HomeMy WebLinkAboutR-2026-053 BSO Fire Services First AmendmentRESOLUTION NO. 2026-053 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A FIRST AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF DANIA BEACH AND THE BROWARD SHERIFF’S OFFICE, FOR MEDICAL, FIRE PROTECTION AND FIRE PREVENTION SERVICES IN ORDER TO REDUCE THE AMOUNT OF FIRE INSPECTORS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on or about October 21, 2025, Broward sheriff’s Office (BSO) and the CITY entered into an Agreement for emergency medical, fire protection and fire prevention services (“Agreement”); and WHEREAS, over the past three years the City has modified its zoning code, which has decreased height and intensity; and WHEREAS, many of the larger development projects that were previously approved have completed construction, thus requiring less fire inspections; and WHEREAS, the City is experiencing a substantial decrease in building permits and fire inspections; and WHEREAS, based upon lower demand the City is seeking to decrease the number of fire inspectors; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA; Section 1. That the above “Whereas” clauses are ratified, made a part of and incorporated into this Resolution by this reference. Section 2. That the proper City officials are authorized to execute the First Amendment to the Agreement between the City and BSO for emergency medical, fire protection and fire prevention services. A copy of the Amendment is attached as Exhibit “A” and made a part of and incorporated into this Resolution by this reference. Section 3. That the City Manager and City Attorney are authorized to make minor revisions to the Agreement for fire services which are deemed necessary and in the best interests of the City. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 2 RESOLUTION #2026-053 Section 5. BOUTSIS CITY ATTORNEY 1 FIRST AMENDMENT TO THE AGREEMENT FOR EMERGENCY MEDICAL, FIRE PROTECTION AND FIRE PREVENTION SERVICES This First Amendment is entered into this _____ day of April, 2026 by and between the Broward Sheriff’s Office (hereinafter referred to as “SHERIFF”) and the City of Dania Beach, FL (hereinafter referred to as the “CITY”). WHEREAS, on or about October 1, 2025, SHERIFF and the CITY entered into an Agreement for Fire Rescue Services; and WHEREAS, the CITY has requested to remove three Fire Safety Inspector positions from the staffing complement for Fiscal Year 26/27. NOW, THEREFORE, in consideration of the mutual terms and conditions contained herein, the parties agree as follows: 1. The foregoing recitations are true and correct and are incorporated by reference. 2. Effective October 1, 2026, the staffing levels will be adjusted to reduce the number of Fire Safety Inspectors to two (2) as reflected in Exhibit “A” to the First Amendment, attached hereto and incorporated by reference. 3 Section 35, b, 3 is modified as follows: BSO shall strive to perform eighty percent of annual inspections of multifamily residential and commercial properties required to be inspected in accordance with the Florida Fire Prevention Code and the Broward County Local Fire Code amendment. . The CITY shall be responsible for the billing and collection of such services. 4. Except as modified herein, all remaining items and conditions of the Agreement, shall remain in full force and effect. 2 IN WITNESS WHEREOF, each of the parties hereto executes this First Amendment through its duly authorized representatives as set forth below.
