SUBJECT: TX-019-26: The applicant, the City of Dania Beach, is requesting several text
amendments to the form-based zoning districts, located within the Regional
Activity Center (RAC), regarding height and density in the City's Code of
Ordinances, Land Development Code (LDC).
Request:
TEXT AMENDMENT
Amend the City's LDC regarding building height and residential density within the RAC form-
based zoning districts.
PUBLIC HEARING NOTICE
This item was duly advertised, posted and noticed pursuant to Article 610 ofthe LDC
Background:
On March 2,2024, the City Commission approved Ordinance Number 2024-02 I e liminating
developmenl incentive bonuses. Since the adoption ofthat ordinance, coupled with evolving
market conditions and increased development costs throughout South Florida, the City has
experienced a critical decline in new development and redevelopment activity. As a result,
opporhrnities to stimulate economic growth, attract private investment, and revitalize key
commercial corridors have signifi cantly slowed.
The City of Dania Beach is uniquely positioned as a gateway community for visitors traveling
from Fort Lauderdale-Hollywood Intemational Airport and Port Everglades. Thousands of
visitors, businesses, and investors travel through the City each day, making the visual image,
economic vitality, and functionality of the downtown and gateway corridors critically important
to the City's long-term economic competitiveness. The City's vision is to transform these areas
into vibrant, walkable, mixed-use destinations that create a strong first impression while
supporting a sustainable economic ecosystem.
On May 20, 2026, a proposed text amendment introducing incentive bonuses within five (5)
fomr-based zoning districts: City Center, East Dania Beach Boulevard Mixed-Use,
Neighborhood Mixed-Use, South Federal Highway Mix-Use and Gateway Mixed-Use districts,
was presented to the Planning and Zoning Board. The amendment sought to provide
opportunities for developers to obtain additional height and densit-v in exchange for enhanced
redevelopment outcomes, investment, and econonric activity. The Planning and Zoning Board
recommended denial ofthe request by a four (4) to one (l) vote.
Sincc that time, staffhas reevaluated the City's redevelopment strategy and determined that
l-uture efforts should be concentrated within the under-utilized Federal Highway corridors. These
districts currently contain vacant or underperforming properties. limited pedestrian activity, and
development pattems that do not maximize the area's economic, social. or urban design
potential. From a planning perspective, encouraging strategic mixed-use redevelopment within
the downtou,n core rvill creale a more cohesive urban environment that promotes walkability,
connectivity, activation of public spaces. and a stronger sense of place.
From an economic development standpoint, the introduction ofcarefully struclured incentivc
bonuses is intended to encourage privale investment and support the development ofa
diversified mix ofresidential, commercial, retail, office, hospitality, and cntertainment uses. A
thriving mixed-use downtown creates the critical mass necessary to support small businesses,
restaurants, relailers, and sen ice providers rvhile increasing daytime and evening activity
throughout the area. Increased residential density within the urban core also supports long-term
business sustainability by creating a built-in customer base that contributes to a stronger local
economy.
The City's goal is not simply to encourage growth, but to guide high-quality redevelopment that
enhances the quality of life ofDaniaBeach, strengthens its position as Broward County's First
City, and establishes a vibrant gateway corridor reflective of the City's long-term vision. By
focusing redevelopment efforts within the Federal Highway corridor and City Center district, the
City can better position itselfto attract investment, create employment opportunities, suppon
existing businesses, expand the tax base, and fosler a modem urban environment lhat benefits
residents, visitors, and the business community alike.
Staff Analysis
Staffis proposing focused growth in very select zoning districts through height and density
bonuses when a developer participates in the proposed incentives, which include open space.
public parking, parks, attainable housing. and rooftop activation. Staff is propostng the
implementation of incentive bonuses in two (2) zoning districts with the RAC; City Center and
South Federal Highway-Mixed-Use zoning districls. This very strategic application enables the
City to focus on the elimination ofblight and encourage redevelopment ofvery under-utilized
properties within the Cily's downtown core.
The proposed maximum permitted height in each fbrm-based zoning district strategically varies
by location within each district to ensure the geatest height is the farthest away from residential
neighborhoods.
CITY CENTER
When established in 2010, the incentives available in the City Center Zoning allowed the density
to be increased from 50 dwelling units per acre. up to 150 dwelling units per acre. Srhen the
incentives rvere eliminated in 2024 the incentives were removed and the 50 d*'elling units per
acre remained. This amendment proposes to reinstale the use ofincentrve bonuses.
ln 2010 the maximum heighl that could be'achieved through the use of incentives was tburleen
( l4) stories. Today, rvithout incentives, the maximum height is seven (7) stories. This
SOUTH FEDERAL HIGHWAY MIXED.USE
The maximum permitted density that could be achieved in the South Federal Highu'ay Mixed-
Use zoning district was twenty-five (25), up to fifty (50) dwelling units per acrc with the use of
incentives. The elimrnation of incentives reduced the allorvable density to twenty-five (25)
dwelling units per acre. This amcndmcnt proposes to re-establish the use of incentive bonuscs.
The maximum allowable height that was allorved ranged from two (2) stories to eight (8) stories
rvith the use of incentives. The elimination of incentives dropped the height down to nvo (2) to
lbur (4) stories, depending on location. This amcndment proposcs to allow the usc ofincentivc
bonuses, depending on location and parcel size.

OPEN SPACE
In the Neighborhood Mixed-Use zoning district, a bonus of one (l) story, ten ( l0) dwelling units,
and five percent (5%) pervious reduction can be eamed when a developer provides 2,500 square
feet of public open space.
In the City Center zoning district, a bonus of two (2) stories. twenty (20) dwelling units per acrc,
and one hundred percenl (100%) pervious area reduction can be earned when a developer
provides 2,500 square feet open space.
PUBLIC PARKING
A bonus of two (2) stories, twenty (20) dwelling units per acre aud five percent (5%) impervious
amendment proposes to reinstate the use of incentive bonuses in strategic localions.

A bonus ofonc (1) story, ten ( l0) dwclling units, and five percent (5%) pen'ious area rcduction
may be eamed when a developer provides activated rooftop space il'ith public access.
ATTAINABLE HOUSING
One (l) story and five percent (5%) pervious area reduction may be eamed for every ten (10) of
attainable house rate units provided by a developer.
Budgetary Impact
These proposed amendmenls will encourage development and continued redevelopment activity.

Recommendation
Community Development staff is requesting the City Commission approval of the modihed

WHEREAS, the City's Strategic Plan goals were to have a financially sound and
responsible city providing services valued by the community; investment in upgradrng city
infrastructure and facilities; to ensure that Dania Beach is the City's residents "Hometown", a
vibrant and sustainable community; and to provide residents and visitors oppomrnities for leisure
and cultural experiences; and
WHEREAS, the City desires to ensure quality of life expectations including safety and
security, critical services lbr clean water and responsive support, strong infrastructure, recreation
and culture and economic stability; and
WHEREAS, in 2024, the reduction in height and density changed zoning and the building
fund saw an extreme reduction in project development; and
WHEREAS, the City in focusing on the future. and proposed changes to homestead
property taxes, and the loss of certain businesses, Iike Spirit Airlines, forces the City to focus on a
proactive approach that honors the City's commitments to the Strategic Plan and SMART Strategic
Growth; and
WHER-EAS, there are certain park projects that remain unfunded, and cetlain
infrastructure projects for storm\.\,ater, water and sewer, roadu'ay improvements, and historic
structure renovations, etc., that need to be funded; and
WHEREAS, the City seeks 1o encourage Smart Strategic Growth by concentrating growth
in existing urban areas instead of law-density residential community areas; and
WHEREAS, SMART Strategic Growth will creale a pedestrian friendly walkable City
with smalltfamily-owned business for amenities and shopping local; and
WHEREAS, mixed use development is intended lo reduce traffic, commute time, lower
infrastructure costs, suppo( the local economy, and improve our quality of life as the projects
would protect existing neighborhoods and ensure protection of the environment by not intruding
into environmentally protected areas and concentrating density along corridors; and
WHEREAS, the City proposed incentives to the main corridor areas to encourage and
create new smart growth investmenl opportunities; and
WHEREAS, the impact fees from implementing incentives create revenues to fund quality
of life initiatives as outlined in the City's Strategic Plan; and
WHEREAS, the Planning and Zoning Board is required to conduct one (1) duly noticed
public hearings in accordance with larv; and
WHEREAS, the City Commission is required to conduct two (2) duly noticed public
hearings in accordance with law; and
WHEREAS, lhe City Commission finds that the approval of the proposed amendment to
the Land Development Code will protect the public health, safety, and welfare ofthe residents of
the City, and further the purpose, goals, objectives and policies ofthe Comprehensive Plan: and
WHEREAS, the City Commission finds and determines that updating the Cily's Code of
Ordinances is in the best interesl of the residents of Dania Beach.

( A) Intent and prrpose. To establish a mixed-use do$'ntown with lransit supportive densities and
intensities where citizens can work, live, and shop in the economic, governrnental,
entertainment and cultural focal point of Dania Beach. This dislrict is designed to encourage
accessible, active, pedestrian-oriented areas within walking distance ol a prospective transit
station on the FEC railway.

of Dania Beach, and it is hereby ordained that the provisions of this ordinance shall become
and be made a part ofthe Code ofthe City of Dania Beach, Florida and codified by Municode.
The sections of this ordinance may be renumbered or re-lettered to accomplish such intention,
and the u'ord "ordinance" may be changed to ''section," "arlicle." or other appropriate rvord.
Section 6. That all ordinances or part of ordinances in conflict with the provisions of
the Ordinancc are repealed.
Section 7. That this ordinance shall take effect l0 days after passage on second
reading.

Hi Captain Tarata,
I wanted to fotlow up on a ca[[ I received from Sgt. Robert Vatdez. He was beyond potite
and professionat- a great guy. The conversation was a bout BSO's efforts to tackte the
crime coming out of the motets on Federal Highway.
I am not sure who prompted the call or what motivated it...but to be clear, I have no
issues with BSO at att- you att do a great job under the circumstances. The probtems
aren't due to a lack of law enforcement or effort from the deputies. lt's a systemic issue
driven by the lack of investment and btight along the corridor.
To the extent my voice carries any weight, l'm doing what I can to push our etected
officiats toward poticies that encourage reatcapitaI investment and redeve[opment of
those seedy motets. I know it is best f or you to remain apotiticat, but l'd encourage you
to speak with them as wet[ and remind them that these motets and btighted properties
are the root of the problem. Anecdotalty, every deputy l've spoken with says the same
thing. Compiting some relevant statistics might be especiatly persuasive.
Thanks again for alt your team does. I reatly appreciate your service and the hard work of
everyone at BSO. Ptease send my best wishes to Sgt. Vatdez and atl the men and women
working to make Dania Beach safer.
