HomeMy WebLinkAbout1994-03-15 Workshop City Commission Meeting MinutesROLL GALL: Present: Mayor: Vice Mayor: Commissioners: City Manager: City Attorney: City Clerk: Commissioner Bertino - yes Commissioner Jones - yes Mayor Grace - yes MINUTES DANIA ClrY COMMISSION WORXSHOP MEETING MARCH 15, 1994 Bobbie Grace Bob Mikes John Bertino Bill Hyde Albert Jones Robert Flatley Frank Adler Wanda Mullikin Commissioner Hyde - yes Vice Mayor Mikes - yes Airport lnterlocal Agreement with Broward County Mayor Grace stated that persons would be given a three (3) minute time limit when addressing the Commission regarding the Airport Expansion Litigation. Vice Mayor Mikes made a motion to allow persons who are representing a group or organization a five (5) minute time allowance instead of three (3) minutes, seconded by Commissioner Hyde. The motion passed on the following roll call vote City Manager Flatley mentioned the frustration that staff and the City Attorneys have experienced with the County during the negotiating process on the airport issue. He mentioned that the Commission held Special Sessions during this time to devblop legal strategies on behalf of the City and that the transcripts of those meetings would be available to the public after the litigation is resolved. WORKSHOP -PUBLIC AIRPORT MEETING 1 MARCH 15, 1994 Attorney Ed Curtis presented the recent draft of the lnterlocal Agreement and the 1994 Master Plan and Part 150 Study. He then presented an overview of the intent of the Agreement: *The annexation/deannexation of lands*The jurisdiction and result of the deannexation/annexation*The restrictions on runway use*The mitigation of noise as a result of the runway use 'The replacement of tax base and infrastructure lost by the expansion Mr. Curtis mentioned that his office is recommending some language changes in the technical aspects on the dismissal of the litigation and on the relinquishing of policing powers in the lnterlocal Agreement. He recommended that these changes be included prior to the Commission taking action on adopting or denying the agreement. Earl Gallop, Esq. clarified that the affect of the agreement will be to divest the City of Dania from DRI Regulatory Jurisdiction and that the County has made a tradeoff for this loss of power with issues as explained by Mr. Curtis. Further comments related to the permitting process that the County will have to go through in order to go foruard with the runway expansion and whether or not the County's main objective is to remove Dania's DRI power. Mr. Gallop advised that Dania would no longer be a permitting entity but rather a commenting entity only in the DRI Process if the lnterlocal Agreement is accepted. Vice Mayor Mikes stressed the need for Dania to retain their power in the DRI Process to go before the Broward County Regional Planning Council and eventually the Governor's Cabinet on this issue. Commissioner Bertino stated his feelings that Dania has to be realistic in regards to this project and that the County has more power than Dania in the DRI Process. Mr. Gallop stated that the lnterlocal Agreement provides for the best possible benefits for noise mitigation than the City can expect to achieve in the DRI Process as the DRI Process is not set up to provide noise mitigation relief unless the City has the political muscle as well as the staying power to influence the Regional Planning Council and Governor's Cabinet. Commissioner Bertino said that this lnterlocal Agreement provides Dania with better restrictions on runway use and operation than has been granted to any other City in the United States dealing with airport expansion. Vice Mayor Mikes stated that the State of Florida is much further ahead in Comprehensive Planning and the DRI Process than most States and that airport issues in states like Texas cannot be compared with Florida. Mayor Grace opened the public hearing at this time and asked those individuals who were representing special groups to come forward first. She asked City Clerk Mullikin WORKSHOP -PUBLIC AIRPORT MEETING MARCH 15, 1994 2 to limit their time to five minutes each and all other citizens to be limited to three minutes. Several residents came foruard to speak in favor and opposition and the Commission gave their individual opinions on the pros and cons to the lnterlocal Agreement. For the record, Mayor Grace asked City Clerk Mullikin to read a letter from Gloria Daly to the Commission encouraging settlement on the airport issue. After the letter was read, Judy Usifer apologized to City Clerk Mullikin for the negative comments that were made by some citizens who did not agree with the comments in the letter.
