respectively, to Planned Residential Development District (PRD-1).
2. TX-049-25: The applicant, the City of Dania Beach, is requesting to allow social services as
a Special Exception use in the Gateway Mixed-Use zoning district by amending the City’s
Land Development Code (LDC). (Withdrawn)
3. TX-051-25: The applicant, the City of Dania Beach, is requesting a text amendment to keep
fowl as a Special Exception, Conditional use in a residential zoning district by amending the
City’s Land Development Code (LDC).

The meeting was called to order at approximately 7:01PM by Chair Robertson. Board Clerk Ibel Larios called the roll.
Discussions/actions notated below were not limited to what was typed.

Motion was made by Board Member De Las Salas to excuse the absences for Vice Chair Joanna Granett and Board
Member Randy Wright was seconded by Chair Robertson. Motion passed 4-0.
II. APPROVAL OF MINUTES
1. Approval of Minutes of the Planning and Zoning Board / Local Planning Agency from the
November 19, 2025 regular meeting.
Chair Robertson asked for clarification on page 2 under 3. TX-036-25, second line - what was meant by broad
authorization in the sentence “ She explained it never was used, allowed for pretty broad authorization, and Staff was
recommending approval.” Discussion ensued and the wording would be corrected.
Motion was made by Board Member Rauhe to approve the minutes of the Planning and Zoning Board/LPA for the
November 19, 2025 meeting with 1 correction and seconded by Board Member De Las Salas. Motion passed 4-0.
III. PUBLIC HEARINGS
City Attorney Boutsis swore in everyone in attendance who was giving testimony tonight on any item. Additionally,
on any quasi-judicial item, she asked for any disclosure(s) that had to be made. There were no disclosures made.
1. VC-023-25: The property owner, Sunday Scura Jr., is requesting to vacate a portion of the Right-of-Way
lying west of the property located at 213-225 NW 1 Avenue. (Continued from November 19th meeting)
Planning and Zoning Manager Batista presented a slideshow starting with an explanation of the commercial property
background. The property owner to the west objected to supporting the vacation of the R ight-Of-Way. However,
there were no utility objections. The ROW was not used for any utilities. The applicant provided the vacation criteria
and the item supported the Comprehensive Plan. Manager Batista clarified that the ROW has always been there and
said that the FEC (Florida East Coast Railway) objected without any issues. Staff recommended the Board recommend
approval tonight to the City Commission. The applicant was here tonight to present their presentation. City Attorney

Boutsis explained a little more of the ROW situation and answered Board Member De Las Salas that if a ROW was
vacated, it would go back to the person who dedicated the land or if it was a 50/50 dedication, it would go back 50%
to one and 50% to the other. Tonight it would go back 100% to the original owner who dedicated the ROW to the
City. Attorney Rod Feiner, Coker & Feiner, gave a PowerPoint presentation and explained the property background
and why the entire vacation was going back to his client, Sunday Scura. Board Member Rosner asked about the FEC
objection and Board Member De Las Salas wanted to know how the building was built in the ROW and the attorney
answered. The property owner, Sunday Scura, gave details about the building. There were no other Board q uestions
and no one from the public wished to speak now.
Motion was made by Board Member De Las Salas to recommend approval of this agenda item (VC-023-25) to the
City Commission and was seconded by Board Member Rauhe. Motion passed 4-0.
2. VA-048-25: The property owners, Tammie and Ellis James, are requesting a variance to allow a six-foot
(6'-0")-high wall in the front yard for the property located at 255 NW 12 th Avenue.
Planner Alejandra Cuervo presented a slideshow starting with an explanation of the property background and that the
request for a six-foot wall in the front yard along the vacated area was for safety concerns. The maximum height
allowed was four feet. The applicant provided sufficient justification and staff’s analysis of each criterion was in the
staff report. The applicant conducted community outreach and no objections were received. Staff recommended
approval. She said that the applicant was in attendance tonight to answer questions. The planner answered Board
Member De Las Salas’ question regarding whether it was a masonry fence with a portion of screen and she explained.
Board Member Rosner asked about the safety concerns. Board Member De Las Salas explained that the applicant
spoke about them at a previous meeting. As there were no other board questions and no members of the public wished
to speak, the Chair called for a motion.
Motion was made by Board Member Rauhe to approve this agenda item (VA-048-25) and was seconded by Board
Member De Las Salas. Motion passed 4-0.
3. VA-050-25: The property owners, Paul and Cheryl Fetscher, are requesting a variance relating to the
setback requirements for a new generator and two (2) liquid propane tanks for the property located at 1414
Argonaut Isle.
Planner Jessica Mackay presented a slideshow starting with an explanation of the property background. She showed
pictures of the property and testified that the existing fence would screen the mechanical equipment. She explained
that the generator setback requirement was ten feet and the proposal was four feet and one inch and the liquid propane
tanks’ requirement was ten feet and the proposal was five feet. The code also required that liquid propane tanks
should be in the rear yard location. The applicant provided sufficient justification and staff’s analysis of each criterion
was in the staff report. The generator met noise and exhaust requirements and would only be used for emergency
purposes. The applicant mailed notices to properties within a thousand feet and the applicant received one letter
stating no objection. Community Development Staff recommended approval and the applicant was in attendance to
answer any questions. There were no more board questions and no one from the public spoke, the Chair called for a
motion.
Motion was made by Board Member De Las Salas to approve this agenda item (VA-050-25) and was seconded by
Board Member Rosner. Motion passed 4-0.
4. TX-038-25: The applicant, the City of Dania Beach, is requesting a text amendment to
modify reasonable accommodation regulations in the City’s Land Development Code (LDC)
in accordance with State Law.
Planning and Zoning Manager Batista presented a slideshow starting with the background on the ordinance and why
the City had to update the language on reasonable accommodation regulations. Staff was recommended that the
Planning and Zoning Board recommend approval of the ordinance to the City Commission. City Attorney Boutsis
gave the board a little background on reasonable accommodations and why this text amendment and the next text
amendment had to be done. Board Member De Las Salas asked for an explanation of what was certified recovery
residents and the City Attorney answered. She further answered Board Member Rosner that by doing this text
amendment, the City would be consistent with state law and all requirements. She answered in the affirmative that
the state has required that cities must allow for rehab home s. There were no distance requirements and each site had
to meet the reasonable accommodations criteria. She further answered Board Member De Las Salas that the state was
allowing drug rehab homes under reasonable criteria. Examples of some other questions asked were regarding what
the city could do and could the city restrict this type of home. The City Attorney explained that the city could not be
contrary to the state’s requirements and gave an example that any type of distance requirement between homes would
be contrary to the state’s requirement. The City Attorney answered Board Member Rosner that the city kept their own

requirements in that were not inconsistent with the state. As there were no further board questions and no one from
the public wished to speak now, the Chair called for a motion.
Motion was made by Board Member Rauhe to recommend approval of this agenda item (TX-038-25) to the City
Commission and was seconded by Board Member Rosner. Motion passed 4-0.
5. TX-046-25: The applicant, the City of Dania Beach, is requesting a text amendment to
modify Certified Recovery Residences definitions and to include the zoning district use
regulations in the City’s Land Development Code (LDC) in accordance with State Law.
Planning and Zoning Manager Batista presented a slideshow starting with explaining that this was the second part to
reasonable accommodations. This part was to adopt an ordinance consistent with state law effective July 1, 2025 for
certified recovery residence. Local governments were to implement certain procedures for handling and processing
certified recovery residents’ requests by January 1, 2026. This would be for a clear description of the use and zoning
districts that allow this activity. Staff was for this ordinance and recommended approval. City Attorney Boutsis asked
the board members to look at the map/chart in their folder and she explained permitted and not permitted. Board
Member Rosner asked if this was to take effect January first and the City Attorney answered. As there were no other
board questions and members of the public did not request to speak, the Chair called for a motion.
Motion was made by Board Member Rosner to recommend approval of this agenda item (TX-046-25) to the City
Commission and was seconded by Board Member Rauhe. Motion passed 4-0.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING THE REQUEST MADE BY 2700 GRIFFIN
HOLDINGS LLLP, A FLORIDA LIMITED LIABILITY LIMITED
PARTNERSHIP FOR PROPERTIES GENERALLY LOCATED AT 4880 SW
28th AVE AND 4901 SW 27th TERRACE, IN THE CITY OF DANIA BEACH,
FLORIDA, TO REZONE THE PROPERTIES FROM TWO-FAMILY
RESIDENTIAL DISTRICT (RD-8000) AND SINGLE-FAMILY 6000
RESIDENTIAL (RS-6000) TO PLANNED RESIDENTIAL DEVELOPMENT
DISTRICT (PRD-1) (UNDER APPLICATION RZ-034-24), SUBJECT TO
CERTAIN RESTRICTIONS; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, pursuant to Chapter 28, “Land Development Code,” (“LDC”) Part 6,
“Development Review Procedures and Requirements,” Article 645 “Rezoning” of the City Code
of Ordinances (the “City Code”), 2700 Griffin Holdings LLLP, a Florida limited liability limited
partnership (the “Applicant”) has applied to the City of Dania Beach (the “City”) for approval of
a Rezoning (RZ-034-24) from RD-8000 and RS-6000 to PRD-1 for properties generally located
at 4880 SW 28th Ave and 4901 SW 27th Terrace, respectively, as legally described in Exhibit “A;”
and
WHEREAS, the City Planning and Zoning Board, sitting as the Local Planning Agency,
(the “LPA”) held a duly advertised public hearing on January 21, 2026, and determined that the
proposed rezoning is consistent with the goals and objectives of the City of Dania Beach
Comprehensive Plan, and therefore recommended approval of the proposed Rezoning (RZ-034-
24) request; and
WHEREAS, the rezoning of the parcel to PRD-1 is consistent with the City’s FLUM; and
WHEREAS, the Planning and Zoning Board is required to conduct one (1) duly noticed
public hearings in accordance with law; and
WHEREAS, the City Commission is required to conduct two (2) duly noticed public
hearings in accordance with law; and
WHEREAS, the City Commission finds that the approval of the proposed Rezoning (RZ-
034-24) will protect the public health, safety, and welfare of the residents of the City, and further
the purpose, goals, objectives and policies of the Comprehensive Plan;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the preceding “WHEREAS” clauses are ratified and incorporated as a
record of the legislative intent of this Ordinance.
Section 2. That pursuant to Chapter 28 “Land Development Code,” Part 6
“Development Review Procedures and Requirements,” Article 645 “Rezoning,” the Rezoning
request (RZ-034-24) from RD-8000 and RS-6000 to PRD-1 for the properties generally located at
4880 SW 28th Ave and 4901 SW 27th Terrace, as legally described in Exhibit “A,” is approved,
subject to the following condition:
1. A Declaration in Lieu of a Unity of Title be recorded in the Public Records of Broward
County, Florida within thirty (30) days of the date of this Ordinance or this Ordinance
shall be deemed null and void.
Section 3. That issuance of a development permit by a municipality does not in any
way create any right on the part of an applicant to obtain a permit from a state or deferral agency
and does not create any liability on the part of the municipality for issuance of the permit if the
applicant fails to first obtain requisite approvals or fulfill the obligations imposed by a state or
federal agency or undertakes actions that result in a violation of state or federal law.
Section 4. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 5. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed to the extent of such conflict.
Section 6. That this Ordinance shall be effective 10 days after this passage and
adoption on second reading.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING CHAPTER 28, ENTITLED “LAND
DEVELOPMENT CODE”, PART 1 ENTITLED “USE REGULATIONS,” AT
ARTICLE 105, ENTITLED “USE REGULATIONS FOR RESIDENTIAL AND
OPEN SPACE ZONIG DISTRICTS” AT SECTION 105-20 TO AMEND THE
USE SCHEDULE TO INCLUDE FOWL WITHIN CERTAIN DISTRICT
REGULATIONS; AND CREATING SECTION 105-270 ENTITLED “FOWL”
TO CREATE MAINTENANCE AND ENFORCEMENT REGULATIONS
RELATING TO HOUSING OF FOWL; AND AMENDING PART 7, ENTITLED
CODE ADMINISTRATION; ARTICLE 725, ENTITLED “DEFINITIONS”, AT
SECTION 725-30 ENTITLED “TERMS DEFINED” TO PROVIDE
DEFINITIONS RELATING TO FOWL; PROVIDING FOR CODIFICATION;
PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
CODIFICATION; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City desires to amend the City’s Land Development Code, Chapter 28,
at Section 105-20, entitled “List of residential and open space districts permitted, special exception
and prohibited use” to include the “fowl” use in certain residential districts; and
WHEREAS, to create section 105-270 entitled “Fowl” to provide for a special exception
process and maintenance and enforcement regulations relating to the “fowl” use; and
WHEREAS, Part 7, entitled Code Administration; Article 725, entitled “Definitions”, at
section 725-30 entitled “terms defined” is proposed to be amended to include definitions relating
to fowl; and
WHEREAS, the Planning & Zoning Board held a public hearing relating to the proposed
ordinance and recommended approval of the ordinance; and
WHEREAS, the City has scheduled and has held two public hearings on the proposed text
amendment; and
WHEREAS, the City Commission finds that the ordinance amendment is reasonably
related to the health, safety, and general welfare of the residents of the City, and furthers the
purpose, goals, objectives and policies of the City of Dania Beach Comprehensive Plan
(“Comprehensive Plan”);
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above “WHEREAS” clauses are ratified and confirmed as being
true and correct, and they are made a part of and incorporated into this Ordinance by this reference.

USE REGULATIONS FOR RESIDENTIAL AND OPEN SPACE ZONING DISTRICTS
* * *
Section 105-270. – Fowl.
The following provisions shall apply to the keeping of fowl in those residential zoning districts
where fowl is listed as a permitted or special exception use in Sec. 105-20 and under the special
exception criteria of section 630-50, of the LDC.
(A) Occupancy: Property must be owner-occupied, or if rented, there must be written consent
from the property owner.
(B) Minimum lot size of 10,000 square feet.
(C) Maximum Number of Hens: Up to four (4) hens per eligible property.
(D) Roosters: Keeping roosters is strictly prohibited.
(E) Use Limitation: Hens shall be kept for personal, non-commercial use only — the sale of
eggs, meat, or birds is prohibited under this Ordinance.
(F) Coop Requirements:
1. Coop must be structurally sound, weather-resistant, predator-proof, and properly
ventilated.
2. Maximum coop height: 8 feet.
3. Maximum coop floor area: 100 square feet .
4. Minimum setbacks: at least 10 feet from all property lines; at least 20 feet from
any adjacent residential structure.
5. Coop must provide adequate roosting, nesting, and shelter space for hens.
6. Coop shall be screened from view from public streets to the maximum extent
practicable through fencing, landscaping, or placement within the rear yard.
(G) Enclosure / Run Requirements:
1. Enclosure must be securely fenced, predator-resistant, and attached or adjacent to
coop.
2. Combined coop + enclosure area must provide sufficient space for number of
hens (e.g. at least 16–20 sq ft per hen).
3. Coops and enclosures must be located in the rear yard only.
4. Minimum setbacks: at least 10 feet from all property lines; at least 20 feet from
any adjacent residential structure.
5. Enclosure must not be visible from public street — screened or placed out of view
as practicable.
6. Maximum square footage is 100 square feet.
7. Hens must be confined to the coop or enclosed run at all times; free-ranging is
prohibited.
(H) Maintenance / Operations.
Maintenance of the fowl must be as follows:
1. Feed must be stored in rodent-proof containers.
2. Waste (droppings, bedding, uneaten feed) must be removed regularly to prevent odors,
flies, rodents, or other nuisances.
3. Coops and runs must be cleaned and maintained to prevent health hazards, foul odors,
pests, or any condition that may interfere with the normal use and enjoyment of
neighboring properties.
4. Hens must have access to food and clean water at all times.
5. On-site slaughter of hens is prohibited.
6. Any excessive noise, odor, unsanitary conditions, rodent infestation, wild-fowl contact,
or any condition that constitutes a nuisance, as defined in Chapters 13 and 17 (Health and
Sanitation and Offenses -Miscellaneous) of the City Code is prohibited.
7. Hens shall not be kept in any structure intended for human habitation (e.g. homes,
garages).
(I) Enforcement and Penalties
1. Violations of this section are enforceable under Chapter 13, Chapter 17, and
Chapter 162, Florida Statutes.
2. Each day a violation continues constitutes a separate offense.
3. Remedies include:
a. Notices of violation;
b. Civil fines;
c. Suspension or revocation of special exception, after hearing, by the Planning &
Zoning Board;
d. Any additional remedies available at law or equity.
Section 4. That Chapter 28, entitled “Land Development Code”, Part 7, entitled Code
Administration; Article 725, entitled “Definitions”, at section 725-30 entitled “terms defined” is
amended as follows:
Sec. 725-30. - Terms defined.

Coop. A secure, predator-resistant structure providing shelter, roosting space, and protection for
hens.
* * *
Hen. A female chicken, kept for egg-laying or as a domestic fowl.
* * *
Rooster. A male chicken (explicitly prohibited under this Ordinance).
* * *
Run or Enclosure. A fenced outdoor area attached to the coop where hens may exercise, roost,
and forage securely.
* * *
Section 5. That all ordinances or part of ordinances in conflict with the provisions of
the Ordinance are repealed.
Section 6. It is the intention of the Mayor and City Commission of the City of Dania
Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a
part of the Code of the City of Dania Beach, Florida. The sections of this ordinance may be
renumbered or re-lettered to accomplish such intention, and the word “ordinance” may be changed
to “section,” “article,” or other appropriate word.
Section 7. That this Ordinance shall be effective 10 days after passage on second
reading.
