Broward County has enacted two new ordinances which are now affective on a cotrnty wide basis. Broward Coun$ Ordinance 93-10 titled'Tree Preserrration" and 'Tree Abuse" are being enforced by the Departrnent of Nafural Resource Protection. Ths orrdiffnce allows for a municipality to adopt their own ordinance as long as it is as stringent as the county's. Our existing ordinance is not as skingent and will not qualifu in this case. If this ordinance is not adopted then the county will be enforcing the tee remoual and tee abuse ordinances. Therefor I have prepared a new ondinance which is almost a direct duplicate of the county's and have also revised our o<isting landscape code to bring it more up to date. Briefly, the new Tree Preseruation ordinance provides for the following: (a) (b) (c) (d) (e) (0 Exempts single-family and duplo< with the o(ception of kees removed prior to a C.O. or the remouai of Historical or Special Stah:s Trees. Provides for the issuance of a tree remorral/relocation license. Provides for tee replaccment. Provides for payment in lieu of replacement/relocation. Provides for the creation of a Tree Presenration Trust Fund' Provides for bonding in cerbin circumstances. ,1 The landscaped section has also been revised and contairs the following provisiors: I (a) (b) (c) (a) (b) (c) (d) (e) 0 ';lThe new Tree Abuse Section provides for the following:,.1 The kimming of bees to be in accordance with National Arborist Association standards. Does not exempt single{amily of duplex. Provides for Remedial Actions. Provides for the upgrading of existing parking lots under conditions. Provides for a 10 foot landscape buffer adjacent to public rights-of-urays with 1 tee per qtery 30 feet and a continuous hedge, wall of other durable landscape barrier. The code now requires a 5 foot landscape buffer. Provides for a 5 foot landscape buffer between parking lots and the adjacent property with 1 tee every 4Q feet and a continuous hedge, wall or other durable landscape barier for residential multi-family projects. Provides for interior landscaping for all vehicular use areas. hovides for site triangles adjacent to public rights-of-way, Provides for the landscaping of all non-vehicular open space based on a percentage of the site. Provides for a 10 foot landscape buffer between commercial, business and indushial properties when they abut a residential properiy which indudes a 5 foot masonry wall or solid wooden fence, tees anery 40 feet, and a hedge on the residential side of the wall. Provides for irstallation requirements. Provides that a min. of 40o/o of the plant material be native to South Florida. Provides for irrigation in compliance with South Florida Water Management Regulatiors. This article shall be known and may be cited as the Tree Preserr.ation frinance of the Gty of Dania- S,ECTION 2672 Declaration of Intent The City Commission of the City of Dania (the "Commission') finds and declares that preserlration of hees is integral to the preservation of air and water pollution in that trees use their leaf zurface to trap and filter out ash, dust and pollen in the air, thereby helping to alleviate air polhttion: that the root q6tems oI trees hold and consolidate soil and other loose earthen materials, thereby helping to pre\€nt erosion, redtre non-point source water pollution and maintaining the continued vitality of natural habitats for propagation and protection of wildlife, birds, game, flsh and other aqr.ratic life; and that removal of trees causes increased srrface nrn-off which conbibutes to water polluUon. Grdng to the many benefits proided to the community by tsees, it is the intent of the Commission, in order to protect the air and water of the 6ity of Dania, to pres€rve this yaluable natural resource of the Gty for the health, salety and welfare oI the general pgblic. While the desbuction of a single be€ may not har,e a significant environmental impact, the Commission recognizes that tree destruction has a cr.rnulative impact that causes s€!,€re environmental degradation and causes s€!€re deterioration of the quality of lile in Dania and, because of this impact, the Commission fin& that t ee destruction is a public nuisance that mr:st be controlled. Any person who possesses on the effectir,rc date of this Arttcle a valid Crty tree removal permit issued under the Gty of Dania Code of Ordinances will not be required to obtaln a tsee remorral license under this secfion. 2. Land der.elopment activiges that do not require a site plan of building permit sha.ll obtain a tree remorral llcense under this section tnrless: (a) Another valid tsee removal permit has been obtained prior to the effective date of this Article, and SECIION2Gl6. ExcePtlons- 1. As provided for in Article l, Sec. 26-1 and Sec. 26-3; or 2. Remoral of tsee species occuning in regulated wate6 as defined by Sections 27'331to 27- 339 of the Broward Counq Code of Ordinances when the mfigadon reqr.rircd by that Iicense for the removal of the trees is equal to or greater than the replacement requiremenb of this Article; or 3. Tree removal may proceed after the expiration of the 15 day period, providing no letters of appeal have been recaived by the Crty, if the utility can: (a) prove prior to Uee remoral that: (1) the tsee will cause a continual disn:ption of servlce (specimen palm tsees may be removed trnder this exemption), (21 the easement or property was in actual use conveying utilifles prior to the elledve date of this section, and (3) the threat oI service interruption cannot be remedied by tree pruning in accordance with National Arborist Association Standards or palm pn-tning in accordance with the standar,& Iisted in "Arboriculh.re Second Edition- fu Richard W. Harris, as amended, or: (b) provide prior to kee remorral that the removal is for the purpos€ of providing neVadditional on€ite service to existing dwelopment. Under this provision, the notification shall be in writing prior to the tree removal. Haris, as amended, SECIJON 2G17. License APPllcatiod An owner of fee simple tide may apply for a tee rerno,.ral license. Alter arbmitting certifted approval of the fee simple ourner, the agent of the owner, the lessee of the property, optionee, contract purchas€r, or holder of an easement may apply for a tree remorral license. A holder of an easement may obtain a license on! when the proposed bee remo',ral is consistent with the r.rse granted by the easement. The Gty shall require that any bee surve!6 or site plans be prepared by any penon qualified to do so under the Laws of Florida. 1. The amount of the fee shal be as established by resolr.rtion of the Dania Crty Commission. (b) The ltcense application filing fee ts not refirndable and may not be applied to any license applicaflon other than the one for *rhich it was originaly paid. (c) For any srbotantial deviadon from the original applicafion there shall be an additional fee. SECTION 2618. Tree Remooal Ucense 1. The Crty may conduct a review or site inspection. A kee may be removed only trfien an applicant has demonsFated to the Gty that the proposed danelopment cannot be located on the site without the removal of the tree, and that there is no practical rray to a\roid bee remoyal. ln determining iI the applicant may remove bees pursuant to a bee removal license the Cip shall consider at a minimum the following: (a) The applicant has made every rearcnable effort, consistent with the plan of development, to incorporate existing trees and to minimize the number of tees removed; (b) The trees proposed to be removed are the minimum number necessary; and (c) The tees proposed to be remor,ed are of poor quality and appearance, are damaging €xisting impro'.rements, are oeating ongoing safety problems for oristing development, or are growing h too clos€ proximity to other hees to permit normal growth and development of affected bees consistent with good foresty pracdces. The appllcant mtst relocate the trees to be removed. If relocation is not a viable so[dion, an applicant shall replace removed trees. If it is determin€d that an applicant cannot relocate nor replace removed bees, the applicant strall pay the appropriate fee into the Tree Preservation Tnst Fund, A determination of the extent of environmental lrnpact by the project development as covered by the scope of this Artide shall be performed by the City. This determinaflon shall be based upon drawings or site plans and a completed tree remorral license application Iorm s$mitted to the City by the applicant. Any damage to any other tree in the site shall constitute a violation ol this Artide' Duration- A license shall be r,alid for the development for not more than two (2) years from the date of is.suance. A one tlme o<tension of up to two yeaE may be issued provided there is no suHantial deviation from the original apptcation and the license extension compltes with all standards in effect at the time of the license extension. Additional conditions may be imposed in the license ec<tension when there is a change in site conditions that may ellect tees. Where any activip regr:lated fu the tree removal license has occlrred, the licensee must comply with all conditiors of the license anen though the license may ha',e exPired. SEC ON 2C79. Tree Relocation 1 Before the crg iss:es a tree remoyal licznse that allows the replacement of any tsee, the 4 5 6 , applicant must demonstrate that reloc.aton is not a viable altemauve. Relocauon shall occur either within the site or offsite with the concr.rrence of the Gty, where the site is pr:blic property, or with the concrrrence of the property owner, where the site is priyate prop€rty. The site shall be in reasonable proximity to the origina'l site and have physiographic conditions similar to the original site. If any tee is to be located either on- site or off-site, a relocation plan shall be sr:bmitted. Relocation plars, as required fu this Section, must first be reviewed and approrred prior to granting the tree remo,ral license. Be{ore a license is issued for tree relocatlon, performance bonds may be required to be postd. If the kees have a dormant period, they shotrld not be kansplanted during that time. Trees shou.ld not be kansplanted dudng periods of strong, dry winter winds or during droughb. Adequate spaces lor root and croum der,elopment shall be provided. Trees shall be root and canopy pruned accorrding to sound abroriculfural standards prior to transplanting. During and following fansplanting, the root ball and tnmk shall be protected. The root ball must be kept moist at all times. Transplanted tees shall be braced for at least one year. Transplanted trees shall not be fertilized at plantlng time, hn shall be watered stdficiently until the tree growth is re-established. All crown pruning shall be done in accordance with Nationa.l Arborist Association standards or palm pruning in accorrdance with the standards listed in "&boriojtrrre Second Edition" by Richard W. Flarris, as amended. SECflON 2620- Tree Replacement 1. Replacement Crlteria - Trees that are remolpd and not relocated shall be replaced so that there is, at a minimurn, no loss of tree canopy coverage upon mafurity of the replacement bees. Performance bonds may be required to be posted. The following procedures shan be used to determine the hee replacement requirements. (a) Tree canopy cowrage on€ite shall first be daermined rsing one or any combinatlon of the following methods: review of aerial photography, on*ite inspection, or review of a bee survey. The City shall require the applicant to submit a kee survey in order to make this determination, unless the appllcant can demonshrate that ls clearly unnecessary. The original licensee and owner of any property on which trees have beer replaced or relocated shall place of record a notice that shall lnform subsequent purchasers, assigns and occupants of the replacement site, that tees on the replacement site may not be removed without a valid tee remo',al lcense SEC ON 2G21. General Relocation/Replacement Conditions 1. Any bee remaining on€ite shall not be unneces.sarily damaged while relocating bees or planting or preparing the site for any replacement kees. 2. Replacement or relocated hees shall not be placed where they will interfere with atisting or proposed utilities, either above or below ground. Acceptable trees that can be planted in the vicinity of overhead power lines are listed in Appendk 2. 3. Where practicable, replacement tee species, installation methods and maintenance methods shall follow xeriscape principles. 4. The licensee shall replace each hee specified in the license within a time period of up to six months with Crty approval. A time adension may be gnnted if fi:ture construction will endanger the replacement trees. However, where an extension for planting has been granted, each tree specified in the licerue must be replaced prior to appro,ral of a Certificate of Occupancy or Completion. 20 I 'l J 4 5 6 7 8 9 l0 ll t2 t3 l4 r5 l6 All relocated or replacement trees shall be located where they will have adequate space for root and canopy development, except where small bees planted in close proximity to one another are to be later relocated to other areas of the site- Where practicable, kees shall be relocated or replaced within the City from which the original trees were removed. Relocated or replacement trees which may reach a height of 30 feet shall not be placed within 20 feet of an owrhead rn ity line. SECflON 26 - 22 Maintenancelt4onitodng Requirements l. The licensee shall be responsible for maintaining the health of any replacement or relocated tree for one (1) year from planting. 2. Determination of Success - (a) The licensee shall determine the condition oI each Eee one year after the tsee was relocated or planted. This determination shall be submitted to the Crty for approrr'al within thirty daf,s of b€ing mad€. If that replacement tee is found not to be viable at the end of the second year monitoring p€riod, the licensee may pay the appropriate amount into the Tree Presenration Tnrst Fund as required by Sed,ton 2623 in leu of planting a third replacement tee. lf the licensee fails to replace the tree or to pay the appropriate amount into the Tree Presenration Trust Fund within sixty (60) daf,s, then the licensee shall be in violation o[ this Section. Large Scale Pro.iecG - lf a tree remoual license includes the relocation of l0 or more trees, or the planting of 100 or more replacement trees, the determination oI succers for the overall relocation effort shall be braced upon a percent suruiyal rate. SECflON 26 - 23 Payment In Lieu of Replacement/Relocatlon When a.llowed by a tree remoual license, any bees which are removed and not relocated shall be replaced in accordance with the requirements of this Article. As a condition of being granted p€rmission to remot/e any trees, the developer, property owner or other applicant shall be required to replace trch bees, unless it is demonstrated that replacement is not a viable altematitre due to a lack of arrailable space. Where replacement cannot be accomplished the applicant.hall pay a replacement fee in lieu of ach:al bee replacement costs into the City of Dania Tree Preservation Trust Fund. A schedr.rle of current yalue of replacement trees plus installation costs which will be ue to calcr.rlate replacement fees shall be established by the City, approved by resolution fu the Commission and updated as necessary, SECIJON 26 - 24 Speclal Slalus Category Trees Propcts containing Special Stahs Category Trees are zubject to the following additional criteria: 1. Criteria and procedures for designatton as a Nahr:al Forest Community. (a) On the effective date of this ordinance all [APC's, NRA's, LJWA's and ESL's which have been rc designated fu Broward County that lay in the City of Dania shall be designated as a Natural Forest Community. (b) The designation of other real property as a Natural Forest Community shall be made by the Commission folloring a public hearing. Belore a site is deslgnated as a Natural Forest Community, the Commission shall make a finding that the Nah.nal Forest Community is at least two acres in size, is generally comprised of a canopnT, subcanopy and groundcowr, and is populated fu natft/e t egetation associated with one or more of the following communitles: (1) Beach and Dune Community 22 ,, 3 4 5 6 7 8 9 l0 ll 12 l3 t4 l5 l5 l7 t8 l9 20 ll n 23 24 5 :6 !7 (c) t2\ A community composed of unconsolidated sand facing the ocean and shaped by the wind, waves, currents, and tides. High Hammock Community This communip develops slowly as organic material accumulated oeating a fa',rorable land elerration. The pres€nce of a h.igh hammock indicates that the site has been undishlted for a period of time. High hammoc&s are among the most diverse systerns in South Florida containing more that 100 species of trees and shrubs, characteristic Eee species include: Iive oak willow bustic, lancewood, mastic strangler fig, satinleaf, mulberry, Simpaon stopper. Shrubs lnclude a variety of fems. Developed areas may also be in this classification. The community does not necessadly have to be vacant land. The Gty Commission shall direct the Gp Manager to publish and mail or hand deliver a notice of public hearing to consider designation of a site as a Nah:ral Forest Communip. Notica of hearing to be held by the Commission to corsider designation of a site as a Natural Forest Community shatl be those required for a City Commission Public Hearing. In addition notice shall be malled or hand delivered to the effected property ouners at least fifteen (15) dap prior to the hearing date. Such notice shall state time, date and place of the hearing, the location of the property under consirJeration, the ecological community or communities alleged to be included within the property, and the effect of the designation on lands classified as Nafural Forest Communities. In addition a map depicting sites designated as Natural Forest Communities shall be maintained at the Crg for viewing by the public. Natural Forest Communities Trees may be remo,;ed provided that the applicant adheres to the following presenration requiremenb to the extent determined to be practicable by the CrtY: (a) Any areas identified during the licensing process as providing habitat to listed species in the most recent v€rsion of "Official List of Endangered and Potent'rally Endangered Fauna and Flora in Florida" hy the Florida Game and Frashurater Fl*r Commission shall be identified and preserved. (b) Areas of high wildlife utilization onsite shall be ldenfrfied and preserved. (c) Areas which contain relatively undistub€d canopy andlor hat,e good skatificadon of corzer (e.g. canopy, sr:bcanopy, ground cowr) shal b€ identified and preserued. (d) Utility line installations shall not be located in presenntlon areas. (e) Resource Management Plan: Any proposed development activity which wouH negatively impact the Natr.rral Forast Community must be mitigated through a Resource Management PIan, approwd fo the Gty, which significantly impror,aes the viability of the remainder of the resource. No Tree Remorral License shall be issued until an agreement providlng for the lmplementation of the Resource Management Plan has been executed and recorded, and any covenants, eas€menb or physical improvements required by the plan are in place. Conserrration Easement: As a condition of an issrance of a license under this s.rbcategory where pres€rvation is required, a conserv'aton easement shall be granted fu the applicant to the City and the citizens of the City. The conservation easement shall: (1) be dr:ly executed and recorded and placed on the face of the plat, (21 meet the approval of the Gty Attomey, (3) prohibit land dearing, development or other harmfirl activity on the preserved portion of the Natural Forested Communi$, (4) allow access to the consenrauon easement by agents of the City of Dania to conduct sh:dies, inspection, and other activiffes corsistent with the p.rrpose of the conseruation easement, and (5) need not provide for access by the general prblic. (3) Specimen tees - Projects or properties containing Specimen Tree{s} are subject to the following additional criteria: (a) Specimen tsees are subject to the presenration and relocation criteria of this Anide. The letters of credit and certificates of deposit shall be drawn upon banks or savings and loans legaUy and actually doing business in Florida. Such bonds mgst meet the approval of the Gty Attomey's Office. This bond shall by in addition to any other bond-requircd hy any other govemmental entity. l. Bonds shall be required for licenses involving the replacement of ten or more hees, or the relocation of five or more bees, or the relocation of any tee with a DBH of ten inches or greater. 2. Calcr:lation for the amount oI bonds shall be computed based upon the equiualent canoplr replacement criteria applied to each tree to be relocated or replaced, as provided in Subsection 25 - 20 and upon the cost of irutallation and maintenance. The fair market '.,alue of the cost of trees that would be required to compensate for the canopy to be related or replaced shall be posted. The bond period strall be {or the bee replacement performance pedod, as stated in the llcense or as extended or released, plus and addlfional 60 days. The form of seorrity shall be reviaped by the Gty Attomey's Office for legal sufficiency and may not be accepted untll appro'.red. 3. Release of Bonds (a) Upon srccessh.rl tee relocation and replacement as determined by this Artcle and written approrral h7 the Crty bonds required for tree relocation and replacement shall be released. The Gty of Dania may condition the release of the bond upon the establlshment of a new bond fu the new owner in fee simPle. Where the licensee plants fifty percent (50%) more that the required number of rephcement !,ees and establlshes a suitable maintenance plan to ensure the viability oI the replacement tsees, the Crty may recognize the additional replacement trees as suitable security in lieu of a bond. SECflON 26'26 Histoical Trees 1. The State, County, the Oty of Dania or any Historical Preservation Society recognized fo the commission may request that the o9 designate a particular tree or group of tees within its ju.isdicfion as a historical tree. Also, any Property owner may make a similar request providing the request is for a tsee of group of Eees located on property under his of her conEol or ownership, The request shall contain the e:<act locatton if the tree(s), the name and addrcss of the orrent owner and effected utilities of the land upon which the bee is loc.ated, and the reasons for requesting the designation' Upon receipt of the request, the Clty shall immediatety notfy th€ affected landowner and affected rnilides by certified mail of the requ6t. The particr:lar tee of $oup of hees which is the subject of the request shall not be remor,rcd until the designation request has been acted upon by the Commission. Consideration by the Commission: A public hearing shal be scheduled within sb<ty (60) days of receipt of the request to consider the matter. When the person(s) requesting this designation !s not the property owner, fre property owner shall be notified oI the request and the time, date' and place of the hearing. As used in this arfide, the following words and terms shall be defined as set forth herein: (a) Enforcement Ageacy The Code Enforcement Dvision of the Gty of Danh ls (b) designated to enforce this ardcle. SECTION 26 - 34 lzgislatlue Findings In addition to those Iegislatiw findings relating to the importance of tee to the public set forth under Section 26 - 12 of he Gty of Dania Code of Ordinances the Commissioners of the Gty of Dania finds that regulations of the cltting, trimming and pruning of tees within the Crty will help ensure that the health, fr:nctfon and rralue oI teq are protected, and will help to prevent dangerots branching conditions that may resrlt in damage or injury to citlzens or property. SECflON 26 - 35 Ptohibition ol Trce Abuse; Fsemptions; Vaniances- 1. No person shall abtse a tee located within the City of Dania unless one oI the following exemptiorr applles: (i) (a) (b) (c) The tree is one of the bee species [sted in Section 26 - B (A and the abrse does not result in a tree that threatens public safety or adjacent property- The abue is necessary to alleviate a dangeros condition posing an imminent threat to the public or property. County, Crty or franchised utilities, water control dishicb, and their authorized agents, may obtain a permit from the Crty, renewable on an annual basis, authorizing the pruning of trees in a manner that may be defined herein as tree abuse provided zuch pruning is necessary to pretent interruptions, or to prevent interference wiih the operation of water control struchres. (b) Any alleged hardship is not self oeated by any person having any interest in the property, A hardship shall not be considered self created if the subject hee uas installed prior to the elfedive date ol this Arttcle. (c) There are unique and special cirormstances or conditions applying to the subject tee or prop€rty upon which it is located, that do not apply generally to other bees or properties. (d) The variance propos€d is the minimum ',rariance necessary to alleeiate the . hardship. (e) That the granting of the variance will be in harmony with the general intent and purpose of this Article and will not create a dangerow condifion that threatens dre public or property. SECTION 26 - 36 Remediol Actions Requhed l. ln the event a person abuses a tree in violauon il this Article, the violator strall be responsible to wrdertake pruning and other remedlal actions that the enforcement agency determines are reasonably necessary to protect public safety and property, and to help the bee survive the tsee abuse damage iI the bee is not a nuisance sp€cies. 2. If the natural habit of growth of the tree is deshoyed, the violator shall install a replacement tree. The diameter of the replacement tree shall b€ equal to or greater than the diameter of the abtsed tree. More than one (1) tee may be utilized for replacement if the aggregated sum oi the diameters of the replacement trees is equal to or greater than the diameter of the abused kee. Eac}r replacement tree shall have a largest diameter commercially ava.ilable in Dade, Broward and Palm Beach counties for the Eee species selected, provided that no replacement tree shall ha'.re a diameter of less than three (3) inches. Diameter measr.rements shall be made at four and one-half (4 l/21 teet abwe ilte ground. This subsection sha.ll not require the replacement of abued trees that are located on oumer-occupied property developed for detached single-family or duplex uage or that are nuisance sp€cies. Replacement tees shall be installed on site. In the event the site cannot accommodate all required replacement tees, the remaining replacement bees shall be installed on public lands if approwd by the enforcement agency. The enlorcement agency may reqr.rire the violator to immediately undertake remedial actions in the event the abused bee is an immediate tfueat to the public or property. No tree remorral permit shall be required under the Dania Code of Ordinances to remove a tree a required by the enforcement agency under this article. SECIION 2H2. bceptlons- Single lamily and duplex are o<empt from this articte, a<cept for &ction 2643,53. SECflON 2H3. Planting Prohibited. Such other information that may be required to give a complete understanding of the proposed plan. SECfiON 2H8. Londscape Requirements for Vehicle Use Atcas. a). In order to improw the appearance of vehicr.rlar use areas and to protect and preserve the app€akmce, character and ralue of the surrounding neighborhoods, and thereby promote ' the general wellare @ providing for installation and maintenance of landscaping, scr€ening and aesthetic qualities, the following standards are established. This section is appllcable to all vehicr.rlar us€ areas, saw and a<cept underground or building endosed ue areas and parking areas s€rving individual slngle and two family homes. b). Reouired Landscaoino Adiacent to Riblic Riqhts-olWaus for Multi-Familv Residential Dewloomenb. There shall be no more than twelve (12) parking sta[s along the same parking aisle without a five (5) foot wide by fifteen (15) foot long intermediate landscape penirsula. Terminal landscape peninsulas shall be ten (10) leet vi:d,e and as long as the required length of the parking stall in that tsle. All other interior vehicular landscape areas shall be a minimum oI five (5) feet wide and one hundred (100) square feet in area. Each intermediate and terminal landscaped peninsr:la shall have a minimum of two (2) hees. Reolacement Reouirements: Vegetation which is required to be planted by this secdon of the code shall be replaced with equi'ralent r,regetation if it is not living within one (1) year of issuance oI a Certificate of Ocorpanry or Completion. 3. Trees: Trees shall not be placed where they interfere with aborp or below ground utilities unless permission has been granted in wdting from the u0lity. a). Re: Dania Motocross Facility Dear Mr. Allan : We are proud that we have been able to bring such a positive project to the City of Dania. lt was the culmination of years of hard work to have found the right location. A site well suited to the use and to the needs of the business and local community. Dania's industrial properties and tax base have been so severely impacted by the influence of the Airport expansion. Our plan is to bring a new business to the area that can co-habitate with the most severe jet noise, where no other business could survive. We hope that Dania will continue to benefit from the advantages of the related business that come from motocross. The sport of Motocross is a market base for every manufacturer of motor bike and motor parts industry. Honda, Kawasaki, Yamaha, Suzuki, Husqvarna, Harley-Davidson AXO, motor bikes, motor parts and accessories, safety gear, clothing, sports paraphanalia, service shops, repairs shops, distributors, dealers, rentals, concessions, marketing, promotions, television, news and media coverage, sports publications, cycle news, signage, radio and news paper advertising. This broad market base will all become part of the area business. As we take our advertizing campaign state wide, the City of Dania share the marquis title as lead name in the Park known as'Air Dania Motocross Park'. We have spoken with area residents and businesses who know and understand what an economic struggle it is in the 1990's. They know that another antique store, or a new restaurant, a new strip center or a new service business will not save or add markedly to the business base. But a new market, a new business base, a new attraction of regional scale can make a difference. Demographically the closest AMA tracks are located in Orlando, Ocala and Dade City, near Tampa. Participants travel from across the state to ride and race these facilities. As they arrive they come with needs. Food, lodging, parts, alternative recreation, travel expenditures, shopping, tourism. This facility also meets a valuable local need. This project comes with the strong support and endorsement of the U.S. Forestry Division and the Department of Agriculture. The Broward and the surrounding Counties of Dade, Collier and Palm Beach, and their Parks Departments all recognize the need for this track. Without a safe AMA regulated track in the South Florida Area, valuable wetlands and similarly fragile environmental areas bear the impact of unauthorized riders. The federal program, known as "Tread Lightly", is supported by this track and the AMA, teaching riders the importance of responsible riding and environmental awareness. This site, occurs in the most remote corner of the City of Dania, and is nearly a mile from any residential area in every conceivable direction. The area is Zoned for the heaviest impact industry types permitted in Dania. yet we want to develop a park, with expansive green areas, landscaping, trees, open space, secure properties, low profile facilities and operating hours that are perfectly compatible with area businesses. They are open during the week and we are a weekend activity. Our traffic is off peak, so low that it does not even raise the level of traffic in the area or on collector roads to week day normal ranges. The activity of Motocross takes place in a sand track site, which has a sound deadening effect on the less intensive two cycle engines that race there. Located under the jet way, at the edge of the total condemnation line, we sit on the threshold or where they consider a business to be barely able to survive. One can hardly hear the bike your on when the jets pass overhead. But to us, this adds an air of excitement. How many people drive their kids to an opportune location to view the thrill of the big jets roar overhead. This is where we belong. This is excitement. This exemplifies area compatibility. This is a new and expanding business. This is a new thought and a new market for Dania. This is the only site in the largest demographic area in the state. This is Motocross. This is to be the safest track ever built in Florida. lt is being designed to 1994 lnsurance and Safety Standards set by the AMA. The track will operate under the guidelines of the AMA ( American Motorcycle Association, Westerville, Ohio ). There are over 280 AMA Tracks Nationwide. We are part of that circuit. We will be sponsoring area qualifier races, in addition to the local run of AMA racing. The track will be built to the the most current AMA safety standards, with all AMA races staffed and manned for great racing, with trained, licensed Emergency Personnel and a full time Ambulance on premises every moment there is racing. We will be open during the week. Not for racing, but for kaining. This is where individuals can practice their skills, with the track to themselves. South Florida Soorts Committeb. Inc. has been in existence as a development business since 1987. Always based here in Broward County. This was the group, headed by Brian Penick as the President of the Corporation, who was the brain trust that has worked to bring a quallfied AMA Motocross Track to South Florida. This venture has looked at a significant number of prospective properties over the past seven years. Motocross Partners Limited. lnc., is a limited partnership group assembled as the investment core of the project. lt is made up of a consortium of local investors who understiand the market potential of this project, and have the faith in the development and management group, which is South Florida Sports Committee, lnc. (SFSC). Tom Laubenthal. Landscape Architect of CAD Landscape lnc.. is a local firm sought out for its planning expertise and its knowledge and experience in park development and sports related facilities. Most recently, his firm completed the Miami Dolphin Training Facilities, which are state of the art in the NFL. He is actively engaged in area University's and schools, designing athletic fields, some of which are programmed to be used as practice fields lor the up coming Summer Olympic Soccer Tournaments. The track course itself, will be designed by other professional racers and course designers, as would a golf course be customized to establish a range of challenges for widely varied skill levels. The track is also subject to change to suit the needs and safety of participants. The AMA. American Motorcvclist Association, has jurisdiction over all facets of motorcycling activities nation wide. The sport of Motocross is governed under the rules, guidelines and safety standards set by this organization. The AMA makes its home at 33 Collegeview Road, Westerville, Ohio 43081-61 14. Locally SFSC is registered as Charter Promoter-Club Number 08256, for 1994. It is this body that establishes the regulation and criteria for track design, relieving the City of any review or liability. The City's purview is limited to the subject area of the parking and spectator areas. lt is these areas that are effected by your local codes and ordinances. Air-Dania Motocross Park Operation. This facility is proposed at this time to operate within the guidelines and acceptable standards of a Temporary Business profile. This means, by code, that this business operated for a maximum of 96 open business days per year. We are primarily a week end activity business. Usually open for one day of racing per week, with an occasional two day event. We do plan to be open for practices on a designated week day, altogether not to exceed the 9-6 day limit. However, it is well known that we have higher aspirations. We are limited at this time to the almost 12 acres that we own. This is totally sufficient for our track and pit areas needs. We, as is the City of Dania, is patiently waiting for the Broward County Aviation Department to conclude its legal arrangements for the disposal of the land areas encumbered by the condemnation process. lt is our desire to acquire more property for the development of permanent restroom facilities, otfices, concession areas and maintenance buildings. Until such time, we operate within the City and County guidelines for our related activity, and within the allowable number of business days. You can quickly access how it would be highly advantageous for us to evolve as we intend, into an expanded business schedule. So as we do we will have to deliver to the City of Dania these new buildings and significant developed parking. Our initial operational profits are earmarked to accommodate this goal. Local Employment Opoortunities. This park require and will have a full time manager and staff. ln addition, any property of this profile will require a significant work force to operate. There are the need for bonded personnel at ticket booths. Otherjobs include parking attendants, concession workers, clean up crews, track groomers and machine operators, technicians for wiring and audio systems, safety and fire rescue professional, ambulance services, police -protection, all of which are the type of jobs that come from a local community. from the civic side, there have already been inquiries of whether local civic groups can play an active roll to subsidize their civic activities and programs, such as schools bands and uniform costs. We are taking this concept under advisement. Traffic lmpact Studv. The normal flows of traffic on SR 84, Ravenswood Road, Collins Road, Port 95 Roadway and Griffin Road have been reduced based on the carrying capacity of l-95 and l-595. Recently there has been an exodus of businesses displaced by the airport condemnation process, further lightening the traffic load in the immediate area. These roads do not bear residential loading, thus our weekend traffic in the absence of businesses which are closed weekends, is less than weekdays. The proposed text change concems listing a motocross park as a special exception use in the M-1 zoning district. This text change request is one of a series of actions requested by the South Florida Sports Committee, lnc. to permit a motocross park on the south side of Collins Road at Tram Road. The text change reQuires two public hearings per Florida Statutes. first reading has been advertised to be heard on February 8 and the second reading will be on February 22. ltis necessary to review the series of actions to fully understand the request so it is suggested that the majority of comments and public hearing input take place at the February 22, 1994 meeting. The item on the February I meeting is a first reading of a zoning code text change to list "Motocross Park" as a special exception use in the M-1 district. On Febtuary 22, a number of items will be scheduled which review the specific request for the motocross park proposed at Collins Road (SW 36 Street) and Tram Road (SW 26 Terrace) including: The second public hearing and reading of an ordinance which would list 'Motocross Park" as a special exception use in the M-1 zoning district. lf this amendment is adopted, then the next action can be considered, if the amendment fails then no additional action can be taken. The request to vacate a 40' road reservation which runs north and south through the property. The request for a variance to not pave the parking lot aisles The request for site plan approval for the motocross park facility The proposed text change is for listing motocross park as a special exception use. As a special exception use the City Commission can approve such a use, deny the use or approve such a use with conditions on a site by site basis. The Planning and Zoning Board has reviewed the zoning text amendment and recommended approval. There is opposition to the text change for allowing the listing of motocross park as a special exception which really deals with the specific request for the site at Tram Road and Collins Road. The opposition to the motocross park is based on noise created by holding motocross events. The discussion of these issues should be held at the February 22 meeting when the specific proposal is reviewed. At the February 22 meeting, the details of suggested conditions of approval which can be placed on the special exception can be discussed is detail. There are suggested conditions such as, limiting the time of approval to one year so that the City Commission could revisit the use and make revisions or even deny the use if necessary. There are also suggestions about noise monitoring and requiring compliance with the Noise Ordinance of the City of Dania. The February 8 meeting is the first reading of the proposed text change. The February 22 meeting will be the second reading and all of the details of the proposed motocross park will be discussed which, if approved, could require a number of actions by the City Commission. That except as herein amended, all other provisions of said section 39-1040 of the code of ordinances shall remain in full force and effect' Section 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 4. At the last P&Z Board meeting, the Zoning Text change was recommended for approval as an added use in this district; the City Attorney felt it would be in the best interest of the City to change this request from a permitted use to a special exception use. MEMORANDUM TO: CITY MANAGER ROBERT FLATLEY FROM:WANDA MULLIKIN, CITY CLERK SUBJECT: BID ADVERTISING DATE: DECEMBER30,1993 ln light of the Commissions' concems regarding the procedure for advertising for bids, the following is the procedure we now use: The charter requires that we advertise for bids at least '15 days prior to receiving them with ads being advertised twice, a week apart, in a newspaper of general circulation throughout the county. ln the past when the Miami Herald offered advertising in the classified Broward edition of the paper, we utilized their paper and rates due to the fact that they were much less than the cost of the Sun Sentinel and also due to the fact that the Sun Sentinel demands more time in which ads must be submitted prior to advertising. This caused a problem due to the fact that it prevented us from advertising for the following meeting, the second reading of an ordinance or any ad that requires a 10 day notice, thus causing a delay for contractors, petitioners and the city. When the Miami Herald discontinued the classified Broward edition of the paper, it made it cost prohibitive and in most cases, ineffective to advertise in the Miami classified section so we chose to advertise in the Broward Daily Business Review which is a business publication throughout Broward County and qualifies as a paper of general circulation in the coung. The rates are much less than the Sun Sentinel and they require much less time for ads to be submitted prior to advertising which makes it possible for us to advertise for second reading of ordinances for the following meeting. We also felt that this being a business paper that businesses may be more likely to observe the bid request .:. il)*t ,..1j*_-r, We only advertise Public Hearing.Erfi Uia requests in the Broward Review. Budget . Ads and Election ads are placed in the Sun Sentinel or Miami Herald. The owner or consumer will also be subject To the maxi- mum fine as set forth in Section 1-8 of the city code; which fine shall be added to and become a part of the utilities bill for that residential unit.,, Note: Staff has discovered that there are instances where utility service has been discontinued for nonpayment that the occupant has been receiving or buying water from other residential units next to or in close proximity. staff feel that if those units supplying the water where billed on an additional unit basis that this practice would be eliminated due to the excessive cost of an additional unit. Section 27-9 (b) A backflow preventer valve shall be installed and maintained on supply line as stated in chapter4620 ofthe South Fla. Building Code. Note: This amendment is necessary in order to reference the proper authority regarding the backflow preventers. I am requesting that you place this ordinance on the next workshop for discussion.
