The city attorney hereby advises the city commissioners that he and other attorneys representing the city in its legal action against Broward County desire advice from the city commissioners that will be confined to strategy relating to litigation expense. The meeting is to be held at 9:00 p.m. or shortly thereafter, on January 11, 1994, in the conference room adjoining the regular meeting room. A certified court reporter shall record the time and termination of the session, all discussions and proceedings that occur, the names of all persons present at any time during the session and the names of all persons speaking. No portion of the session shall be off the record. The court reporter notes shall be fully transcribed and filed with the city clerk within a reasonable time after the meeting. The transcript shall be made part of the public records upon conclusion of the litigation. This session shall commence at 9:00 p.m. or shortly thereafter at the regular meeting of the city commission which starts at 8:00 p.m., by the mayor announcing the commencement and estimated length of the private session. After the private session, the regular meeting shall be reopened and the mayor shall announce the termination of the session. Frank C. Adler City Attorney pertinent data related to calculating dredge volumes including width and length of the canal reach that may require dredging. Bases on the information compiled in the Phase I Survey, the Consultant will prepare a report entitled, "Preliminary Findings and Recommendations for Canal Dredging and Maintenance for the City of Dania, Florida." The report will summarize the existing conditions of the Dania Cutoff Canal within the canal and will identifu the areas that warrant additional surveying efforts to determine dredge volumes and associated maintenance costs. The Consultant will meet once with City staff and the Marine Advisory Board in adjunct meetings, to discuss the findings of the Phase I survey and to recommend areas of the canal that require further work. TASK II. PHASE II SURI/EY Based on the results of the Phase I Survey and discussions with the City, the Consultant will perform an in-depth bathymetric survey of those canal areas that have been identified in the Preliminary Report as being in need oI dredging. Depths will be located relative to the established referenced, point along the end canal using electronic distance measuring equipment. The boat will be equipped with a chart recording survey fathometer with digitizer; a trisponder positioning system, a differential global positioning system (DGPS), or other suitable instrumentation for positioning, a paper printer and an electronics technician. Water surface elevations will be obtained during the course of the survey using the elerrations established on concrete bulkheads as outlined in Task 1A above. Depth readings will be corrected for tide flucfuations and converted to acfual bottom elerrations relative to National Geodetic Vertical Datum (NGVD). TASK III - PI.A,N TION REPORT The Consultant will prepare a bound report entitled, "Finding and Recommendations for Canal Dredging and Maintenance for the City of Dania, Florida." The report wilt summarize the estimated dredge volumes and associated costs for maintenance dredging c SCOPE OF SERWCES ilht DANIA CUTOFF CANAL BATHYMETRIC SURI/EY Tfl - PHASE AND 7A Data Collection: The consultant shall review available bench marks within the city and will identifu locations along the canal upon which the tide staffs will be established. The elevations are to be established on top of concrete bulkheads on the waterward edge of the canal or by staffs set in the water at locations accessible by boat. These elevations will be referenced throughout the bathymetric survey for apptying tidat corrections during data reduction. The consultant will provide the City with descriptions and elerratiors of each ref.erenced bench marks for use during fufure bathymetric surveys. 78 Suruey: The Consultant will coordinate a bathymeteric surveying team in collecting centerline and two (2) offset canal profile depths of the Dania Cutoff Canal from the eastem city timits to the westem limits of the City Of Dania. 7C Preliminary Report: The consultant will provide the city with centerline bottom elevation data for the canal in tabulated and graphical format. Cross sectional profiles of selected problem areas will also be presented. A priority list will be established summarizing the order in which reaches of the canal may be dredged. The consultant will prepare a table identifuing canal reaches, the dredge volumes in each reach and the minimum centerline bottom elevation obtained in each reach. The Consultant will discuss and agree upon the system for prioritizing the dredging sequence of the canal with the City staif. The Consultant will apply the priorifizing system to the data and will prepare a table summarizing the dredging priority and dredge volume of each canal reach. Bases on the estimated dredge volumes the Consultant will eualuate the dredging costs and present these costs within the summary table. The report will also include a discussion on the permitting constraints that may be imposed by the Departrnent of Environmental Protection (DEP), the U.S. Army Corps of Engineers (COE) the South Florida Water Management District (SFWMD) and the Broward County Departrnent of Natural Resources Protection (DNRP), for future dredging projects. Section 4.201 (2) of the Zoning Code prohibits the sale of liquor, wine or beer for consumption on the premises at any location within 1,000 feet of any established school or church. This is measured by the shortest straight line from building to building. There is approximately 420 feet between Grampas and the Dania United Methodist Church. The Planning and Zoning board reviewed this request at their December "15, 1993 meeting. By a vote of 4-1 their recommendation is to approve the variance. The applicant indicated that the sale of beer and wine is essential to remain competitive with other restaurants serving lunch and dinner and is particularly important to being competitive in the tourism industry. lt was also explained that the serving of beer and wine on the premises is a right commonly enjoyed by other properties in the same zoning district. Examples of several businesses within 1,000 feet of the Dania United Methodist Church include Dino's Pizza next door, Penn Dutch restaurant, and the Dania Beach Hotel. Any outside engineering services, studies, or laboratory testing not specifically mentioned in the Scope of Services will be the responsibility of the City of Dania. A11 municipal, permit, and agency fees as well as Title Certificates will be paid by the client. Reimbursable Expenses Berry' & Calvin, Inc. will be reimbursed for the printing of drawings and specifications, deliveries, federal express services, required travel time and travel expenses, long distance telephone calls, fax transmittals, and postage, as required. Reimbursable expenses will be invoiced directly to the City of Dania at a multiplier of 1.25. Due to the difficulties of predicting the number or duration of meetings, no meetings are included in the Schedule of Fees shown above. Preparation for and meeting attendance, as necessary, will be provided on a time and materials basis and will be billed at the standard hourly rates in accordance with the attached Hourly Rate Schedule. CLIEI.{T RESPONSIBILITIES The City of Dania or their representative shall be available to meet with Berry & Calvin, Inc. and provide decisions in a timely manner throughout the course of the project. The City of Dania will provide Berry & Calvin, Inc. with plans and other pertinent information which may be necessary to properly survey or engineer the site. All rates and fees quoted in this document shall be effective for a period of six (6) months, after which time they may be renegotiated with the City of Dania. All original documents shall be retained by Berrl' & Calvin, Inc. and will remain their property. This information is proprietary and will not be shared with others without prior written consent. The City of Dania may request reproducible copies of all original documents upon payment of all ouatanding invoices, and at the client's expense. Invoices for work accomplished to date will be submitted twice monthly and are payable within thirty (30) days. The City of Dania will pay invoices upon receipt and understands interest charges of L.5Vo per month will be applied to any unpaid balance past thirty (30) days. Berry & Calvin, Inc. may elect to stop work until payment is received. If work is stopped for thfuty (30) days or more, Berrl'& Calvin, Inc. may request compensation for start-up costs when work resumes. We appreciate the opportunity to submit this proposal. To artain speed and accuracy in writing this technical material, Bermex developed and instituted the first computerized methods of writing, tracking and bidding the specification documents and the subsequent repair work. Adopted by the Detroit Housing and Urban Development Office, this computerized process, eventually known as the Property Monitoring system, soon became the standard for HUD activity. Bermex provided the trained personnel to perform these inspection and repair services in nine major metropolitan areas across the United States. Utilizing the property Monitoring System, Bermex has pre-inspected, written repair specifications, prepared bid packages, and monitored the bid awards and construction of over 125,000 homes. Simuitaneously, Bermex supplied the Federal Emergency Management Agency with inspection personnel at the sites of natural disasters across the country. Bermex provided, and mobilized within 24 hours, the fieid personnel and project management needed ro assess disaster damage and the necessary repairs. Buildilg upon Bermex' expertise in inspection and repair specifications, Bermex began providing energy conservation services in 1981, with the inception of federally mandated energy conservation programs. Bermex has provided major utilities and rural electric cooperatives with all of the necessary hardware and software, tools, personnel and supervision to perform services, including: Advertising and promotion, progmm eligibiJity determination, scheduting, cls data entry, on-site audit with the necessary explanations to the customer, computerized processing of audits, pre- and post- instailation inipections, preparation of the customer bid and credit applications, staffing of toll-free hotlines to answer t€chnical inquiries, quality assurance follow-up, complaint investigation, and all necessary record keeping and reporting. Bermex was also instrumental in the start-up of the Michigan Energy Assurance Home Repair and weatherization Program in the metropolitan Detroit area. For Broward County Environmentai Services in Florida, Bermex currently provides a staff of meter readers reading approximately 50,000 water meters monthly. originally Bermex read only half of the system's meters; however, due to Bermex' performance, Bermex soon began reading all of the system's meters. For the City of Fort Worth, Texas, Bermex reads all of the City,s 165,000 residential, commercial and industrial water meters. In addition, Bermex provides special two man crews with required safety equipment to read the City's vault meters For Equitable Gas company, Bermex provides trained and uniformed meter readers to perform regular route reading, appointment reads, meter re-reads, dial glass replacemenB, three-month investigations, straight turn-offs, and collection work. Bermex suppiies trained and uniformed meter readers to read regular routes and to obtain appointment ieads. For appointment reads, Bermex receives customer calls via a toll-free number, schedules customer appointments, and obtains reads. Bermex office personnel enter the data directly on F4uitable's CIS. In 1993, Bermex began providing tumkey meter reading services for two new water utilities in Florida - the City of Sunrise, and Fon Pierce Utilities Authority. During the employment process, a candidate's drivers license number and social securitynumber are recorded. All applicants are then run through a security check with the statePolice for criminal behavior-and/or convictions, as well-as a credit check with a localagency. A candidate's possession of reliable transportation is confirmed and a valid driversIicense number, vehicle registration, and proof of insurance are obtained. citizenship is verified through_ each candidate completing an empioyment eligibilityveriflcation form from the U.S. Department of Justice Immigraion-and Natriraization Service. Previous job performance is reviewed and compatible candidates are identified. The finalscreening procedure entairs the checking of references with an applicant,s previous employers. As an added precaution, all field personnel hired by Bermex are covered under a $10,000Employee Dishonesty Bond policy. As a result of years of meter reading ixperience, Bermex hasdeveloped intemal tests that effectively screen the candidates and atiows the most qualifiedindividuals to be selected for employment. Trainins Bermex is in a unique position, as a result of several years of meter reading experience, to provide trained meter readers. Using an internally developed tr-aining program, Bermex has the capabiiity to effectively train employees to perform at desired levels. Trainees complete three days of classroom training in which several instructional methods are utilized: Audio and video training; a meter reading slide program, including coverage of electric kilowatt hour meters, demand meters, and time-of-day meters; textbook and workbook exercises with sampies and practice questions; hands-on hand-held meter reading device instruction; review tests; and question and answer sessions. Trainee performance undergoes intense scrutiny and appropriate comments are relayed back to the trainee. Also inciuded is an orientation to Bermex as a company, our role as a contractor, personnel poiicies, and the general company philosophies. Bermex also includes general instruction in safety procedures, rules and reguiations, and customer service relations. At the completion of classroom instruction, successful trainees proceed into fieid training. Bermex will coordinate with the utility a minimum of two days of field uaining where trainees are accompanied by an experienced meter reader. Bermex solicits comments and feedback is given to the meter reader. This procedure allows ary corrective actions to be immediately implemented and helps ensure that Bermex meter readers are delivering the best possible service. Training materiais include Resources Inc.'s (Tampa, FL) audio-visual training program for watthour, demand, and time-of-day meters. Program includes workbooks complete with exercises and testing. Additional material includes VHS video on meter reading, handouts on safety and dogs, and the Itron hand-held unit. First day classroom training* Reading of water meters.* VHS video (30 minutes).I Exercises and testing.f If rrainee does not pass tests, he can not continue. Second day classroom training* Meter reading exercises and tests.* Meter reading -- can't reads, skip rates, missed reads, lag routs, deferred routes, special keys, customer/route keys, and reading route maps. Third day classroom training* Hand-held unit - keyboard, start-up, reader information, review, search, meter change, new meter, read sequence, and end of route.* Meter locations, must reads, postcards, do not reads, customer reads and number consecutive estimates.* Practice entering reads - controlled route. Fourth day training* Customer relations training.* Identification badge.* Additional hand-held unit training and practice.* Sent to field with experienced meter reader on his regular route.* Ensure trainee can walk ten miles (physical endurance for reading) and has no problem with being afraid of dogs. Fifth day of training* Bermex orientation to cover company handbook and company policies and procedures such as time sheets, vacation, etc..* New hire paperwork.* Testing, as required.* Sent to field with experienced meter reader on his regular route. Continued field supervision Safetv Bermex company policy states that the health and safety of the employee takes precedence over all other concems. The goals are to prevent accidents, reduce personal injury andoccupational illness, and to comply wilh safety and heatth standards. As such, Bermex devotes considerable attention to this matter. Management and fieldpersonnel are trained with safety as a focal point. Bermex Managers and Supervisors inevery office hold scheduled safety meetings covering such subjects as driving safety, weather awareness and safety, animal safety, slips and falls, as well as health and htness. In addition, safery information is communicated through written hand-outs, safety Team meetings, and postings within the office. Description of Safety Practices As standard Bermex procedure, all Bermex offices follow the safety procedures described below: safety practices and procedures are a specific topic during training, and monitored on a day-to-day basis. All meter readers are equipped with dog repellant and the safety clothes and equipment required for their particular job, such as safety boots, safety goggles, gloves, hard hats, first aid hts, safety vests, fire extinguishers, etc. All Bermex vehicles are marked with Bermex identification and the appropriate safety devices, such as warning signs, flashing lights, and back up horns. Bermex meter readers adopt the safety policies and practices of the ciient. Bermex management performs a review of drivers licenses every six months. Bermex' insurance company performs annual audits of safety practices. Bermex Managers and Supervisors comply with the Injury & Illness prevention Program.
