requires no more than 12 parking spaces in a row without a landscape island. The site
plan indicates areas of car storage with up to 26 spaces without a landscape island.
The Planning and Zoning Board recommends approval of the variance (4-0). The
landscape plan meets the requirement for total number of trees. The trees have been
placed where they are more visible to the public near NE 7 Avenue rather than in the
car storage rows. The Planning and Zoning Board felt this would be in the public
interest. lt was noted that there is a large green space between NE 7 Ave. which is
owned by Broward County. The petitioner indicated the possibility of adding
landscaping to this area would be discussed with the Broward County Aviation
Department prior to the City Commission meeting.

B. The second variance requested concerns the area and height of a proposed pole
sirt$ Section 3-38 (1) of the Dania Code of Ordinances permits an area of 100 sq. ft.
an'd a height of 20' in the IRO zoning district. The request is for a sign with an area of
200 sq. ft. and a height of40'.
The Planning and Zoning Board recommended approval of the request for the height of
40' but did not recommend exceeding the 100 sq. ft. of area permitted by code (4-0).
The recommendation was based on meeting the criteria for granting a variance found in
Section 10.13 of the Zoning Code. The site is located east of Federal Highway with
visibility to the site impaired by "Mt. Dania' as well as frontage roads, landscaping and
ramps onto l-595 and access roads to the airport. This was determined to be a unique
circumstance and hardship for the petitioner. The Planning and Zoning Board was
hesitant to recommend a variance for the size of the pole sign' A concern was
expressed that a comprehensive focus needs to be made on signage directing attention
to the area east of the airport.
C. The third variance requested concerns a request for two wall signs. Section 3-38
(2) of the Dania Code of Ordinances allows one wall sign in the IRO district. The area
of said sign is not to exceed 60 sq. ft. The request is for a 60 sq' ft. wall sign on the
north elevation of the building and for a second wall sign on the west elevation which is
proposed to be 1 10 sq. ft.
The Planning and Zoning Board recommended approval of the second wall sign at 1 10
sq. ft. indicating that the sign fit the scale of the building and once again referring to the
remote location of the building from the areas which visibility is needed [l-595, Federal
Highway, airportl.
4. S|TE P|-AN (SP-36-94)
Should the previous petitions for use of flexibility units, and special exception be
granted then the site plan can be considered. The Planning and Zoning Board
recommends the site plan for the car rental facility be approved.
The proposed site plan entails 17.749 acres with 13.328 acres north of the existing
Federal Self Storage Building on NE 7 Avenue and 4.421 acres south of the same
building. A customer service building , storage building, VIP building, and car wash with
a total building area of 20,780 sq. ft. is proposed on the northern portion of the site.
This 13.328 acres is Parcels B and C of the Port Everglades Commerce Center Plat.
Parcel C is a mangrove preservation area and no building are proposed. The 13,636
sq. ft. maintenance building is proposed on the 4.421 acre southern portion of the site
known as Parcel A of the NISA Plat. This requires a delegation request to change the
note on the plat from a 310 room hotel which is pending per the review of the request
for the car rental facility.

Access to the site is available over easements reserved when the sites were platted.
The recommendation is to approve the site plan as it conforms to the bulk requirements
of the Zoning code. Parking is sufficient as the site is primarily car storage. variances
were requested for signage and for the location of landscape islands. The overall
amount of landscaping shown exceeds city requirements. Preliminary engineering
indicates adequate water, sewer and drainage.

Date:November 30, 1994
An item scheduled for the December 13, 1994 City commission meeting is review of a
site plan for the property at 212 North Federal Highway. The proposed addition is to
the east of the existing structure which is used for a commercial establishment selling
coffee products. Six existing structures are proposed to be demolished. These are
small buildings formerly used as motel units.
The Planning and Zoning Board reviewed this site plan request at their November
'|.7 ,1994 meeting. The recommendation is to approve the site plan as rt conforms to all
applicable requirements of City Code.
The 37,830 sq. ft. site is zoned C-2. The surrounding area to the north. south and west
is also zoned C-2 and is developed with commercial uses along Federal Highway. The
property to the east is zoned RD-6000 and is developed with duplexes and single family
residences.
The proposed buiiding would total 12,298 sq. ft. and be used for retail and office type
uses including the existing coffee equipment sales and office tenants. The building
addition would extend easterly of the existing Victoria L'Originale along the south
property line. Parking would be on the north and east of the building with one access
point from Federal Highway. A total of 53 parking spaces are being provided. The
landscape plan conforms to buffering requirements including a wall along the east line
abutting residentially zoned property.
The recommendation is to approve the site plan as it conforms to all applicable codes

Re:SP-38-94 Request For Site Plan Approval for a Dunkin Donut Shop at the
Northwest Corner of Federal Highway and SW 6 Street
Date:November 28, 1994
An item scheduled for review at the December 13, 1994 City Commission meeting
concerns the request to construct a new commercial structure at the northwest corner
of Federal Highway and SW 6 Street. The petitioner is Mr. Ali Hussaim, the owner of
the property.
The Planning and Zoning Board reviewed this request at their November 17, '1994
meeting. The recommendation is to approve the site plan as it conforms to all
applicable ordinances.
The proposed site is 21,300 sq. ft. or .49 acres. The property is zoned C-3. The site is
vacant but was formerly the site of a service station. The proposed use is a permitted
use in the C-3 district. The C-3 district fronts both sides of Federal Highway. The
adjoining site to the west is zoned RD-6000 and is developed with a single family
residence. The proposed 4200 sq. ft. building includes a drive-thru window.
The proposed site plan conforms to all applicable ordinances including being a
permitted use, meeting all bulk requirements such as setbacks, meeting parking
requirements and meeting requirements of the landscape code including the required
buffering along the western property line which abuts residentially zoned property.

This City of Dania joins with the seven (7) Cities now seeking legislative relief
from the requirements to obtain a Certificate of Public Convenience and
Necessity from the Board of County Commissioners for delivery of advanced life
su pport transport emergency med ical services.
We are in support of the local bill they have filed. We urge you to begin a
dialogue with all Cities, abandoning the current proposed conceptual plan but
focusing on this urgent matter.
We see no basis for the Board of County Commissioners not supporting this
legislation or alternatively granting Certificates of Public Convenience and
Necessity to these Cities as well as any other applicant City immediately.
Much can be done now by all parties to put in place the needed resources to
alleviate any further system failures.

(ALS) EMERGENCY MEDICAL SERVICE SYSTEMS
WITHIN MUNICIPAL FIRE RESCUE DEPARTMENTS;
REQUESTING THE BROWARD LEGISLATIVE
DELEGATION'S SUPPORT OF A SPECIAL ACT AND
GENERAL LAW EXEMPTING MUNICIPALITIES FROM THE
REQUIREMENTS TO OBTAIN A CERTIFICATE OF PUBLIC

WHEREAS, the City of Dania, Florida, currently provides advanced life support
medical services within its municipal boundaries; and

WHEREAS, the City Commission of the City of Dania unanimously supports the
Fire Rescue Department's commitment to provide the best quality advanced life support
system, patient care and transportation; and
WHEREAS, the City Commission of the City of Dania is commifted to maintain
quality response times and the quality of service to all the residents of the ci$; and

WHEREAS, the State of Florida currently has sufficient laws, rules and
regulations concerning the local operation of advanced life support services, specifically
F.S.401, and 10d-66; and
WHEREAS, the City Commission of the City of Dania supports home rule
authority and the municipal right to decide the level of service provided to its residents;
and
WHEREAS, the City of Dania has the local governmental power, authority, and
responsibility to protect and preserve the lives, health, safety and welfare of the city's
residents and visitors; and
WHEREAS, legislation has been filed with the local legislative delegation
exempting municipalities from the requirements to obtain a Certificate of Public
Convenience and Necessity (COPN) from the county in which the municipality will
operate; and
WHEREAS, the City Commission of the City of Dania deems the proposed
legislation to be in the best interest of our residents and visitors.
NOW THEREFORE, BE IT RESOLVED BY THE CIry COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1. The City Commission of the City of Dania strongly supports the
proposed legislation and urges the Broward Legislative Delegation and the entire State
Legislature to act on and pass the bill as proposed.
Section 2. That all resolutions or parts of resolutions in conflict herewith be and
the same are hereby repealed to the extent ofsuch conflict.
