RE:AMENDMENT OF SECTION 8-3; FEE SCHEDULE FOR PERMIT FEES
Date:August 17, 1994
Please schedule the first reading of an ordinance amending Section 8-3 of the Code of
Ordinances. This section of the code deals with the fee schedule for building permits
including, structural, plumbing, electrical and mechanical. The proposed change to
increase the minimum fee was discussed at the budget workshop and the August 16,
1994 workshop.
The proposal is to increase the minimum fees from $27.50 to $35.00. The additional
$7.50 for such permits as re-roof, certificate of occupancy, fences and minimum
plumbing and electrical fees will generate an approximately $10,000 increase in
revenues.

There are also some additional categories added to the schedule based on review by
the individual inspectors who reviewed the fee schedule of other communities. The
most changes were made to the mechanical category. The proposed ordinance is
attached.

Date August 18, 1994
A current application for an apartment complex has illustrated a problem with a portion
of our zoning code. Specifically the requirement for the number of parking spaces for
multifamily dwellings is much higher than necessary. An ordinance has been prepared
which reduces the parking requirement to a more reasonable level. Such an ordinance
would allow Dania to be more in line with the rest of Broward County and the country,
and be more competitive for multifamily development projects. Lowering the
unreasonable standard would also result in less pavement adding open space and
landscaping to developments. Please schedule this for first reading at the August 23,
1994 City Commission meeting.
The attached chart shows that Dania now requires 2.2 spaces per multifamily unit.
There is no regard to the number of bedrooms per unit. Hollywood and Ft. Lauderdale
require 1.5 spaces per unit regardless of the number of bedrooms. The complex
proposed on Sheridan Street is 144 units. The Dania requirement is 317 spaces. A
similar development in Hollywood or Ft. Lauderdale requires 216 parking spaces. That
is a lot more asphalt.
The suggested amendment would be the same as Broward County. This is in effect in
the area west of Ravenswood Road. An efficiency or one bedroom unit would require
1.5 parking spaces while two spaces would be required for two bedrooms and 2.5
spaces for three bedrooms or more.
For the proposed 144 unit development, this would result in requiring 260 spaces (1 5 .
57) + (2.0. 87). ln comparison to other communities this is much more reasonable.
The reduction in the number of parking spaces from 317 spaces to 260 spaces results
in a minimum of 9906 sq. ft. of pavement for the parking space and aisle.

Ordinance Amending Zoning Code
July 25, 1994
illl at'^-
Based on the city commission workshop discussion concerning undersized lots, an
amendmertt to the zoning code needs to be made. The direction given at the workshop
was to allow variances in the redevelopment target areas to be processed in a more
streamlined fashion. Variances would be directed to the City Commission without the
step of obtaining a recommendation from the Planning and Zoning Board'
It is suggested that Section 10-14 of the Zoning Code be amended. This section refers
varianJe-s and special exceptions to the Planning and zoning Board for advisory
comment.
The following language is suggested. Please give me your feedback and then the
process to amend the code can begin.
'.REFERRAL TO PLANNING AND ZONING BOARO. EACH APPLICATION FOR A SPECIAL EXCEPTION

RE:VA-24-94 AND SP-25.94. THE PETITION OF SHERIDAN 3OO, INC.
REQUESTING SITE PLAN APPROVAL FOR 144 APARTMENTS ANDREQUESTING VARIANCES FROM DENSITY REQUIREMENTS AND
PARKING REQUIREMENTS OF THE ZONING CODE - SHERIDAN ST.
Date August 18, 1994
Two items are scheduled for the August 23, 1gg4 city commission meeting concerning
a proposed 144 unit apartment development on the north side of sheridan street. Theproperty involved is Parcel "A', 300 sheridan, a plat consistin g of 4.72g acres which is1,381' west of SE 5 Ave. and approximately 300,east of SE 2 Ave. One item is apublic hearing concerning variances requested from density requirements and parking
requirements.
The land use designation on the site is Residential 4g units/acre. The Broward countydesignation is Residential - 50 units/acre. The city of Dania reviewed the plat in 19g5
and granted site plan approval for a seven story, 243 unit adult congregate care facility. The plat was recorded in 1987. The note on the plat limits the ule to 243 high rise
u nits.
The property to the north is olsen Middle school which is zoned open Space and has a
land use designation of community Facilities. The property to the east is vacant and is
zoned c-2 with a land use designation of commercial. The property farther east is thesheridan square Shopping center which is zoned c-2 and has a land use designationof commercial. The property to the immediate west is the Kensington Medical clinic. This site is zoned c-2 and has a land use designation of commeicial. The property
east of SE 2 Ave and south of olsen Middle school is zoned c-2 with a land usedesignation of commercial. The lots fronting the east side of sE 2 Avenue aredeveloped with residences. The property to the south is in Hollywood. The property
directly south is part of Hollywood Lincoln Mercury. To the east are the sheridan by theBeach Condominiums.
o{ft
#b. l
Page2
VA-24-94 and SP-25-94
The proposed site plan consists of 144 apartment units in six buildings. There would be
57 one bedroom units and 87 two bedroom units. Access is from Sheridan Street on
the west side of the property per plat requirements. An emergency access is at the
southeastern corner. There are security gates at the entrance to a parking lot which is
along the periphery of the site. There is a wall along the periphery of the site. The site
plan also includes a recreational building and swimming pool.
Two variances are requested. One variance requested concerns density. The site is
zoned RM-2 which allows 16 units per acre. The request is for 30.45 units per acre.
The second variance requested is for number of parking spaces. The zoning code
requires 2.2 spaces per apartment for a total requirement of 317 parking spaces. The
request is for 267 parking spaces.
The Planning and Zoning Board reviewed the variance requests at their August
meeting. The Planning and Zoning Board recommended approval of the parking
variance but recommended to deny the variance for number of units and the site plan
by a 3-2 vote. The Planning and zoning Board felt uncomfortable with the requested
dinsity and did not think the criteria for obtaining a variance had been met.
ln the case of the request for a parking variance the Planning and zoning Board
recommendation is to approve. Another memorandum in this meetings backup packet
recommends amending the parking requirement for multifamily units. The requirement
of 2.2 spaces is not consistent with any code in the area. The requirement across the
street in Hollywood for example is 1.5 spaces per unit. The number of spaces provided
on the site pian exceeds the number recommended to be adopted which is 1.5 spaces
for one bedroom units and 2.0 spaces for two bedroom units. ln this case that equals
260 spaces. The site plan indicates 267 spaces.
The recommendation of the Planning and zoning Board is to deny the variance
pertaining to density and thus to deny the site plan. The Planning and Zoning Board
felt the density of 30 units per acre to be excessive.
ln most cases, I would concur with the Planning and Zoning board that the site is too
dense but in my opinion there are unique circumstances which should be considered.
The number of units is consistent, actually lower, than the Dania and Broward County
Land Use Plans permit. The land use plan designates the site as 49 residential units
per acre. The original site plan was for 243 units of adult congregate care units. With
ihe exception of parking, which is less for adult congregate units, the proposed site plan
is less dense than the previously approved project. The proposed project generates
less vehicular trips per day and less water and sewage usage'
The proposed site plan is also consistent with the approved plat for the site. The plat
was approved with a note restriction limiting development to 243 high rise units.
Page 3
VA-24-94 and SP-25-94
Perhaps a request could have been made to adopt an additional zoning district which
allows a density consistent with the comprehensive plan. My feeling was since this is
the only such property so designated on the plan that a variance procedure made
sense.
Should the variance for density be granted, it is recommended the site plan be
approved. The site plan conforms to bulk requirements of the zoning code such as
setbacks and height. The proposed site plan also conforms to open space and the new
landscape requirements. The conceptual utility plans have been reviewed by
appropriate departments and approved.

RE:VC-20-94 - Request of Berry and Calvin, lnc. on Behalf of VST/VMIF
Oakridge Partnership for Vacation of Anchor Easements and
Building Setback Lines
Date: August 17, 1994
An item scheduled for public hearing review at the August 23, 1994 City Commission
meeting concerns the proposed vacation of easements and setback lines at property at
the southwest corner of Griffin Road and SW 31 Street. This is the site proposed for a
shopping center.
One request is to vacate three anchor easements which is 5' x 47' each. These
easements were for guide wires to anchor utility poles. There is also a request to
vacate the existing setback lines which include a 60' front building setback line and a
25' rear setback line.
The Planning and Zoning Board reviewed this request at their July 27 , 1994 meeting. lt
was noted that the City Commission authorized the application at the June 14, 1994
meeting as requlred by Section 3 of Part lX, Article 3 of the City Charter.
The Planning and Zoning Board found that there is no public purpose for the anchor
easements or the setback lines. The various utilities have supplied letters indicating no
objection to the vacation. The building setback lines only concern the property fronting
Griffin Road. The proposed shopping center encompasses a much larger area of
approximately 30 acres. A resolution has been prepared vacating the anchor
easements and building setback lines.

INTEROFFICE MEMORANDUM
GROWTH MANAGEMENT DEPARTMENT
I
TO:Robert Flatley
City Manager
FROM:
RE:REQUEST FOR TRAILER AT 1O BRYAN ROAD, DANIA BOAT YARD
Date August 16, '1994
The attached letter requests permission to place a 24' x 60' trailer at '10 Bryan Road.
This site is located on the east side of Bryan Road to the C-10 Canal to the south of
Tigertail Boulevard.
Mr. Flynns letter indicates the request is for no longer than 12 months. The trailer
would be used for office space. The intent is to construct a permanent showroom as
well as office and service area. The attached site plan shows the proposed location.
These requests have traditionally been reviewed by the City Commission. lt is
recommended that permission be granted to locate the trailer on the site. This will allow
the owner to prepare and submit plans for their permanent improvements.
