First of all a special exception use was granted for the motocross facility. The site is located in the M-1 , Light lndustrial district and a motocross park is a listed special exception use., The City Commission found that the criteria for granting a special exception listed in Section 6.40 ofthe Zoning Code had been met and approved the special exception subject to conditions. The special exception was granted for a period of one year at which time the special exception will be reconsidered by the City Commission. The City Commission will once again review the special exception based on the performance during the first year in terms of compliance with the conditions which are listed below: 1 The special exception is granted for a period of one year. Factors for review after one year are: Status of Platting - Platting should begin within six months after the facility opens. Platting is necessary to build any permanent facilities. Noise Considerations. Review experience with lime paved aisles versus asphalt pavement. Restrooms versus porta-lets. Review of sale of alcoholic beverages. Hours of operation. a b c d e f. Dear Mr. Pennick: Page 2 Motocross Pro;ect 2 J 4 The use must comply with Article lV - Noise of Chapter 17 of the Dania Code of Ordinances. a Section 17-86 establishes permissible sound levels which may be received by land use categories. The sound which may be received in a residential area from 7:00 a.m. to '10:00 p.m. is 66 dB(A). b. The City of Dania shall monitor the events a minimum of once a month for each of the first six months of operation at the Dania Cutoff Canal.1. The petitioner shall pay all costs of such testing. Please contact BSO to arrange this testing.2. Continuing failure to meet noise requirements shall result in the City Commission immediately revoking the special exception. An 8' wall shall be constructed along the south property line adjacent to the track along with a bordering hedge to help muffle noise to the south. The number of spectators and riders is limited to a maximum of 790 persons at any one time. This is based on the site plan with 'l 18 parking spaces in the pit area at 2 persons per vehicle and 1 18 spectator parking spaces at 3.3 persons per vehicle. The track may not be open for events and for practice more than 90 days per year. 5 The track shall not be open for practices more than one weekday per week. Each weekend day open is considered an event. 6. The hours of operation shall be limited to 7:00 a.m. to 10:00 p.m. 7 . The special exception is based on the site plan dated May 19, 1994. Any changes to the site plan with the exception of track layout must be approved by the City Commission. No overnight stays shall be permitted on the premises with the exception of a security guard. a b o . Page 3 Motocross Project lf alcoholic beverages are sold, there must be complianc,e with the responsible vendor program. Sale of alcoholic beverages cannot occur after 9:30 p.m. The City Commission also approved a variance from Section 39-216(c) of the Zoning Code. This section requires parking lot aisles to be paved with a six-inch course of lime rock and on asphalt surface. The variance allows the parking lot aisles to be an eight inch thick material of limerock, sand and sludge and was recommended by Keith and Schnars. Please note that the performance of this surface will be reviewed in one year. The City Commission also approved the site plan documents as dated May 19, 1994. This updated site plan includes detail of the fence and additional landscaping. You may now apply for permits to construct your facility. An occupational license is required prior to beginning operations. We need to discuss an appropriate fee for such a category of license. WA;lc To From: Date: CITY OF DANIA INTER-OFFICE MEMORANDUM Robert Flatley, City Manager Dan Oyler, City Planner May 19, 1994 Dania Beach Blvd. /A-1-A Landscape ProjectRe As you are aware the city has engaged the firm of W Sod to install the Washingtonia Palms and Saw Palmetto at the above location. At this time the Washingtonia Palms have been installed and are a striking addition to the entrance to our beach. I have been notified by the sole-source provider of the Saw Palmetto that the 25 gallon plant are not available at this time for the completion of the project. I have had a conversation with the provider, Perkins Nursery and he suggest that we go to 45 gallon material which is a larger plant and will be visible from the roadway. conversation with w sod indicates that he does not want to install the 45 gal. material because of the weight of the plant material (400 - 500 lbs. each) Mr. Dan Perkins of Perkins Nursery, Carl Higgins, Landscape Architect for the F.D.O.T. and I met on the site on Tuesday, May 17,1994 to review the situation. Mr. Higgins suggests that we proceed with the installation of the 45 gal. material but increase the number of the plant material originally planed to 90 - 45 gal. Saw Paimetto to be placed on both sides of the roadway and 132 '7 gallon Palmetto to be placed to the lefi of the entrance road to the beach under the existing Washingtonia Palms. The original 100% reimbursable grant we received from F.D.O.T. was in the amount of $75,876.00 which the city has available for this project. W Sod has invested $27,00.00 in material and labor in the installation of the 80 Washingtonia Palms and has agreed to this amount as reimbursement for his work efforts leaving a total of $48,760.00 for the balance of the project' The specifications call for the Saw Palmetto to have a two year hardening off period prior to been installed in the ground. To my knowledge and that of Carl Higgins (see attached letter) there is only one supplier of the Palmetto in the state that can meet this specification. Mr. Carl Higgins and I feel that Perkins Nursery is the only one qualified to provide these plants and also to install them in the proper manner so as to guarantee their survivability. Therefore we request that the city waive the required bidding procedures by the proper resolution and allow the proper city officials to enter into a contract with Perkins Nursery in the amount of $48,178.00 for the installation to the above mentioned saw Palmetto at no direct cost to the city. Attached you will find the proposal from Perkins Nursery, the letter fom the F.D.O'T. and the resolution. Date:May 19, 1994 Public hearings are scheduled for the May 24, 1994 City Commission meetinS. concerning the request 6y the South Florida Sports Committee, lnc. to construct and operate a motocross parl facility on l l.66 acres of property located on the south side of Collins Road (SW36 St.) at sw 26 Terrace. The public hearings include the request for a special ""."piion use for this site within the M-l zoning district and a request for a variance to allow unimproved parking lot aisles. Consideration of the proposed site plan for the motocross facility is also scheduled for review on May 24' The Planning and Zoning Board reviewed these requests at their December 15, 1993 and January 19, i 994 meetings. The recommendation is to approve each of the requests. The recommendation for both the special exception request and the variance is to approve with conditions and safeguards. These conditions relate to concerns raised concerning noise, traffic and progress toward constructing more permanent facilities' 1. Sp ial Exce tion The request is for a special exception use as a motocross park facility on the site which ii zoned M-1, Light lndustrial. The use is a listed special exception use in the M- l district as per the recent zoning text amendment. The special exception was found to be consistent with the criteria for a special exception use as outlined on Sections 6.40 , 10.'12 and 10.14 of the zoning code. The attached list of conditions were recommended by the Planning and Zoning Board. These conditions include time limitations to review performance of temporary facilities such as the portalets, plattin& and review of the variance from paving requirements for the parking aisles. other conditions address the issue of noise by limiting the hours of operation, requiring conformance to the noise requirement of City Code, requiring noise monitoring and requiring a wall with a hedge on the south property line adjacent to the track. The number of persons on the site is limited for traffic reasons. Parking is based on this limitation. The site would be operated primarily on weekends so the number of trips would not conflict with adjoining uses. Variance A variance is requested from section 39-2'16(c) of the zoning code. This section requires parking lot aisles to be paved with a six-inch course of lime rock and an asphaltic .oncret" or portland cement surface. The request is to have the aisles be covered with an 8 inch thick material composed of limeroc( sand and rock and silt/sludge. This was recommended by the engineering firm of Keith and schnars in a letter dated october 20, 1993. This specification matches the grass parking area at Joe Robbie Stadium. It was recommended that the parking area be part of the review of the site, special exception and variance in one year. Site Plan The proposed site plan is recommended for approval. with the exception of the requested variance for paving parking aisles the plan conforms to parking, setback and bulk requirements. The recommendation is to adopt the site plan dated May "19, 1994. The landscape plan was updated to meet requirements of the recently updated landscape code. The City Commission also directed that you recommend a security system. This should be a priority. It was decided that the bathroom would be left where it is, at least for now. This is in keeping with getting the bullding occupied. Direction was also given to replicate the stenciled cornice in the main reception room. The City Commission expressed concern for restoring the front and rear porches due to security and maintenance problems including the potential for people loitering or even sleeping on the porches. lt was decided to keep the porches enclosed. lt was also decided to leave the second floor as is for now with work following if grant funds become available. The room will remain open rather than reconstructing walls which formerly constituted bedrooms. The second floor should be used for display space. Thank you for attending the Dania City Commission workshop meeting of May 17,1994. I am summarizing the direction given at the meeting while it is still fresh in my mind. Another action which needs to be taken is to request that the Dania Historic Society utilize a portion of the building for an office, if needed, and as a display area for photographs, information etc. Lastly, direction was given to make contacts with state officials to check their opinion about the likelihood of funding grant requests to rehabilitate the house. lt may not be worthwhile to spend the funds to apply for a grant. lf you disagree with my impressions of what occurred at the workshop, please contact me. The back porch was originally screened with wooden rolling shutters: The architect recommends restoring the open porch and screened porch. The reconstruction of the rolling wooden shutters may be considered should it be deemed of historic interest and made part of a more comprehensive restoration. Second Floor Shadow As the second floor. . is currently a large open area conducive to gatherings, exhibits, or open office area, rather than reconstruct the original bedroom configuration, the architect proposes to paint the original floor plan on the floor as a shadow' of the.original layout. This would memorialize the original plan without compromising use of the larger open space, a graphic histoiicism. 1. ln all cases remove chases, refinish floors, and replicate the existing wood trim (at bases, shoemolding, window and door frames, etc.) 2. lnterior design and furnishinqjs should incorporate some of the original elements. (For example, if there was a piano in thd music room, try to investigate where it was located and what model, type, etc.) 3. Furniture distribution might lend itself to different functions and activities. A furniture layout is included here to start thinking about possible configurations. 4. Utilization ot Office 3 by the Historical Society would involve an essential and desirable entity in. the restoration and utilization of the house. This may be advantageous in applying for grant funding or other means of support. Estimate of probable cost An accurate estimate of cost can be obtained with more detailed descriptions of the proposed work and a thorough investigation of by a contractor.
