WIIEREAS' Nora and Jessie Black came to Dania, Florida in 1925 to become permanent residents of theCity of Dania and to raise their family in Broward County; and
WIIEREAS' the Black Family grew in great numbers with thirteen children bom to this union - sevengirls and six boys; and
wHEREAS' the Black Family accomplishments as farmers, business owners, real estate owners,
restaurant owners and home owners has provided many contributions to the community; and
WIIEREAS, the Black Family's effiorts as teachers, lawyers, and parents has provided a rich history of
community spirit ; and
WHEREAS, the Black Family has resided in the City of Dan ia for over 72 years with Butler Black being
the oldest member in the City of Dania; and
WIIEREAS, the City of Dania wishes to recognize this pioneer family at their family reunion in the City
of Dania and Broward County, and
NOW TIIEREFORE, I, Bob Mikes, as Mayor of the City of Daniq Florida do hereby proclaim the

WIIEREAS' the quality of the many parks located in the City of Dania is an important health, recreation,
scenic, and economic benefit to residents and visitors alike; and
WIIEREAS, the National Recreation and Parks Association (NRPA) recognizes July as parks &
Recreation Month throughout the nation; and
WHERf,AS' more than 20 municipalities in Broward County will follow the regional initiative of the
Florida Recreation and Parks Association (FRPA) to similarly proclaim July as Parks and Recreation
Month: and
WHEREAS' such recognition will create awareness of the diverse parks and recreation programs and of
the values and benefits offered by the City of Dania to our community under the theme "The Benefits
Are Endless...."; and
WIIERJAS, this event will bring people together from all over the county, in recognition of the
individual community, environmental and economic benefits they receive by visiting these parks; and
WHERf,AS, the City of Dania will present a variety of programming and special events on weekdays
and weekends during the month of July which will highlight the value and benefits ofparks; and

hand out information about upcoming July events.

heavily trafficked areas.
* Sponsor a poster contest for your local elementary school children under the theme of
"July is Parks and Recreation Month."
* HotO a photo or video contest for your local high school teens encouraging them to
capture people having fun in your city's parks.
* HotO a "Play Da/ special event dedicated to Family Fun and Fitness.
* Encourage your municipal and civic leaders lo walk the talk by holding an employee

PROCLAMATION
WIIEREAS, each year on June 14, we celebrate the birthday of the Stars and Stripes, which came inro
being on June 14, 1777 . At that time, the Second continental congress authorized a new flag to
symbolize the new Nation, the Unites States of America; and
WHf,REAS' the Stars and Stripes first flew in a Flag Day celebration in Hartford, Connecticut in 1861,
during the first summer ofthe Civil War. The first national observance ofFlag Day occurred June 14,
1877. the centennial ofthe original flag resolution; and
WHEREAS' by the mid 1890's the observance of Flag Day on June l4 was a popular event. Mayors and
governors began to issue proclamations in their jurisdictions to celebrate this event; and
WHEREAS' in the years to follow, public sentiment for a national Flag Day observance greatly
intensified. Numerous patriotic societies and veterans groups became identified with the Flag Da1,
movement. Since their main objective was to stimulate patriotism among the young, schools were the
first to become involved in flag activities; and
WHEREAS, in 1916, President Woodrow Wilson issued a proclamation calling for a nationwide
observance ofFlag Day on June 14. It was not until 1949 that congress made this day a permanent
observance by resolving "That the I4rh day of June of each year is hereby designated ar ftag Oay. . .

Each year on June 14, we celebrate the birthday of the Stars
and Stripes, which came into being on June 14, 1777. At that time,
the Second Continental Congress authorized a new flag to symbolize
the new Nation, the United States of America.
The Stars and Stripes first flew in a Flag Day celebration in
Hartford, Connecticut in 1861, during the first summer of the Civil
War. The first national observance of Flag Day occurred June 14,
1877, the centennial of the original flag resolution.
By the mid 1890's the observance of Flag Day on June 14 wasa popular event. Mayors and governors began to issue
proclamations in their jurisdictions to celebrate this event.
In the years to follow, public sentiment for a national Flag Day
observance greatly intensified. Numerous patriotic societies and
veterans groups became identified with tlre Flag Day movement.
Since their main objective was to stimulate patriotism among the
young, schools were the first to become involved in flag activities.
In 1916, President Woodrow rililson issued a proclamation
calling for a nationwide observance of Flag Day on June 14. It was
not until 1949 that Congress made this day a permanent observance
by resolving "That the 14th day of June of each year is hereby
designated as Flag Day...' The measure was signed into law by
President Harry Truman.
Although'Flag Day is not celebrated as a Federal holiday,
Americans everywhere continue to honor the history and heritage it
represents.

Bud Palm has asked Berry and Calvin to review the dollar amount charged for each
ERC under the lmpact Fee schedule in our ordinance #27 -202. He recommends NO
CHANGE at this time. Bud explains that money has been allocated for a study to
review the accuracy of this fee, and as such, we should wait until this study is
commissioned and completed.
Berry and Calvin also recommend, as I have, to NOT change the rate for mini-
warehouses from 0.01 to 0.05, as, without study and justification, this can be seen as
arbitrary and capricious.
I recommend we submit the proposed changes to Sections 27 -202 and 27-54 to the
Commission for the review and decision, leaving the mini-warehouse at 0.01, and they
can discuss and vote on it while they consider the ordinance change.

Bud Palm has asked Berry and Calvin to review the dollar amount charged for each
ERC under the lmpact Fee schedule in our ordinance #27 -202. He recommends NO
CHANGE at this time. Bud explains that money has been allocated for a study to
review the accuracy of this fee, and as such, we should wait until this study is
commissioned and completed.
Berry and Calvin also recommend, as I have, to NOT change the rate for mini-
warehouses from 0.01 to 0.05, as, without study and justification, this can be seen as
arbitrary and capricious.
I recommend we submit the proposed changes to Sections 27-202 and 27-54 to the
Commission for the review and decision, leaving the mini-warehouse at 0.0'l , and they
can discuss and vote on it while they consider the ordinance change.

I have had the 2 schedules (Ordinances #27 -202 & 27 -54) reviewed and compared for typos
and accuracy. I have also polled several other cities and the county to determine their methods of
calculations.
The majority of the cities, and the county, use the DNRP flow schedule, as I've proposed.
The minority use either the size of the water meter, or their own schedule (as Dania does now).
The system which uses the water meter size is rather convoluted, and results in far less income to
the city.

NOWTHEREFORE, BE IT ORDAINED BY THE CIry COMMISSION OF THE CIry
OF DANIA, FLORIDA:
Section 1. That in order to be in agreement with the code or regulation of
Broward County Department of Natural Resources Protection Section 27-54, Article lV
of Chapter 27 ot the Code of Ordinances of the City of Dania is hereby amended in its
entirety to read as follows:
"Sec 27-54. Schedule for Sewer Connection Charges.
A sewer connection charge will be made for each connection to the city
sanitary sewer system, such charge payable at time of making application for permits
based on the following schedule:
Sewer connection charges will be composed of a one-time tapping charge of fifty
dollars ($50.00) per tap plus twenty cents ($0.20) per average daily gallonage used

Please schedule the second reading (Public Hearing) of an ordinance approving the
request for plat approval for approximately 3.5 acres of land which is situated on the
south side of Griffin Road and east of SW 31" Avenue. The name of the proposed plat
is "LETO ACRES'. The applicant is John Leto. The City Commission, at their May 27,
1997 regular meeting, approved this ordinance on the consent agenda.
The Planning and Zoning Board reviewed this request at their February 19, 1997
meeting. The recommendation is to approve the plat as it conforms to platting
requirements of the City of Dania. The proposed use is for 38,200 square feet of office.
There is an existing 1 ,400 square foot (approximate) commercial building on the
property.
The plat is separated into two (2) parcels: Parcel A which fronts on Griffin Road and
contains approximately .8 acres and Parcel B which represents the balance of the site.
Parcel A is zoned B-2 (Community Business) - Unincorporated Zoning) and Parcel B is
zoned A-1 (Limited Agricultural) - (Unincorporated Zoning). The current land use
designations for the site are commercial for Parcel A and Low Medium (10) Residential
for Parcel B according to the Broward County Planning Council. The current plat note
for office designation for the entire site would not be consistent with the land use plan
designations for the property. However, Parcel A could be designated for the office
designation, and Parcel B could either be designated for not development, or for
residential designations consistent with the land use plan of Low Medium (10)
Residential.
The recommendation is to approve the plat as it complies with the requirements of City
Code.

Lionel N. Jadoo, Dania Nursing Home, has submitted a petition for a text amendment to
the Zoning Code which would allow existing nursing homes with a minimum of fifty (50)
beds, the ability to operate and own adult living facilities in separate dwelling units, with
kitchen and bathroom facilities, that are occupied by no more than six (6) residents per
dwelling unit.
He has also submitted a companion special exception request that would provide for the
siting of eight (8) of these facilities across the street and adjacent to the existing Dania
Nursing Home, which is also located in an RS-6000 zoning district and is currently
operating as a non-conforming use.
At the request of Mr. Richard Coker, council for the petitioner, an ordinance has not
been prepared so that the Commission may determine the exact language to be
included in the zoning text amendment as it pertains to providing: Definitions for
"special Residential Facilities" categories; providing a procedure to obtain a certificate
of occupancy; determining density of special residential facilities; and to specify
providing development standards and conversion to other uses.
The subject area is zoned RS-6000 and the predominant uses in the area residential,
and predominantly single family uses. The Florida Statutes provide for the location of
community residential homes for six (6) residents or less. However, there is a 1,000
foot separation between each of these facilities by State Statute. The intent of the
Statute was to permit these facilities to exist in a residential setting thereby not providing
more intensive uses than might be acceptable for single family residential
neighborhoods.
The property owners have acquired the parcels and provided significant renovations to
the properties in anticipation of this proposed use. However, this use is not permitted in
the zoning code of the City. Linked to the petition is a special exception request for the
five (5) lots and eight (8) facilities on those lots.

The Planning and Zoning Board, at their April 16, 1997 regular meeting, recommended
denial of the Text Amendment request and denial of the request for Special Exception
use, by a 4-1 vote.
The City Commission should review the special exception request in light of the criteria
established in Section 6.4, Special Exception Uses, City of Dania.

parcel which was scheduled for the commission meeting of May 27n. Due to the fact that I was
out of town, I requested my superior, Mr. Fortin, attend the meeting for me. Unforn:nately, he
thought the meeting was for the following night since Monday was a holiday.
I am asking once again, that this change of Plat Note request be scheduled for the next possible

A vacation petition has been submitted conceming property in the 3400 block south of
Griffin Road. The areas to be vacated are located adjacent to the Donna Subdivision.
The petition requests vacation of a canal right-of-way, an alley and an anchor easement
located within the canal right-of-way. The portion of the canal right-of-way to be
abandoned commences approximately thirty feet (30') south of Griffin Road and is sixty
feet (60') wide and one hundred and sixty feet (160') deep. The alley west ofthe canal
also commences thirty feet (30') south of Griffin Road and is twenty feet (20') wide and
one hundred and sixty feet (160') deep. The majority of the alley east of the canal has
been abandoned through a previous vacation. This petition includes the remainder of the
alley which is approximately five feet (5') deep. Finally, the applicant is requesting
vacation of an anchor easement located within the canal right-of-way. (See attached.)
The first step in the vacation process is for the City Commission to grant permission to
apply for vacation. This process is explained in Section 3 ofPart IX, Article 3, ofthe City
Charter.
Please schedule the request to obtain permission to apply for vacation for the May 27,
1997 City Commission meeting. Backup information, such as the survey, letters from
utility companies, etc. will be submitted to the City Commission and Planning and Zoning
Board during the process which requires a public hearing.

Dear Mayor Mikes:
On behalf of our client, Bennett David, I hereby request the City Commission begin the vacation
procedure for vacation of the 60' canal, the 20' alley west of the canal, the remainder (a 5' strip) of
the 20' alley east ofthe canal and a 5' anchor easement within the canal in the 3400 block of GrifEn
Road. I have highlighted the areas to be vacated on the attached copy ofthe plat.
The canal has been filled in and replaced with a culvert structure as a requirement ofthe Oakridge
development's surface water management permit. The anchor easement was needed to provide
electric to the pump house, which has been demolished. The majority of the east 20'alley was
vacated by O.R. 15647-358. Our proposed vacation will vacate the remaining 5' ofthe alley between
the vacated alley and the Griffin Road right of way line, since that area no longer functions as an
alley.
The west 30'ofthe canal right of way and the entire 20'alley west ofthe canal will revert to the
property owner to the west, who will in turn quit claim the 50'back to our client. All the area to
be vacated is within the City of Dania and will be under one ownership.
We have contacted all the utility providers to obtain their waiver of objection letters. Any easements
they may need will be dedicated per separate instrument(s) at the time the vacation ordinance is
recorded in the public records of Broward County.

We also request that the City waive any requirements to replat the area, as Florida Statutes provide
that ownership ofthe vacated area automatically revert to the adjacent owner(s). The entire area
being vacated is proposed to adjoin Mr. David's property to the east, as the property to the west is
already walled in and is in the city of Hollywood. This has been agreed to by the Michael Swerdlow
Company, owner ofthe property to the west ofthe area being vacated.
Along with the copy ofthe Donna Subdivision plat I am enclosing our vacation application for your
review. We will provide copies of the letters from the utility providers as we receive them.

Attached is an application for a City of Dania occupational license for an astrology/
fortuneteller business at 1410 S. Federal Hwy. The applicant is Nancy Rose Williams.
Chapter 12.5 of the Dania Code of Ordinances requires the City Commission to grant or
review a fortunetelling or astrology license. A hearing is required to obtain such a
license. The applicant has been given notice that this hearing is to be held at the June
10, 1997 City Commission meeting.
Section 12.5(d) lists the criteria by which the City Commission may refuse or revoke a
Fortunetelling license. A copy of that criteria is attached. A background check is
required to be completed by the Broward Sheriffs Office and FDLE concerning the
applicant's moral character and business responsibility. After checking with FDLE and
BSO, it has been found that there is no criminal history on Nancy Rose Williams'
background.
The property al 141O S. Federal Hwy. is zoned C-3 (General Business.) A
Fortuneteller/Astrologist is a permitted use in this district. ln order to obtain a license
Nancy Rose Williams must produce a surety bond in the amount of $1,000.00. The
license fee is $1,000.00 per year.

PROVIDING FOR ISSUANCE AND REVOCATION OF
LICENSES; PROVIDING FOR JUDICIAL REVIEW,

Section 1.License Requ i red .
It shall be unlawful to engage in the business of
fortunetelling, palmistry, clairvoyancy or astrology in the Clty
of Dania, Florida, unless such business is conducted by an
individual who has applied for and obtained a Iicense from the
City of Dania for such business.
Section 2. Issuance and Revocation of License.
(A) The Cit.y Commission of the City of Dania, Florida, is
hereby authorized to grant or renew a fortunetelling, palmistry,
clairvoyancy or astrology license for any period of time not
exceeding one year to any individual applying therefor on a form
Eo be provided for in Section (B) of this section and the filing
by the applicant of the bond required by Section 5 of this
ordinance.

(B) The form on which application sha11 be made for a
fortunetelling, palnistry, clairvoyancy or astrology license shall
require the following informations
(1) Name of applicant;
(21 Residence and business address of appl!.cant;
( 3 ) The length of tlme for which a fortunetelling,
palmistry, clairvoyancy or astrology license is desired;
(4) A statement. as to r,rhether or not the applicant. holds, or
has held a fortunetelling, palmistry, clairvoyancy or
astrology license from any state, municipality,
governing body or licensing authorityt a list of such
Iicenses and a statenent of the time, place and by whon
issuedi a statement as to whether any state,
nunicipality, governing body or licensing authority has
ever refused to issue or to rene!, a fortunetelling,
palmistry, clairvoyancy or astrology license Eo the
applicant together with a full and accurate statement as
to the reasons for any such refusal; and a st.atenent as
to whether any stat.e, municipality, governing body or
licensing authority has every revoked a fortunetelling,
palnistry, clairvoyancy or astrology Iicense held by the
applicant together with a fulI and accurate statement as
to the reasons for any such revocation.
(5) A statement as to whether or not the applicant has ever
been convicted of any crimel misdemeanor or violation of
any municipal ordinance, and if so, the nature of the

offense and the punishment or penalty assessed thereto.
(6) A photograph of the applicant, taken within 60 days
immediately prior to Lhe date of the filing of the
application, which picture shall be 2" by 2" showing t.he
head and shoulders of lhe appllcant in a clear and
dist.inguishing manner, except that the city commission
may walve this requirenent with respect to an
application for renewal of a fortunetelling, palmistry,
clairvoyancy or astrology license by an individual.

clairvoyancy or astrology license issued under this
ordinance who has in a previous application under this
ordinance complied with this requirenent;
(7) The fingerprints of the applicant and the names of at
least two reliable property owners of the County of
Browardl State of Florida, who will certify as to the
applicant's good moral character and business
responsibil ity, excepE that the city commission nay
waive this requirement with respect to an application
for renewal of a fortunetelling, palmistry, clairvoyancy
or astrology license by any individual holding an
unexpired license issued under this ordinance who has in
a previous application under this ordinance complied
with this requirement.
(C) Before issuing a fortunetelling, palmistryl clairvoyancy
or astrology license to- any individual applying therefor the city

commission shaIl refer the application to the Bro$rard County
Sheriff's office who shal1 cause to be made such investigation of
lhe applicant's moral character and business responsibility as he
deems necessary for the protection of the public good, except that
the city commission nay waive this requirement with respect to an
application for renewal of an existing license by any individual
holding an unexpired fortunetelling, palmistryr clairvoyancy or
astrology license issued under !his ordinance if an investigat.ion
of such applicant.'s moral character and business responsibility
has previously been made under this section in connection with a
prior application for such license under this ordinance. The
Sheriff or his deputy shaLL cause the invesEigation hereln
provided for to be made vrithin a reasonable time and shall certify
to the city commission whether or not the moral character and
business responsibility of the applicant is satisfactory.
(D) A fortunetelling, paLmistry, clairvoyancy or astrology
license may be revoked by the city commission or an application
for issuance or renelval of such license may be refused by the city
commission, if they determine after notice and hearing:
f ) That the appl icant or license-holder is not an
individual of good moral character and business
responsibi l ity; or
2l That the application of the applicnt or license-holder
contains any fa1se, fraudulent or misleading material

3) ThaE the applicant or Iicense-holder has perpetrated a
fraud upon any person vrhether or not. such fraud was
perpetraEed in Ehe conduct of the business in Ehe Cit,y
of Dania, Florida, or
4) ThaE the applicant or license-holder has violated any of
the statutes of the SEate of Florida relating to
fortunetelllng, palmistry, clairvoyancy or asErology; or
5) That the applicant has been convicted of any crine or
misdemeanor involving moral turpitudei or
6) That the applicant or license-holder has conducted his
or her business in the City of Dania, Elorida, in an
unlawful manner or in such a manner as to constitute a
breach of the peace or a menace to the health, safety or
general welfare of the public.
(E) Notice of the hearing provided for in sub-paragraph (D)
above shal1 be given in writing to the applicant or license-holder
as the case may be. Such notice shall be mailed, post.age prepaid
Eo the applicant or license-holder as the case may be at his last
known address at least five days prior Eo the date set for
hearing. The applicant or license-holder as the case may be shall
have the right to be represented at, such hearing by counsel.
Section 3. Judicial Remedy by Circuit Cou rt .
Any person aggrieved by any decision of the city
may, within 30 days from the date of rendition of such

and for Broward County, Florida, for a review of such decision of
the city commission, which said review shall be limited Eo a
petition at common law for a writ of certiorari.
Section 4. License Fees.
The fees for a fortunetelling, palmistry, clairvoyancy or
ast.rology license shall be in the sum of One Thousand Dollars
($1r000.00) for each twelve month period or fraction thereof.

Every applicant for a fortunetelling, palmistry, clairvoyancy
or astrology license sha1l file with the Clerk-Auditor of the City
of Dania, Florida, a surety bond running to the City of Danial
Florida, in the anount of One Thousand Dollars with surety
acceptable Eo and approved by the clty commission conditioned that
the said applicant, if issued a fortunetelling, palmistryl
clairvoyancy or astrology l.icense will comply fully with all the
provisions of the ordinances of the City of Dania, Florida. and
the statutes of the State of Elorida and will pay all damages
which may be susEained by any person by reason of any fraud,
deceit, negligence or other wrongful act on the part of the
licensee, his agenE or employees in the conduct of the licensee,s
business. A liability insurance policy issued by an insurance
company authorized to do business in the State of Florida which
conforms t.o the above requirements may be permitted by the city
commission in iEs discretion in lieu of a bond.

The provisions of this ordinance shall apply to all nert,
applicants for occupat.ional licenses for fortunetelling,
palmistry, clairvoyancy or astrology activities and for all
renewals of licenses issued for fortunetelling, palmistry,
clairvoyancy or asErology activities that are in effect at the
Eime of the effective date of this ordinance.
Section 8. Penalties.
Any person violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction
thereof shaIl be fined not exceeding $500 or by inprisonrnent in
the county jail not exceeding 90 days, or by both such fine and
imprisonment. Each violation shall constitute a separat.e offense
and shall be punishable as such hereunder.
Section 9. Separability.
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitut ional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions of this ordinance.
Section 10. Codi fication.
The provisions of Ehis ordinance shall be included in and

MARCH 25, 1997 REGULAR MEETING
4.2 VA-06-97 - Bill Bonilla, Petitioner - BVT lnstitutional lnvestments, Owner
400 E. Sheridan Street (Publix Shopping Center)
Request for a variance from the Sign Code, Section 3-33 (m) for the construction
of a double sided illuminated pole sign containing '150 total square feet.
Leigh Kerr, Planning Consultant for the City, advised that BW lnstitutional
lnvestments is requesting a variance for a 150'sign where a 50' is permitted for
property located in the Sand Piper Bay Shopping Center at the northwest corner
of SE 5h Avenue and Sheridan Street. The property is presently zoned C-2.
Bill Bonilla, BW lnstitutional lnvestments, requested approval of the variance for
the sign in an effort to attract more business into the shopping center. Mr.
Bonilla explained his difficulty in coping with the many violations from the
previous owner and expressed his intention on working with the City to resolve
the problems.
Mayor Mikes opened public hearing.
Richard Shodrick, 410 SE 14 Street, Sandpiper Bay Townhomes, explained the
ongoing problem with trucks parking in the back of the shopping center and
running their refrigeration units all night. Mr. Shodrick mentioned his efforts to
contact the BSO, City staff and owners of BW in Tampa to stop the private truck
owners from parking at the shopping center and disturbing area residents.
Mr. Bonilla mentioned his efforts to obtain "Tow Away" signs to deter the trucks
from parking. Discussion followed on the ineffectiveness of citing the vehicles
with tickets when the owner is not around. Commissioner Bertino thought that
once the "Tow Away" signs are posted and authorization is received from the
petitioner to tow the vehicles, the problem will come to a close.
John Bruckner, Meadowbrook Lakes Condominium, mentioned that he has
experienced similar truck parking problems in his neighborhood and that the
provisions in the noise ordinance need to be addressed to rectify the problem.
Vito Mancino stated that the owner has the responsibility of stopping
tresspassers from parking on his property and that this is not a City responsibility.
Hearing no further comments, the Mayor closed the public hearing.
Commissioner Etling suggested to include a condition to the variance that the
petitioner provide authorization for the towing. He commended the petitioner for
providing information from the tenants that the lack of proper signage does cause
a hardship to businesses in the shopping center.
Commissioner Bertino questioned the petitioner on whether he would consider
completing the sidewalks for citizens to walk to the shopping center and asked
for an explanation on the proposed landscaping around the sign. Mr. Bonilla
agreed to install the sidewalks and presented a landscaping plan for the public to
view that will be property landscaped by an engineer. Mr. Bonilla agreed to
install 10 royal palms around the perimeter of the shopping center in the middle
of the swale to better the appearance.
Commissioner Etling suggested an extension from the sidewalk out to the street
in order for people to access the sidewalk from the east because of the drainage
problem lhat exists on the swale. Mayor Mikes suggested to install the sidewalk
up near the property line for the dryest land. City Manager Smith suggested to
have the Public Works Department work with the property owner to come up with
a joint resolution to the standing water problem.
Vice Mayor Cali asked for a commitment from the petitioner to have "No Parking"
signs erected by Friday to assist the residents of Sandpiper Bay. Mr. Bonilla
agreed to the request.
A motion was made by Commissioner Bertino, seconded by Commissioner
Hyde, to grant the variance contingent upon: "Tow Away" signs being
constructed by Friday, the City being given permission to tow any vehicles in
violations of the "Tow Away" signs, sidewalks being constructed in compliance
with city staff recommendations, property landscaping being added to the sign
and at least ten royal palms being added to the swale area in a radius around the
shopping center.
Victor Lohmann, Planning & Zoning Board, advised that one ofthe issues that
arose with the Planning & Zoning Board was to include into the variance that the
petitioner forego any additional pole signs that would meet the 50 square foot
sign limitation on the property. Mr. Bonilla agreed to the commitment.
Commissioner Bertino included the condition for no additional pole signs as
presented to the motion. Commissioner Hyde agreed and seconded the motion.
The motion passed on the following roll call vote:
