PROCLAMATION
WHERDAS' Black History Month recognizes the African-American People who have championed the
cause of Freedom and strengthened the fabric ofthis country. During this celebration, we pause to
remember the countless contributions of Aliican American men and women who have made our Great
Nation.
wIfEREAS, today's African-American History Month began in 1893, and was renamed Negro History
week in 1926 through the efforts of Dr. Carter G. woodson, and, in 1965, was renamed Black History
Month.
WHEREAS' it is in the Spirit of Love of Country, respect for American Democratic Principles and
Institutions that it is upon a Commitment of Solidarity with the heterogeneous ethnic, racial, cultural and
religious population of the Black Communities.
WTTEREAS' Black History Month offers us an opportunity to look at the events and pioneers who
helped shape this country in many ways and to recognize the accomplishments ofa few who have served
our Great City: Dr. Von D. Mizell (helped found Provident Hospital in 1938 and the NAACP's Broward
Chapterin 1945. OnJuly4, 1961, he led a march to Fort Lauderdale Beach to protest inaccessibility of
"black-only" beaches.); Boisy N. Waiters (First Black Commissioner); Chester Byrd (First Black
Mayor); J.A. Ely (First Black Principal of Attucks School); Albert Jones (Commissioner and Community
Leader); and Bobbie H. Grace (First Black Female Mayor and Commissioner).
NOW' THEREFORE, I, John Bertino, Mayor of the Great City of Dania acknowledge the contributions
made by the African-American Community to the multicultural diversity of this City, and do hereby
proclaim the month of February, 1997 as

Formal Presentation of Commendation to Pete Heng
February 18, 1997
Attached is form of commendation which has been presented to Pete Heng upon the
recommendation of his Battalion Chief, Michael Bernardo, the contents of which are
self-explanatory.
The actions taken by Firefighter Paramedic Heng epitomize the highest performance
standards which can ever be expected from someone in our chosen profession; I
therefore feel that this commendation should also be formally presented to Pete at the
next commission meeting.

BE IT RESOLVED BY THE CIry COMMISSION OF THE CITY OF

Section 1. That the commissioners desire and do herebygoon
record that it is the intention of the City Commission of the City of Dania to
convey said strip of land to the adjoining property owners except for an
easement for utilities which will be retained by the City.

Dear Dr. Marston:
The purpose of this lener is to request that you enact regulations
to restrict certain gear types on the permitted artificial reef sites in
Broward County and protect these areas from commercial overfishing
that is currently taking place. Recreational anglers are experiencing
increasing conflicts with commercial fishing vessels over Broward's
artificial reefs, and many gamefish are being depleted. Broward's
artificial reefs provide extremely valuable economic and social benefits
and have been created and paid for by recreational fishing interests.
These sites must be protected for the benefit of those who paid for them
and for whom their use was intended.
Broward's artificial reefs have been placed at a cost of hundreds
of thousands of dollars. This money came from private donations from
recreational anglers, recreational fishing and diving organizations, and
other sources intended for recreational use. The Pompano Beach
Fishing Rodeo along has contributed $300,000 to reef sites in Broward
anr rnh/
Broward's artificial reefs face special problems not experienced
in other areas of the state. Because most of the reefs are placed in
relatively shallow water, many are already shared by both divers and
recreational anglers. Adding in a nontraditional commercial fishing
factor, seriously over stresses an already fully utilized resource. Also,
the natural reef area itself is much narrower than Dade County's reef
area to the south, and Palm Beach County's reef area to the north. This
forces Broward County's 43,000 boaters to operate in an extremely
narrow strip of reef area if they wish to take advantage of the artificial
reefs. Since the reefs are located much closer to shore than in other

counties, even small outboards can and do access the reefs, adding to
the congestion over the artificial reefs.
We now face a serious problem of having commercial fishing
operations depleting the gamefish species found at the artificial reefs
such as amberjack, grouper, snapper, king mackerel, jack, little tunny,
cobia, barracuda, and others. With the development of markets for
previously non{argeted species, there are practically no species that
aren't feeling the commercial pressure.
While recreational anglers fishing these sites are guided by bag
limits, and a strong catch and release ethic, commercial fisherman are
striving to make profits by catching as many fish as possible, and are
subjeci to much higher landing quotas; or in many cases, no limits at all'
Does it make sense to restrict a recreational angler to one amberjack
while the commercial vessel fishing next to him over an artificial reef
catches as much as his boat will hold?
Broward County has approximately 43,000 registered boats plus
many more boats that fish here which are registered in other areas'
About 87% of all powerboats are used for fishing and many utilize
Broward's artificial reefs on a regular basis. Saltwater anglers fished in
Florida in 1995 a total of 21.1 million days. Way back in 1991, artificial
reefs in Florida averaged 2,539 visits per reef by anglers' lt is probably a
lot higher in Broward County where we have so many boats and the
reefs are so close to shore, and no doubt the number has grown
significantly in the last 6 Years.
Economically these reefs are even more important. ln 1991,
Florida recreational anglers spent S1.92 billion generating an economic
output of $3.5 billion and supported over 58,000 iobs. They also
contributed more than $1 15 million in state sales tax. These numbers
have no doubt increased substantially since 1991. Broward County
contributes 4 to 5 o/o of these totals.

$893 per year to give up fishing at artificial reefs. Even none reef users
value artificial reefs. South Carolina anglers who don't use the reefs are
willing to pay $226 per year to have the reefs available for future use.
The total economic impact of sport fishing at South Carolina artificial
reefs is $ l7,823,00. None of these figures take into account the huge
value of the reefs to sport divers. lf these reefs are depleted by
commercial overfishing, they will lose their value as a recreational asset.
What we are suggesting is that it is hoth socially and
economically advisable to protect these dedicated reef sites for the
benefit of recreational anglers and divers to the greatest extent possible.
Commercial fishing is not only depleting the resources on the reefs, it is
reducing the incentive for recreational anglers to continue to support
Florida's aftificial reef program.
We ask that you take the following steps to protect Broward's
artif icial reef sites:
Prohibit the use of any angling gear other than manually
operated rod and reel not attached to the boat. Rods must
be at least 40" from center of reel to tip of rod.
2. Terminal tackle should be restricted to not more than 2
hooks per line.
3. Bang sticks and power heads should be prohibited from
artificial reef sites.
4. Fish taken from artificial reef areas should be protected from
commercial fishing pressure. This can be accomplished by
prohibiting vessels within the permitted reef sites, which
have fishing gear in the water, from possessing any fish
which is in excess of recreational bag limits, and further
limit the possession of species which are not sub.iect to bag
limits to a maximum of 5 of each species per angler with
the exception of certain small species which are used for
bait including goggle eyes, blue runners, herring, pilchards,
menhaden, and bhl lyhoo.

Ordinances of the City of Dania be and the same is hereby amended to read as
follows:
"Sec 33-4 Regulation and use of waterways and facilities related thereto.
Section 3. That all ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed to the extent ofsuch conflict.
Section 4. That this ordinance shall be in force and take effect immediatel v
upon its final passage and adoption.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF DANIA, FLORIDA:
Section 1. That Section 33-40(8), Article ll of Chapter 33 of the Code of
(8) Recognition of U.S. Coast Guard and U.S. Army Crops of
Engineers rules and regulations. All operators of watercraft
are hereby charged with knowledge of and compliance with
all established rules and reoulations of Broward County
Reqistration Requirements for boats, the U.S. Coast Guard,
and U.S. Army Corps of Engineers governing boats, docks
and waterways, all of which are incorporated herein and
made a part hereof by reference."
Section 2. That except as herein amended, all other provisions of said Section
33-40, Article ll of Chapter 33 shall remain in full force and effect.

The Unsafe Structures and Housing Appeals Board met on July 29, 1996 and found that
the addition was constructed without a permit and occupied without a certificate of
occupancy and therefore is unsafe.
Owner was given 60 days to apply and obtain a variance with an additional 30 days to
obtain variance.
If at the end of 90 days the owner has done neither, then the building official would take
the appropriate action to demolish the building. The petitioner applied for a variance on
October l, 1996.
The Planning and Zoning Board after hearing testimony at the January 22, 1997 meeting,
recommended approval of this variance request as it conformed to the criteria for
reviewing variances set forth in Section 10.13 ofthe Zoning Code.

Auto Body" operates at this site as a non-conforming use. Section 8.20 of the Zoning
Code indicates that no existing building or premises devoted to a non-conforming use
shall be enlarged, extended, reconstructed, substituted or structurally altered except
when changed to a conforming use. There are also requests for variances to the side
yard and rear yard setback regulations of the RD-6000 zoning district as listed in the
Section 4.202 ot the Zoning Code, Schedule of Lot, Yard and Bulk Regulations. The
requests for a side yard setback of 5 feet rather than the 7 feet required and for a rear
yard setback of 5 feet rather than the 15 feet required.

DATE: February 19, 1997
A3,112 square foot building currently exists on the site, and the applicant is proposing a
2,780 square foot addition. The current zoning of the property is Community Business
(B-2). The applicant proposes to utilize the building as an office with ancillary warehouse
space which is permitted use in the B-2 district. Primary access to the site is proposed on
the north side ofthe site and a one way exit only is proposed on Ravenswood Road.
In advance of the Planning and Zoning Board meeting, the applicant modified their site
plan to address the issues outlined by the staff; and the staff finds the application
consistent with the City's codes and recommends approval.
The Planning and Zoning Board reviewed this request at its January 22, 1997 meeting and
recommends approval ofthis request as the proposed plan conforms to all applicable City
codes.

Please schedule this item for the February 25, 1997 City Commission meeting. This is a
site plan review for a proposed 2,780 square foot addition to the office building at 4675
Ravenswood Road, (Anglers Avenue). This site is located at the southwest corner of
Ravenswood Road and Southwest 46m Court, and the request is by GSD Investments, Inc.
This parcel received site plan approval for an addition at the City Commission's June 25,
1996 meeting with a slightly different configuration. The original intent was to acquire a
lot in the back and add it to the property. They were not able to complete that
transaction, so they are now before the Commission with this amended site plan.

The l9th Anniversary edition ofthe Dania Marine Flea Market is scheduled for April 24 through
April 27, 1997 at the Dania Jai Alai Fronton parking lot. The Marine Flea Market's positive
economic impact to the City of Dania has increased each year as the popularity of the event has
grown. For 1997, we've expanded the to four days and we're planning additional promotions and
activities to make the Dania Marine Flea Market even bigger.
As in past years, the Marine Flea Market vendors will be utilizing open-sided canopies for
protection from the sun and heat. I would like this lefter to serve as our request to temporarily
erect these canopies on the Fronton parking lot.
If it is necessary to bring this matter before the City Commission, I will be happy to be in

RE Tent Permits for Annual Marine Flea Market

Ralph Brown of Dusky Marine writes to us questioning the requirement, or exemption
therefrom, of obtaining permits for tents or canopies. He is correct in his statement that Dusky
has obtained their permit each year. He is equally correct in that other tents have been erected
without permits having been issued. He is incorrect, however, in his request to be "exempt from
pulling permits...also", as no one is exempt fiom the requirement.
The problem is that most vendors are unaware ofthe permit requirement. I would
suggest that the event's organizers make it clear to all vendor applicants that permits are required
to be obtained prior to the opening day. In this fashion, we should be able to have all tents
permitted. We cannot "exempt" anyone from the permit, as it is a City and Building Code
requirement, but the commission could choose to waive the fees.

Attached please 6nd a letter which I received fiom the Aragon Group over the
holidays regarding the Dania scholarship which was included as part of the SeaFair
settlement agreement.
As you are well aware, the City Commission was requested to make
recommendations to tie university for scholarship recipients. I will be glad to appear
before the commission to discuss this issue, or to have others from the university also
appear for informational purposes.
At this point, I would zuggest that we target at least one student for the Fall l99Z
term. we would also suggest t}at the scholarship be need based for an undergraduate
student. It could either be a freshman or a transferring student.
The total amount available, $5,146.87, allows us to offer a firll tuition and book
allowance scholarship of $2,500.00 annually (distributed $1,250.00 per term) for a fi.rll time
undergraduate student. (In-state tuition c,rrently costs about $l,8OO.OO per year plus
books, and we anticipate an increase by next fall ofbetween 7 to l0 percent.)
Since this amount would allow for support of two firll time students, we could
award both scholarships for FaIl 199?. However, if distributed in this manner, no new
scholarships would be available until one of the students graduated or left FAU, since most
students need such support t}roughout their complete undergraduate program. A better
suggestion might be to award one scholarship in Fall 1997 and a second in Fa[ tgga, so
that new applicants could be staggered.

Dear Mr. Smith
The Dania Economic Development Corporation has entered hto an agreement with Bette
Baron and Seymour Bernstein to acquire the above-referenced parcels of property. The property will
be incorporated in the Dania Economic Development Corporation program to provide new housing
for low to moderate income families.
The City of Dania Finance Department has advised our firm that there are numerous
outstanding claims of lien on the properties for lot mowing and/or debris removal. We request that
the Dania City Commission consider waiving the amounts due on these parcels of property so that
the Dania Economic Development Corporation may acquire same and use them in the housing
program.

SUBJECT: JOINT HOLLYWOOD/DANIAFEDERAL HWYPROJECT-UPDATE
1. Hollywood PD met with the State Attomey's Office to discuss the prosecution side of our
program. It appears the S.A. office will be cooperating with us on this. I will have more details
on Friday when we meet with Hollywood.
2. We have asked Dania Code Enforcement, Fire and Building departments to meet with us this
week to discuss and plan out ourjoint efforts. We plan to contact owners of motels along Federal
Hwy. to make sure they are in strict compliance with all city codes and ordinances.
3. We are also putting together a list of names of hotel/motel owners on Federal Hwy and we will
send them a letter, under your signature, inviting them to join us in our efforts (to be ow
partners) to solve the prostitution problems on south Federal Hwy.
As I mentioned, we will meet again with Hollywood PD at 10:00 on Friday February 28 at
H.P.D. to review status ofour program and develop a timetable for our next phase. Please ask Lt.
Griffin to attend. As you know, we concieved this program back in November of '96. I have
attached a copy of our original proposal.

As you know, prostitution and sfteet level narcotic activities have long been a problem along the
south end of Dania's Federal Highway and Hollywood's north Federal Highway. Ongoing efforts
by our street crimes and road patrol units have generated good(albeit short term) results. A long
term solution to these problems is necessary to the improvement of the qualipy of.life and a more
attractive business environment for this highly visible part ofour City.
During our last monthly meeting with Sgt. Healey, of the Hollywood P.D., we discussed the
possibilities of a joint project. Hollywood is facing the exact same problem as Dania therefore it
makes sense to address both issues at the same time.
Accordingly, I would like to propose the following:

To develop a comprehensive strategic operations plan concentrating on the suppression ofstreet
level prostitution and related narcotics activities and subsequent enhancement ofthe quality of
life and business climate and community control through the maintenance of public safety.

Prostitutes and drug addicts are a common sight in this highly traveled portion of US Highway I
Burglaries, both business and residential, are a considerable problem in both the Dania and
Hollywood areas. It is safe to assume that the two are related. When prbstitutes and addicts face
strong street level enforcement in Dania, they nrn south to Hollywood. When Hollywood has
strong enforcement in their area, they run north to Dania. Additionally, the heavy concentration
of low priced motels in the Federal Highway corridor are frequently used by prostitutes and drug
addicts for their business. This makes it far more difficult for law enforcement to fight the street
level problem. It is suspected that several ofthese motels may be facilitating this activiqv or at
the least, they are believed to be a significant contributor to the problem. When not using a
motel, poor lighting and unlighted alleyways provide cover for prostitutes and addicts to conduct
their business and creates an unsafe environment for police.
THE GOAI,:
To eliminate the street level prostitution and related narcotics activities, to strengthen the
residents and businesses into a more proactive neighborhood and business watch groups, to train
businesses and residents in crime prevention techniques and to develop an ongoing partnership
between the business communiry, area residents and law enforcement that rdstores and maintains
an improved quality of life in their neighborhood.
OR.IF'CTIVES:
* To conduct surveys and identify problems in the Dania and Hollywood portions of U.S. I .
* To do a comprehensive analysis to determine the size and magnitude of the problem.
t To contact the State Attomey's Office as well as legal advisors and explore legal avenues and
statutes that may help us to deal with the motel side of the problem.
* To contact the HoteyMotel Association and explore available avenues and State guidelines and
regulations, if any, covering the motel side of the problem.
r To contact Code Enforcement artd Fire Department Units from Dania and Hollywood to
discuss existing ordinances and regulations which may assist us in the solution.,
*To develop a multi phase action plan.
*To establish a special operations plan for each phase as needed.

This notice pertains to residential areas of
the City of Dania. This notice does not
apply to commercial operations or
residential owners in complexes of five (5)
units or more, or four (4) unit complexes
that have chosen the option of commercial
pick up.
DEFINITIONS:
Bulk trash item6 are fumiture, concrete
rubble, mixed roofing material, rock,
gravel, equipment, wire, cable, and white
goods (appliances).
Bulk vard trash refers to all types of palm
fronds, large cutting of vegetative and
wood matter which are part of a normal
yard maintenance. All limbs and other
wooden material must not b€ over six (6)
inches in diarn€ter
Please adhere to the following rules or
your trash will not be picked up subjeciing
you to a !!&
'l . Please bag all loose grass clippings
and leaves. These are NOT bulk trash
items and should be placed out with
your regular household garbage twice
per week. The bulk trash truck will
lqlpick up grass or leaves.2. Bulk trash items (furniture, etc.), bulk
yard trash (kee limbs) and white goods
must be separated and not co-mingl6s.
The trash lrucks will NOT pickup piles
with these items mixed together.3. Never mix household garbage (food,
bottles, etc.) with bulk trash. Place
these items in required containers for
regular garbege pick up.4. lf you have an alley, place your trash
in the alley. lf there is no alley, place
your trash on the curb/swale in front of
your home near the roadway. (Use the
swale area where pickup is not
availablel.5. Large appliances will be collected
along with the regular bulk pick up.

trash out.

8.7 Discussion of prison/work release status and possible moratorium

City Manager Smith advlsed that a letter from Chief Rick Frey, BSO,
states that the Wackenhut Corporation has decided to construct the work
release facility at a location on Sample Road and that Dania is no longer
being considered as the site location.
VERBATIM TRANSCRIPT ON FOLLOWING COMMENTS:
COMMISSIONER MIKES. "Some of the concern was in the community, I
mean we all know we had a candidate running that... I wasn't sure
whether he would have to abstain on this if it was still running around, you
know sometime after the election and he was up here. But, I would like to
ask one question, though ..."
MAYOR BERTINO: "So, that's a mute point, at this, at this...."
COMMISSIONER MIKES: "Well, maybe it's a mute point."
MAYOR BERTINO: "Go ahead."
COMMISSIONER MIKES: "Let me raise one issue, huh, to the City
Attorney - lf we discuss budgetary items in reviewing a budget that deal
with the Sheriff's budget, etc, etc.... and we are making decisions on the
budget; if someone's in the employee of the Sheriff sitting up here, will he
have to abstain"?
Clry ATTORNEY ADLER: 'lf he gets elected, yes."
COMMISSIONER MIKES: "He will have to abstain on the budget?"
CITY ATTORNEY ADLER: "Sure, sure"
VICE MAYOR GRACE: "Why bothe/'
MAYOR BERTINO: 'Well, I, I don't know why because l, l'm on the
School Board and when we make any deals with the School Board, l'm
on the School Board Budget, l'm hired by them."
VICE MAYOR GRACE: "We're employed, he's employed by us, John.
You know he is."
MAYOR BERTINO: "No, ok, lthink...."

"So, he couldn't vote on the budget, thank
CITY ATTORNEY ADLER: "You don't need his vote anyhow cause, huh,
they'll be enough votes to approve it without his."
MAYOR BERTINO: "No, I don't, I think that is something that will have to
be addressed at the time. Anything further on that Commissioner Mikes."
COMMISSIONER MIKES: "No, I and that's good news that just came in
at the last minute. l'm sure a lot of people will be glad to hear that. I
cannot think of an area, the one last area in this City that we have, we
have lost so much to that airport on the east side that was going to be our
commercial tax base to off load the burden on the taxpayers and then we
got transferred out. Then that corridor between State Road 84, Griffin
and Stirling is our future base and to have a prison or homeless facility or
whatever in there to inhibit the ability of that area to develop and develop
as a tax base would cost every taxpayer in this City eventually. And
we've got really a good thing going for the first time in years and years.
And, it was a battle on the second time around. You know I killed that
thing when I was mayor in 94 and Frank Adler remembers when our city
manager at the time, Mr. Flatley, was running around - we almost had
that prison work release center approved but we had changed our Code
which tightened things up and the second time, it was such a battle to get
it on the agenda but luckily the votes were there and so we still have a
good area out there for high value development and I want to keep it
going that way and keep the junk out there out of there that other cities
continually want to give to us. Thank you."
