A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING THE PLAT APPLICATION "SARATOGA
CROSSINGS III" (PL-057-20) SUBMITTED BY HSQ GROUP, INC., ON
BEHALF OF DAVID OPTEKAR AND OUR HOUSE IN DANIA, INC., FOR
PROPERTY LOCATED AT 840 AND 850 W. DANIA BEACH BOULEVARD,
IN THE CITY OF DANIA BEACH, FLORIDA, THE LEGAL DESCRIPTION
IS CONTAINED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED
TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Chapter 28 "Land Development Code" (the "LDC"), Part 6
"Development Review Procedures and Requirements," Article 640 "Plats," of the City of Dania
Beach, (the "City") Code of Ordinances ("City Code"), HSQ Group, Inc., on behalf of
owners David Optekar and Our House in Dania, Inc. (collectively, the "Applicant") has applied
to the City for approval of a Plat (PL-057-20) attached as Exhibit `B," for the property
bearing the legal description contained in Exhibit "A;" and
WHEREAS, the SARATOGA CROSSINGS III plat will be restricted to 75 midrise
units; and
WHEREAS, on July 30 and August 26, 2020 the City's Development Review
Committee (the "DRC"), which includes representatives from the Broward Sheriff's Office,
Broward Fire Department, Public Services Department, the City's landscape consultant and the
Planning Division staff, reviewed the SARATOGA CROSSINGS III plat for compliance with
all applicable regulations; and
WHEREAS, staff recommends approval of the Plat (PL-057-20); and
WHEREAS, the City Commission conducted a duly noticed public hearing on October
27, 2020 in accordance with Article 610 of the LDC; and
WHEREAS, the City Commission finds that the Plat (PL-057-20) request is consistent
with the LDC and Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as
being true and correct and they are made a specific part of this Resolution.
Section 2. That this certain application for the "SARATOGA CROSSINGS III" Plat
(PL-057-20), a copy of which is attached as Exhibit `B," is approved with the no outstanding
conditions.
Section 3. That the issuance of a development permit by a municipality does not in
any way create any right on the part of an applicant to obtain a permit from a state or federal
agency, and does not create any liability on the part of the municipality for issuance of the permit
if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a
state or federal agency, or undertakes actions that result in a violation of state or federal law.
Section 4. That the associated Planning & Zoning Division Staff Report prepared for
application PL-057-20 is hereby incorporated into this resolution as findings of fact.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
