Home My WebLink AboutR-1996-014RESOLUTION NO. 14-96 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, AUTHORIZING THE CITY MANAGER TO CONTRACT FOR THE PURCHASE OF SUPPLIES, SERVICES, EQUIPMENT AND MATERIALS IN THE AMOUNT OF EIGHry THOUSAND, NINE HUNDRED AND EIGHTY DOLLARS ($80,980.00) WTHOUT COMPET|T|VE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; AND PROVIDING THAT ALL RESOLUTIONS OR PARTSOF RESOLUTIONS IN CONFLICT HEREWTH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania, Part lll, Article 3, Section 4, Subsection (J), authorizes the City Manager to purchase supplies, services, equipment and materials for the City Government in an amount up to and including Fifteen Thousand Dollars ($15,000.00) without competitive bidding and without advertisement for bids, if he is authorized to do so in advance by a resolution adopted by the City Commission; and the City Commission may by resolution authorize the purchase by the City Manager of designated supplies, services, equipment and materials in an amount in excess of Fifteen Thousand Dollars ($15,000.00) without competitive bids and without advertisement for bids WHEREAS, the City Manager has determined that it is necessary to contract for professional services relating to Tigertail dredge and fill project in connection with Bass Pro Shops per Resolution 04-96 WHEREAS, the City Manager has determined that such services can be obtained at the least cost to the City by accepting the proposal of Berry & Calvin lnc copy of which is attached NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CIry OF DANIA, FLORIDA; Section 1 .That the_City Manager be and is hereby authorized to contract with Berry & Calvin, lnc. for professional services relating to Tigertail dredge and fill project in connection with Bass Pro Shops without competitive bidding and without advertisement for bids. Section 2. That the City Manager be and he is hereby authorized to pay from City funds to said Berry & Calvin, lnc. the sum of Eighty Thousand, Nine Hundred and Eighty Dollars ($80,980.00) upon the satisfactory completion of the work provided to be done by said contract. Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict Section 4. IL Euvironmental Permitting Services (Assuming .that Federal, State, and Locai Environmental permits are required). A. Gather available information necded to assist with the prcparation and processingof both environmenal permit applications and the ERp permit applications.B. Prepare for submital, the joint apprication materiais for the required u.S Armycorp of Engineers (usAcoE) and Broward county Depanment of Natural Resource Protection (BCDNRP) dredge and fill permia. Coordinate and attend two (2) on-site mcetings with the permitting and commenting agensies to assess the j urisdictional arcas and define probable agency permit conditions. Prepare a Mitigation Maintenance and Monitoring PIan as required by the agencies. Process the submitted permit applications with the Federai, S tate and County agencies responding to requests for additional informadon and addressing commenting agency questions and concerns, assuming minimai heid work. III. Professional Civil Engineering Services Prcparation of dredge and fill plans and specifications for construction bidding: A, Prepare dredge and fill plans and specifications for the excavation and deepening of the existing lake including the placement of the fiil on the proposed access road and the Tri-Rail parking lot. B. Prcpare the bid documents such that an excess quantity of fiil may be produced and a credit is gained by the City for the excess.C. Assist the City in obtaining bidders, review the bids and make recommendations on award of the bid for dredge and fill. D. Prepare the site geometry of the access road and the Tri-Rail parking area in order to determine the limits of embankment. E. Assisr the City in obtaining bids for the project, review the bids and make recommendations to the City on award of the bid for the fill work. G. Perform services during the construction of the project consisting of review of shop drawings, periodic field observations consisting of l0 hours per week, rcview of pay requests, and performing three sets of soundings to calculate the f,rll removed during that period. H. Arrange for ten soil borings to be taken at a deplh of 60 feet each for use in the bidding of the project. I. Review of access road pians prepared by others 930 day time limit). J. Professional services required due to changes in the site plan initiated by the client, their rcpresentatives or other consultans (e.g. architecs, landscape architects, etc.) after either design or prcparation of the construction drawings has commenced will be biiled as Additional Services. Any outside engineering services, studies, or laboratory testing not specificaily mentioned in the Scope of Services will be the responsibility of the City of Dania. All municipal, permit, and agency fees as well as Title Certificates wiil be paid by the client. Reimbursable Exoenses Bcrry & Calvin, Inc. and its subcontraclors wiil be reimbursed for the printing of drawings and specifications, deiiveries, federal express services, required travel time and travel expenses, long disunce telephone calls, fax transmittals, and postage, as required. Reimbursable expenses wiil be invoiced direltly to the City of Dania. CLIENT RESPONSIBILITIES The City of Dania or their representative shali be available to meet with Berry & Calvin, lnc. and provide decisions in a timely manner throughout the course of the project. The City of Dania will provide Berry & Caivin, Inc. wilh plans and other peninent information which may be necessary to properly survey or engineer the site. TERMS OF AGREEI\{EI{T The terms of the Agreement shall be valid for the ciient's acceptance for a period of tJrirty (30) days from the date of execution by Berrl' & Calvin, Inc. after which time this contract offer becomes null and void if not accepted formaily (evidenced by receipt of an executed copy of this document). All rates and fees quoted in this document shall be effective for a period of six (6) months, after which time they may be renegotiated with the City of Dania. All original documents shall be retained by Berq, & Caivin, Inc. and will remain their properry. This informadon is proprietary and will not be shared with others without prior written consent. The City of Dania may request reproducible copies of aII originai documents upon payment of City of Dania B&C DOC:\PROPOSALUaouary\95-lrt49R.N27 Page 5 January 5, 1996 all outstanding invoices, and at the client's expense. Invoices for work iccompiished to date will be submitted twice monthly and are payable within thirty (30) days. The City of Dania will pay invoices upon receipt and understands interest charges of 1.57o per month wiil be applied to any unpaid baiance past thirry (30) days. Berry & Calvin, Inc. may elect to stop work until paymenr is received. If work is stopped for thirty (30) days or more, Berry & Calvin, Inc. may request compensation for stan-up costs when work resumes. We appreciate the opportunity to submit this proposal.
