PARKING REQUIREMENTS OF THE ZONING CODE.

The requests of Sheridan 300, lnc. concerning building 144 apartment units on 4.729
acres on the north side of Sheridan Avenue is scheduled for review at the September
20, 1994 City Commission workshop meeting. This was continued from the August 23,
1994 regular meeting. Minutes of that meeting are attached.
Concerns at the meeting included storm water drainage due to increased density,
making provisions for the use of gray water in the future and whether the parking was
adequate.
A revised site plan has been prepared and is attached. The drainage plan has been
submitted with final engineering. A letter from Berry and Calvin indicates the 100 year
storm will be contained on the site with no off-site discharge. The number of buildings
has been reduced from six buildings to three buildings. The same number of units are
proposed in four story buildings rather than three story buildings. The lake area has
been increased. The landscape plan has been supplemented. The engineering plan
indicates a line for future gray water use.
The applicant and engineers will be at the meeting to present their case

The City Commission directed that parking at Harbour Towne Marina be discussed at
the September 20, 1994 workshop meeting. Accordingly, representatives of Westrec,
Tugboat Annies and the Vegas Express have been invited to explain parking.
Background information includes submittals made as part of the occupational license
application. A parking map for Harbour Towne will be at the workshop meeting. lt is
too large to copy. There are 845 automobile parking spaces in Harbour Towne plus car
/trailer spaces and loading spaces.

Attached is the revised addendum to the City's agreement with BSO for Police
Services for 94195.
After negotiations with BSO staff, it has been agreed that they will continue to
provide 6 CSA's at a lesser cost to the City than the originally proposed increase
of 5%. The previously submitted addendum called for a 5o/o lee increase, from
$3,383,690 to $3,552,873. We have budgeted $3,490,290 assuming a decrease
in the number of CSA's from 6 to 4. The revised addendum includes 6 CSA's.
The fee requested by BSO for 94/95 is $3,502,714; $12,424 more than has been
budgeted for 94/95.
Further negotiations with BSO staff reduced the maximum amount of contract
increase for fiscal years 95/96 through 97/98 to an amount not to exceed the
current rate of 5%.

SHERfFF) to be effective october 1, 1994.
RECITALS
WHEREAS, the CITY heretofore contracted with the SHERIFF toprovide municipal police services;
I.{HEREAS, the CITY is desirous of renewing the police servicescontract for a four (4) year period.
THEREFORE, in consideration of the sums hereinafter set forthand for other good and valuable consideration, the receipt andlegal sufficiency of which are hereby acknowledged, it is hereby
agreed as follosrs:
1. The term of this Agreement is hereby extended to
September 30, 1998.
2. Sections L,L2, 1.2-1, L.2.2, L.2.3, 1.2.4, and 1.2.5 arehereby deleted frorn this Agreenent.
3. Section 1.2 is hereby added to this Agreehent as follows:

Notwithstanding anything to the contrary contained inthis Agreenent and wj,th respect to Article VIII of the
Agreenent, the compensation payable by the CfTY forfiscal years 1995/96 through 7997 /98 shall be increasedby a sun not to exceed the following percentage of the

For purposes of thisAgreement, a fiscal year is defined as October 1 throughSeptember 30. BSO shall submit an invoice for suchadditional costs on or before Septenber 1st of each year.This invoice shall be due and payable within thirty (30)days of receipt by the CITY.
BSo agrees to credit the CITY with any aggregate costdecreases attributed to salary and employee benefitadjustnents, as described above, provided the CITYTstotal budget for the Dania District.

The parties acknowledge that the considerationprovided in Article VIfI with respect to fiscalyears 1994/L995, 1995/96, L996/97, and t997/98include a 3.5 percent vacancy rate. The CITY sha1lbe entitled to an annual credit i.f the annualvacancy rate exceeds 3.5 percent. A vacancy occurswhen a deputy or e:nployee is absent from work andsuch absence results in a salary Iregular salaries,special pay, FICA taxes (regular and special payonly), retirement contribution/regu1ar, retirenenlcontribution/ specia 1 risk, and Iife and healthinsurancel savings to BSO.

BSo agrees that any currency seized wj.thin theCITY, through active participation of DaniaDistrict's personnel, pursuant to thisagreenent and chapter 932 of the FloridaStatutes, and subsequently forfeited to BSO,shall be deposited into the Law EnforcenentTrust Fund established by the Bror./ard CountyCommission in an arnount which represents theDania District,s share, as defined inparagraph 9.5, of such currency. Suchcurrency shall be earrnarked for BSO,s usewithin the conf j.nes of the City.
Upon concurrence of the District Commander,the CITY nay apply to BSo for the use of suchfunds if such application is in conpliancehrith Florida Statutes. Bso aqrees to subraitsuch application to the Broward CountyComnission for appropriation. Uponappropriation, such funds sha11 be rnadeavailable to BSO for its designated use withinthe confines of the City.
The parties agree that the decision to disposeof or use personaL property sei.zed within theCITY through active participation of DaniaDistrict personnel sha11 be in the solediscretion of BSO. In the event BSO decidesto use such personal property outside of theCITY, BSO sha1l allocate funds to the LawEnforcenent Trust Fund equivalent to the DaniaDistrict's share, as defined in paragraph 9.5,of the nutually agreed upon fair rnarket value

of such personal property less any lien onsuch property and the cost incurred by BSO inproceeding erith such forfeiture actionincluding, but not Limited to court costs,attorney fees, publication costs, storagecharges, security, and naj.ntenance costs.Such allocated funds sha1l. be earmarked forBSO's use within the confines of the city.
The parties agree that the deeision to use ordispose of real property seized within theCITY through active participation of DaniapersonneJ. shal1 be in the soLe discretion ofBSO. fn the event BSO decides to dispose ofsuch real property, BSo sha11 allocate fundsto the Lar,, Enforcenent Trust Fund equivalentto the Dania District,s share, as defined inparagraph 9.5, of the nutually agreed uponfair narket value of such real property lessany J.oans, nortgages, liens, or any otherencumbrance on such property and the costincurred by BSO in proceeding with suchforfeiture action including, but not linitedto court costs, attorney fees, publicationcosts, security, and rnaintenance costs. Suchallocated funds sha11 be earmarked for BSOrsuse within the confines of the CITY.
9 5 The Dania District,s share will be based uponthe ratio that the Dania Di.strict,spersonnel's participation bears to theparticipation of al,1 1aw enforcernent agencj,es,and units' participatinq in the seizure of theproperty.
5 BSO shalI, on a quarterly basis, supply theCITY with a lrritten record of the above-described fines and forfeitures. Suchreport(s) shaIl include a description andestinate of value of properties sej-zed underthe larrs of the State of Florida, whether ornot disposition thereof has been adjudicated.Moreover, such report(s) sha11 be anended,from tine to ti:ne, by reflecting the ultinatedisposition of property described in anearlier report(s), and such amendatoryreport(s) shall be submitted to the CITYwithin ten (10) days of the ultinateadjudication with regard to the seizure ofsuch property.

The SHERIFF shallhonor the CITY's agreements rrith locaI vendors
concerning towing within the nunicipal boundariesof the CITY oF DANIA; provided however, that thevendors rneet all of the SHERfFF's specificationswith regards to naintaining criminal evidence andits ability to provide adequate insurance coverageto the satisfaction of the Director of the
SHERIFF's C1ains Division. SHERfFF reserves theright to tow if vendor fails to cornply with saidspecification. Further the SHERIFF also reservesthe right to continue to use the towing servicesother than those of the local- vendors with regardsto a1t confiscations/ forfeiture cases occurringwithin the CITY oF DANIA,

1994/95 Sewer Rates
At the July 20, 1994 budget workshop, I informed the Commission that the sewer
rates for 94/95 were being reviewed and that a rate reduction would be
suggested.
As a result of a reduction in the administrative transfer to the general fund, a
reduction in the cost to Hollywood for the treatment of sewage as a result of the I

ln 1992, Rachlin & Cohen prepared a five year projected rate study. Since the
expenditure forecasts were affected by factors unknown to Rachlin & Cohen at
the time, such as the anticipated cost of the I & I program, the bond refunding by
Hollywood and the decision to postpone enlarging or building a new sewer
treatment plant which affected the Large Users, the rates set in the study
generated more than sufficient revenue to meet the Sewer Fund's requirements
in FY 92 & 93. Rates were reduced in 93/94 by 7%, however, based on the
above facts and the savings to the City because of the I & I correction program,
further reduction is warranted.

On one hand, we have lower electric bills for cooling our
homes and businesses and cheaper pnces at the gas pumps
when filling up our cars and trucks, but higher than proiected

incorporating the newest and most advanced air poilution control
equipment during the construction stage of the two waste'to'

over what was pro.iected when the lnterlocal Agreement between
the County and Cities was approved in 1987.
As a resuit of these pollution controls, these tacilities have

the Criffin Road area of the City of Dania for the fiscal year 1995, shall be in the
amount of $23.27.
Sanitation charges will be charged continuously whether said premises is
occupied or not.
Section 2. That the foregoing charges shall be billed in advance, monthly, to
the owner of the properry serviced, beginning October 1, 1994.
Section 3. Bills are delin quent if not paid within twenty (20) days after the
initial rendition of the bill. lf not paid within the time specified on the bill. a penalty
of I 0% will be assessed.
Section 4. That the foregoing charges are subject to change if during the fiscal
year 1995, Broward County increases its disposal cost (tipping fees) which are
currently proposed to be set al 575.87 per ton. Any such increase in disposal

The portion of sE 14 Street east of olsen Middle school and south of sandpiper
woods has been sodded. The area does need to be mowed. lt is suggested that
Public Works be directed to mow this area regularly or that Sandpiper Woods be asked
to volunteer to mow this area.
Landscape work continues at Olsen. Shrubs will be planted along the fence line along
SE 14 Skeet in approximately two weeks. lt is estimated that the street repairs will be
completed in two months.
As you know, school districts are exempt from obtaining building permits and paying
fees. According to city Attorney Adler, school districts are exempt from paying impact

Pursuant to your recent meeting with Mr. David Heath of our firm, we are pleased to submit this
proposal to provide The City of Daria ('The City") with consulting services in connection with the
proposed restaurant and bait shop development on the Dania Pier. This letter outlines the services we
will undertake, the terms and con&tions which will govem the engagement, and the professional fees
and expenses to be incurred in the performance of our work.
We understand that The City seeks a restaurant developer to construct and operate a full service
restaurant on the new Dania Fishing Pier, which is currently under construction. Earlier this year, The
City adverhsed a Request for Proposal seeking an operator for the proposed facility. A single proposal
was received. Negotiations with the proposer have not progressed at a satisfactory pace and you desire
assistance in expediting the process. You have asked us as consultants to assist in moving the process
forward.
Work Prograur
To accomplish the outlined objectives, we have developed a work program to be performed by our
consulting team. Specifically, we will:
. Review the current proposal to determine the extent to which the projections and operating
assumptions are reasonable and consi,stent with industry norms;
. Prepare a brief letter report highlighting our findings and conclusions as to the achievabiJity of the
operating proiections and the suitabfity of the developer.

Should The City be unable to reach acceptable arrangements with the current proposer, we would be
prepared to provide assistance in the structuring of a new Request for Proposal to entice others to
parbicipate in the process. Specifically, we would:

to tle identified multiunit restaurant operators. Interested operators would receive a revised
Request for Proposal document to be prepared by The City staff;

Pursuant to your recent meeting with Mr. David Heath of our firm, we are pleased to submit this
proposal to provide The City of Dania (The City) with consulting services in connection with the
proposed restaurart and bait shop development on the Dania Pier. This letter oudines the services we
will undertake, the terms arrd conditions which will govern the engagement, and the professional fees
and expenses to be incurred in the performance of our work.
We understand that The City seeks a restaurant developer to construct and operate a ful1 service
rcstaurant on the new Dania Fishing Piea which is currently under construction. Earlier this year, The
City advertised a Request for Proposal seeking an operator for the proposed facitty. A single proposal
was received. Negotiations with the proposer have not progressed at a satisfactory pace and you desfue
assistance in expe&ting the process. You have asked us as consultants to assist in moving the process
forward.
Work Prog:arn
To accomplish the outlined objectives, we have developed a work prograrrr to be performed by our
consulting team. Specifically, we will:
Review the current proposal to determine the extent to which the projections and operating
assumptions are reasonable and consistent with industry norms;
Prepare a brief letter report highlighting our findings arld condusiors as to the achievability of the
operating proiections and the suitabfity of the developer.
Additional Seryices
Assistance with a New Request for Ptoposal
Should The City be unable to reach acceptable arrangements with the current proposer, we would be
prepared to provide assistance in the structuring of a new Request for Proposal to entice others to
participate in the process. Specfically, we would:
. Develop a one-page brochure highlighting the restaurant development opportunity for distribuhon
to the identified multi-unit restaurant operators. Interested operators would receive a revised
Request for Proposal document to be prepared by The City staff;
