HomeMy WebLinkAboutR-1996-121A RESOLUTION OF THE CIry OF DANIA, FLORIDA, AUTHORIZING AND DIRECTING THE CIry MANAGER TO REFUND PAYMENTS MADE TO THE CITY BY PROPERTY OWNERS FOR THE CONSTRUCTION OF AN ALLEY IN BLOCK 3, TOWN AND COUNTRY ESTATES, SECTION ONE, UPON THE PROPERTY OWNERS APPLYING FOR SAME NO LATER THAN SIX MONTHS FROM THE EFFECTIVE DATE OF THIS RESOLUTION; PROVIDING FOR CONFLICTS AND PROVIDTNG FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CIry OF DANIA, FLORIDA; WHEREAS, during the year of 1987 and 1988, the City of Dania collected various sums of money from contractors building single family residences in a subdivision known as "Block 3, Town and Country Estates, Section One", to cover the costs of construction of an alley in the block between S.E. 3rd Avenue and S'E. 3rd Court; and WHEREAS, the amounts collected were not correct and fell far short of the amount needed to pay the costs of the alley with some property owners paying $800.00 per lot, some paying $400.00 per lot and other owners failing to pay any amount; and WHEREAS, the costs to construct this alley far exceeds the amount collected even if each lot owner had contributed $800.00 each, and WHEREAS, it is in the best interest of the City and the property owners that have paid said sum to refund to the property owners the amounts paid to the city upon the various property owners applying for a refund of the sums paid- NOW THEREFORE, be it resolved Section 1. That the City Manager is hereby authorized and directed by the City Commission of the City of Dania, Florida to refund the amounts paid, without interest, to each of the parties who have paid the assessments upon said parties filing with the City Manager a request for such refund, which requests must be made no later than six months from the effective date of this resolution. 1 RESOLUTION NO, 121-96 RESOLUTION NO.121-96 Section 2.
