TUESDAY, OCTOBER 13, 2020 - 7:00 P.M.

2. Moment of Silence and Pledge of Alle ig ance
Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United
States Flag.
Mayor Lewellen noted items 9.2 through 9.5 would be continued until the December 8t' City
Commission meeting at the request of the applicant.
3. Presentations and Special Event Approvals
3.1 Presentation by Walmart Pharmacist A.J. Ubaque on flu shots, Shingles Vaccine and
the October 24, 2020 Drug Take -back Program - requested by Commissioner Harris
Mr. Ubaque presented information on the flu and flu vaccines, Shingles vaccine and the Drug
Take -back Program. He encouraged everyone to get the flu vaccine.
3.2 Recognition of Parks and Recreation Department employee, Cyrus Writer, Lifeguard,
for his quick and heroic action that saved the life of a swimmer in distress
City Manager Garcia recognized Lifeguard Writer for his quick and heroic action that saved the
life of a swimmer in distress.
Eric Brown, Director of Parks & Recreation, spoke about Lifeguard Writer's heroic act, and the
intense training the lifeguard team undertakes daily.
4. Proclamations
4.1 LGBTQ+ History Month - Vice -Mayor Odman
Vice -Mayor Odman read the proclamation for LGBTQ+ History Month.
4.2 Breast Cancer Awareness Month - Mayor Lewellen
Mayor Lewellen read the proclamation for Breast Cancer Awareness Month.
5. Citizen Comments
Francisco Rojo, Landmark Companies, spoke in support of item 7.12.
Nectaria Chakas, representing the applicant for items 9.2 through 9.5, noted she submitted a
letter requesting the items be continued.
Tammie James, 255 Tamara James Avenue, requested to wait to speak until items 9.2 through
9.5 are taken up.
Attorney Chakas explained the reason for the request to continue items 9.2 through 9.5.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, reported on a letter received about loitering and
trespassing near Publix, and noted the problem has been remedied. He spoke of the drug
takeback event on Saturday, October 24th, and of speed trailers. He also reported on recent
criminal activity in the City and gave crime statistics since 2018.
Commissioner James commented on the homeless situation in the City and questioned if more
could be done.
Captain Marks addressed the BSO deputies' homeless outreach.
Vice -Mayor Odman thanked Captain Marks for the details in his report.
Mayor Lewellen noted she appreciates all of BSO's efforts in the City.
Commissioner Brandimarte expressed appreciation for BSO's attention to issues at
Meadowbrook and outside City Hall.
City Manager Garcia spoke of Captain Marks' initiatives and his great law enforcement work.

Captain Sergio Pellecer, BSO District Fire Chief, gave an update on his department's personnel
safety measures in furtherance of service to the residents, and noted their public safety education
is being taught virtually and they are reaching out to the schools.

Vice -Mayor Odman motioned to adopt the Consent Agenda; seconded by Commissioner
Harris. The motion carried unanimously.
Commissioner James noted she intended to pull item 7.12 from the Consent Agenda for
discussion.

7.12 RESOLUTION #2020-123

City Attorney Ansbro read the title of Resolution #2020-123.
Commissioner James noted she favors this item but wants the public to know this is a conditional
loan commitment and there is an opportunity to speak on the item. Community buy -in is a
priority; this item will come back before the Commission.
Commissioner James motioned to adopt Resolution #2020-123; seconded by Commissioner
Harris. The motion carried unanimously.

9. Public Hearings and Site Plans
9.1 RESOLUTION #2020-124 Amended
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
AN AMENDMENT TO THE DANIA BEACH COMMUNITY REDEVELOPMENT AGENCY'S ("CRA")
REDEVELOPMENT PLAN TO PROVIDE GRANTS FOR RESIDENTIAL ASSISTANCE PROGRAMS
INCLUDING BUT NOT LIMITED TO RENTAL, MORTGAGE, AND UTILITY ASSISTANCE; PROVIDING
FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (CRA)
City Attorney Ansbro read the title of Resolution #2020-124 and noted the resolution would be
amended to mirror the action taken at the CRA Board meeting, which was to remove mortgage

and utility assistance, and to add language that any funds remaining once the program is
concluded, if they are derived from City funds, would be returned to the City.
Commissioner James motioned to adopt Resolution 92020-124, as amended to remove
mortgage and utility assistance, and to add language that any funds remaining once the
program is concluded, if they are derived from City funds, would be returned to the City;
seconded by Commissioner Harris.
Mayor Lewellen opened the Public Hearing.
Luis Rimoli, 902 Natures Cove Road, noted the money going through the CRA would not be
reimbursable by the County, and questioned why the City would not be frugal with taxpayer's
money and create one program for the entire City rather than create separation. It is important
for the City to use money wisely; if there is an opportunity to do one program, we should think
about everybody in the City.
Frank DiPaolo, Director of Finance, explained for the City to utilize the program that the County
offers, the County would administer and guarantee funding replacement. If the City decides to
run its own separate programs for the CRA and the City, reimbursement is not guaranteed. He
suggested the City use the most advantageous program administered by the County to receive
Cares Act funding.
Commissioner James addressed Mr. Rimoli's comments.
Mayor Lewellen said she is not opposed to doing a rental assistance program, but she does not
favor doing two programs. The concern is that there is now $500,000 of rental relief that
potentially we can only get reimbursed for half of. It behooves us to try to get money
reimbursed to us and facilitate a program that is the most beneficial to our residents. She realizes
this is only an amendment to the Plan, but we need to have serious discussions about the program
and the criteria. The opportunity of having money reimbursed to the City is being missed.
Vice -Chair Odman agreed, but noted we came together for a 5-0 vote at the CRA Board meeting.
The reimbursement option will be utilized; it is important to remember the money that is not
used will go back to the City. The way we are handling this is building trust and fostering
transparency; we got to a good place where the entire City is getting a good thing.
Mayor Lewellen noted she does not agree with the program being separated and the potential of
non -reimbursement. It needs to be very clear that if there is a problem with this, it will have to
be revisited.

City Attorney Ansbro read the title of Resolution #2020-125, Resolution #2020-126, Resolution
#2020-127, and Resolution #2020-128 as they all relate to the same applicant, and noted the
applicant has requested these items be continued until December 8, 2020.

Nectaria Chakas, representing the applicant, confirmed they are requesting the items be
continued until December 8tn
Tammie James, 255 Tamara James Avenue, noted they have had meetings with the developers
but they were not informed the items would be deferred. She addressed the meetings the Byrd
Point residents had with the developer and the concerns the neighborhood has. She hoped this
Commission and the new Commission would consider the impacts to their neighborhood as the
project is humongous. She and her neighborhood oppose this project.
Seeing as there was no one else to speak in favor or opposition, Mayor Lewellen closed the
Public Hearings.
Commissioner James noted she attended the three community meetings with the developer.
There is a huge concern in the neighborhood and she felt the items were being continued until
after the election. She would like to be the bridge between the community and the developer so
that there is a project the community favors.
Mayor Lewellen addressed Commissioner James' comments and asked for clarification why the
items are being continued.
Attorney Chakas explained the applicant's re -design of the project and desire to have a
compromise with the community.
Commissioner Brandimarte noted Mike Lally will do the right thing.
Commissioner James spoke of several conversations she has had. She is happy the tone has
changed, but when the items come back before the Commission, she hopes the concerns of the
community are considered.

City Attorney Ansbro read the title of Resolution #2020-129, and noted this item was a quasi-
judicial hearing and he would swear -in those who would speak as they came forward. He asked
the Commission to disclose any communication they had on this matter.
Corinne Lajoie, Planning & Zoning Manager, gave a presentation on the site plan request.
Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.

10.1 RESOLUTION NO. 2020-130

LEASED PROPERTY WITHIN MUNICIPAL BOUNDARIES; AUTHORIZING THE JOINING OF THE

City Attorney Ansbro read the title of Resolution #2020-130 and gave an overview of the County
Charter question and joining Weston's lawsuit in opposition to it.
Commissioner James asked for clarification of the outcome of the lawsuit if we were successful.
City Attorney Ansbro noted the question would not be removed from the ballot, but the question
could be found unconstitutional and the outcome of the vote would be null and void.
Commissioner James spoke in support of this item.
Commissioner Harris noted the League of Cities has been pushing a no vote on this ballot
question. The County is trying to take away our ability for Home Rule.
Commissioner James motioned to adopt Resolution #2020-130; seconded by Commissioner

11. Commission Comments
11.1 Commissioner Brandimarte
Commissioner Brandimarte thanked City Manager Garcia for her report included in the agenda
packet, in particular, about the Christmas lights, and spoke of Ocean One.
11.2 Commissioner Harris
Commissioner Harris thanked Deputy Public Services Director Ozaydin and Public Works &
Utilities Operations Manager Greene for taking care of the recent flooding issue on SE 3rd
Terrace.
Commissioner Harris encouraged a yes vote on the County's question one and a no vote on
question two.
Commissioner Harris felt the Wave project is doing the right thing and we will work through the
process.
11.3 Commissioner James
Commissioner James had no comments.
11.4 Vice -Mayor Odman
Vice -Mayor Odman referenced Breast Cancer Awareness Month and encouraged the scheduling
of mammograms; some health care departments are backed up due to COVID. Everyone should
take care of their health needs.
11.5 Mayor Lewellen
Mayor Lewellen thanked the local businesses for continuing to follow COVID safety rules;
another surge may be coming. She has been impressed by the way our businesses have been
taking the lead to keep people safe.

Mayor Lewellen appointed Luis Rimoli for a term beginning November 1, 2020 and ending
October 31, 2024.
12.3 General Employees Pension Board — no appointments

Vice -Mayor Odman motioned to approve the appointment of Luis Rimoli to the Dania
Beach Housing Authority; seconded by Commissioner James. The motion carried
unanimously.
13. Administrative Reports
13.1 City Manager
City Manager Garcia noted a total overhaul of the Chamber audio would be completed by the
end of the month. She also noted the bulletproof glass would be installed by month's end. We
are looking at November 2nd to open City Hall at 8:00 a.m.; a game plan to do so will be brought
to the next meeting. A kiosk for utility payments will be installed to augment our services to the
residents. She gave an update on holiday decorations and the sign on Dania Beach Boulevard.
Vice -Mayor Odman asked if we should all plan to be in City Hall for the November 10u'
meeting.
City Manager Garcia said yes.
Vice -Mayor Odman questioned if there is an option to re -assess total in -person meetings if a
Commissioner has a cough or does not feel well.
City Manager Garcia responded yes, we will do a hybrid.
Vice -Mayor Odman noted she wants to get together with Human Resources and send an email
out to everyone regarding the option for joining meetings on the computer.
Discussion ensued regarding returning to City Hall, whether the Governor would extend the
virtual meeting order, and when the parks would be open for children returning to school for
after -school playgrounds.
Eric Brown, Director of Parks and Recreation, gave an update on the parks' playgrounds re-
opening plan.
City Manager Garcia noted this is changing every day; we are going to be pro -active, but shifting
gears if necessary.
13.2 City Attorney

City Attorney Ansbro clarified City Commission meetings must be in person if the virtual
meetings are not extended by the Governor. There must be a quorum of three Commissioners in
the same room for a meeting to be held. He commented on the Police Services agreement
approved tonight and noted the BSO substation at Dania Pointe will now be able to open.
