VA-030-25: The applicant and property owner, Robert Webster, requests a variance to permit a six-foot (6’-0”) high fence on a portion of the front yard property line, for the property located at 3040 SW 45th Street. 2. OT-032-25: The applicant, Ruben Nunez of Spirits Cellar Corp., requests a waiver of 630’ to allow a new alcohol-based business as close as 370’ where the Land Development Code (LDC) requires a minimum 1,000’ separation for the property located at 13 South Federal Highway. The meeting was called to order at approximately 7:00PM by Chair Robertson. Board Clerk Ibel Larios called the roll. Discussions/actions notated below were not limited to what was typed. I. ROLL CALL Chair W. Motion passed 5-0. II. APPROVAL OF MINUTES 1. Approval of Minutes of the Planning and Zoning Board / Local Planning Agency from the July 16, 2025 regular meeting. Motion was made by Vice Chair Granett to approve the minutes of the Planning and Zoning Board/Local Planning Agency for the July 16, 2025 meeting and was seconded by Board Member De Las Salas. Motion passed 5-0. III. PUBLIC HEARINGS 1. RZ-006-25: The applicants, Dania Live 1748, LLC, Dania Live 1748 II, LLC, Spirit Airlines, Inc., and Discount Auto Parts, LLC, are requesting to rezone the property located north of Stirling Road, east of Interstate 95, and west of Bryan Road, by amending the Dania Pointe Development Design Guidelines relating to commercial intensity, residential density and other modifications. Planner Jessica Mackey presented with a slideshow for this re-zoning application starting with a brief background on the property and showed the location of all its parcels. The request tonight was to amend the Dania Pointe Development Design Guidelines (DDG) and she explained why. Planner Mackey said that no objections were raised at the Community Outreach Meeting. She further stated Staff found that the DDG complied with the City’s Land Development Code and recommended approval of the DDG amendments. The applicant was here to present and answer any questions. Planning and Zoning Board/Local Planning Agency Minutes 2 September 17, 2025 Attorney Dennis Mele presented with a slideshow explaining reducing retail a little and increasing hotel in order to comply with market demand. They were also changing some of the units from high-rise to mid-rise. He answered questions regarding such things as what would be located in the different areas, ride share locations, what it was that the applicant wanted to accomplish, where the Spirit Hub (residential building, training building, and office building) would be located, projected impacts on traffic flow and parking on Stirling and Bryan Road, etc. As there were no other board questions/comments, the Chair called for public comment but there wasn’t any. There was one more board question that Attorney Mele answered regarding if community benefits, e.g., affordable housing and parks, were included. Motion was made by Board Member De Las Salas to approve RZ-006-25 and was seconded by Board Member Rauhe. Motion passed 4-1 (Board Member Silver opposed). IV. BOARD ITEMS 1. City Commission actions on items previously heard by the Board: Director Norena explained that today’s agenda contained the updates for the three items listed below. o TX-010-25 Hotel Parking Amendments:  2nd Reading on August 26 – Motion passed unanimously o OT-005-25 Cooper Hawks Extended Hours:  August 26 City Commission – Motion passed unanimously o TX-048-24 GTWY-MU-II Text Amendment:  2nd Reading on August 26 City Commission: Motion passed 3-1 (Mayor Davis opposed & Commission Ryan was excused) 2. RESOLUTION #2025-PZ-004 RESOLUTION NO. 2025-PZ-004 A RESOLUTION OF THE PLANNING AND ZONING BOARD OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A VARIANCE (VA-030-25) TO SECTION 235-30(A) OF THE LAND DEVELOPMENT CODE, TO PERMIT A SIX (6’-0”) FOOT HIGH FRONT YARD FENCE, WHERE A MAXIMUM OF FOUR (4’-0”) FEET IN HEIGHT IS PERMITTED, SUBMITTED BY THE PROPERTY OWNER, ROBERT S. WEBSTER, FOR THE PROPERTY LOCATED AT 3040 SW 45 STREET, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28, the Land Development Code (the “LDC”) Part 6 “Development Review Procedures and Requirements, “Article 625, “Variances” of the City Code of Ordinances (the “City Code”), the property owner, Robert S. Webster (the “Applicant”), applied to the City of Dania Beach (the “City”) for approval of a variance (VA-030-25) for the property located at 3040 SW 45 Street, legally described on Exhibit “A” and incorporated by this reference; and WHEREAS, LDC Section 625-40 states that the Planning and Zoning Board may grant a variance based on its determination that the Applicant has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant proposes to maintain a pre-existing six (6’-0”) foot fence located on the east boundary in the front yard of the property, where LDC Section 235-30(A) permits a maximum of four (4’-0”) feet of height for front yard fences; and WHEREAS, the Applicant installed the fence in 2017 without a permit; and WHEREAS, the Applicant has provided sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the Code; and WHEREAS, the Staff Report analyzes the applicant's request based on the variance criteria and supports the Applicant’s request; and is incorporated by reference herein as the City’s finding of fact; and WHEREAS, the Planning and Zoning Board conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the Planning and Zoning Board found that the variance (VA-030-25) request is consistent with the Comprehensive Plan, and Land Development Code, and will protect the RESOLUTION #2025-PZ-004 public health, safety, and welfare of the residents of the City, and further the purpose, goals, objectives, and policies of the Comprehensive Plan; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing “WHEREAS” clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution by this reference. Section 2. The application (VA-030-25) for a variance to LDC section 235-30(A), to permit a six (6’-0”) foot fence in the front yard; where a maximum of four (4’-0”) feet in height is permitted, is supported by staff and recommended for approval. In the pursuit of the approvals granted, the Applicant shall comply with the condition below. 1. The applicant shall submit and receive approval for a permit for the decorative side of the fence, which shall be oriented to the exterior or public side, consistent with Code Section 235-50. It must be completed when the permit is submitted. This condition shall fully satisfy the fence orientation for the purpose of meeting the current City code. Section 3. That the associated Planning and Zoning Division Staff Report prepared for the above application is incorporated into this resolution as findings of fact. Section 4. That pursuant to LDC Section 625-500 “Expiration of Variances,” the variance (VA-030-25) shall automatically expire and become null and void unless the applicant files a complete building permit application with construction drawings for the improvements shown on the site plan, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. That this Resolution shall take effect ten (10) days after the passage and adoption. WHEREAS, pursuant to Chapter 28, Part 1 of the Dania Beach Land Development Code (the “LDC”) Section 110-50(E), entitled “Proximity of Alcohol Beverage Establishments to Other Establishments and Uses” states that an Applicant for license to sell liquor, in addition to beer and wine, within one thousand (1,000) feet of another place of business so licensed, may apply for a waiver of proximity requirements set forth in section 110-50(B)(9); and WHEREAS, the applicant, Ruben Nunez, Spirits Cellar Corps, has requested a Waiver (OT-032-25) of the distance separation requirements for property located at 13 S Federal Highway, Dania Beach, Florida, legally described in Exhibit “A,” pursuant to Section 110-50(E) of LDC; and WHEREAS, the City Planning and Zoning Board, sitting as the Local Planning Agency, recommended that the City Commission approve the proposed Waiver of the proximity is consistent with the requirements set forth in Section 110-50(E)(1) at its duly advertised public hearing on October 15, 2025, meeting; and WHEREAS, the Planning & Zoning Board took into consideration the following criteria from Code Section 110-50(E)(1) in recommending approval: (a) That the waiver maintains the stability and appearance of the community; (b) That the waiver will not adversely impact the public interest or adjacent property and all necessary alternative measures shall be taken by the applicant to prevent any such impact; (c) That the sale of liquor in addition to beer and wine at the requested location will not cause a detrimental impact to the value of existing contiguous uses, to uses in the general area and to the zoning district where the sale is to be located; (d) Any applicant for a waiver of the proximity requirement must be enrolled in the Florida Responsible Vendor Program administered by the Division of Alcoholic Beverages and Tobacco, and must continue to be a member in the responsible vendor program as a condition of obtaining the waiver. 2 RESOLUTION #2025- WHEREAS, the Applicant has provided sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the Code; and WHEREAS, the City’s Staff Report analyzes the applicant’s request based on the criteria and supports the Applicant’s request and is incorporated by reference herein as the City’s findings of fact; and WHEREAS, the City Commission has determined that the Applicant has met the criteria for a waiver of the distance separation requirement by a preponderance of the evidence; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission found that the approval of the Waiver request (WA- 032-25) is consistent with the LDC and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing “WHEREAS” clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28 “Land Development Code,” Part 1 “Use Regulations,” Article 110 “Use Regulations for Commercial and Mixed Use Districts,” of the City Code, the Waiver request (OT-032-25), as shown on Exhibit “B,” is hereby approved. Section 3. That pursuant to the approvals granted, the Applicant shall comply with the following conditions. 1. Customers must park at the Dania Beach City Hall garage. 2. Applicant shall provide signage to indicate parking will be provided at the Dania Beach City Hall garage. 3. The business hours shall be from Monday to Saturday, 10:00 a.m. to 5:00 p.m., for appointments scheduled online by customers. Then, from 5:00 p.m. to 8:00 p.m., for the business to allow walk-ins to integrate the CRA’s vision for business and economic development to encourage pedestrian activity and support community growth. 4. City staff shall review and act upon all submittals related to Certificate of Use or parking compliance within thirty (30) calendar days of receipt. 5. Applicant is required to provide a tasting room, Per Code Section 302-10. Applicant must fulfill this requirement at the permitting level. 6. Applicant is required to enroll in the Florida Responsible Vendor Program before Certificate of Use issuance. 3 RESOLUTION #2025- Section 4. That pursuant to LDC Section 110-50(E)(6), “Resolution to grant waiver” approval shall automatically expire after one hundred and eighty (180) days, within which a building permit shall be secured if one is required to implement the use for which the waiver is granted. The waiver shall expire if the building permits to implement the improvements authorized by the waiver is not secured within the time frame specified in this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law Section 6. That the associated Community Development, Planning & Zoning Division Staff Report prepared for the above application(s) is incorporated into this resolution as findings of fact. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 8.
