Home My WebLink AboutR-1995-104RESOLUTTON 119. 104-95 WHEREAS, the City of Dania's Comprehensive Plan was adopted on April 11, 1989; and WHEREAS, it has become necessary to prepare an evaluation and appraisal report to the Comprehensive Plan as the first step toward updating the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CIry OF DANIA, FLORIDA: Section 1. That the City Commission of the City of Dania, Florida does hereby approve the contract between Berry and Calvin, lnc. and City of Dania, for the preparation of an evaluation and appraisal report, a copy of which is attached hereto and made a part hereof as Exhibit "A". Section 2. That the Mayor-Commissioner, City Manager and City Clerk- Auditor are hereby authorized and directed to forthwith execute said Agreement on behalf of the City of Dania, Florida. 1 Resolution No.10 4- 95 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING THE CONTRACT BETWEEN BERRY & CALVIN, INC. AND THE CITY OF DANIA TO PERFORM THE NECESSARY WORK TO COMPLETE AN EVALUATION AND APPRAISAL REPORT OF THE CITY OF DANIA COMPREHENSIVE PLAN; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 4. That this resolution shall be in force and take effect immediately upon its passage and adoption. SCOPE OF SERVICES Berry & Calvin, Inc. will perform the following services based on our understanding of the prolect requirements: A. A description of the public participation process to be used in preparation of the local government's Evaluation and Appraisal Report. A detailed workplan that the Recipient will follow in completing the Scope of Services required by their contract with the Department of Community Affairs (DCA). Berry & Calvin, lnc. will perform the Scope of Services for an hourly not to exceed fee as shown by the following recap: PROPOSED SCHEDULE OF FEES Prof essional Engineering Services TOTAL t202,24.OO ADDITIONAL FEES Additional services as required by the City of Dania which have not been included in this proposal will be addressed in a separate contractual agreement. Professional services required due to changes in the site plan initiated by the client, his/theit representatives or other consultants (e.g. architects, landscape architects, etc.) aft€r either design or preparation of the construction drawings has commenced will be billed as Additional Services. Any outside engineering services, studies, or laboratory testing not specifically mentioned in the Scopo of Services will be the responsibility of the City of Dania. All municipal, permit, and agency fees as well as Title Certificates will be paid by the client. Reimbursable Exoenses Berry & Calvin, lnc. and its subcontractors will be reimbursed for the printing of drawings and specifications, deliveries, federal express services, required travel time and travel expenses, long distance telephone calls, fax transmittals, and postage, as required. Meetino Attendance Due to the difficulties of predicting the number or duration of meetings, no meetings are included in the Schedule of Fees shown above. Preparation for and meeting attendance, as necessary, will be provided on a time and materials basis and will be billed at the standard hourly rates in accordance with the attached Hourly Rate Schedule. CLIENT RESPONSIBILITIES The City of Dania or their representative shall be available to meet with Berry & Calvin, lnc. and provide decisions in a timely manner throughout the course of the proiect. The city of Dania will provide Berry & Calvin, lnc. with plans and other pertinent information which may be necessary to properly survey or engineer the site. Berry & Calvin, lnc. agrees to perform the work according to the terms and conditions of contracts between the City of Dania and DCA. More specifically, Betry & Calvin, lnc. as the subcontractor would be obligated to the following. lf the Recipient subcontracts any or all of the work required under this contract, the Recipient agrees to include in the subcontract specific language to inform the subcontractor that the subcontract is bound by the terms and conditions of this contract between the Recipient and the (Oepartment of Community Affairs). The Recipient agrees to include in the subcontract that th€ subcontractor shall hold the Department and Recipient harmless against all claims of whatever nature arising out of the subcontractor's performance of work under this contract, to the extent allowed and required by law. If the Recipient enters into a subcontract. a copy of the executed subcontract must be forwarded to the Department as a portion of the workplan. TERMS OF AGBEEMENT The terms of the Agreement shall be valid for ths client's acceptance for a period of thirty (30) days from the date of execution by Berry & Calvin, lnc. after which time this contract offer becomes null and void if not accepted formally (evidenced by receipt of an executed copy of this document). All rates and fees quoted in this document shall be effective for a period of six (6) months, after which time they may be renegotiated with the City of Dania. This information is proprietary and will not be shared with others without prior written consent. The City of Dania may request reproducible copies of all original documents upon payment of all outstanding invoices, and at the client's expense. lnvoices for work accomplished to date will be submitted twice monthly and are payable within thirty (3O) days. The City of Dania will pay invoices upon receipt and understands interest charges of I .5 o/o per month will be applied to any unpaid balance past thirty (30) days. Berry & Calvin, lnc. may elect to stop work until payment is received. lf work is stopped for thirty (3O) days or more, Berry & Calvin, lnc. may request compensation for start-up costs when work resumes.
