A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING A SPECIAL EXCEPTION (SE-074-20) TO
ALLOW FOR ACADEMIC SCHOOL USE PURSUANT TO A REQUEST
SUBMITTED BY LEE RASKIND, ON BEHALF OF HOLLYWOOD
PLAYGROUP LLC, FOR PROPERTY LOCATED AT 3201 GRIFFIN ROAD
IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28, Part 6 of the Dania Beach Land Development Code (the
"LDC"), Article 630, entitled "Special Exception Uses", states that special exceptions may be
approved by the City Commission; and
WHEREAS, Lee Raskind, on behalf of Hollywood Playgroup LLC, is requesting a
special exception to allow for academic school use at 3201 Griffin Road, in the community
business (C-2) zoning district, per Section 100-60 of the LDC; and
WHEREAS, the City Commission conducted a duly noticed public hearing in
accordance with Article 610 of the LDC;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That special exception application (SE-074-20) is approved with the
following conditions that must be addressed prior to approval of the new use.
1. Provide a Traffic Study, prepared and stamped by a licensed traffic engineer in the State
of Florida, that identifies the proposed number of students will not result in vehicles
stacking in to the public Right of way during peak hours.
2. Modify drop-off/pick-up time to remain 8:30 AM — 9:00 AM drop-off and 3:30 PM —
4:00 PM pick-up for the daycare aged children, and establish 8:00 AM — 8:30 AM drop-
off and 4:00 PM — 4:30 PM pick-up for the school aged children.
Section 2. That the issuance of a development permit by a municipality does not in
any way create any right on the part of an applicant to obtain a permit from a state or federal
agency, and does not create any liability on the part of the municipality for issuance of the permit
if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a
state or federal agency, or undertakes actions that result in a violation of state or federal law.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

We did a mailing notifying everyone of the public hearing and set up a zoom meeting. Nobody attended which leads me
to believe there are no objections, We've been operating for almost 2 years and have had no complaints or issues thus
fa r.
