PROCLAMATION
WHEREAS, the House of Representatives has recognized August 25 - September 1,
1997, as Firefighter Appreciation Week in the State of Florida and commends the
Firefighters for their efforts on behalf of the Muscular Dystrophy Association; and
WHEREAS, the Muscular Dystrophy Association and Firefighters nationwide have been
partners in the fight against neuromuscular diseases for over four decades; and
WHEREAS, in 1996 Florida Firefighters raised over $886,788 in support of Muscular
Dystrophy Association's important cause; and
WHEREAS, the Muscular Dystrophy Association is sponsoring City of Dania Firefighter
Appreciation Week to be held August 25 - September 1 , 1997, in honor of the efforts of
Dania Firefighters; and
WHEREAS, it is fitting and appropriate that the City of Dania join the Muscular
Dystrophy Association in support of our Firefighters; and
NOW, THEREFORE, l, Bob Mikes, as Mayor of the City of Dania, Florida do hereby
proclaim the week of August 25 - September 1 , 1997, as

Accompanying this transmittal, please find 3 resolutions for consideration by theCity Commission on August 12, 1997:
1. The restated Preliminary Rate Resolution for fire rescue assessments
updates the information used to document the historical demand for fire rescue seryicesand revises the parcel apportionment methodology to be applied when calculating the
fire rescue assessments. This restated preliminary Rate Resolution will supersede andsupplant Resolution No. '106-97 adopted on July 22, 1992 concerning fire rescue
assessments, and upon adoption of this resolution, Resolution No. '106-g7 will be of nofurther force and effect.

Because the city commission on July 22nd decided to update its fire rescue
assessments using historical information specific to the city of Dania and because thecity commission went ahead and adopted the preliminary Rate Resolutions on that date,

it was necessary for us to craft 3 resolutions which address the mnsequences of the city
commission's actions. Those consequences are as follows. wth regard to the fire
rescue assessment, the Preliminary Rate Resolution needs to be replaced in its entirety
in order to update the information used to document historical demand and to revise theparcel apportionment methodology to be applied in calculating the fire rescue
assessments. This revision will result in non-residential parcels being assessed based
upon square footage tiers on a per building, as opposed to a tax parcel, basis. As well,in all 3 non-ad valorem assessment programs, the attached resolutions accomplish
setting a new public hearing date for september 11,1997 with the appropriate revision
to the mailed and published notices for each program.
Although this transmittal is being sent by facsimile to the Distribution List, a clean
copy of each resolution is being sent to Marie Jabalee by Federal Express for Friday
delivery.
Upon adoption of these resolutions at next Tuesday's City Commission m-eeting,
Government Services Group, lnc. ("GSG") will cause the appropriate notices to be
mailed to all affected property owners and the City Clerk will coordinate the publication
of the appropriate published notice on or before August 21,1997, as required in each
of the resolutions.
Due to scheduling conflicts, Mark Lawson will not be able to attend the City
commission meeting next week. However, either or both camille Gianatasio and Robert
sheets of GSG will be in attendance. As well, I am presenfly attempting to rearrange
a recently scheduled hearing in north Florida so that I might also be in attendance.

A Request to Rezone Property From C-2 to C-3.

This is a request to rezone lots 13 through 16, inclusive, of Block 21 of the Town
of Modelo Plat from C-2 to C-3.The site in question is located on the north side of
Southwest First Street, between Southwest First Avenue and Southwest Third
Avenue. This is the First Reading of this proposed Ordinance with the Second
Reading scheduled for August 26, 1997.
The Planning and Zoning Board considered this matter at their July 16, 1997
Meeting. As a result of their Hearing on this matter they are unanimously
recommending your favorable consideration. At that time no one appeared to
speak in opposition to this item.
The Comprehensive Plan land use designation for this site is commercial. All
properties adjacent to and surrounding this site enjoy a Comprehensive Plan
land use designation of commercial as well. Properties to the north, east and
south currently are zoned C-3. Property to the west as well as the subject site
are zoned C-2.
The subject site is presently occupied with multi-family and single family
residential. Property to the north and immediate east of the petition site are
currently vacant. An office building is located at the north-west quadrant of the
intersection of Southwest First Street and Southwest First Avenue. Property
located to the south contains the Willow Manor Retirement Home and multi-
family. Uses found to the west of the site are single family.
The proposed rezoning is consistent with the Comprehensive Plan and
compatible with the current zoning in the immediately surrounding area.

Antenna: .a transmitting and/or receiving device used for personal wirelessservices that radiates or captures electroiragnetic waves, including directionalantennas, such as panel and microwave dish antennas, and omni-directionalantennas and satellite earth stations.
Guyed tower: a telecommunication tower that is supported, in whole or in part,by quy wires and ground anchors.
Microwave: dish antennas: a dish-like antennas used to link personal wirelessservice sites together by wireless transmission ofvoice or data-
Monopole tower: a telecommunication tower consisting of a single pole or spireselfsupported by a permanent foundation, constructed ;ithout quy wires andground anchors,
Panel antenna: an array ofantennas designed to concentrate a radio signal in aparticular area.
self-support/lattice rower: a telecommunication tower that is constructed rvithoutquy wires and ground anchors.
( I ) Freestanding telecommunication towers may be permitted :rs an accessoryuse in the following zoning tlistricts:
(a) (OS) Parks and Recrearion greater than five (5) acres. On properry
owned by the city, the city shall authorize the application and use of ciryproperty after the applicant executes a lease agreement acceptable to the city.The city shall have no obligation whatsoever to execute such lease even if theapplicant can meet the criteria set forth herein.

Section 33-305. Definitions.
Stealth facility: any telecommunications facility which is designed to blend intothe surrounding environment. Examples ofsteaith facilities includearchitecturally screened roof-mounted antennas, antennas integrated intoarchitectural elements, and terecommunication towers designe-d to rook rike lightpoles, power poles or trees.
Telecommunication tower: a quyed, monopole or self_suppor attice tower,constructed as a free-standing structure, containing one or more antennas used inthe provision of personal wireless service.
Whip antennas: a cylindrical antenna that transmits signals in 360 degrees.
Section 33-306. Telecommunications Towers.

(4) Exceptions. The location of a new telecommunications tower in any zoningdistricts specified in this section must be approved ;. ;;;;d exception.
(5) Minimum standards. Except where a special exception is granted, everytelecommunications tower must meet the fotto*ing miri.um ,tundu.d.,
(a) Prior to the issuance ofa building permit by the building division,GroMh Management Department a divelopment ptan shall !e presented forapproval to planning division, Growth Management Department. Eachapplication for a proposed telecommunicatioi tower shall include allrequirements for site development plan approval as required in Chapter 29 ofthe Land Development Code. The birecior of the Cro'*ttr ManagementDepartment may waive all or some of these provisions for stealth towerswhich are designed to emulate existing structures already on the site,including but not limited to light standiards o, po*". pol"..
(b) A statement shall be submitted prepared by a professional registeredengineer licensed to practice in the State ofFlorida, which through rationalengineering analysis certifies the tower,s compliance with applicable
standards as set forth in the South Florida Buiiding Code, Iatest BrowardCounty Edition, and any associated regulations in-cluding Electronic IndustryAssociation/Telecommtinications Induitry Association st-andard for windIoad; and describes the tower,s capacity, including an example ofthe numberand type of antennas it can accommodate. No toJer shall be permitted toexceed its loading capacity. For all towers attached to existing structures, thestatement shall include certification that the structure can support the loadsuperimposed from the tower. All towers shall have the capacity to permitmultiple users; at a minimum, monopore towers shafl be abie to accommodate

two (2) users and at a minimum, self-support/lattice or quyed towers shall beable to accommodate three (3) users.
(c) Height /setbacks and related location requirements.
1. The height of a telecommunications tower shall not exceed onehundred and fifty (150) feet. Tower height shafl be measured from thecrown ofthe road ofthe nearest street.
2. Telecommunication towers shall conform with the setbacksestablished for the underlying zoning district.
3' Monopole, Iaftice or quyed terecommunication towers sha not bepermined within two hundred and fifly (250) feet ofany residentialdistrict.
4. Monopole, lattice or quyed telecommunication towers shall not belocated within seven hundred,and fifty (750) feet ofant existingmonopole, lattice or quyed telecommunicution to*"r".
5. All buildings and other structures to be located on the same propertyas a telecommunication tower shall conform with the setbacks establishedfor the underlying zoning district.
(d) Aircraft hazard. Prior to the issuance of a building permit by the buildingdivision, Growth Management Department, th" "ppli;;;;;il provide evidencethat the telecommunication towers or antennas arl in compliance with FederalAviation Administration (FAA) regulations. where an anlenna *ill not exceedthe highest point ofthe existing structure upon which it is to be mounted, suchevidence shall not be required.
(e) Approval required from other govemmental agencies. Each application for atelecommunication tower may be required to ir"f ,ia" *.itt"n upproval or astatement ofno objection from other federal or state agencies that may regulatetelecommunication tower siting, design, and constructi"ion.
(f) FCC emissions standards. AII proposed telecommunication towers shallcomply with current radio frequency emissions standards ofthe Federaluommuntcations Commission.
(g) Buffering.
I . An eight (8) foot fence or wafl constructed in accordance with Chapter 29of the. Land Development Code, as measured from the finistred graae ofthesite, shall be required around the base of any lattice tower and may bepermitted around any accessory building oritructures.

2. Landscaping, consistent with the requirements of Chapter 29 the LandDevelopment Code, shall be installed around the entire perimeter ofany fenceor wall. Ad_ditional landscaping may be required around the perimeter ofafelce3r wlfl and around any or all anchors or supports ifdeemed necessaryto buffer adjacent properties. The city may require landscaping id.excess of
th.e requirements of the city code in order to eniance compatibility with
adjacent residential and non-residential land uses. Landscaping shall beinstalled on the outside ofthe perimeter fence or wall.
3. Landscaping consistent with perimeter and on-site requirements inChapter 29 ofthe Land development Code, shall be instailed around anv
accessory buildings or structures.
(h) High voltage and ,.No Trespassing,, waming signs.
l. If high voltage is necessary for the operation ofthe telecommunications
tower or any accessory structures. .HIGH VOLTAGE - DANGER.
WARNING sign shall be permanently attached to rhe fence or wall and shall
be spaced no more than forty (aO) feet apart.
2. 'NO TRESPASSING" warning signs be permanently attached to the fenceor wall and shall be spaced no more than forty (40) feeiapart.
3. The letters for the ..HIGH VOLTAGE _ DANGER,'and ..NO
TRESPASSING" warning signs shall be at least six (6) inches in height. thetwo warning signs may be combined into one sign. The warning sigis be
installed at least five (5) feet above the finished grade ofthe fence.
4. The warning signs may be attached to free standing poles if the content ofthe signs may be obstructed by landscaping
i, Equipment storage. Mobile or immobile equipment not used in direct supportofa tower facility shall not be stored or parked on the site ofthetelecommunication tower, unless repairs to the tower are being made.
j. Removal ofabandoned or unused facilities. All abandoned or unusedtelecommunication tower facilities shall be removed by the tower owner/operatorwithin ninety (90) days ofthe cessation ofuse. A tower shafl be consideredabandoned if use has been discontinued for one hundred eighty (l g0) consecutivedays. Telecommunication t6wers being utilized for other p-u.por"., including butnot Iimited to light standards and power poles, may be "xernpt from thisprovision.
(k_) Signs and advertising. the use ofany portion ofa tower lor signs oradvertising purposes, including company name. banners, streamers, etc., shall bestrictly prohibited.

(6) Inspections:
(a) Telecommunication tower owners, shall submit a report to the citybuilding division, department of corn.unity d;;;;;;Jnq certiffingstructural and electrical integrity on the foliowing schedule:
l. Monopole towers at least once every five (5) years.
2. Self-support/lattice towers at least once every two (2) years; and
3. Guyed towers at least once every two (2) years.
(b) Inspections shall be conducted by an engineer licensed to practice in theState of Florida. (b) Notwithstanding the above provisions ofthis section towers in existence
as ofOctober l, 1996, may be replaced with a tower ofequal or less visualimpact after approval by the city manager or his desigaee. However, iftheproposed new tower would not be consistent with the minimum standardsunder this section replacement must be approved by the city commission.
Section 33-307. Antennas not located on telecommunications towers
(l) Antennas shall be permitted as follows:

(2) Minimum standards. Building or rooftop antennas shall be subject to the
fol lowing minimum standards.
(a) Building rooftop stealth antennas shall be subject to the following minimum
standards:
I . No commercial advertising shall be allowed on an antenna:
2. No signals, lights or illumination shall be permiued on an antenna unless
required by the Federal communication commission or the Federal Aviation
Administration:
3. Any related unmanned equipment building shall not contain more than
750 square feet ofgross floor area or be more than twelve (12) feet in height;
and
4. Ifthe equipment building is located on the roofofthe building, the area of
the equipment building shall not occupy more than twenty five percent (25%)
ofthe roof area.
5. Each application shall contain a rendering or photograph ofthe antenna
including, but not limited to, colors and screening devices. This shall be
subject to administrative approval for consistency with the definition of
stealth facility.
(b) Building rooftop non-stealth antennas shall be subject to the following
minimum standards:
l. Antennas shall only be permitted on buildings which are at least fifty (50)
feet tall. Antennas may be placed on building less than fifty (50) feet tall in
the OS district if public safety needs warrant the antenna;
2. Antennas may not extend more than 20 feet above highest point ofa roof.
Stealth antennas attached to but not above rooftop,t*"tur". jiall be exemptfrom this provision. Antennas may exceed twenty (20) feet above the roof in
the OS district ifpublic safety needs warrant additional height;
3. Antennas, and related equipment buildings, shall be located or screened tominimize the visual impact ofthe antenna upon adjacent properties and shall
be ofa material or color which matches the ixterior ofthe building or
structure upon which it is situated;

(6) Exceptions The location of a new antenna in any zoning district other thanthose districts specified in this section shall be prohilited unless approved as aspecial exception.
Section 33-308. Shared use ofcommunication antennas.
(l) Notwithstanding any other provision of this articre, to minimize adversevisual impacts associated with ihe proliferation anJciustering oftelecommunication towers, co_location offacilities on existing or new towersshall be encouraged by:
(a) only issuing permits to qualified Shared Facilities at locations where itappears there may be more demand for towers than the properry canreasonably accommodate; or
(b) giving preference to eualified Shared Facilities over other facilities inauthorizing use at particular locations.

(3) To satisfo the requirements of(2) (a) ofthis section, the.facility owner mustsubmit a written evaluation ofthe stuctural capacity of the tower.
(4) The requirements of(2) (b) ofthis section will be deemed to have been met ifthe facility owner shows that it has executed ajoint use agreement with at least
one other unaffiliated entity for shared use, and agrees tolffer a simirar contractto others. In other case, the facility owner must enter into an agreement with thecity, acceptable to the city, to offer space on fair, reasonable, nondiscriminatoryterms, at fair market value, and to negotiate leases promptly and without unduedelay. A condition ofany permit for a eualified Shared-Facility shall be thatthepermit shall be terminated, and the facility removed, if the city finds that thefacility owner is not complying with its obligations under this section and
associated agreements with the city.
(5) Co-location of communication antennas by more than one provider onexisting or new telecommunication towers shall take precedence over the
construction of new single-use telecommunication towers. Accordingly each
application for a telecommunication tower shall include the following:

(a) the facility is appropriately designed for sharing; and
(b) the facility owner is prepared to offer adequate space on the iacility to
others on fair and reasonable, nondiscriminatory tenns.

tower, if an appropriate telecommunication tower or towers is/are available.
The evaluation shall analyze one or more ofthe following factors.
I . structural capacity of the tower or towers;
2. radio frequency interference;
3. geographical service area requirements;
4. mechanical or electrical incompatibility;
5. inability or ability to locate equipment on the tower or towers;6. availability oftowers for co-location;
7. any restrictions or limitations of the Federal Communication
Commission that would preclude the shared use ofthe tower.

(b) the City may deny an application if an available co-location is feasible
and the application is not for such co-location.
(6) A telecommunication tower that is determine to be inappropriate for sharingshall be assumed to be inappropriate for sharing the same ry;es offacilities in thefuture. Such towers will not need to be evaluated in the futuie regarding sharingwith the same type of facility for which it has been determined to be
inappropriate. The community deveropment department sharl retain a list ofsuch

towers, and will provide a copy ofthe list to all potential applicants. The city
may require additional sharing feasibility evaluations if warranted by changed in
technology.
(7) For any telecommunications tower approved for sharing use, the iiwner of the
tower shall provide notice ofthe location ofthe telecommunication tower's load
capacity to all other providers.
(3) Fees for tower placement and use including antenna installation will be
determined by a separate resolutions.
(4) Public land or right-of-way lease agreement will be established by a separate
instrument.
Section 33-310. That all ordinances or parts of ordinances in conflict herewith
be and the same are hereby repealed to the extent ofsuch conflict.
( I ) The City shall act promptly on any application submitted in accordance with
the provisions ofSections 33-304 through 33-308 ofthis chapter. The reasons for
rejecting any application filed under this article does not prevent a person from
filing an application for a special exception in accordance with application law.
(2) The issuance ofa permit, however, is not lease and no municipally-owned
property may be used without a lease agreement with the City. The City may, as
appropriate, to protect its property and the public interest, establish additional
requirements beyond the minimum requirements of a permit for municipally-
owned property. this provision further does not prelude the city from issuing a
Ietter of intent for the purposes of leasing sites on designated city property for the
construction and installation ofpersonal wireless service facilities. For
designated neighborhood parks, the city will encourage the installation of
facilities which have a minimal impact on the surrounding areas and are
consistent with the development ofthe park.
Section 33-3 I l. If any section, sentence, clause, or phrase of this Ordinance is
held to be invalid or unconstitutional by any court of competent jurisdiction, then
said holding shall in no way affect the validity ofthe remaining portions ofthis
Ordinance.
Section 33-312. It is the intention o f the City Commission and it is hereby
ordained that the provisions of this Ordinance shall become and be made a pan of
the City of Dania, Florida Zoning Code ofthe Code Ordinances, and that the
Sections ofthis Ordinance may be renumbered, releftered, and the word"ordinance" may be changed to ,.section," .,article,,, or such other word or phrase
in order to accomplish such intention. In no case shall any provision be read to
eliminate any requirements for a franchise, Iicense or other authorization to
occupy the affected property.

This is a request for the Meadowbrook shopping center located at 300 East Dania
Beach Blvd., which is developed as a retail shopping center. The property has an
existing seventy-two square foot pole sign fronting on Dania Beach Blvd.
on July 24,1984, the City commission approved a sign variance for the subject site to
permit a total of seventy-two (72) square feet. The current request is to add an
additional ninety-six (96) square feet beneath the existing sign to accommodate a plaza
directory. This would provide for a total of one hundred and sixty-eight (168) square
feet.
The code of the City of Dania permits a sign no greater than fifty (50) square feet. The
Planning and Zoning Board, after reviewing the criteria used to consider a variance
request, recommended approval of this request at their June 25, 1997 regular meeting.

Dear Mr. Smith:
On behalf of our client, RaceTrac Petroleunl we strenuously object to the City's
failure to place the site plan for the above-referenced project on the City Commission
agenda for this evening. The City is attempting to improperly delay the site plan approval
in order to impose upon RaceTrac nsw 26ning regulations which are just being discussed
for the first time, at tonight's City's Commission meeting. This delay of the RaceTrac site
plan is improper and contrary to established case law.
RaceTrac Petroleum submitted is site plan to the City of Dania on March 3,7997,
for Planning and Zoning Board approval. The site plan was considered by the Planning and
Zoning Board on March 19, 1997, and approved subject to a few conditions including the
requirement that RaceTrac resolve the Trafficways issue before City Commission approval.
As you are aware, Racetrac obtained the necessary waiver Traffrcways from the Broward
County Planning Council at its Jutre meeting. We advised Lcigh Kerr of the outcome of the
Planning Council hearing and requested direction on how to proceed to the City
Commission with the site plan. I-eigh Kerr responded on June 30, 1997, with a letter
(attached) to Susan Holland, the project engineer. The letter directed RaceTrac to resubmit
the site plan and to address three issues in the resubmittal: (1) correction of dumpster
detail; (2) revision of the signage - the City was now requiring a smaller sign; and (3)
revision of aspects of the landscape plan - the City was requesting that the sabal palms
proposed for the front of the site 6" gxshanged for beauty leaf trees planned for the rear

roadway to the site and from the site to the roadway, and would interfere with the overhead
power lines, contrary to Section 26-53 of the Code. The Code is specifically drafted to give
a property owner choice in the design of its required landscaping. The tlee requirements
are simply otre per 40 linear feet of perimeter landscape area ' 40Vo to be shade ttees 30Vo
to be intermediate trees and no more than ljVo to be small trees. Palms may constitute
207o of the required trees. However, if palms are used as replacement trees, then three
palms are considered equivalent to one tree. The landscape plan submitted on July 9, 1997
complies with the Code. In fact the landscaping provided exceeds the Code requirements.
In regard to tle signage issue, in light of the City's request for a change in the signage as
it had been approved at the Planning and Zoning Board, we requested a further
interpretation of the rwo signage provisions that affect gas stations. The matter was
considered by I*igh Kerr and by the City Attorney. Following their discussion, we were
advised that the City was maintaining its interpretation that a single smaller sign was all that
would be permitted. Although we did not agree with the City's interpretation, in the spirit
of cooperation, RaceTrac acceded to the City's request and by letter (attached) on August
l, 1997, submitted a revised sign plan which complies with the City's interpretation. AII
matters had then been resolved in a timely manner for the City Commission s consideration
of the site plan this evening.
My client has proceeded in good faith and with a cooperative attitude in processing
its site plan through the City. We have been hformed that the City is now proposing to
enact design guidelines for gas stations in the historic district. Those regulations, directed
specifically at this project, have not yet been noticed for formal hearing, have not yet been
presented to affected property owners, and have not been reviewed by the Planning and
Zoning Board although your code requires a prior review by the Planning and Zoning Board
before presentation to the commission. There is no legitimate method for the City to
impose the new design guidelines on the RaceTrac site plan - it is entirely improper for the
City to hold up the site plan until the City's legislative effort catches up with the site plan.
This delay results in damages to RaceTrac resulting from lost revenue from the site as well
as additional carrying costs under its purchase contract, regardless of the impact of the
design guidelines on the site. Obviously, the imposition of the desip guidelines would result
in further drmages.
The law in Florida holds that a local government cannot withhold a development
approval that is entitled to be issued for the purpose of subjecting the property to a yet-to-
be-adopted zoning regulation. Dade County v. Jason, 278 So.2d 313 (Fla. 3rd DCA 1973);
City of Margate v. Amoco Oil Co., 546 So.2d 1091 (Fla. 4th DCA 1989).

Given the above, unless the RaceTrac site plan is placed on the next City
Commission Agenda and considered by the City Commission strictly in light of the current
applicable site plan and C-3 2sning provisions, regetfully we vrill have no alternative but
to pursue our client's legal rights.

Although we have not received a written response to my letter of July 15, 1997, I
understand from a conversation with Frank Adler this past week and with you., yesterday,
that the City's interpretation of Sections 3-39(b)(1) and 17-19(e) is that a single sign with
ar area of 25 square feet is all the ground or pole signage permitted on the site.
If you will recall, the orieinal sipage plan with the larger square footage advocated
in my July 15, 1997,letter was approved by the Planning afi 7-nung Board. Nonetheless,
in light of the Cit/s position, we have amended our stnage plan for the ground sign to
bring it into compliance with your interpretation. I have attached a copy of the revised
sipage plan.
Our application to proceed to the City Commission for approval of the site plan met
the deadline for the July 23, 1997 agenda. ln my conversations with you the week before
that hearing, you advised me that the site plan had not beetr placed on the City Corrmission
agenda for July 23, 1997 because the sipage issue had not been resolved. In light of the

Dear Leigh:
In response to your letter of June 30, 1997, we have reviewed the signage provisions in
the City code and in interpreting the provisions of Sections 17 - 19(e) and 3-39(b)(l), we have
reached a different conclusion from the one expressed in your letter.
Section l7-19(e) requires each gasoline station have a price sign prominently
placed and easily read. The size of the sign is limited to a maximum of 15 square
leet and a minimum of 12 square feet. The letters are required to be 10" in
height.
These two provisions authorize two signs and do not require the pole or ground
identification sign to include within the authorized square footage the information required in the
price sign.
The signs authorized are one 25 square foot sign for identification and one l5 square foot
sign for price information. We believe those code provisions would also allow a single sign
structure on which each of the sign components - the identification and price sign - are included,
as long as the resulting signage does not exceed the 12 foot height limitation.

the waiver for the trafiicways with the conditions that you identified in the meeting with

Broward County TrafEcways Plan dedication requirement for the proposed RaceTrac Petroleum site
located on the west side ofFederal Highway between Old Griffrn Road and Dania Beach Boulevard,
immediately north of NW 3rd Street, in the City of Dania.
At its meeting of June 19, 1997, the Broward County Planning Council voted to deny the applicant's
request for a fi:ll waiver ofthe 20 foot requted right-of-way dedication, and instead granted a partial
waiver of 8 feet, requiring that a 12 foot roadway easement be retained.

Commission and pursuant to that, you have agreed to enhance landscaping in
front of the facility above what code requires.

Motion made by Anthony Stevens to approve the minutes of the February '19, 't997,
Regular Planning and Zoning Board, seconded by June Silvernale. Motion passed
unanimously.
NEW BUSINESS
SP-07-97 - Holland Engineering, lnc. on behalf of RaceTrac Petroleum, request
recommendation of a site plan approval for a gas station at 303 North Federal Hwy.
Legal Description: Lots 1,2,3 and 4 in Block G of Hanson and Nelson Subdivision.
Leigh advised the board that most of the items recommended in his memo have been
addressed by the petitioner, and that the board has been given the revised plans. A
question was raised regarding the size of the sign being over 50 square feet. Mr. Kerr
stated that signs on gas stations are allowed to display fuel price signs in addition to the
main sign. Leigh stated that the only items that have not been met is the certification to
section 6.24(a) which speaks to the separation requirements from schools, recreation

Leigh Kerr addressed the board with a description of the proposed site plan. The
request is for a Racetrac gas station, located where the abandoned Broward Linen
building stands. Leigh advised the board of an issue relating to the a 106' right of way
required by the Broward County Trafficways Plan. The petitioner would have to resolve
this matter with the County before the Dania Commission could make final approval of
the project.

and residential; and the FDOT approval of access from US 1. A question regarding the
dumpster enclosure access was raised, and Leigh commented that he would check into
that issue.
At this time Susan Holland, of Holland Engineering addressed the board. Ms. Holland
stated that they have received a letter today from DOT approving the access from
Federal Highway. The letter was given to Leigh Kerr for review. Victor Lohmann
brought up concerns relating to the properties to the north also being gas stations and
possibly fixing one property at the expense of others. Mr. Paul Bland, of Racetrac
Petroleum, addressed the board to answer any questions relating to this matter. City
Attorney Adler reminded the board that their decisions need only be based on whether
the site plan conforms to all applicable city codes. Leigh Kerr confirmed that site plan
conforms to all of the City's code requirements, other than the ones listed in his memo.
This item was opened to the public for comment, hearing none and seeing none; the
public hearing was closed.
Motion was made by Kim Daise to recommend approval of item SP-07-97 with the
conditions set forth in the March 14, 1997 memo from Leigh Kerr relating to the
trafficway issue with Broward County, certification of separation requirements from
schools, recreation and residential, seconded by June Silvernale. Discussion by the
board resumed regarding the right to abstain from voting. City Attorney Adler advised
the board that unless there is a conflict of interest with the petitioner, all members must
vote either yes or no. The motion was again made by Kim Daise, and seconded by
June Silvernale with the conditions set forth in the previous motion. The motion passed
on the following roll call:

4. LU-08-97 - \Mlson Atkinson for Griffin Point, lnc., request for land use change from
Residential to Commercial. The location is approximately 2300 block on the North side
of Griffin Rd.
Legal Description: Lot 16 Blk 4 Marshall Everglade Subdlvision.
Leigh Kerr described the request for Land Use Change to the board. Leigh stated that
this request is not an amendment to the City's Comprehensive plan because the area
to the west of Ravenswood Road has not yet been made a part of the plan as yet, and
that this will be an amendment to Broward County's land use plan. Leigh described the
surrounding zonings and uses in the area. Leigh stated the petitioner is requesting the
change in land use due to the impact of the airport noise. He further stated that the
City will be looking at revising land use changes in this area as part of its'
comprehensive plan update. Leigh described some of the analysis on the impact of
services relating to the proposed change in land use, stating that the most significant
impact would be in the area of traffic. Leigh confirmed that the future road conditions

for the site show that there would be adequate capacity to support the change in traffic.
Leigh introduced Wilson Atkinson to the board to answer any questions relating to the
petition.
The board posed questions as to notificatlon of property owners. lt was confirmed by
staff that notification was sent out to all property owners within 300' of the site. Mr.
Wilson Atkinson addressed the board to describe the procedure that must be followed
to change the land use on a property. He advised the board that once the land use is
change further public hearings would be necessary relating to rezoning the land and
preparing for site plan review. He stated these items would come before this board
after the State and County approve the land use change which in itself takes nearly 6 to
8 months to complete. Mr. Atkinson concluded stating conversations and research that
was done relating to future airport uses and surrounding development in the area.
At this time Chairperson Daise opened the item for public comment. Mrs. Dottie & Joe
Honan, residing in the residential area of the West Dania Heights subdivision lots 4 and
10, addressed the board stating opposition to the land use change. Reasons for
opposition being they felt it would adversely affect the value of their property. other
discussion entailed between the petitioner, the board and Mr. & Mrs. Honan relating to
concerns of traffic through the residential area, property values and the problems with
the commercial properties in the area.
Victor Lohmann questioned Leigh Kerr about the County's master plan for this area.
Leigh Kerr briefly explained the policies relating to areas surrounding airports, which
discouraged residential and supported non-residential uses. There was further
discussion relating to the airport issue and the effect of the land use change between
the board, the Honans, Mr. Atkinson and Leigh Kerr. Mr. Fred Elson of 2295 SW 45th
St. addressed the board with concerns relating to traffic generated by the commercial
uses in the area and when the properties, which currently hold residential zonings,
could expect to be upgraded to similar commercial uses, which would help the adverse
effect on the property values of the residential zonings in the area. After further
discussion of the upcoming Comprehensive Plan update and property value concerns
Chairperson Daise closed the public hearing.
The item was brought back to the board for discussion. Discussion entailed relating to
changing the land use on one piece of property and leaving the others to wait. Motion
was made by June Silvernale to recommend approval of the Land Use Change request'
seconded by Anthony Stevens. Motion passed on the following roll call:
