Proposed Ordinance Title
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING CHAPTERS 17, ENTITLED “OFFENSES –

Summary of Proposed Ordinance (including public purpose to be served)
The state adopted House Bill 1365, which prohibits counties or municipalities from authorizing or
otherwise allowing “any person to regularly engage in public camping or sleeping on any public
property, including, but not limited to, any public building or its grounds and any public right-of-way
under the jurisdiction of the county or municipality, as applicable”. This bill was codified at Section
125.0231, Florida Statutes, and became effective July 1, 2024. It prohibits counties or municipalities
from authorizing or otherwise allowing “any person to regularly engage in public camping or sleeping
on any public property, including, but not limited to, any public building or its grounds and any public
right-of-way under the jurisdiction of the county or municipality, applicable”. Further the state law
provides for a private cause of action that becomes effective on January 1, 2025, for residents to file
suit against a city if, after 5 business days’ notice to the City, of a violation of Section 125.0231, the
violation has not been cured.
The County adopted a camping ordinance that the City is to implement and provide a notice
provision for complaints.
Estimate of Direct Economic Impact on Private For-Profit Businesses

No revenues. It will cost the City to enforce the changes in state law as to camping but there are no
regulatory charges to residents.
