MINUTES OF VIRTUAL REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, DECEMBER 8, 2020 - 7:00 P.M. 1. Call to Order/Roll Call Mayor James called the meeting to order at 7:02 p.m. Present: Mayor: Vice -Mayor: Commissioners City Manager: City Attorney: City Clerk: Tamara James Marco A. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Dania Beach Redevelopment Plan status and update by Ken Krasnow, Colliers International South Florida Mr. Krasnow gave a PowerPoint presentation on Ocean Park at Dania Beach which is attached to and incorporated into these minutes. City Manager Garcia briefly addressed the redevelopment plan. 3.2 Presentation regarding the Public Art Master Plan and survey by Leslie Fordham, Public Art & Design Administrator, Broward County Cultural Division Ms. Fordham gave a PowerPoint presentation which is attached to and incorporated into these minutes. 3.3 1000 Mermaids - Artificial Reef Project — Options Presentation by Stacy Brown Evan Snow and Ms. Brown, both with Ocean Rescue Alliance, gave a PowerPoint presentation which is attached to and incorporated into these minutes. Commissioner Odman asked what the underwater logo is made out of. Ms. Brown explained it would be concrete. Commissioner Odman felt Option 2 would be the best, and is particularly interested in the mermaids. Mayor James felt we should do a workshop since there would be a lot of discussion and tonight's agenda is large. City Manager Garcia noted the PowerPoint would be sent to the Commission as well as tentative dates for a workshop. A brief discussion ensued regarding the sculpture modules, and the Coral Rangers Program and timeline. 3.4 Covid update by Commissioner Odman Commissioner Odman gave a Covid update via a slide presentation which is attached to and incorporated into these minutes. Mayor James would like a Commissioner to be involved in City meetings held related to Covid. 3.5 Presentation of the proposed new Stormwater Projects by Fernando J. Rodriguez, Public Services Director and Dincer A. Ozaydin, Deputy Director/City Engineer Public Services Director Rodriguez and Deputy Public Services Director Ozaydin gave a PowerPoint presentation which is attached to and incorporated into these minutes, and responded to questions from the Commission. 3.6 Special Event request from Dania Live 1748 II, LLC to host a "Gay Men's Chorus of South Florida Holiday Show" on November 28-29, 2020 at Dania Pointe, 81 SW 18th Avenue, from 7:00 p.m. - 10:00 p.m. (Community Development) Commissioner Odman motioned to retroactively approve the Special Event request for the Gay Men's Chorus of South Florida Holiday Show; seconded by Commissioner Lewellen. The motion carried unanimously. 3.7 Special Event request from Dania Live 1748 II, LLC to host a "Drive in Holiday Concert" on December 5-6, 2020 at Dania Pointe, 81 SW 18th Avenue, with two shows per day from 1:00 p.m. - 2:30 p.m. and from 7:00 p.m. - 9:00 p.m. (Community Development) Minutes of Virtual Regular Meeting 2 Dania Beach City Commission Tuesday, December 8, 2020 — 7:00 p.m. Commissioner Lewellen motioned to retroactively approve the Special Event request for the Drive in Holiday Concert; seconded by Vice -Mayor Salvino. The motion carried unanimously. 3.8 Special Event request from Dania Live 1748 II, LLC to host "Cars at the Pointe" events on the third Sunday of every month for the next 11 months beginning on December 20, 2020 and ending on October 17, 2021 at Dania Pointe, 81 SW 18th Avenue, from 10:00 a.m. - 2:00 p.m. (Community Development) Eleanor Norena, Director of Community Development, addressed enforcement of social distancing and complaints of noise at Dania Pointe events. Commissioner Lewellen motioned to approve the Special Event request for Cars at the Pointe events; seconded by Commissioner Odman. The motion carried unanimously. Director of Community Development Norena noted St. Ruth Missionary Baptist Church would like to hold drive-in services on an ongoing basis beginning December 20, 2020. A Special Event request would be brought to the Commission at the first meeting in January. A brief discussion ensued regarding streamlining the Special Event request process. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Pastor Paul Wiggins, 321 SE 3`d Street, congratulated the newly elected officials and commended them for stepping up to lead the City. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, addressed the noise issue raised regarding Dania Pointe events, and noted the Neighborhood Support Unit would be participating in the Sheriff's Winter Wonderland at the Public Safety Building. He reported on recent criminal activity in the City and reviewed crime statistics. Captain Sergio Pellecer, BSO District Fire Chief, gave an update on his department, noting that Fire personnel are taking every precaution to ensure the safety of our residents during calls. He spoke of the Toy Drive held at Dania Pointe. Minutes of Virtual Regular Meeting 3 Dania Beach City Commission Tuesday, December 8, 2020 — 7:00 p.m. Kayri Pozo, 1101 W. Dania Beach Boulevard, said she is a new resident and would like to be involved in the City. She described issues with lack of parking at Saratoga Apartments and asked for assistance from the Commission. Mayor James noted she would have the Community Development Director follow up with Ms. Pozo. 7. The motion carried unanimously. 7.7 ORDINANCE #2021-001 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, REPEALING ARTICLE X ENTITLED "SMOKING RESTRICTIONS IN PUBLIC PARKS" OF CHAPTER 17 OF THE CITY CODE OF ORDINANCES ("OFFENSES; MISCELLANEOUS"), AND REPEALING CODE SECTION 17-30, ENTITLED, "SMOKING PROHIBITED IN CERTAIN AREAS OF PUBLIC PARKS"; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. A brief discussion ensued regarding measures that could be taken to inhibit smoking in public parks. Viki Stein and Boruch Igal Hatanian, 5911 SW 36 Terrace and 5901 SW 36 Terrace, spoke in opposition to the proposed ordinance. Susan Steinhauser, 5842 Eagle Cay Circle, Coconut Creek, expressed support of the ordinance. Stephanie Jofe, 5880 SW 37th Terrace, spoke in support of the zoning overlay ordinance. Scott Lewis, 930 SW 98th Terrace, Pembroke Pines, said he favors the creation of an Oak Hammock Tree Protection Overlay under the City's Land Development Code, and yielded the balance of his time to Ms. Jofe. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Commissioner Odman suggested continuing the item due to the time. City Attorney Ansbro recommended that the ordinance be passed on first reading and second reading be scheduled at the second meeting in January, with perhaps a workshop scheduled in the meantime. Ryan St. George, City arborist, addressed the ordinance, state law, and concerns expressed by the residents. He responded to questions from the Commission. Discussion ensued regarding the ordinance and moving forward with passing it on first reading or continuing it. Minutes of Virtual Regular Meeting 8 Dania Beach City Commission Tuesday, December 8, 2020 — 7:00 p.m. Commissioner Odman motioned to adopt Ordinance #2020-003, on first reading, to include seeking dates for a workshop no later than the first week of January 2021 and before second reading of the ordinance; seconded by Commissioner Lewellen. Mayor James noted she wanted residents to have an opportunity to speak at a workshop. Commissioner Lewellen suggested perhaps we could have residents submit questions beforehand to avoid repetition. Vice -Mayor Salvino suggested having an hour workshop with only the Commission and then bringing the residents in to ask questions. (FIRST READING) (Community Development) City Attorney Ansbro read the title of Ordinance #2021-004, Ordinance #2020-005, and Resolution #2020-152 as they relate to the same property. He advised these items were quasi- judicial hearings and swore -in those who would speak as they came forward. He asked the Commission to disclose any communication they had on these matters. Richard Lorber, Planning & Zoning Manager, gave an overview of the Comprehensive Plan amendment, rezoning and plat requests for Harbor Landings. Mayor James questioned density of the current zoning and of the proposed zoning. Mayor James opened the Public Hearings. Debbie Orshefsky, Holland & Knight, representing the applicant, was available for questions. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearings. Vice -Mayor Salvino noted he spoke with the City Attorney regarding adopting an ordinance designating the atrium as the Commission Chamber, which would allow for prohibiting the bringing of firearms into City Hall, and with having a metal detector, the glass on the dais could be removed and re -used in Code Compliance. City Manager Garcia noted it would cost approximately $38,000 to remove the glass. She can get an estimate for removing only the top glass. Commissioner Lewellen asked that the mitigated cost to re -use the glass also be provided. Commissioner Lewellen motioned to withdraw the award of RFQ #18-005 Architectural Services for the Historic Nyberg -Swanson House; seconded by Vice -Mayor Salvino. The motion carried unanimously. 10.9 Review and approve City Commission meeting dates for 2021 - City Clerk City Clerk Schneider addressed the two Commission meeting dates impacted by major holidays. Commissioner Lewellen motioned to approve the City Commission meeting dates for 2021, as amended, to cancel the November 23, 2021 and December 28, 2021 meetings; seconded by Vice -Mayor Salvino. The motion carried unanimously. City Clerk Schneider noted the CRA Board meeting dates for 2021 would mirror the dates of the first Commission meeting of every month. 11. Commission Comments 11.1 Commissioner Davis Commissioner Davis spoke of the Lighthouse Community Church Thanksgiving event. She noted she was seeking the Commission's support to assist residents during the holiday season due to the pandemic with Walmart gift cards for $125.00, and asked for a consensus. Mayor James asked where this money would come from. City Manager Garcia noted money was not found, but if the Commission would want to take it from Commission contingency, we would do so. Commissioner Odman noted the Commission decided they were not going to give out money in this fashion any longer. Minutes of Virtual Regular Meeting 13 Dania Beach City Commission Tuesday, December 8, 2020 — 7:00 p.m. Vice -Mayor Salvino addressed the past history of the Commission with being asked for donations. Commissioner Davis explained the difficult time the community is experiencing during the pandemic. It is a one-time holiday ask, not a regular occurrence. Residents need to feel we have done as much as we can do for them. Mayor James asked how Commissioner Davis would determine the 200 residents who would receive the gift cards. Commissioner Davis noted it would be on a first come, first served basis. Commissioner Lewellen said she wanted to be consistent. She asked if there was any money we put aside for something that was not used that could be used for the gift cards. Frank DiPaolo, Director of Finance, said no, and clarified CARES Act money could not be used for this. Commissioner Lewellen felt perhaps this could be considered at the next meeting, even though it would be after the holidays. Further discussion ensued. Mayor James felt we should find business sponsorships. Commissioner Odman asked if the City Manager could talk with Commissioner Davis about the different relationships and partnerships we have had in the past. City Manager Garcia noted this is something the Commission should discuss during their strategic master plan session.
