HomeMy WebLinkAboutR-2020-124 Adopting Amended Community Redevelopment Plan to Provide Grants for Residential Assistance Programs AMENDED 10-13-20RESOLUTION NO.2020-124 AMENDED A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING AN AMENDMENT TO THE DANIA BEACH COMMUNITY REDEVELOPMENT AGENCY'S ("CRA") REDEVELOPMENT PLAN TO PROVIDE GRANTS FOR A RESIDENTIAL RENTAL ASSISTANCE PROGRAM; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the findings and purposes stated in Section 163.335, Florida Statues, Section 163.370(1), Florida Statutes, provides that a Community Redevelopment Agency shall have the power to appropriate such funds and make such expenditures as are necessary to carry out the purposes of this part; and WHEREAS, Section 163.387(1)(a), Florida Statutes, provides that funds allocated to and deposited into this fund shall be used by the agency to finance or refinance any community redevelopment it undertakes pursuant to the Plan; and WHEREAS, the Dania Beach Community Redevelopment Agency ("CRA") desires to include in the Plan goals and objectives related to the provision of funding to assist property owners and residents with the payment of monthly rent payments in order to assist those individuals with expenditures that are necessary to retain housing in order to prevent homelessness, the spread of slum and blight, and the additional expenditure of public funds to provide additional police, fire, and other services resulting from the loss of housing; and WHEREAS, on October 13, 2020, pursuant to Section 163.361, Fla. Stat., the CRA Board approved the proposed amendment to the CRA Redevelopment Plan, which is attached as Exhibit "A," and incorporated by reference and recommends that the Dania Beach City Commission adopt the amendment to the Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission, pursuant to Section 163.361, Fla. Stat., approves the recommended CRA Plan Amendment that was approved by the CRA Board on October 13, 2020. Section 3. That if any funds remain once the program is concluded, if they are derived from City funds, they shall be returned to the appropriate City account. Section 4. That all resolutions or part of resolutions in conflict with any of the provisions of this Resolution are repealed. Section 5. N BF CITY ATTORNEY AND CORRECTNESS: 2 LORI LEWELLEN MAYOR RESOLUTION #2020-124 AMENDED 10/13/2020 Exhibit A — CRA Plan Amendment Amending Page 83 COMMUNITY REDEVELOPMENT PROGRAMS Beautification and Appearance Improvement Signage/Entry Features/Public Art/Landscape - The visual appearance of amenities needs to be enhanced in the community redevelopment area. Further, there is a need to establish an identity for this important core area of the community. The CRA will be empowered to pay for aesthetic and identity enhancements, including but not limited to, signage, entry features, public art, and landscaping. Residential Reinvestment Programs Residential Rehabilitation - The appearance and integrity of residential neighborhoods within the redevelopment area is critical to its success. Accordingly, the CRA may provide grants or loan interest subsidies, or a combination thereof, to residential property owners, condominium owners and condominium associations for the rehabilitation of their properties. These funds can be used for a broad range of permanent (fixed) improvements including, but not limited to, roof repair, landscaping, painting, parking and driveway upgrades and sewer hook-ups. In -Fill & New Housing - The Agency shall identify vacant lots within the redevelopment area for the development of new housing. The Agency shall recruit developers and builders to fulfill this goal. The CRA will be empowered to give grants to such developers and builders to reduce the costs of developing the new housing structures. The CRA will prepare and adopt guidelines for determining eligibility and the amount of the incentive payment or discount. Homeowner Reinvestment Grant - Upon application to the Agency, owners of real property with a "Homestead Exemption" may apply for grant funds for uses that will be outlined by the Agency. Eligible owners of the real property within the community redevelopment area may be eligible for the life of the redevelopment trust fund. Only the owners of real property with a "Homestead Exemption" at the CRA's inception are eligible to participate in this program. Residential Rental Assistance Grant Prolonged economic hardship can lead to residential displacement which can contribute to incidents of homelessness and exacerbate slum and blight conditions within the Redevelopment Area. The CRA will be empowered to provide grants for a residential rental assistance program. The CRA will prepare and adopt guidelines for determining eligibility and the amount of the assistance. 3 RESOLUTION #2020-124 AMENDED 10/13/2020 This program is designed to retain existing homeowners and discourage displacement as the redevelopment effort moves forward. This program is also designed to help homeowners reinvest in their homes, the community and the City. The Agency will prepare and adopt specific guidelines for determining eligibility and the payment amounts. Mortgage Subsidies and Second Mortgage Assistance - In order to encourage homeownership, the CRA may provide subsidies to reduce the costs of purchasing a house or condominium unit. The Agency shall have the authority to structure such subsidies in a variety of ways, including but not limited to, grants to be applied toward the purchase price and second mortgages wherein no repayment is required during the homeowner's period of ownership. The CRA must be repaid the grant or second mortgage principal upon the sale of the residential property. The Agency will prepare and adopt guidelines for determining eligibility, penalties and procedures. 4 RESOLUTION #2020-124 AMENDED 10/13/2020
