AN ORDINANCE OF THE CITY OF DANIA FIORIDA
REPEALING THE MANDATORY RETIREMENT AGE
FOR THE DANIA GENERAL EMPLOYEES'
RETIREMENT SYSTEM, AS SET FORTH IN SECTION 18-
29.2(e); PROVIDING THAT ALL ORDINANCES OR
PARTS OF ORDINANCES AND ALL RESOLUTIONS OR
PARTS OFRESOLUTIONS IN CONFLICTHEREWTIH BE
REPEALED TO THE EXTENT OF SUCH CONFLICT; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the mandatory retirement age of 70 set forth in the second sentence of
Section 18-29.2(e) of the Dania Code violates the federal Age Discrimination in
Employment Act, rhe Florida civil Rights Act of 7992 and Section 1.12.M4 of the Florida
Statutes,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
FT,ORIDA:
Section 1. The second sentence of Section l8-29.2(e) of the Dania Code, which
reads: "In no event shall a member retire later than age seventy (70), unless the board
extends such member's retirement date by written authorization on a year-to-year basis" is
hereby REPEALED and deleted from the Dania Code.
Section 2. That all ordinances or parts of ordinances and all resolutions or parts
of resolutions in conflict herewith be and the same are hereby repealed to the extent of such
conllict.
Section 3. That this ordinance shall be in force and take effect immediately upon
its final passage and adoption.
