HomeMy WebLinkAboutO-2026-023 Exceeding $1M for NW 1st Street LAP1 ORDINANCE #2026-023 ORDINANCE NO. 2026-023 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS EXCEEDING ONE MILLION DOLLARS ($1,000,000.00), TO FUND THE NW 1ST STREET COMPLETE STREETS AND PEDESTRIAN CONNECTIVITY PROJECT (LAP); PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 2, “Certain Expenditures” of Article 3, “Powers of the City”, of the City Code of Ordinances, the City Commission must, by ordinance, approve any expenditures of City funds that exceed One Million Dollars ($1,000,000.00) after two (2) advertised public hearings of the ordinance; and WHEREAS, the total project cost for the NW 1st Street Complete Streets and Pedestrian Connectivity Project (LAP), is $4,376,868.00, including construction, construction engineering and inspection (CEI), contingency, and all related project costs, which exceeds the $1,000,000.00 expenditure threshold; and WHEREAS, funding for this project will be appropriated from Stormwater Account No. 403-38-36-538-63-10, funded through a combination of Florida Department of Transportation (FDOT) Local Agency Program (LAP) funds and City funds, and supplemented by City funds as necessary. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above “WHEREAS” clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Ordinance by this reference. Section 2. That the proper City officials are authorized to expend more One Million Dollars ($1,000,000.00) in funding the Project. Section 3. That funding for this Project shall be appropriated from Stormwater Account No. 403-38-36-538-63-10, as determined by the City’s Finance Department. Section 4. That all ordinances or part of ordinances in conflict with the provisions of the Ordinance are repealed. Section 5. That this Ordinance shall be effective immediately after passage on second reading. 2 ORDINANCE #2026-023 PASSED on first reading on August 25, 2026.
