PROCLAMATION
WHEREAS, breast cancer is the leading cause of death in women between
the ages of 30 and 50; and
WHEREAS, breast cancer also affects the male population with
approximately 1,000 new cases diagnosed each year; and
WHEREAS, recognizing the serious nature of this disease and the obvious
lack of progress in its treatment, lifestyle factors are coming to the forefront as
possible contributing causes and nutrition is being given a more serious look as
perhaps being able to play a critical role in its prevention; and
WHEREAS, through prevention, education and early detection we can
hopefully stop the spiraling increase of this deadly disease.
NOW, THEREFORE, l, Robert A. Mikes, as Mayor of the City of Dania,
Florida, in recognition of the seriousness of this disease, do hereby proclaim the
month of October, '1994

in the City of Dania and urge all our citizens to educate themselves in recognizing
the warning signs of this disease and some of the positive steps that can be

Dear Dr. Ringleberg:
ln reference to the attached contract, number LPA45, the City of Dania requests federal
funding in the amount of $1,607.00 from the Florida Fluoridation Grant administered by
the Decartment of Health and Rehabilitative Services. These funds will be used to
upgrade our community water fluoridation system.
We agree to purchase and install, operate and maintain the fluoridation equipment in
the prooer order, and use the equipment for fluoridation purposes only. We affirm our
commitment to continue fluoridation of our water supply afier grant funds have been
expended. We agree to send copies of the daily and split sample monitoring reports
(requireC by the Department of Environmental Regulation) of the fluoride residual to the
Public Health Dental Program at monthly intervals.
This contract amount is based on an approved cost-estimate. Copies of all invoices for
this equipment will be sent to the Public Health Dental Program Office within three
months of the receipt of the first payment.
We agree to comply with the conditions of the State of Florida, Department of Health
and Rehabilitative Services, Contract Number LPA45.
We are aware that the grant program is based upon the availability of federal funds
under this or any duly authorized successor grant and that the Public Health Dental
Program has no funding obligation if the grant ends without a successor grant.

The Broward Governmental Co-operative Purchasing Group is an organization
designed to enable governmental agencies to join together in purchasing goods,
services and equipment in a volume large enough to allow substantial savings on such
purchases.
Participants are encouraged to join other agencies whenever possible and cannot take
advantage of the volume savings unless they participate in joint or cooperative
purchasing.
I have compared some of the price quotes given by the cooperative with quotes from
non-participating agencies and feel that the city will realize substantial savings when
purchasing goods, services and equipment through this purchasing group.
Attached for consideration is resolution establishing policy relating to public purchasing.

ESTABLISHING POLICY RELATING TO PUBLIC
PURCHASING; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the city of Dania expends a significant portion of its annual budget
on the purchase of capital equipment, consumable materials and services; and
WHEREAS, it is in the policy of the City of Dania to obtain these goods, services
and equipment in the most cost effective manner in order to maximize savings and
reduce the burden to the taxpayer; and
WHEREAS, a recent research survey by the National lnstitute of Governmental
Purchasers (NIGP) has resulted in finding that 66% of the governmental agencies that
responded to the survey do participate in cooperative purchasing and through this
participation have benefited with the achievement of significant savings; and
WHEREAS, there exists a governmental purchasing cooperative, The Broward
Governmental co-operative Purchasing Group, dedicated to coordinating joint
purchasing between governmental agencies in Southeastern Florida, which will greatly
facilitate the realization of the City of Dania's goal to increase cooperative purchasing of
goods, services and equiPment.
NOW THEREFORE, BE IT RESOLVED BY THE CIry COMMISSION OF THE
CITY OF DANIA, FLORIDA:
section 1. That the city of Dania, in an ongoing effort to maximize savings of
taxpayer dollars, hereby establishes policy to participate in the program offered through

Bids for resurfacing various tennis, basketball and racquetball courts
An item on the October 11 agenda concerns a bid award for resurfacing and
repairing tennis, basketball and racquetball courts at various City parks in the
amount of $38,860. The funds for this project were not included in the 94/95
budget. Funding for the resurfacing of Meli Park tennis courts in the amount of
$14,000 was budgeted in FY 93/94 and can be carried over into the 94/95

Bids were received and opened on Wednesday, September 21 , 1994 for
the above referenced project. One bid was received from Recreational Design &
Construction, Inc. in the amount of $'108,654.00.
The city had budgeted $48,000.00. I feel that the bid is out of line with
what the cost should have been and recommend that we reject all bids.
I believe that the project should be bid again but in two separate
proposals. 1. All lighting work and 2. The Frost park baseball field. I would
propose that the bidding be done as soon as possible. The funds for this project
were in last years budget. lf the City wishes to contlnue this project the funds
would have to be allocated .

Trails End Mobile Home Park
Mr. Mike Conry of the airport, has been to the property and has found the
hole in the fence that Mr. Pete Prosic reported and is in the process of repairing
it. He also informed me that a security company patrols the area from 6pm to
6am and makes at a minimum of 3 visits to the site a night, 7 days a week. The
security patrol also checks the Ravenswood area.
During the day the management company checks the property and
repairs any trailers that may have been broken into.

Recently the ciry solicited bids on a design-bid basis . several prospective bidders picked up
information out none submitted actual bids on the project. Dan Oyler and I met with hvo of tireprospective oiooers to ascertain why they had declined to bid on the project . The answer being thatthe project'"/as too small to wanant the expense of doing the research and design with minimal

In Florida, cities and counties have saved taxpayers significant funds in recent years by
putting waste cbllection and recycling up for competitive bids.

There are oniy three companies doing business statewide that have the
capital, resources, and geographic reach to be serious bidders on the
most important public contracs throughout the state. Those three
companies have untii now been aggressively competing against each
other, bringing prices down.
On a large number of bid contracts, the lowest bids tend to be submitted
by the three large companies: Waste Management, Arwoods, and
Browning-Ferris.
Local hauiers may compete successfully for some bids in their immediate areas,
but none of them has the geographic reach to compete throughout the Sate of
Florida, and many of them lack the resources (facilities, rruck, etc.) to bid on
many major jobs.
The Browning-Ferris takeover, if successful, would combine two of the
three major competitors, leaving only two.
a The waste collettion industry has a welldocumented history of nj<ing
advantage of opponunities to behave anti-competitively.
Accordingly, preserving the number of major competitors is essential to
preserving competirion, and thus to saving taxpayers money.
As an example of the importance of competition, the current contnct for
residentiai recycling in Dade Counrv saved Dade Counrv taxpavers over
half a miilion dollars a year because Attwoods underbid both Browning-
Ferris and Waste Management (whose bids were practically identical) by

consolidation in the last twenty years. This has already reduced the
number of competitors.

on that contract would have been Browning-Ferris and Waste
Management. On this one contract alone, thercfore the absence of
Attwoods would have cost Dade County 5500,000.
As another example, vigorous competition in 1992 for the renewal of the
Ciry of lackonville Beach collection contmct among Browning-Ferris
(which won), Attwoods, and Waste Management brought the price of
that contract down from $655,200 per year for the previous term to
$590,400. Such a drop would not occur in the absence of competition.
A third exampie is the 1992 Orange County Schools bid. The previous
contract cost the county $381,832 per year. Athvoods won the new one
with a bid of $183,456 per year, bidding below both Browning-Ferris
($216,462) and Waste Maragement (5194,725).

In another field, coilection and disposition of regulated medical waste from hospitals
and other medical facilities, acquisition of the largest supplier of this service in Florida
(Attwoods' MedX subsidiary) by the largest suppiier of this service throughout the
United States, and the second largest in Florida @rowning-Ferris) would be likeiy to
eliminate the downward pressure on this portion of medical costs that such competition
has created.
Unless steps are taken to stop it, the trend of consolidation within tire waste indusry
wiil inevitably continue. The acquisition of the second largest waste collector in
Florida, by the third largest, will leave oniy two significant statewide service providen.
Their market dominance will become unchallengeable if they are ailowed to continue
on the acquisition traii.

Attached is an application for a City of Dania occupational license for an astrology/
fortuneteller business at 330 South Federal Hwy. The applicant is Kathy Louise
\Mlliams-Epbraim.
Chapter 12.5 of the Dania Code of Ordinances requires the City Commission to grant or
review a fortunetelling or astrology license. A hearing is required to obtain such a
license. The applicant has been given notice that this hearing is to be held at the
October 11, 1994 City Commission meeting.
Section 12.5(d) lists the criteria by which the City Commission may refuse or revoke a
Fortunetelling license. A copy of that criteria is attached. A background check is
required to be completed by the Broward Sheriffs Office concerning the applicants
moral character and business responsibility. A memo from Chief Frey indicates no
criminal history on Kathy Louise \Nilliams-Epbraim's background.
The property at 330 South Federal Hwy. is zoned C-3, General Business. A
Fortuneteller/Astrologist is a permitted use in this district. The property has been
previously used as a fortune{elling establishment. The former operation was operated
by Sofie \y'y'illiams The occupational license for Sofie \Mlliams was not renewed in
October.
ln order to obtain a license Kathy Louise Williams-Epbraim must produce a surety bond
in the amount of $1,000.00. The license fee is $1,000.00 per year.

Sec, 12.5'1. License required.
It shall be unlawful to engage in the business of fortunetelling, palmistry, clairvoyancy or
astrologi in the city urrless such business is conducted by an individual who has applied for
an? obtained a license from the city for such business. (ord. No. 20.90, $ 1, 4.10-90)
Sec. 12.5-2, Issuance and revocation of license.
(a) The city commission of the city of Dania, Florida, is hereby authorized to grant or
renew a fortunetelling, palmistry, clairvoyancy or astrologr license for any period of time not
exceeding one year to any individual applying therefor on a form to be provided for in para'
graph (b) of this section and the liling by the applicant of the bond required by section 12.5.5
of this chapter.
(b) The form on which application shall be made for a fortunetelling pa]mistry, clairvoy.
ancy or astrologr license shall require the following information:
Name of applicart;

Besidince and business address of applicant;
The length of time for which a fortunetelling, palmistry, clsirvpyancy ot astrolory
license is desired;
(4) A statement as to whether or not the applicant holds, or has held a fortunetelling,

body or licensing authority; a list of such licenses and a stat€ment of the time, place
and by whom issued; a statement as to whetber any state, municipality, governihg
body or licensing authority has ever refused to issue or to renew a fortunetelling,

individual applying therefor, the city commission shall refer the application to the Broward

character and business responsibility as he deems necessary for the protection of the public
good, except that the city commission may waive this requirement with respect to an appli
cation for renewal of an existing license by any individual holding an unexpired fortunetell'
ing, palmistry, clairvoyancy o, a-st,olory license issued under this chapter if an investigation

The sheriff or his deputy shall cause the investigation herein provided for to be made within
a reasonable time and shall certify to the city commission whether or not the mora-l character

(d) A fortunetelling, palmistry, clairvoyancy or astrolory license may be revoked by the
city commission or al application for issuance or renewal ofsuch license may be refused by the
city commission, if they determine alter notice and hearing that:
(1) The applicant or license'holder is not an individual of good moral character aad
business resPonsibilitY; or
(2) The aPplication of the applicant or license holder contains any false' fraudulent or
misleading materia.l statement;
(3) The applicant or license holder has perpetrated a fraud upon any person whether or
not such fraud was perpetraled in the conduct of the business in the city; or
i4) The applicant or license holder has violated any of the statutes of the State of Florida
relating to fortunetelling, palmistry, clairvoyancy or astrolo6t; or

Sec, 12.5-3. Judicial remedy by circuit court.
Any person aggrieved by any decision ofthe city commission may, within thirty (30) days
from the date of rendition of such decision, apply to the circuit court for the Seventeenth
Judicial Circuit in and for Broward County, Florida, for a review of such decision of the city
commission, which said review shall be Iimited to a Petition at common law for a writ of
certiorari. (Ord. No.20.90, S 3,4'10-90)
Sec. 12.5.4. License fees.
The fees for a fortunetelling, palmistry, clairvoyancy or astrologr license sha.ll be in the
sum ofone thous6nd jsllgrs ($1,000.00) for each twelve.month period or fraction thereof. (Ord.

Sec. 12,5.6. Bond.
Every applicant for a fortunetelling, pa-lmistry, clairvoyaacy or astrolory license shall file
with the clerk-auditor of the city a surety bond running to the City of Dania, Florida, in the
amount ofone thousand dollars ($1,000.00) with surety acceptable to and approved by the city
commission conditioned that the applicant, if issued a fortunetelling, palmistry, clairvoyanry
or astrologr license, will comply fully with aII the provisions of the ordinances ofthe city, and
the statut€s of the State of Florida and will pay all damages which may be sustained by any
person by reason of any fraud, deceit, negligence or other wrongftrl act on the part of the
licensee, his agent or employees in the conduct of the licensee's business. A Iiability insurance
policy issued by an insurance company authorized to do business in the State of Florida which
conforms to the above requirements may be permitted by the city commission in its discretion

Sec. 12,5-6. Place of conducting activities.
No fortunetelling, palmistry, clairvol ancy or astrolopr activities shall be conducted rvithin
any of the residential areas of the city or other areas not zoned for such activity. (Ord. No.

(5) The applicant has been convicted of any crime or misdemeanor involving mora.l tur.
pitude; or
(5) The applicant or license holder has conducted his or her business in the city in an
unlawful manner or in such a marner as to constitute a breach of the peace or a
menace to the heaJth, safety or general welfare of the public.
(e) Notice of the hearing provided for in paragraph (d) above shall be given in writing to
the applicant or license holder as the case may be. Such notice shall be mailed, postage prepaid
to the applicant or license holder as the case may be at his Iast known address at least live (5)
days prior to the date set for hearing. The applicant or license holder as the case may be shall
