Dear Mr. Flatley:
On behalf of the South Broward Student Government Association, I would
like to take this opportunity to extend a sincere thank you to the Dania City
Commission. Had it not been for your extreme dedication and superb
organization, ow '1994 Homecoming Parade would have been impossible!
As a direct result of your efforts, over 300 students will parade down U.S. 1 on
Friday, October 28, 1994 at 2:15 p.m. For the past month, clubs and
organizations across our campus have been preparing for this event. Had it
not been for your support, their efforts would have been a waste of energy.
Any city can talk about how much they care. It takes a true commitment to
excellence to lead by example. We believe in setting goals and striving for
excellence. We would like to thank you for allowing us the opportunity to
reach our goals.
Please accept my invitation to watch the South Broward Bulldogs in action
during our 1994 Homecoming Parade. The parade will step off at 2:15 from
our campus and end just north of Stirling Street. Once again, thank you!

AN ORDINANCE OF THE CIry OF DANIA, FLORIDA,AMENDTNG SUBPARAGRAPH (b), SECTTON 4,
ARTICLE 3 OF PART III OF THE CITY CHARTER TO
PROVIDE FOR THE APPOINTMENT AND REMOVALOF DEPARTMENT HEADS BY THE CITY MANAGER;
PROVIDING FOR CONFLICT; AND PROVIDING FORAN EFFECTIVE DATE.
BE IT ORDAINED BY THE CIry COMMISSION OF THE CITY OF DANIA, FLORIDA:
Section 1. That subparagraph (b) of Sectron 4, Article 3 of Part lll of the charter of
the City of Dania, Florida, be and the same is hereby amended to read as follows:
"Sec. 4. Powers and duties:
(b) To appoint or remove all department heads and other subordinate
officers and employees except the city attorney who shalt be apoointed
bv a majority vote of the city commission and assistant city attornells
who shall e aooointed bv the ci attornev."
Section 2. That except as herein amended. all other provisions of said Article 3 of Part
lll of the City Charter shall remain in full force and effect.
Section 3. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict herewith be and the sa:ne are hereby repealed to the extent of such
conflict.
Section 4. That this ordinance shall be in force and take effect immediately upon its
final passage and adoption.

As you know the Utilities Department is conducting its own I
study on the remainder of the sewer l-ines in the City. We
made numerous repairs over the past two years and there

1.4 Bud Palm, Utilities Director, reponed that the engineers original estimate on the IEaI
System was 1.9 million gallons of wasre water. The dry weather infiltration was 1.3 million
for a total of 3.2 million gallons per day contribution. The city's contribution has been
reduced to 2 million gallons a day.. The original cost for the repairs and SSES Portion was
$988,900 of which thi engineer expeoed only 35O,OOO gallons removed and the City has saved
$744,000 to date. commissioner Jones commended Mr. Palm and his depanment for their
effons to reduce sewer rates. Mr. Pelm advised that the Sewer Budget is reduced by $400,000
this year and that sewer rates should come down even more next year. Discussion followed
on the need to address water conservation in the future.
A motion was made by commissioner Jones, seconded by commissioner Benino to adopt the
resolution extending the proposal of Madsen/Barr corporation ro supply labor, equipment
and materials to install 8-inch, lGinch and l2-inch Uliners in manhole sections of the City's
Sanitary Sewer System and approving an additional expenditure of an amount not to exceed
$60,000.

1.5 City Manager Flatley presented a list of items that need to be declared surplus from the
Public \Uorks Depanment. He mentioned that the items s'ill be advenised and circulated in
the community for bid offering. commissioner Jones requested city Manager Flatley to
distribute a lisi of items being considered for surplus to the commission before they are
cannibalized. Mr. Flatley confirmed that the City takes whatever pans that are reusable from
vehicles prior to them being declared surplus. He suggested to continue these items if the
Commission wants more time for review.
Mayor Mikes read the list of items being declared surplus. He cautioned that advertising may
.or, rno.. than what may be gained from receiving bids and recommended to use a local paper
in Dania for the advenising. city Attorney Adler stared that the value amounE are
determined by garage perronn"l and that the real value is the amount the city can obtain
when they r.il ,h" ii.-r. Commissioner Jones mentioned his concern that items are stored in
the Public rVorks Compound for extended periods of time before being declared surplus and
that vandalism is taking place. Commissioner Hyde suggested to provide a more secure area
for items in an effon to prevent vandalism.

Budget constrarnts have caused most departments to handle the same or in some cases, increasing
work loads with less statf. Time and fiscal resources are limited.
Employee morale has suffered due to the increasing work demands, the perception that their efforts are
not appreciated, and to some degree, over compensation issues. (l'his however, should be less of a
factor now that employees have received their C0LA's).
There is a need to demonstrate t0 our customers - citizens, businesses and visitors - in the community
that our organization delivers an ever increasing quality and quanttty of service which makes Dania a
great community in which to live, to do business, and to visit.
With respect to the latter two areas, if we are succ..ssf ul in raising others awareness of our community
as quality focused; this will have direct and positive impact on our overall economic development
pr0grams.
Through the recently established Broward Ouality Council, faining is oflered at reduced rates to allow
business and government entities to obtain high quality training from nationally recognized firms to
achieve success in implementing quality initiatives
Dania has a size and uncomplicated organizationar structure which is optimal for success of this type
of strategy.

T0ivl is not a one-time experience or quick fix, but with it represents a change in our corporate culturefta: can provide a framework for continuous improvement through enhancet communication, teambuiiding, problem solving, process improvement, and understanJing of what is necessary to achievecusiomer satisfaction.
Attached is a suggested training package through the Broward Quality Council to begin implementation. While

Dania, Florida - Plans are being finalized for the City of Dania,s three day gOth
Birthday celebration being held in conjunction with Broward county,s 22nd Annuai
Pioneer Days November 4 - 6, 1994. The event wi be co-hosted by the Dania
Historicaj Society and the Broward County Historical Commission.
The Dania 90th Birthday celebration festivities will kick-off with a fund-raising
cruise aboard the vegas Express on october 27th. Tickets are available for the low
price of s20 per person. The Dania cultural Affairs committee will present .steppin,
out ln The Nlneties" - an evening of dinner and dancing at the l.T. parker community
center on october 29th. Tickets are g2o per person. For more information on these
events please call Dania City Hall.
The Nyberg/Swanson House will be dedicated at 5:00 pM on Friday, November
4th which is the actual 90th birthday. The goth Birthday celebration continues on
saturday and Sunday November sth and 6th and will feature actvities for the whole
family. The Main Entertainment stage will include live entertainment from such well
known bands as "The Fabulons", "Sha-Shaty,, and .patty Lea & The Southem Jam,.
children will enjoy the activities provided by the Broward sherifrs office such as a
puppet show a robot demonstratron and the Mounted patrol as well as fun and games

such as a greased pole climb, bounce house and face painting. A birthday
proclamation ceremony and cake-cutting will take place on Saturday at 1:30 PM on the
Main Stage. An antique show and sale will run continuously throughout the weekend
along Federal Highway.
The Pioneer Oays theme is "Tales of Broward Cities" and has a variety of
events. Pioneer Days activities, which will also be at City Hall, will begin with an
opening ceremony at 10 AM on Saturday, November 5th which will honor pioneers from
cities throughout Broward County as well as Dania. The two day observance will
feature over 50 exhibitors, history talks, recognition awards to Pioneers from throughout
Broward County and storytelling plus much more.
Dania, Broward County's oldest city, was incorporated in 1904. The majority of
the citizens at that time were farmers who benefited from the rich soil and made a living
growing tomatoes. Many were of Danish Heritage - hence the name Dania. The town
grew with the help of Henry Flagle/s railroad which shipped tomatoes to all areas of the
United States. Dania became known as the Tomato Capital of the World."
ln 1945, the first of many antique stores opened and it is believed this sparked a
resurgence in Dania's growth and today, Dania is known as the "Antique Center Of The
South." The city is also recognized as a center for Florida's prosperous marine
industry, many tounst attractions and the city's 17,000 friendly people.
All events will be held at Dania City Hall, 100 West Oania Beach Boulevard.

Ilnder thesecriteria, it is beyond peradventure that the nodified developnentplan is a su.bstantial deviation to the previously apProved DRI .
A substaoti.al deviation must be submi.tted for DRI review whenthere is a change j.n the plan of develoPment. S 380.05(19). It iscounsel's view that review is required at the Point that anincipieat idea crystallizes into a specific uodified pJ.an of
dewelopment. The actions of Broward County clearly evidence theexistence of a speci,fi.c modified pIan. The county has further
cotrutritted itself to the modified plan by the actions desclibedearlier in thj-s correspondence.

Broward County is presently in violation of Chapter 380. Thecounty has not filed a notice of proposed change with the City ofDania as required by S :40.06(19)(f)2. The notice of proposed
change initiates the DRI rewiew process. A vi.olation of the

Enclosed please fino a copy of a Joint Participation Agreement entered into between Broward
county and the state of Florida Department of rransportation. The Joint participation
Agreement commits the State of Florida to paying $2,733,800 for the construction of Runway
9N27L to transport siandards; and $6,808,600 to acquire land for the approach and transition
zone of Runway 9W27L. ln reality, the acquisition of land is for the construction of the new
9Rl27L transport category runway. The City of Dania issued a development order for the Fort
Lauderdale-Hollywocci International Airport terminal expansion. A copy of the Dania resolution
is attached hereto. lt is clear that the expansion of the runway to the transport category is a
substantial deviation nom the development order pursuant to 5380.06(19)(b)(2) and that
acquisition of land is cresumed to create a substantial deviation pursuant to S38O.06(19XeX3).
Broward County, as the developer, has not made application for the substantial deviation of the
development approval and needless to say, the cig of Dania has not had an opportunity to
review any such appiicarion.
The Florida Department of rransportation is participating in the funding of a development
without the developer satisfuing the requirements of 5380.06. The City of Dania requests the
Florida Department cf Transportation to vacate all .loint participation agreements entered into
with Broward county uniil such time as Broward county has applied for an received the
requisite developmer:i orders.

The City of Dania hereby notifies Broward County that the development
I described in the 1994 Fort Lauderdale/Hollyivood lntemational Airport Mister plan is a
I violation of chapter 380.06 Flonda statutes. specifically, the acquisition of the 97' acres to the east of the airport for the approach protection area or the extended runway,the retention of the 106 acres of the 'Ravenswood area' for airport uses and theextension of runway 9N27L are each a substantial deviation ftom the approved airportdevelopment orders.
The city of Dania hereby demands that Broward county submit an applicationfor development approval within 60 days and advise the city within 30 days oitne intentto submit the application

Arbor Day in the Ciry of Dania.
(b) Dan Oyler reponed that the Nacional Arbor Day Foundatioo has ooce again
designated Dania as a Tree Ciry. He then advised that Collins Elementary anC Dania
Elementary will be celebrating National Arbor Day and encouraged the Commission to
amend cheir programs.
Mr. Oyler advised thar Ellen Nyberg-Stoinoff donated funds towar& moving che Nyberg-
Swanson house and has also donated sable palms from her house in Deerfield;o be planted
around the Nyberg-swanson house chat is being moved near the Chamber of Commerce.
Discussion followed on rhe need to prepare an ordinance on tree protecrion anc swale are3
planring for the next *'orkshop. Vice Mayor Mikes advised that people are trinming trees
anywal rhey wanr and not in accordance with the National Arbor regulations. Mr. Flade.r
confirmed that rree trimming is a problem to enforce in the Ciry.

1. Will Allen, Growth Management Director, presented a chart on the stacus of impacr
fees for Habitat for Humaniry and L.E.S. lvlr. Allen advised that the Ciry cannot *'aive waler
and sewer impacr fees, however, the City has waived building, inspection, police and 6re
impact and general interim ser'ice fees in rhe past.
Mike Smith, Personnel Director, advised rhat a request is being made through the
Community Development Block Grant progran to pay rhese impact fees for these
organizations. He cautioned that these fees mav not be covered based on CDBG requiring
that funds cannot be issued for projecs thar have already been staned or completed. He
advised that even if the Ciry is successful in recei'ring grant funds, they will not be available
until Ooober 1993.
Mr. Allen advised that these fees can add up based on the fact that Byrd Poinr built 25 single
family unirs, Dania Housing .{uthoriry recently built't0 units, and chat DEDC is considering
24 townhomes next to Collins Elementary. tVater and sewer impact fees are used for
infrastructure, extending wate: and sewer lines, and for treating plants and ahhough building

inspecrion fees have been waived, rhe City still incurs cos[s to go out and complete rhe
inspections for these organizacions.
Commissioner Berrino expressed his concern that a precedent will be set and that che Ciry is
nor in a financial position to be waiving these costs. He suggested to consider Ciry Artoroey
Adler's idea of liening the propeny and collect the fe'-s when the propeny is sold. Ciqv
\lanager Flatley advised rhar liening the ProPerry does not always work when properrv is
somerimes abandoned and rurned back over to the organization.
FL\BITAT FOR HIJWIAMTY
Discussion followed with Habitat for Humaniry rePresentatives on the possibiliry of taking
our a second morrgage with no inrerest for che amount of the impact fees so that building
could go forward. The mongage maturity date could be set the same dare as the first mofgage
on each properr,v. Vice Mayor Vlikes suggested to leave rhe amount of interest free for 1C
vears as an incentive to pay lhis off and then 3olo ilte:est would accrue after 10 '7ears.
Ciry Anorney Adler mentioned rhat promissory nores P'ere suPPose to be executed on each
Habitat for Humanity home and that some of the homes did not have promissory notes
e:ecuted by rhe Building Department. Anorney Alls*'onh questioned the legality of going
back and liening a propeny thar has already closed.
llayor Grace requested to add the Habitat for Humaniry request to rhe April 27 meering.
.r'[r. Graham, LES, stared the difficulty of building lo*'income housing with limired funds
from the Community Block Grant Program. Mr. Graham advised thar clear title has to be
obrained on rhese properries anci that financial instirutions would not accept a lien for irnpact
fees. Discussion followed oo whether these ProPefties are tax exemPt and not on the u-t rolls
s'hich is different from the othe: projects.
