HomeMy WebLinkAboutR-2025-152 DR-007-25 Plat Note AmendmentRESOLUTION NO. 2025-152 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE PLAT NOTE AMENDMENT (DR-007-25) FOR THE “DANIA POINTE” PLAT; SUBMITTED BY DANIA LIVE 1748, LLC, DANIA LIVE 1748 II, LLC, SPIRIT AIRLINES, INC., AND DISCOUNT AUTO PARTS, LLC, FOR THE PROPERTY LOCATED NORTH OF STIRLING ROAD, EAST OF INTERSTATE 95, AND WEST OF BRYAN ROAD, WITHIN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Greenspoon Marder, LLP, on behalf of DANIA LIVE 1748, LLC, DANIA LIVE 1748 II, LLC, SPIRIT AIRLINES, INC., AND DISCOUNT AUTO PARTS, LLC, (the “Applicants”) are requesting approval of a Plat note amendment (DR-007-25) to the “Dania Pointe” Plat, recorded in the Public Records at Plat Book 183, Page 91 (the “Plat”), for the Property legally described in Exhibit “A” (the “Property”); which document is incorporated by reference into this resolution; and WHEREAS, the Applicant is proposing to increase the number of hotel rooms and mid- rise units permitted, decreasing the intensity of commercial and office uses, and removing the high- rise units permitted on the Property, said Property being located within the plat limits of the Plat; and WHEREAS, the Applicant is requesting an amendment to the Plat to change the Plat note to reflect the intended proposed and future use for the referenced platted property, said amendment is attached in Exhibit “B”; and WHEREAS, staff has reviewed the proposed request and finds that it remains consistent with the concurrency standards established for the Plat, and therefore recommends approval; and WHEREAS, City Code of Ordinances, Chapter 28, entitled “Land Development Code” (“LDC”), Part 6, entitled “Development Review Procedures and Requirements,” Section 640-70 titled “Amendment of plat” provides that the Plat note amendment must be approved by City Commission; and WHEREAS, Broward County requires that the City concur with the proposed revision prior to review by the Broward County Commission; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Chapter 28, Part 6 of the LDC, Article 610; and 2 RESOLUTION #2025-152 WHEREAS, the City Commission finds that the approval of the proposed Plat note amendment (DR-007-25) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives, and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. The foregoing “Whereas” clauses are ratified and confirmed as being true, and they are made a part of and incorporated into this Resolution. Section 2. Pursuant to Chapter 28, "Land Development Code," Part 6 entitled "Development Review Procedures and Requirements," Article 640, entitled "Plats," at Section 640-70, entitled "Amendment of plat," the Plat Note Amendment (DR-007025) for the “Dania Pointe” Plat, recorded in the Public Records at Plat Book 183, Page 91 is approved and the Plat note is changed as follows: From: This plat is restricted to 944,000 square feet of commercial use; 506,000 square feet of office use; 350 hotel rooms; 400 high-rise units; and 1,000 mid-rise units. To: This plat is restricted to 865,000 square feet of commercial use; 473,000 square feet of office use; 550 hotel rooms; and 1,110 mid-rise units. Section 3. That the approvals granted by this Resolution are subject to the Applicant’s compliance with the following conditions: 1. Proposed water and wastewater quantities will be evaluated as each future application is submitted, as well as the required parking and drainage improvements necessary for the shopping center’s future improvements. (Engineering) 2. Broward County approval is required. (Engineering) 3. Provide a recorded copy of the plat prior to issuance of a building permit. (Planning and Zoning) Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a State or Federal agency and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a State or Federal agency or undertakes actions that result in a violation of State or Federal law. 3 RESOLUTION #2025-152 Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be effective 10 days after passage.
