2. Moment of Silence and Pledge of Allegiance
Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Update on the new openings and holiday plans for Dania Pointe by Kim Butler,
Marketing Director for Dania Pointe/Kimco
This item was taken up immediately after item 3.2.
Ms. Butler provided an update on new store openings, an upcoming video shoot, and upcoming
events in November and December.
3.2 Presentation on "Public Services Department Beautification Program and Summary
of Capital Improvement Projects" — Fernando J. Rodriguez, Public Services Director
and Dincer Ozaydin, Deputy Public Services Director/City Engineer
Public Services Director Rodriguez and Deputy Public Services Director/City Engineer Ozaydin
gave a PowerPoint presentation on Capital Improvement Projects and stormwater projects, which
is attached to and incorporated into these minutes. They responded to questions from the
Commission.
3.3 Special Event request from Blue Ridge Tree Farm to allow holiday tree sales from
November 24, 2020 - December 24, 2020, at Community Bible Church, 4650 SW 30
Avenue, daily from 10:00 a.m. - 9:30 p.m. (Community Development)
Commissioner Harris motioned to approve the Special Event request for holiday tree sales;
seconded by Commissioner James. The motion carried unanimously.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
City Attorney Ansbro read an excerpt from the Decorum Policy.
Sheila Johnson, 290 SE 7th Street, questioned whether the City charges stormwater fees.
City Manager Garcia noted information would be put together and provided to Ms. Johnson to
answer this and her other questions received via email.
Sarah Levtov, 5960 SW 37 Terrace, spoke about flooding and drainage issues in her
neighborhood.
Sean Ritterman, 588 SW 36th Terrace, spoke about the Zoning -in -Progress in place to create a
tree overlay district. He noted the residents do not know what they can or cannot do, he does not
understand the historic heritage designation of the trees, and felt this is contrary to state law.
6. Public Safety Reports
BSO Lieutenant Tarala reported on recent criminal activity in the City and the prescription take -
back event held recently.
Captain Sergio Pellecer, BSO District Fire Chief, gave an update on his department and the
monitoring of personnel to ensure the safety of our residents. He addressed efforts undertaken
with nursing homes, hydrant maintenance, and fire safety presentations.

Commissioner James motioned to adopt the Consent Agenda, with the exception of Item
#7.4; seconded by Commissioner Harris. The motion carried unanimously.
7.4 RESOLUTION #2020-131
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A CONTRIBUTION AGREEMENT WITH
DANIA LIVE 1748, LLC AND DANIA LIVE 1748 II, LLC, BOTH DELAWARE LIMITED LIABILITY
COMPANIES, THE DEVELOPER OF DANIA POINTE, IN WHICH AGREEMENT DANIA POINTE AGREES

City Attorney Ansbro read the title of Resolution #2020-131.
Commissioner James noted the backup indicated a new fire station was not feasible and asked
what we are doing with that funding to ensure we are addressing the need from an increase in
service calls. She wanted to know what the plan is to address our growing community.
City Manager Garcia explained there was a previous agreement with Dania Pointe to have a
police substation; a fire station was cost prohibitive and we need to take a look at density. The
game plan is to add to the existing personnel or equipment or take steps for a future substation.
We are planning within the next couple of weeks for the opening of the police substation.
Commissioner Brandimarte thought it was a shared substation for fire and police.
City Manager Garcia noted you cannot co -mingle the requirements of police and fire.

9. Public Hearings and Site Plans
City Attorney Ansbro noted he would be addressing an emergency ordinance regarding
continuing virtual meetings at the end of the public hearings.
9.1 ORDINANCE #2020-013
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE REQUEST MADE BY THE APPLICANT CCI PROPERTIES 1, INC. TO AMEND CHAPTER 28,
ENTITLED "LAND DEVELOPMENT CODE," OF THE CITY CODE OF ORDINANCES BY AMENDING
PART 1, ENTITLED "USE REGULATIONS," ARTICLE 105, ENTITLED USE REGULATIONS FOR
RESIDENTIAL AND OPEN SPACE ZONING DISTRICTS," AT SECTION 105-220, ENTITLED "PRD-1

City Attorney Ansbro read the title of Ordinance #2020-013.
Corinne Lajoie, Assistant Director of Community Development, was available for questions
regarding the text amendment for Harbor Landings.
Commissioner James asked if this means the only type of projects that can be built are affordable
housing.
Assistant Director of Community Development Lajoie said no, but they do have to have an
affordable housing component to comply with County requirements.
Attorney Deborah Morshefsky, representing the applicant, noted the proposal is for 15% of the
units (42 units) to be affordable housing.
Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.
Commissioner Brandimarte motioned to adopt Ordinance #2020-013, on second reading;

City Attorney Ansbro read the title of Ordinance #2020-015 and noted at his direction, staff is
withdrawing this item to allow them to provide a comprehensive public notification of the
proposed Tree Protection Overlay amendments to both residents in the proposed overlay, as well
as to property owners within a 450' radius of the proposed overlay.
Commissioner Brandimarte asked if the City has ever done this for one particular area.
City Attorney Ansbro responded no and explained the unique nature of this area, for which the
residents have reached out to the City to protect.
Mayor Lewellen opened the Public Hearing.
Stephanie Jofe, 5880 SW 37th Terrace, spoke in support of the ordinance.
Michelle Nadel, 5861 SW 37th Terrace, spoke in support of the overlay ordinance, and noted the
recent removal of trees and shrubs that this ordinance would have protected. She also addressed
recent flooding in her neighborhood and hopes the City can assist with replacing the removed
trees.
Sarah Levtov, 5960 SW 37 Terrace, spoke about hazardous trees on or near her property that
arborists recommended be removed. Having the State law allows her and her neighbors to keep
their property safe; the ordinance would inhibit this.
Shira Sipper, 5921 SW 36t' Terrace, spoke about the tree ordinance. She loves the trees, but
many are dangerous and she felt there is nothing wrong with removing trees and replacing them.
Mayor Lewellen noted this item would come up again when the revised ordinance is brought
back.
Michael Jofe, 5880 SW 37th Terrace, addressed several issues raised about this ordinance; it
would allow removal of a hazardous tree.

Dania Beach City Commission
Tuesday, October 27, 2020 — 7:00 p.m.
Rod Feiner, Coker and Feiner, representing the contract purchaser of the property where the trees
were recently removed, spoke about the virtual community meeting held last evening. He noted
the tree removal was done pursuant to law.
Seeing as there was no one else to speak in favor or opposition, Mayor Lewellen closed the
Public Hearing.
City Attorney Ansbro noted the revised ordinance would be heard by the Planning and Zoning
Board and suggested all those residents with concerns should stay informed and attend the
meeting.
Commissioner James questioned having a sunshine meeting regarding the trees.
City Attorney Ansbro noted Community Development could work towards hosting a community
meeting where the Commissioners could be invited.
9.3 ORDINANCE #2020-016

City Attorney Ansbro read the title of Ordinance #2020-016, Resolution #2020-138, and
Resolution #2020-139 as they relate to the same property. He advised these items were quasi-
judicial hearings and swore -in those who would speak as they came forward. He asked the
Commission to disclose any communication they had on these matters.
Corinne Lajoie, Assistant Director of Community Development, gave a presentation on the
vacation, site plan, variance, and plat requests for Saratoga Crossings III.
Nectaria Chakas, Lochrie & Chakas, representing developer Atlantic Pacific Communities, gave
a PowerPoint presentation which is attached to and incorporated into these minutes.
Commissioner James noted her major concern is that this would box in the developments there
and the drainage issues would be magnified. She asked if the drainage could be tied in to City
drainage pipes.
Attorney Chakas noted there is no existing drainage system to tie into, although the City is
working on its master plan. Sites are not allowed to drain into the street, but must retain the
stormwater onsite.

Commissioner James asked about the community outreach.
Attorney Chakas responded everyone was supportive of the project.
Mayor Lewellen opened the Public Hearings.
Rev. Paul Wiggins, 215 NW 5t' Avenue, questioned the marketing plan regarding one -bedroom
units and noted he did not see anything indicating family.
Attorney Chakas explained this was intended to be for single occupants, although three
occupants per unit would be allowed.
Vice -Mayor Odman noted it was explained to her that Saratoga I and II have a number of two
and three bedroom units to accommodate families, and the demand was for one -bedroom units.
Attorney Chakas confirmed this is geared for single occupants. This would add 75 one -bedroom
units to affordable housing.
Commissioner James noted her major concern is that every month and often weekly, she receives
complaints about towing at Saratoga Crossings. She would like to know how Atlantic Pacific
Communities is addressing this concern expressed to her about management of their properties.
Attorney Chakas explained they have relaxed their towing policy on weekends; there are certain
rules that Atlantic Pacific would like to be enforced.
Commissioner James asked about the relationship with the Housing Authority.
Attorney Chakas responded the Housing Authority would own the property and Atlantic Pacific
would manage the project.
Commissioner Brandimarte noted she is happy to see someone come in with one -bedroom units.
The Saratoga development is beautiful.

City Attorney Ansbro gave a background to the emergency ordinance to extend virtual meetings,
and noted the Governor will likely not extend virtual meetings. He had been discussing this with
Vice -Mayor Odman in light of the fact that COVID is on the increase. Other cities are doing
similar measures; our concern is to protect the elected officials, staff and the public. This would
allow us to continue virtual meetings for 90 days. He recommended adoption of the emergency
ordinance.
Mayor Lewellen confirmed this would give us the option to continue virtual meetings; Fort
Lauderdale had a large outbreak of positive individuals after opening their City Hall.
Vice -Mayor Odman thanked City Attorney Ansbro and Assistant City Attorney Boutsis for
acting quickly on this matter. She is trying to avoid the situation in Fort Lauderdale; none of us
should have to give out health information as to who is most high risk. This ordinance addresses
this and solves that issue. She encouraged the Commission to adopt the ordinance.
Commissioner Brandimarte noticed the Chamber is set up for the meeting but appears to only
allow five people to sit in the room.
Assistant City Attorney Boutsis noted there are 12 seats to ensure six feet distance, which is set
up for the Special Magistrate hearing Thursday morning.

10. Discussion and Possible Action
10.1 Notice requirements - Mayor Lewellen
Mayor Lewellen felt the distance for notification should be extended farther out depending upon
the size and nature of the project; she felt 1,000 feet would be an improvement.
Discussion ensued regarding the distance.
The Commission consensus was to move forward with extending the distance of notification to
1,000 feet.
10.2 Rental relief for small businesses - Mayor Lewellen
Mayor Lewellen said she knows the CARES Act money is available. She would like to see if
there is something we could do regarding rental assistance for businesses.
Assistant City Manager Sosa-Cruz explained Broward County would be opening up their two
programs, rental assistance to small businesses and residential assistance program. City staff is
requesting to send a letter to the County administrator, Bertha Henry, for the County to
administer our CARES funds allocated to the City of Dania Beach. We would like to allocate
$500,000 for small business assistance and $500,000 for residential assistance program under the
small business assistance program. Federally, $25 million dollars has been allocated to the small
business assistance and $10 million for the not -for -profit programs. We have drafted a letter to
the County Administrator for Broward County to administer these programs. Regarding the
County program, there is no maximum amount cap and it would go back to March. The tenant
applies and the landlord receives the check. Staff would like Commission consensus to allow
Broward County to administer the program, which is strictly for the CARES Act funding. This
has nothing to do with the $500,000 budgeted for the City and CRA. Staff feels this is the best
option at this point.
Frank DiPaolo, Director of Finance, said the key here is that if the City does not use this money,
it will be unspent and returned to the Federal Government, or it could be reallocated to other
cities in the County. The County wants to know as soon as possible. This is fastest way to get
the money in people's hands.
Mayor Lewellen felt this is the best way to handle this; we need to be sure our businesses and
residents are aware of the program so they take advantage of it. She suggested perhaps a mailing
or a hotline be set up to help them walk through the process.
City Manager Garcia noted we can go through the BTR and Code Red to ensure those that need
it that the funding is there. The letter is ready to go and staff is requesting the Commission's
support.

Commissioner James asked if the County has continued to administer the CARES Act funding
for the cities or do we have a plan B ready to go.
Assistant City Manager Sosa-Cruz said the County has the capacity to handle the programs for
the other six cities that have signed up; the portal has not opened up for either program. They
have hired additional employees, have streamlined the program, and have more money than
people are requesting. The small business program is for any business that has not received any
previous federal assistance by either not qualifying or applying. The residential assistance
program allows tenants to self -certify their income to streamline the program to try to get the
money to people and businesses as fast as possible.
Commissioner James wanted to be sure we have something in line if the County does not have
the capacity to do it.
The Commission consensus was to move forward with the County administering the programs.
10.3 Key to the City request from Commissioner James
Commissioner James noted she would like to present a Key to the City to Commissioner
Brandimarte for her many years of service to the community and requested the Commission's
approval.
The Commission consensus was to approve the Key to the City request.

Vice -Mayor Odman noted she has had good feedback on the reporting app, and asked if there is
an opportunity to allow for notifications, not necessarily the Code Red type.
Assistant City Manager Sosa-Cruz said the website has notifications that residents can sign up
for; he is meeting with IT tomorrow to explore the capabilities on the reporting app.
11.5 Mayor Lewellen
Mayor Lewellen felt the mailers are still helpful and noted when she hears from residents about
an issue, she tells them about the reporting app.
Mayor Lewellen noted she talked to CRA Interim Director Weekes about neighborhood
entryway signage. She suggested any neighborhood that does not have a sign be included and
we get them a sign.
City Manager Garcia felt we should be transparent and bring this matter back with a Resolution
to take funding from Commission contingency.
Assistant City Manager Sosa-Cruz noted we need funds to relocate two previous signs on East
Dania Beach Boulevard and Sheridan Street.
City Manager Garcia responded we will bring separate items for the additional signs and for the
relocation of the two signs.
Mayor Lewellen encouraged early voting.
