RESOLUTION NO. 57.7
A RESOLUTION OF NECESSITY DELCARING THE NE-
CESSfTY OF PAVING NORTHEAST 3RD STREET, DANIA,
BROWARD COUNTY, TLORIDA, FROM NORTHEAST 6TH
AVENUE, ON THE I.IEST, TO GULFSTREAM ROAD, ON
THE EAST; AND PROVIDING THAT ALL RESOLUTIONS,
OR PARTS OF RESOLUTIONS, IN CONFLICT HEREWITH
ARE HEREBY REPEALED TO THE EXTENT OF SUCH CON'
FLICT; AND PROVIDING THAT THIS RESOLUTION SHALL
BE IN FORCE AND TAKE EFFECT IMMEDIATELY UPON
ITS PASSAGE AND ADOPTION
"I5. Request Cononission to adopt the
resolution of necessity for the paving of
3rd Street from approximately 6th Avenue
to Gulfstream Road. This is a very smal1
job and we should be able to use the unit
price from the bids on S. E. 5th Avenue to
do this work. The price will be approximately
$2,OOO.OO. This cost will then be assessed, to
the benefitteil adjacent properties. "

WHEREAS, the city cornmission accepts the said recommenda-
tion of the city manager and has determined that it is wise and
expedient to construct certain imProvements in the City of Dania,
Florida, as hereinafter described, the cost of which sha1l be
assessed against the property specially benefitted in proportion
to the benefit to be derived therefrom,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF DANIA, FLORIDA:
section l. That the necessity is hereby declared to exist
for the construction of

county, Florida, from Northeast 6th Street,
on the west, to Gulfstream Road., on the East.
Section 2. That the city commission of the City of Dania,

Florida, shall neet at 8:30 p m 6, 1974, in the

is prepared in advance by the city manageri and
VIHEREAS, item 15. on the agenda of the meeting for the city
commission of City of Dania held on April 15, 1974, reads as follows:

purpose of hearing any objections or remonstances that may be made
to the construction of the improvements, as aforesaid, and the
city clerk-auditor be, and she is hereby authorized and directed to
give notice of said hearing in accordance with the charter require-
ments of the City of Dania, Florida.
Section 3. That the city manager is authorized to determine
if the work can be done under the existing unit price bei-ng paid
for the current project known as the Fifth Avenue Project. If so,
he shall not be required to advertise for competitive bids from
other sources.
Section 4. That the city commission shalf meet at the
time and place aforesaid and hear objections, protests anil remon-
strances which any Person or Persons may Present in person, by
petition, or by attorney, and the city commission shalI consider
alI objections and protests, if any, and make, amend, confirm or
rescind the resolution of necessity, and determine $rhether the
proposed improvements sha1l be made antl how the cost thereof shalf
be assessed, and the determination of the city commission sha11 be
final and conclusive.
Section 5. That all resolutions, or parts of resolutions,
in conflict herewith are hereby repealed to the extent of such con-
f1ict.
section 6. That this resolution shall be in force and take
effect immediately upon its passage and adoption.
PASSED and ADOPTED this 15th day of ApriJ., 1974.

Item 15. of the agenda of the city commission for April
!5, 1974, refers to a resolution of necessity to pave }lortheast
3rd Street. Item l-5. of the minutes shohrs that such a resolution
was adopteil.
with respect to your letter of August 29, L974, wherein
you indicated that you had not received miscellaneous items for
1974, you tlid not mention the above resolution of necessity.
We probably used one of the standard mimeographed forms
as of April L5, 1974, and f assume that r may have simply handed
the form to you after it was approved. on the other hand, I do
not note that we assigned any number to any resolution of necessity
which we might have prepared. This is the type of form where we
probably were not in the habit of retaining copies.
At any rate, so that the internal records of our office
may agree with your records, I have currently drafted a custom
resolution to which I have assigneil the number, 57.7.
Please check your record.s. If you have not already received
the resolution of necessity adopted on April 75, L974, pJ-ease file
the enclosed resolution in your resolution file.
